This paper is a short commentary on Elinor Ostrom's criticism of 'The Tradegy of Commons', which is part of her research on Common Pool Resources (CPR) institutions. She delivered an institutional theory of Common Pool Resources governance and also seriously undermined so called social paradoxes, as Olsons' logic of collective action or prisoners dilemma as a model of social situations. The core of these social paradoxes and Garett Hardin's Tragedy of Commons respectively, is an assumption of rational choice taken by an isolated, selfish and egoistic individual. In Ostroms opinion such theories are not really wrong, but are very special cases in the World of interpersonal communication, customs and institutions. Ostrom has developed an institutional analysis of CPR governance and formulated basic rules of a good and durable CPR Institution. Ostroms' works takes account of both laissez-faire and centralized, government-run allocation as the wrong approach toward management of the Commons. These analyses seem useful in Poland, where nowadays CPR governance is highly centralized.
The article analyzes the actions of capitalist countries in the situation of the crisis, related to the Covid-19 pandemic, primarily the actions of the world's leading economic, powers (the United States, China, Japan, Germany, India). An attempt is made to find, the characteristics and motifs of these actions. On this basis, an assessment is made of the, adequacy of the definition of the capitalist state by Friedrich Engels as "the ideal collective, capitalist".
The author analyses the socio-cultural determinants which influence the internal structure of collective action. It is determined by: the ability to fulfill contracts, the predictability of behaviour and showing trust to others. The author goes on to describe the factors that limit them as a result of the specificity of social relations in the Polish society, which 82 Janusz Hryniewicz Studia z Polityki Publicznej are dominated by the network of micro-groups and it means that only within them - not within the wider society - one can see social relations, in which contracts tend to be fulfilled and trust guaranteed. At the same time, the author indicates that the Polish society's capacity for collective action seems to be limited as a result of the fact that the Cartesian culture has not been fully adopted. There are many ramifications of that including a lower potential to analyse the goals of collective actions and making them more rational. In the Cartesian type of societies, their members are more favourably inclined to act together. They are more favourably adapted towards democracy, collective action and one can see a higher level of self-organisation, a wider range of personal freedom, as well as the setting up of associations. There is no need to impose top-down directives and top-down coordination when collective action must be taken.
The confl ict in Chechnya, was not only a threat to the territorial integrity of Russia but also to its energy security. Energy issues were one of the main means of pressure which Russia has used in relation to Chechnya. The ultimate goal of Russia's actions was to transform Chechnya from an exporter of oil on one completely dependent on Russian energy sources. The article is an attempt to defi ne the importance of natural resources for Russia and Chechnya. The author concludes that the mere extraction of resources was more important for Chechnya, while insuring the security of supply and activity in the Caspian Sea made Chechnya very important for Russia. ; Konflikt w Czeczenii stanowi zagrożenie nie tylko dla integralności terytorialnej Rosji, ale również dla jej bezpieczeństwa energetycznego. Kwestie energetyczne były jednym z głównych środków nacisku, który został zastosowany przez Rosję w stosunku do Czeczenii. Punktem docelowym działań Rosji było przekształcenie Czeczenii z eksportera ropy, w całkowicie uzależnionego od Federacji Rosyjskiej odbiorcę energii. Artykuł stanowi próbę określenia znaczenia surowców naturalnych i bezpieczeństwa energetycznego dla Rosji i Czeczenii. Autorka stwierdza, że chociaż samo wydobycie surowców miało większe znaczenie dla Czeczenii, to zapewnienie bezpieczeństwa dostaw i rozgrywka o surowce Morza Kaspijskiego sprawiły, że Czeczenia stała się dla Rosji szczególnie ważna.
The subject of these reflections on the contemporary international relations is, on the one hand, sovereignty and, on the other, international security, and the analysis of the relationship between the system of collective security and the sovereignty of states in the context of sustainable peace and stability in the world. States have traditionally been tied to the idea of sovereignty. However, among the most characteristic features of the international relations of our time is the growing number of various types of threats originating in states (e.g. Iran, North Korea), in organisations or other entities (e.g. al-Qaeda). Security and sovereignty are two basic concepts most commonly discussed in literature and international legal doctrine. There are two reasons for that: (i) firstly, the main actors in international relations are states which are sovereign entities and the relations or cooperation between them is based on respect for the principle of that sovereignty, and (ii) secondly, the issue of safety is a key issue and a prerequisite for the performance of fully sovereign rights of these countries, necessary to ensure international cooperation and socio-economic development. This paper discusses the need to institutionalise legitimate use of force in global organisations as well as in their regional structures, and to rapidly and effectively manage situations and conflicts intercept to international peace and security. It also draws special attention to the role and place of international organisations in the maintenance of international peace and security both, at universal, and regional level. ; Przedmiotem niniejszych rozważań, dotyczących współczesnych stosunków międzynarodowych są z jednej strony suwerenność, a z drugiej – bezpieczeństwo międzynarodowe oraz analiza związku pomiędzy systemem bezpieczeństwa zbiorowego a suwerennością państw w kontekście utrzymania trwałego pokoju i stabilności na świecie. Państwa są tradycyjnie przywiązane do idei suwerenności, jednakże do najbardziej charakterystycznych cech stosunków międzynarodowych naszych czasów należy narastanie różnego rodzaju zagrożenia, zarówno ze strony państwa (np. Iran, Korea Północna), jak i ze strony innych podmiotów (np. Al-Kaida). Bezpieczeństwo i suwerenność to dwa podstawowe pojęcia w literaturze i doktrynie prawnomiędzynarodowej. Dzieje się tak z dwóch powodów: po pierwsze – głównymi aktorami w stosunkach międzynarodowych są państwa, będące suwerennymi podmiotami, a stosunki czy też współpraca między nimi oparte są w zasadzie na poszanowaniu owej suwerenności; po drugie – kwestia bezpieczeństwa jest podstawowym zagadnieniem i warunkiem niezbędnym do wykonywania w pełni suwerennych praw tychże państw oraz zapewnienia współpracy międzynarodowej i rozwoju społeczno-gospodarczego. W artykule tym poruszono również problem konieczności instytucjonalizacji legalnego użycia siły, zarówno w organizacjach ogólnoświatowych, jak i na gruncie struktur regionalnych organizacji międzynarodowych, aby szybko i skutecznie zarządzać sytuacjami i konfliktami zagrażającymi pokojowi i bezpieczeństwu międzynarodowemu. W artykule zwrócono również szczególną uwagę na rolę i miejsce organizacji międzynarodowych w procesie utrzymania pokoju i bezpieczeństwa międzynarodowego, zarówno na poziomie ogólnoświatowym, jak i regionalnym.
There are many dilemmas related to creating Poland's energy security. There is still a discussion between the government and experts who point out the difficulties and problems of the energy sector. In Poland, there is a lack of strategy continuity and rapid response to trends prevailing on international markets. The whole article has been divided into three parts, introduction and ending. Chapter one Strategy for Poland's energy security in 2015–2020 – key government decisions. The second chapter describes energy investments in Poland in 2010–2015. Chapter three shows the dilemmas of Poland's energy security. The article also presents the impact of EU relations on state environments. It indicates that the decisions taken are a complex process and the implementation of actions in the energy sector cannot be considered solely in the short term. ; Istnieje wiele dylematów związanych z kreowaniem bezpieczeństwa energetycznego Polski. Ciągle toczy się dyskusja między rządem a ekspertami, którzy wskazują na trudności i problemy sektora energetycznego. W Polsce brakuje ciągłości strategii i szybkiego reagowania na trendy panujące na rynkach międzynarodowych. Całość artykułu została podzielona na trzy części. Część pierwsza omawia kluczowe decyzje rządu zawarte w strategii bezpieczeństwa energetycznego Polski w latach 2015–2020. Część druga opisuje inwestycje energetyczne w Polsce w latach 2010–2015, a trzecia ukazuje dylematy bezpieczeństwa energetycznego Polski. Artykuł wskazuje, że podejmowane decyzji to proces złożony, a realizacja działań w sektorze energii nie może być rozpatrywana wyłącznie w perspektywie krótkookresowej.
Collective bargaining in employment relations is one of the most important instruments for shaping the modern system of employment. An overall analysis of the Labour Code regulations on collective agreements negotiations allows to state it significantly formalizes the process of its commencement and conduct in the scope of voluntariness of their commencement and rules of performance as for their conduct, however some of the legislation should be criticized. Collective agreements negotiations should be conducted in good faith and with due regard for the legitimate interests of the other party. From the point of view of the conduct of collective agreements negotiations in good faith and with due regard for the legitimate interests of the other party an indication established as a result of the demands of the trade unions, which clearly exceed the financial capabilities of the parties of the workers' side, is doubtful, a contrario it shall be permitted to submit demands, which exceed these capabilities, but so far it is not clear.
