It discusses the problematic issues of consideration and resolution in a criminal case of a civil claim for compensation for property damage or compensation for moral damage caused by a criminal offense. The essence and content of the "civil claim in the criminal process" is determined, the advantages are noted, and the problems of a civil lawsuit in the criminal process of Ukraine are discussed. The authors propose to consider the filing of a civil claim as a right of the victim, corresponding to the obligation of the criminal prosecutor's office and the court to take measures for the timely reparation of damages. Some reasons are revealed that complicate the implementation of the principle of inevitability of civil liability for a crime committed simultaneously with the procedure for convicting the perpetrator. As a conclsuion se proposes to develop new approaches to the institution of a civil lawsuit in the criminal process of Ukraine, contributing to the improvement of the activities of the criminal prosecution authorities and the court to restore the violated civil rights of victims of crime.

This article consists in an attempt to elaborate a guideline for the calculation of economic compensation in Family Law. To reach this end, a singular conception about the institution's legal qualification is assumed, as a basis to set a model of quantification from the guidelines indicated by the legislator in article 62 of the Civil Marriage Act. This will allow the establishment of certain principles and guidelines for the setting of the amount. ; Este artículo consiste en un intento de elaborar pautas para el cálculo de la compensación económica. Para este cometido debe asumirse una concepción sobre la calificación de la institución, para luego, en segundo término, referirse al modelo de cuantificación a partir de las directrices indicadas por el legislador en el artículo 62 de la Ley de Matrimonio Civil. Esto permitirá establecer ciertas pautas para la fijación de la cuantía.

The article is dedicated to the study of the specifics of compensation for damage caused to the life and health of participants in the armed conflict in Ukraine. It is mentioned in the article, that damage caused to the health consists of the earnings (income) lost by the victim as a result of loss or decrease in professional or general working capacity (lost profit), as well as additional losses incurred due to damage to health (real damage). The conclusion is made, that the term "lost earnings" can be applied only to military personnel serving on the military draft, since for them the earnings that a citizen had before being drafted for military service will be taken as the basis. Property losses caused to military personnel under the contract are calculated on the basis of his or her cash benefits and other income (not related to the performance of military duties). Therefore, when compensating for damage caused to the health of military personnel under a contract, the term "lost cash benefits" should be used. The lost cash benefits shall include allowances for long service, for knowledge of a foreign language, for an academic degree or academic title, pension, for work with information constituting a state secret, since they have permanent nature. In addition, when determining the amount of damage caused to military personnel, payments made during the year are taken into account, in particular, bonuses for conscientious performance of official duties and income from teaching, scientific and creative activities.

This work examines the incidence that the system of financial compensationstructure has on the achievement of the objectives of attracting, retaining and motivatingworkers in the organization. The research is based on the possible restrictionsidentifications of the financial compensation systems in searching these objectives. It isstarting on the analysis of the labor Colombian market conditions, specifically, on joboffer and demand; on Colombian labor legislation related with salaries and wagesand other financial incentives contemplated not only in general legislation but on theorganizational behavior theory.To establish the restrictions among the signal dimensions, chronic conflict clouds werestructured. These served later as a basis to elaborate current reality tress (C.R.T), asinitial diagnosis. In addition, future reality trees (F.R.T) were considered a proposalto evaporate chronic opposing conflicts, using the proportionate analysis methodologyfor the theory of restrictions (T.O.C.) ; Este trabajo examina la incidencia que tiene la estructura de los sistemasde compensación financiera en el logro de los objetivos de atraer, retener ymotivar a los trabajadores en la organización. La investigación se basa en laidentificación de las posibles restricciones de los sistemas de compensaciónfinanciera en el cumplimiento de estos objetivos. Se parte del análisis de lascondiciones propias del mercado laboral colombiano, específicamente, de lascondiciones de oferta y demanda de trabajo; la legislación laboral colombianaen lo relacionado con sueldos y salarios y demás incentivos financieros quecontempla en el código sustantivo del trabajo y la teoría del comportamientoorganizacional.Para establecer las restricciones entre las dimensiones señaladas se estructuraronlas nubes de conflicto crónico que, posteriormente, sirvieron de base paraelaborar los árboles de realidad actual (a.r.a), como diagnóstico inicial y losárboles de realidad futura (a.r.f), como propuesta para evaporar los conflictoscrónicos encontrados, usando la metodología de análisis proporcionada por lateoría de restricciones (t.o.c.).

Economical compensation, particularly articles 61 and 62 of the Civil Marriage act, hasn't been exempt from doctrinal discussion because of its lack of clarity in its drafting, sense and approach. The doctrine has tried to elucidate its legal nature in order to interpret the cited norms. Also, the courts had been hesitant as they came from tendencies shown in strict readings of article 61 from the Civil Marriage Law as a requisite of the institutions' admissibility, towards others that center in elements that as exemplary titles mention the legislator in article 62 of the Civil Marriage Law, though dispensing article 61 of the Civil Marriage Law. However, a welfare tendency in the application of the institution is observed, coming from the tradition in family matters within the alimony institution. Economical compensation is not alimony but has elements that allow determining a welfare sense and approach from the weaker spouses' point of view. ; La compensación económica, en particular los artículos 61 y 62 de la Ley de Matrimonio Civil, no ha estado exenta de discusión doctrinal, ya que no es clara en su redacción, sentido y alcance. La doctrina ha intentado dilucidar su naturaleza jurídica y conforme a ello poder interpretar las normas citadas. Paralelamente la jurisprudencia ha sido vacilante, en cuanto existen tendencias desde una lectura estricta del art. 61 de la LMC como requisito de procedencia de la institución a otras que se centran en los elementos que a título ejemplar menciona el legislador en el Art. 62 de la LMC, aun prescindiendo del art. 61 de la LMC. Sin embargo, se advierte una tendencia asistencial en la aplicación de la institución proveniente de la tradición en materia de familia de la institución de los alimentos. La compensación económica no son alimentos, pero tiene elementos que permiten determinar un sentido y alcance asistencial respecto del cónyuge más débil.

Not all the theories that deal with the problem of the growth of inequalities as between different national regions go on to recommend the use of regional development funds as a panacea for such inhalances, only those that apriori see the open market as being incapable of righting such phenomen a being given to recommending this sort of corrective action. The Spanish Constitution of 1978 would seem to have lent its ear to the council of the latter school when creating the Inter-Territorial Compensation Fund. The author, in a somewhat critical tone, tells of the highways and bye-ways wandered by the notions behind the setting up of this fund within the Constitution itself from its early days on through the law that governs its workings, then through the LOCFA and on to the cross-roads of the Autonomic Goverment Agreements of the summer of 1981. Many of the fine hopes that the passing of the Inter-Territorial Compensation Fund legislation gave rise to have withered on the stem, some because the original purpose of it has lost its point, some because of its not being used to favour those backward regions that most needed its assistance, some because of its being used to do little more than patch and mend the holes in the budgeting of the Autonomic Communities. The author concludes by saying that for all its inadequacies, the Fund is still a necessity and, as such, must be kept in being. ; No todas las teorías sobre la evolución de los desequilibrios regionales implican la aceptación de los fondos regionales de desarrollo, sino sólo aquellas que reconocen la incapacidad del mercado para corregir los desequilibrios espaciales de nivel de vida. Esta es la onda en que se sitúa la Constitución española de 1978 al crear el Fondo de Compensación Interterritorial. El autor cuenta desde una perspectiva moderadamente crítica las andanzas y peripecias que ha tenido que sortear la idea original del Fondo. desde la Constitución hasta la ley que regula su funcionamiento, pasando por la LOFCA y los Pactos Autonómicos del verano de 1981. Muchas de las expectativas levantadas por el FCI se han visto defraudadas, ya sea porque se ha desvirtuado la finalidad con que fue creado, ya sea porque no ha llegado a utilizarse como verdadero instrumento en favor de las regiones menos desarrolladas, sino para tapar agujeros de las necesidades financieras de las Comunidades Autónomas. A pesar de todo, es imprescindible su mantenimiento.

Compensation in maintenance in paternity trial in Ecuadorian legislation ; Compensación en los alimentos en juicio de paternidad en la legislación ecuatoriana

Este artículo es resultado de las indagaciones sobre la valoración que las mismas víctimas del conflicto armado, del municipio de San Carlos Antioquia (Colombia), hacen de la implementación de la Ley 1448 (Ley de Victimas); dicho proceso de investigación, evidenció entre otros hallazgos, la contradicción entre el discurso oficial y el relato de las víctimas en relación a los procesos de reparación, discursos contradictorios respecto a la transición, el estado de vulneración e insatisfacción de necesidades básicas de las personas victimizadas así como una alta confusión en la implementación de la Ley. Estos resultados, entre otros, permiten afirmar que, la reparación hoy, dista mucho de ser un proceso que aporte a la reconstrucción del tejido social, a la paz y la reconciliación.

En el artículo se exponen someramente la regulacion penal del delito de lesiones en nuestra legislación penal, del que hay que deducir las referencias y concreciones necesarias sobre daño cerebral. Asimismo, se deja indicado el sistema indemnizatorio existente para la indemnización por lesiones provinientes de accidentes de circulación culposos, incluyéndose como Anexo a este trabajo el baremo de cálculo de indemnizaciones que incorpora esta ley. Se incluye una valoración crítica final sobre el conjunto dl sistema en relación a las exigencias de los casos de daño cerebral, que concretan este campo las carencias referidas en el Editorial de este trabajo. ; This article presents a cursory view of the penal regulation of personal injury under Spanish legislation from which the necessary classification and particularities concerning brain injury must be deduced. The existing system of compensation for injury caused by traffic accidents in which there is evidence of fault is also covered. The criteria used to calculate compensation included in this statute appears here as an appendix. Finally, a critical evaluation of the system as a whole with regard to requirements for cases of brain injury is offered, which sums up the shortcomings referred to in the editorial included in this issue.
