Reforms in many industries and business fields in Ukraine need application of modern political tools. One among principles of domestic policy of Ukraine as a state is development of competition and support of efficient control over natural monopolies and prevention of monopolism on markets. Legal confirmation of any economic policy will be carried out by definition of the domestic policy principles. Antimonopoly-competitive policy is one among the focal points of the economic policy in particular. Competition advocacy according to generally accepted approach is a part of such competitive policy; therefore, definition and interpretation of the advocacy competition will affect the contents of the antimonopoly-competitive policy of the government in general and its application in competing industries in most cases, and in particular application with respect to transport. Analysis of scientific publications dedicated to the competition advocacy in Ukraine reveals a variety of interpretations of this notion and arising numerous ambiguities in the content as a result. The article contemplates the meaning of some notions similar to advocacy such as lobbing, informative-educational activities, fundraising. Contents of notions 'advocacy competition' and 'advocacy' are compared. The foregoing allows us to interpret the content and to show difference between competition advocacy and other notions. Definition of the antimonopoly-competitive policy in legislation is considered together with available activities constituting competition advocacy among the tasks of an anti-monopoly authority in Ukraine. It is considered also whether the governmental bodies are charged with tasks on initiation and organisation of competitive environment in the wide sense of these words. Ambiguous content of the competition advocacy definition in Ukraine is complicated with non-availability of any normative definition of this notion in Ukrainian legislation. Study of the notion 'competition advocacy' will allow us to make a conclusion on the possibility of its application in many industries of national economy and in railway transport in particular. ; Реформирование многих отраслей и сфер хозайства в Украине требует применения современных инструментов политики. Одним из направлений экономической политики является, в частности, антимонопольно-конкурентная политика. Адвокатирование конкуренции по общепринятому подходу является частью конкурентной политики, поэтому от определения и наполнения адвокатирования конкуренции зависит содержание антимонопольно-конкурентной политики государства вообще и ее применение в конкурентных отраслях, в частности, на транспорте. Анализ научных публикации, посвященных адвокатированию конкуренции в Украине, свидетельствует о разнообразии трактовок этого понятия и возникающую вследствие этого множественную неоднозначность содержания. В статье рассматривается значение схожих с адвокатированием понятий, таких как: лоббирование, информационно-образовательная деятельность, фандрайзинг. Сравнивается содержание адвокатирования конкуренции и адвокации. Указанное позволяет раскрыть содержание и отличие адвокатирования конкуренции от других понятий. Рассматривается определение антимонопольно-конкурентной политики в законодательстве и наличие деятельности, которая составляет адвокатирования конкуренции среди задач антимонопольного органа Украины. Рассматривается возложено ли на государственные органы задачи по инициации и создания конкурентной среды в широком смысле. Неоднозначность содержания определения адвокатирования конкуренции в Украине усложняет отсутствие до настоящего времени нормативного закрепления этого понятия в законодательстве Украины. Неоднозначність змісту визначення адвокатування конкуренції в Україні ускладнює відсутність до цього часу нормативного закріплення цього поняття в законодавстві України. Дослідження змісту адвокатування конкуренції дозволить зробити висновок про можливість застосування його у багатьох галузях економіки та на залізничному транспорті зокрема.

The transformation of the economy of Ukraine predetermines the need for comprehensive analysis of its impact on the areas of economic activity because the depth of transformation processes has significant differences. In this regard especially important is innovation environment, on the development of which the competitiveness of the national economy largely depends, as well as the pace and quality of economic development. The analysis of the features of the transformational changes in the environment, especially in the innovation sector, is particularly relevant under conditions of global competition. The aim of the article is to study the development of global innovation environment, development and scientific substantiation of directions ensuring national innovation competitive advantages, to identify opportunities to use integration processes to enhance international innovation investment cooperation. To achieve this aim we applied the following methods: abstract–logical, structurally–logical, comparative and statistical. Peculiarities of innovation development in Ukraine under conditions of growing global competition were examined. We studied transformational changes in the development of investment and innovation environment in Ukraine, which made it possible to determine the real state of its innovation appeal. The innovative development was considered as self–reproductive basis for the formation of new patterns of economic dynamics, modernization of the national economy, technological convergence of Ukraine into global economic space, maintaining intellectual potential. The study of the transformation of innovative development and market transformation efficiency of social production showed that the innovation attractiveness of Ukraine is significantly affected not only by the general state of the national economy but by the conditions of business activities. The practical value of the research is in the fact that the implementation of the formulated strategic objectives in the innovation field will allow the national economy to solve the problem of substantial growth of the gross domestic product, to improve investment attractiveness, to create conditions for the development of existing and for attracting new companies, to create new sectors of the economy in the field of small and medium sized innovative businesses, to form the clusters of innovative enterprises, to ensure integration of science, government and business. The issues of the transformation of innovative development will require further detailed study in the context of overcoming the crisis of competitiveness of the national economy, market transformations for the efficiency of social production.

The article is devoted to the definition of the role of the European Commission in the framework of ensuring competition in the European Union. The provisions of normative acts and scientific works are analyzed. The issue of antitrust activities of the European Commission is analyzed by analyzing concrete examples of the implementation of its powers. The author points out that among the important functions of the European Commission it is necessary to highlight the provision of competition, that is, to prevent abuses of dominant positions on the market by large industrial companies and to prohibit agreements between the parties that lead to restrictions of competition, production or market opportunities. The policy itself is based on the principles of maximizing the scope of the market mechanism and reducing interference in the economy. The author draws attention to the fact that ensuring the principle of protecting competition in the global market can only be achieved by effectively combating anti-competitive practices such as anticompetitive concerted actions or, as they are called throughout the world, conspiracies or cartels. After analyzing these legal provisions, the author came to the conclusion that the European Commission's competition policy is based on five basic principles: prohibited concerted practices, agreements and mergers between companies that could negatively affect trade between member states, prevent competition within to restrict or distort the common market; It is prohibited to take advantage of a dominant position on the market when it may adversely affect trade between Member States; control of state aid in member countries in any form that threatens free competition because it benefits individual enterprises or the production of individual goods; European-wide merger plans are assessed from the point of view of potential consequences for competition and may become banned; the liberalization of some sectors, which to date dominated the monopoly of certain public or private enterprises. ...

In the article it is carried out the analysis and applied the method of generalization of legislative documents, scientific-research and scientific-methodological literature, presented points of view of specialists on organization of the process of preparation and building distances of sports tourism competitions. While planning distances it is necessary to take into account aims and tasks which are set before a specific competition. At the mass level – it is, first of all, propaganda of tourism and education, change of experience, and at the highest level – testing of preparedness and revealing the strongest participants and teams. In tourist competitions, during many years, there were established traditions, defined a set of stages and methodology of their undergoing, moreover, the question of participants' safety should be put on the first place. While planning a distance it is necessary to take into account its complexity and accordance with readiness of participants to goals and tasks which are set by organizers of competitions. If less than half of the teams pass technically and tactically complicated distance, this means that efficiency of such competitions is insignificant. Here an important role is played by a competition inspector who should estimate accordance of the class of a distance with the level of preparedness of participant, and if necessary, recommend to chiefs of a distance to simplify it and abase its class. This is reached, first of all, not by change of a distance scheme, its length, but simplifying of technically complicated stages. Requirements for distances and stages – dynamism and spectacular component. While planning a distance for competitions it is necessary to take into account such factors as season, natural peculiarities of a region, natural conditions which should be taken into account depending of a kind of tourism. The most important thing while planning a distance is saving of lives and health of participants. The objective of our study is to analyze peculiarities of competition distances and technical stages in hiking. Accumulated knowledge, correctly organized competitions and planned distances would allow to define the strongest competitors, highlight the effectiveness of the training process, improve the results of performances at competitions. ; У статті проаналізовано та застосовано метод узагаль­нен­ня законодавчих документів, науко­во-дослідної та науково-мето­дичної літератури, висвітлено погляди фахівців на органі­зацію процесу підготовки й побудову дистанцій змагань зі спортивного туризму. При пла­нуванні дистанцій потрібно враховувати цілі та завдання, які поставлені перед конкрет­ни­ми змаганнями. На масово­му рівні – це насамперед про­паганда туризму й навчання, обмін досвідом, а на найви­щому рівні – перевірка підго­тов­ле­ності та виявлення най­сильніших учасників та ко­манд. У туристських зма­ган­нях, протягом багатьох років склалися традиції, визначені набір етапів і методика їх про­ходження, причому на перше місце організатори повинні ста­вити питання безпеки учас­ни­ків. Плануючи дистанцію, по­трібно враховувати її склад­ність і відповідність підго­товле­ності учасників до мети й завдань, які ставлять органі­затори змагань. Якщо постав­ле­ну технічно та тактично склад­ну дистанцію пройдуть менше по­ловини команд, віддача від таких змагань буде незначна. Ось тут дуже важлива роль інспектора змагань, який по­винен як експерт оцінити від­повідність класу дистанції рівню підготовки учасників і, якщо буде потреба – рекомен­дувати начальникам дистанції спростити її, понизити клас. Це досягається насамперед не зміною схеми дистанції, її протяжністю, а спрощенням технічно складних етапів. Ви­моги до дистанцій і до етапів – динамічність, видо­вищність. Важливим під час планування дистанцій змагань є пора року, природні особли­вості регіону, клімат, погодні умови, які потрібно врахову­вати відпо­відно до виду ту­ризму. Най­важ­ливішим при пла­нуванні дистанцій є збере­ження життя та здоров'я учас­ників. Завдан­ням нашого до­слід­ження було проаналізу­вати особливості дистанцій зма­гань і технічних етапів у пі­шохідному туризмі. Накопи­чені знання, пра­виль­но орга­ні­зовані змагання та сплано­вані дистанції да­дуть змогу визначити сильні­ших учас­ників, висвітлити ефектив­ність тренувального про­цесу, по­кра­щити результати виступів у змаганнях.

Regional political processes through the prism of party struggle in Volyn region are analysed. The attention is focused on the fact that the state forming processes have opened up opportunities for the development of the national state, taking into account historical and cultural identity of its regions. It is proved that in condition of the absence of a sustainable social base the local organizations of political parties do not primarily represent interests of social groups, and are pragmatic projects of financial and industrial groups, the growth in the number of which correlates with the beginning of the next electoral campaign. Political competition of local cells of political parties at the regional level in Ukraine is considered. The factors that allow regional political parties to overcome the representational barrier and be represented in local authorities are determined. It is stated that all political parties represented in Volyn region use different methods of political campaigning, namely: administrative resources most effectively uses Pro-regime BPP «Solidarnist», a financial resource – UKROP, populism – the Radical party of Oleh Liashko, nationalism – Svoboda, the charismatic leader of the «Batkivshchyna», «new faces» – «Samopomich» and «Narodnyi control», «old faces» – «Nash krai». The current state of participation of political parties in local electoral processes is investigated. It is reasoned that the greatest opportunity to find the necessary resources for the election campaign, and therefore to be represented in local government are parliamentary parties which are in power at the national level. However, the political forces that do not have significant financial resources, in fact, are in the role of outsiders in the election race. It was investigated that this situation takes place in Ukraine for the lack of a tradition of public funding of parties and a developed system of membership dues. ; Проаналізовано регіональні політичні процеси через призму партійної боротьби у Волинській області. Акцентовано увагу на тому, що державотворчі процеси відкрили широкі можливості для розбудови національної держави з урахуванням історичної і культурної самобутності її регіонів. Обґрунтовано, що за відсутності сталої соціальної бази місцеві організації політичних партій переважно є не виразниками інтересів соціальних груп, а є прагматичними проектами фінансово промислових груп, зростання кількості яких корелює з початком чергової електоральної кампанії. Розглянуто політичну конкуренцію місцевих осередків політичних партій у регіональному аспекті в Україні. Визначено, чинники які дозволяють регіональним політичним партіям долати репрезентативний бар'єр та бути представленими у місцевих органах влади. Зазначено, що усі політичні партії, представлені у Волинській області використовують різні методи політичної агітації, а саме: адміністративний ресурс найбільш ефективно використовує провладний БПП «Солідарність», фінансовий ресурс – УКРОП, популізм – Радикальна партія Олега Ляшка, націоналізм – Свобода, харизматичність лідера – ВО «Батьківщина», «нові обличчя» – «Самопоміч» та «Народний контроль», «старі обличчя» – «Наш край». Досліджено сучасний стан участі політичних партій у локальних виборчих процесах. Аргументовано, що найбільшу можливість знайти ресурси, необхідні для виборчої кампанії, а відтак і бути представленими у місцевій владі, мають парламентські партії, які знаходяться при владі на національному рівні. Натомість політичні сили, які не володіють значними фінансовими ресурсами, фактично опиняються у ролі аутсайдерів виборчих перегонів. Досліджено, що такий стан речей має місце в Україні за відсутності традиції державного фінансування партій та розвиненої системи членських внесків.

This article deals with the topical problems of defining, detailing and differentiating the corpus delictli in the sphere of protection against unfair competition, on the basis of the examples of offences given in Art.8 'Discrediting the entity' and Art. 15-1 'Spreading misleading information' in the Law of Ukraine 'On Protection against Unfair Competition'. The aim of the research is to provide more detailed qualification and further systematization of the legislation that regulates the legal relations in the competitive environment. The author makes the analysis of the components of the delicts described in Art. 8 and Art. 15-1 of the Law of Ukraine 'On Protection against Unfair Competition' (the subject, the object, the subjective and the objective parts), defines the peculiarities of each element in the frame of the given delict, including the offence purpose, ways and means of committing the crime, мета, способи, засоби вчинення, the injured party, caused damage and its influence on the specification of the act. Taking all the results into consideration, the author gives the comparative analysis of all the delicts in the sphere of unfair competition. The author also analyses various theoretical and practical issues, gaps and contradictions existing in the current legislation of Ukraine, as well as in the scholastic works as to the differentiating and regulating the elements of the corpus delictli: scientists' points of view, legislation norms and the conclusion of the Antimonopoly Committee of Ukraine. The work reveals the author's own suggestion as to the definition and the peculiarities of the elements of the body of such delicts as discreditation of the entity (Art. 8) and dissemination of misleading information (Art. 15-1) as well as arguments for each position of the given elements. The author also focuses on the problem of differentiating the liability for committing delicts in the sphere of protection against unfair competition. The investigation examines the political competition of parties. In the framework of these issues in more details is discussed the state of research and development problems in the works of foreign and domestic political science. It is proved that competition between political parties for support from the community is an important criterion of democratization of the political process. The attention is focused on the fact that political competition between political parties is an important factor in the legitimization of power by raising the level of political activity of citizens in electoral periods through engaging them in active political activities. The key concept of "political competition of parties" is considered by the author in the context of theories of democracy based on fundamental developments of the theory of political parties, which carried out foreign and domestic researchers of political science. It is noted that the nature of political competition of parties depends on the type of political regime and level of political culture of citizens. It is proved that political competition has a different character in different types of political regimes. In authoritarian and totalitarian political regimes, the relevant preferences have pro-government political parties. In democratic political regimes political parties act in equal conditions. It is noted that for the Ukrainian political process characteristic is the neglect of political and legal norms and the establishment and compliance with the "rules of the game" at which will happen the political competition of parties. In turn, the Ukrainian political elites consider the political and legal norms not through the prism of certain qualitative characteristics and values, but using technical tools, which you can change depending on the specific political situation and the rating of political parties. Акцентовано увагу на тому, що політична конкуренція між політичними партіями виступає важливим чинником легітимізації влади завдяки підвищенню рівня політичної активності громадян у виборчі періоди та через залучення їх до активної політичної діяльності. Наголошено, що для українського політичного процесу характерним є зневажливе ставлення до політико-правових норм і створенням та дотриманням «правил гри» за якими відбуватиметься політична конкуренція партій. В свою чергу, українські політичні еліти розглядають політико-правові норми не через призму певних якісних характеристик та цінностей, а через технічний інструментарій, який можна змінювати залежно від конкретної політичної ситуації та рейтингу політичних партій. The investigation examines the political competition of parties. In the framework of these issues in more details is discussed the state of research and development problems in the works of foreign and domestic political science. It is proved that competition between political parties for support from the community is an important criterion of democratization of the political process. The attention is focused on the fact that political competition between political parties is an important factor in the legitimization of power by raising the level of political activity of citizens in electoral periods through engaging them in active political activities. The key concept of "political competition of parties" is considered by the author in the context of theories of democracy based on fundamental developments of the theory of political parties, which carried out foreign and domestic researchers of political science. It is noted that the nature of political competition of parties depends on the type of political regime and level of political culture of citizens. It is proved that political competition has a different character in different types of political regimes. In authoritarian and totalitarian political regimes, the relevant preferences have pro-government political parties. In democratic political regimes political parties act in equal conditions. Shows the factors influencing the choice of methods of protection of enterprises against unfair competition, namely: the development of legislation on protection from unfair competition; the availability of fair competitive relations in the market; the awareness of business entities on the rights for protection against unfair competition; the desire of market participants to seek excessive profits; the protection of rights of business entities; establishing sustainable business relationship with partners; the degree of formation of the competitive environment; weaknesses in the management system; dependence on suppliers of raw materials from abroad. Зазначено погляд науковців, щодо недоліків законодавства в сфері недобросовісної конкуренції. Наведено дії, які пов'язані із дискредитацією конкурента ( дискредитація конкурента; купівля-продаж товарів, виконання робіт, надання послуг із примусовим асортиментом; порівняльна реклама; схилення до бойкоту господарюючого суб'єкта та інше). У статті розглянуто питання співвідношення недобросовісної конкуренції з порушенням прав інтелектуальної власності. Розкрито зміст обох понять із зверненням до нормативно-правової бази України. Приділено увагу порушенням прав, що випливають із патенту, як актам недобросовісної конкуренції та їхньому впливу на конкурентне середовище на ринку лікарських засобів. Висловлено пропозиції з удосконалення законодавства у сфері патентного права з метою мінімізування недобросовісної конкуренції та зловживань правами, що випливають з патенту. ; В статье рассмотрены вопросы правового регулирования недобросовестной конкуренции, ее соотношение с нарушением прав интеллектуальной собственности. Внимание уделено нарушениям прав, вытекающих из патента, как актам недобросовестной конкуренции, а также явлению как «патентного троллинга». При раскрытии данного вопроса обращено внимание на законодательное регулирование указанного на письма Антимонопольного комитета Украины и решения высших судов в толковании этих норм, а также на научные статьи в данной сфере. Предложено возможные варианты решения этих вопросов. ; The article deals with issues of legal regulation of unfair competition, its relation with violation of intellectual property rights. Attention is paid to the violation of the rights arising from the patent as acts of unfair competition, as well as the phenomenon of «patent trolling». At disclosure of this issue, attention was paid to the legislative regulation of the above issues, the letters of the Antimonopoly Committee of Ukraine and the decisions of higher courts in interpreting these norms, as well as on scientific articles in this area. Possible options for solving these issues are stated. Also, the article describes the ratio of unfair competition and violation of intellectual property rights in order to focus on cases of the application of a law in a particular situation, as well as study of the question how violations and abuses of rights affect the competitive environment on the market of medicines, which leads to a decrease innovations and patent values in the field of manufacturing of medicinal products.

It is alleged, on the basis of concrete examples, that today in our society there is a lack of obvious signs of the transition from confrontational confrontation to dialogue and compromise between interests. It turns out that the uneasy socio-economic situation, falling incomes, numerous mistakes of power in public policy and the implementation of key reforms have led to an increase in such phenomena as the decline in trust in leading political parties and the growth of support for frankly populist rhetoric. The emphasis is placed on the fact that the political process is constantly accompanied by crises, any serious political crisis immediately becomes a collective topic for discussion, and is included in the sphere of public political discourse. ; Розкрито сутність політичної конкуренції як однієї із вагомих характеристик якості демократичного процесу. Проаналізовано бангатопартійність, мотиви політичної участі, загрозливі наслідки політичного маніпулювання суспільною свідомістю та суспільними настроями, дисбаланси у політичній системі: інституціональний та функціональний прояви. Стверджується, на основі конкретних прикладів, що на сьогодні в нашому суспільстві бракує очевидних ознак переходу від конфронтаційного протистояння до діалогу та компромісу між інтересами.
