Dopo aver analizzato il conflitto, le sue funzioni e le modalità di gestione, l'autore si sofferma dapprima sulle varie tipologie di mediazione per poi focalizzare l'attenzione sulla mediazione civile e commerciale evidenziando i dati disponibili dall'entrata in vigore del tentativo obbligatorio come condizione di procedibilità della domanda giudiziale per le materie civili, alla fine del 2013. ; After analyzing the conflict, its functions and how to manage, the author dwells on the various types of mediation first and then focus on civil and commercial mediation highlighting the data available from the entry into force of the mandatory attempt as condition of admissibility of the claim for civil matters, at the end of 2013.

For ages economists, philosophers, historians, political scientists and many other thinkers and scholars have argued about the connections between world economy and international relations. Within this broad subject, two related and prolific debates exist: the possible peacekeeping or warmongering effects of trade and, inversely, the influences of warfare and peace on commerce. The present dissertation introduces a theoretical and empirical assessment about the interdependence between international trade and interstate conflict. In particular, a causal perspective on the issue is adopted. The first part presents the most renown theories about trade and conflict, trying to extrapolate the alleged casual linkages behind them. In the second part, a detailed review of the previous empirical studies is provided. Furthermore, an empirical analysis on the interdependence between international trade and militarized interstate disputes (MIDs) is attempted employing a vector autoregression (VAR) model. Finally, personal considerations about the examined arguments conclude the thesis.

Oggetto della ricerca è l'analisi della gestione del conflitto sindacale nelle relazioni industriali nell'Unione europea, e in particolare l'assenza del riconoscimento dello sciopero tra le materie legislative di competenza della Comunità europea. Lo studio è strutturato in tre capitoli. Il primo è dedicato all'esame degli aspetti fondamentali del sistema di relazioni industriali in Europa; in particolare vengono ripercorse le tappe dell'evoluzione del dialogo sociale, i principali attori e regole, le differenti modalità di organizzazione delle parti sociali, le forme di partecipazione dei lavoratori nonché il sistema delle relazioni industriali nell'Unione Europea. Il secondo capitolo è incentrato sul tema del riconoscimento all'interno dei diritti sociali fondamentali "comunitari", del diritto di sciopero. In particolare, nei paragrafi centrali l'attenzione si incentra, sul diritto dei lavoratori a ricorrere ad azioni collettive per la difesa di propri interessi, così come sancito nella Carta dei Diritti Fondamentali dell'Unione Europea, (proclamata a Nizza il 18 dicembre 2000). Nonostante tale importante riconoscimento, la regolamentazione del diritto di sciopero non rientra tra le materie legislative di competenza della Comunità europea (art. 137.5, del TUE, ora art. 153.5 TFUE). L'esclusione può essere letta come espressione della volontà politica degli Stati membri di rispettare gli standard nazionali, rinunciando a qualsiasi interferenza del diritto comunitario su un terreno nel quale è difficile prospettare armonizzazioni normative, in ragione della eccessiva difformità delle discipline nazionali. Tale scelta ha, tuttavia, determinato una grande differenziazione tra le discipline nazionali, con particolare riferimento alla regolamentazione dello sciopero nei servizi pubblici essenziali. Il tema dell'esclusione si è riproposto e acutizzato negli ultimi anni a seguito di una serie di pronunce della Corte di Giustizia, relative ai casi Viking, Laval e recentemente Commissione vs Germania. In particolare, nel secondo paragrafo sono analizzate le sentenze Viking e Laval, abbinate non solo dal contenuto, ma anche dalla prossimità temporale, la prima dell'11 dicembre, la seconda del 18 dicembre 2007 che registrano un cambiamento rispetto alla precedente fase di indifferenza, in quanto per la prima volta, il diritto di sciopero è riconosciuto come diritto fondamentale dell'Unione europea. L'attenzione è posta anche sulla recentemente pronuncia della Corte di Strasburgo sul diritto di sciopero che con la sentenza Enerij del 21 aprile 2009 marcherebbe una netta evoluzione giurisprudenziale, in quanto si potrebbe sostenere che la Corte abbia ritenuto che il diritto di sciopero, fintantoché è esercitato per sostenere la contrattazione collettiva, è ugualmente essenziale alla libertà sindacale e pertanto direttamente riconosciuto e tutelato dall'art. 11 della Convenzione Europea per i Diritti dell'Uomo. Il terzo capitolo, infine, si propone, pertanto, di analizzare comparativamente le soluzioni legislative adottate dall'ordinamento italiano, francese, inglese e tedesco, riguardo la disciplina dell'azione di autotutela collettiva e del diritto di sciopero nei servizi pubblici essenziali nei principali Paesi dell'Unione Europea dove, i differenti ordinamenti nazionali rendono difficile un confronto teso al raggiungimento di una disciplina comune. In particolare, la legislazione italiana con la previsione di una apposita Commissione di garanzia, quale autorità pubblica indipendente, cui sono affidati compiti di verifica e anche di statuizione in relazione alle prestazioni indispensabili da effettuare per garantire ai cittadini la possibilità di continuare a fruire, seppure con delle limitazioni, dei propri diritti costituzionalmente tutelati, rappresenta un caso unico in Europa che pone l'Italia sotto questo profilo in una posizione più avanzata rispetto all'Europa. ; Object of the search is the analysis of the management of the trade-union conflict in the industrial relations in the European Union, and in particular the absence of the acknowledgment of strike between the legislative matters of competence of the European Community. The study is structured in three chapters. The first one is dedicated to the examination of the fundamental aspects of the system of industrial relations in Europe; in particular they go over again the stages of the evolution of the social dialogue, the main actors and rules, the different kind of organization of the social parts, the forms of participation of the workers let alone the system of the industrial relations in the European Union. The second chapter focuses on the topic of the acknowledgment inside of "communitarian" fundamental of the social rights and of the strike right. In particular, in the middle paragraphs the attention is focused on the right of the workers to resort to collective actions for the defense of own interests, thus like sanctioned in the Paper of the Fundamental Rights of European Community, (proclaimed in Nizza 18 December 2000). Although such important acknowledgment, the regulation of the strike right is not included between the legislative matters of competence of European Community (art. 137.5, del TUE, ora art. 153.5 TFUE). The exclusion can be read like expression of the political will of the Member States to respect the national standards, renouncing to any interference of the communitarian right in a branch in which it is difficult to show normative agreements in reason of the excessive difference of the national disciplines. Such chosen it has, however, determined a great differentiation between the national disciplines, with detail reference to the regulation of strike in the essential public services. The topic of the exclusion has been reproposed and intensified during the last few years as a result of a series of judgment of the Law court, relative to the cases Viking, Laval and, recently, Commission vs Germany. In particular, in the second paragraph are analyzed the Viking and Laval sentences, matched not only by content but also by the temporal proximity, the first of 11 December, the second of December 18 2007. They records a change regarding the precedence phase of indifference, as for the first time, the strike right is recognized like fundamental right of the European Union. The focus is also on the recent ruling by the Strasbourg Court on right to strike, in its judgment of 21 April 2009 Enerij would mark a clear development of the case, as it could be argued that the Court has held that the right to strike, as long as it is exercised to support collective negotiation, it is equally essential to freedom of association and therefore directly recognized and protected by art. 11 of the European Convention on Human Rights. The third chapter, at last, proposes, therefore, to analyze comparatively the legal approaches adopted by the Italian, French, English and German rules, about the discipline of the collective self-defense and the right to strike in essential public services in main countries of European Union, where the different national rules make difficult a compare aimed to the reach of a common framework. In particular, the Italian legislation with a provision for a special Commission of guarantee, represents a unique case in Europe and place Italy in a more advanced position than the member States. Indeed, to this authority, are entrusted assessment tasks and regulatory in relation to essential services, that must guarantee to the citizens the possibility of continuing to enjoy, albeit with some limitations, of their constitutionally protected rights. ; Dottorato di ricerca in Persona, impresa e lavoro: principi e tutele di diritto interno, internazionale, comunitario e comparato (XXIII ciclo)

OBJETIVO: la reconciliación asegurada por el Derecho se demuestra a menudo insuficiente y lenta en la efectiva solución del conflicto. La mediación, como nueva forma democrática del "hacer justicia" en los conflictos sociales, es un nuevo proyecto para la contención de los tiempos, de los costes, del formalismo y de la rigidez del juicio ordinario y que al mismo tiempo puede llevar a cabo una justicia psicológica cercana a los individuos. MÉTODO: investigaciones en los Tribunales, en los Organismos de mediación y comparación de análisis estadísticos nacionales sobre la mediación y sobre juicios pendientes del 2012 al 2015. RESULTADOS: las indagaciones estadísticas y las investigaciones enfatizan que la mediación en Italia, desde el momento de entrada en vigor (marzo 2011) de la Ley 28/2010 a hoy, es un organismo utilizado cada vez más como sistema de gestión de conflictos mejorando, por tanto, las relaciones sociales y reduciendo los tiempos y costes de la justicia. Desde el 2014 al 2015 las causas han disminuido un 9,5% y el porcentaje de los intentos obligatorios de mediación respecto al total de los procedimientos de mediación, en el 2015, ha sido del 81,6%. Es más, las estadísticas demuestran cómo con la participación directa de las partes, aumentan las resoluciones de controversias. De hecho, cuando la parte invitada comparece, lo que sucede en el 44,9% de los casos, el éxito positivo de las mediaciones es del 43,5%. CONCLUSIONES: la mediación no es una simple técnica para resolver conflictos, sino un proyecto de sociedad nueva que está contribuyendo a pasar de un orden antiguo, pensado como sometimiento del ciudadano a las decisiones superiores, a un orden innovador, útil en el tercer milenio, basado en la participación real y activa del individuo en la gestión de la vida cotidiana colectiva. La mediación es una bisagra fundamental para poder llevar a cabo un salto de cualidad en la gestión de conflictos. Sería oportuna una masiva campaña mediática que hiciera conocer a los ciudadanos la verdadera cara y potencialidad de la mediación. ; OBJECTIVE: the pacification ensured by law it is often inadequate and slow for the effective solution of the conflict. Mediation, as a new democratic form of "justice" in social conflicts, is a new project to save time, costs, the formality and rigidity of the ordinary proceedings and at the same time it can implement a psychological justice nearby individuals. METHOD: researches in the Courts, in mediation systems and comparison of national statistical surveys on mediation and on pending cases from 2012 to 2015. RESULTS: statistical surveys and researches put in evidence that mediation in Italy, since the entry into force (March 2011) of the Law 28/2010 to date, is increasingly used as a party-sharing system institution and no more as order imposed for conflict management improving, therefore, social relationships and reducing time and costs of criminal proceedings. From 2014 to 2015 the causes decreased by 9.5% and the percentage of mandatory mediation efforts compare to the total of the mediation processes, always in 2015, was equal to 81.6%. And yet, statistics show that, with the direct participation of the parties, increase the solution of the disputes. In fact, when the referred persons appear, and what it happens in 44.9% of cases, the positive outcome of mediations is about 43.5%. CONCLUSION: mediation is not a simple technique to resolve conflicts, but a project of a new society that is helping to pass from the ancient order as submission of the citizen to superior decisions towards an innovative order, to be used in the third millennium, based on real and active participation of the individual to the collective management of everyday life. Mediation is an unbreakable key to make a quantum leap in conflict management. It would be opportune massive media campaign to make citizens aware of the true face and the potential of mediation.
