But mediation not only helps to solve specific problems, because its potential encompasses aspects of greater complexity. Thus, mediation helps us to know ourselves better, to better understand others, and to use what we have learned to better manage future conflict situations. In asociety where there is no culture of agreement and where there is no education in the field of emotions, mediation becomes an adequate and effective tool to resolve conflicts in apeaceful and constructive manner. This paper is an analysis of mediation, in which special focus was put on the creativity of individuals in the world of social meanings. The typology of mediation participants and the ways in which they build a situation is presented, including: (i) types of social relations in advisory situations as described by Alicja Kargulowa; (ii) Roger Fisher's, William Ury's and Bruce Patton's method of negotiations; and (iii) the work by Kenneth L. Thomas and Ralph H. Kilmann in which the relation between negotiators and the purpose of mediation, or the attitude of negotiators to its purpose and other participants of a conflict situation have been taken into account. This different approach to mediation allows the reader to see other aspects of the procedure. Contrary to the criminal trial, the vision of mediation presented here reveals that the settlement arrived at by the parties is not the only benefit of the procedure, as it does not only focus on facts but also on relationships and the interests of the parties.Looking at the process of mediation through the prism of the negotiating parties may be an inspiration and raise awareness. It also serves to ensure openness to the philosophy of restorative justice. ; W artykule podjęto analizę mediacji, eksponując indywidualną kreatywność jednostki w świecie znaczeń społecznych. Przedstawiono typologię uczestników mediacji i ich sposobów budowania sytuacji. Autorka pokazuje typy uczestników, uwzględniając: (1) sposoby nawiązywania rodzajów stosunków społecznych w sytuacjach poradniczych opisanych przez Alicję Kargulową; (2) metody negocjowania wyróżnione przez Rogera Fishera, Williama Ury'ego, Bruce'a Pattona oraz (3) opracowanie Kennetha L. Thomasa and Ralpha H. Kilmanna uwzględniające stosunek negocjatorów do celu i innych osób w sytuacji konfliktowej. Pokazanie odmiennego od prezentowanych dotychczas obrazu mediacji zwraca uwagę na inne niż prawne aspekty mediacji w sprawach karnych. Przedstawiona wizja mediacji pozwala dostrzec, że spisana przez strony ugoda nie jest jedyną korzyścią ze stosowania tej procedury, która w przeciwieństwie do procesu sądowego koncentruje się nie tylko na faktach, lecz także na relacjach i interesach działających i kształtujących przebieg interakcji stron. Być może spojrzenie na przebieg procesu mediacji przez pryzmat negocjujących stron konfliktu stanie się inspiracją czy będzie służyć uwrażliwieniu i otwarciu na filozofię sprawiedliwości naprawczej.
The paper discusses the issue of mediation as one of the forms of solving criminal conflicts. The author presents, among others, the problem of mediation in connection with the principles of restorative justice, the issue of the mediation models accepted in criminal proceedings and also makes an attempt of indicating other forms of conflict solving based on negotiations. The author also makes a brief description of the shaping of lawmaker's motives in the case of mediation and then refers to contemporary issues of mediation proceedings. ; Artykuł obejmuje problematykę mediacji jako jednej z form rozwiązania konfliktu karnego. Autorka przedstawia m.in. kwestię mediacji w odniesieniu do założeń sprawiedliwości naprawczej, kwestię przyjętych modeli mediacji w postępowaniu karnym, a także podejmuje próbę wskazania innych form rozwiązania konfliktu, opartych na negocjacjach. Krótko opisuje historyczny proces kształtowania się założeń ustawodawczych mediacji, by następnie odnieść się do aktualnych, wybranych zagadnień postępowania mediacyjnego.
The subject of this article is the analysis of the activity undertaken during mediation in the context of the characteristics of the mediation process and the normative conditions of the legal relationship and disputes resolved through this form of ADR. In order to implement the project, the content of the work will contain a list of functions performed by the mediator during mediation as 'the environment for performing the role' (which is not closed due to the dynamics of interaction in the negotiations). Their character and content determine the nature of the social and professional role of mediators in the Polish legal order, it also allows us to illustrate in detail the key issues for reflection on the professional role, including, for example, legal liability and conflict of roles. Mediation functions are diversified in terms of the frequency of their implementation depending, among other things, on the strategy of conducting mediation, the specificity of the dispute and the legal regulation of mediation. The discussion of the last of the indicated differentiating factors (i.e. the impact of universally binding law) will be reflected in the content of the paper. ; Przedmiotem rozważań niniejszego artykułu jest analiza aktywności podejmowanej w trakcie mediacji w kontekście specyfiki procesu decyzyjnego mediacji oraz uwarunkowań normatywnych stosunku prawnego i sporów rozwiązywanych za pomocą tej formy ADR. W celu realizacji zamierzenia treść pracy będzie zawierać katalog funkcji pełnionych przez mediatora w trakcie mediacji jako "środowiska realizowania roli" (który ze względu na dynamikę interakcji w ramach rokowań nie posiada zamkniętego charakteru). Ich charakter oraz treść przesądzają o charakterze roli społecznej i zawodowej mediatorów w polskim porządku prawnym; pozwalają również w sposób szczegółowy zobrazować kluczowe zagadnienia dla rozważań nad rolą zawodową, w tym takie, jak np. odpowiedzialność prawna czy konflikt ról. Funkcje mediacyjne ulegają zróżnicowaniu w zakresie częstotliwości ich realizacji w zależności m.in. od strategii prowadzenia mediacji, specyfiki sporu oraz regulacji prawnej mediacji. Omówienie ostatniego ze wskazanych czynników różnicujących (tj. oddziaływania prawa powszechnie obowiązującego) znajdzie odzwierciedlenie w treści pracy.
Mediation is one of the alternative dispute resolutions. The aim of the article is to present research results conducted on 100 respondents. The survey concerned the awareness of society and their knowledge about mediation. It will allow to compare results with the actual mediation's exploitation in conflict situations. The author points to frequency of using mediation in Poland and abroad. The article also presents the advantages of mediation and society apprehensions in proportion to the exploitation of this method as a struggle with conflict. ; Mediacja jest jednym z alternatywnych sposobów rozwiązywania sporów. Celem artykułu jest przedstawienie wyników badań przeprowadzonych na 100 osobach ankietowanych. Ankieta dotyczyła świadomości społeczeństwa i jego wiedzy na temat mediacji. Pozwoliło to na porównanie wyników z rzeczywistym wykorzystywaniem mediacji w sytuacjach konfliktowych. Autorka wskazuje na częstość stosowania mediacji w Polsce i za granicą. Opracowanie przedstawia także zalety mediacji oraz obawy społeczeństwa w stosunku do wykorzystywania tej metody jako walki z konfliktem.

The paper analyzes the benefits of using family mediation as an alternative method of family conflict resolution and problems encountered when introducing it into the social life in modern societies. The analysis shows that the development of family mediation in Poland resembles that of other European states. In Poland, as in other European countries, family mediation was first "discovered" by the professionals dealing with family conflicts, then it was given a proper legal status and became included in the civil codes. The next phase was a protracted process of accepting the method of mediation by lawyers, conflicted parties, and other professionals who would be in the position to support the growth of family mediation. While analyzing the benefits of family mediation, a state of art type of study was done on the effectiveness of the mediation process and the clients' satisfaction indicating the short and long term advantages of family mediation. The paper proves no linear relationship between the effectiveness of the mediation procedures and the acceptance of this method in the court practice and in the society. Why people do not choose mediation despite its logical advantages over the adversarial court process? Trying to answer this question an analysis of potential sources of resistance to mediation is presented together with the relevant concepts of the moral resistance and the public resistance. These two concepts help us understand why do parties in conflict prefer adversarial court proceedings with the "winner" and "looser" over peaceful resolutions offered by mediation, enabling agreement and "keeping the face".
Celem niniejszego opracowania jest nakreślenie specyfiki gospodarczych sporów transgranicznych oraz zaprezentowanie mediacji jako metody ich rozwiązywania, alternatywnej wobec sądów powszechnych, dającej zwaśnionym stronom możliwość zarówno ich szybszego i mniej kosztownego zakończenia, jak i kontynuowania relacji gospodarczych oraz rozwijania dalszej współpracy pomiędzy przedsiębiorcami. W pierwszym kroku określone zostaną cechy konstytutywne mediacji oraz specyfika mediacji transgranicznej ze szczególnym uwzględnieniem aspektów interkulturowych. W tym kontekście przedstawione zostaną specyficzne kompetencje mediatora, niezbędne do skutecznego przeprowadzenia postępowania mediacyjnego w tego typu konfliktach oraz podstawy prawne zastosowania mediacji w odniesieniu do sporów pomiędzy podmiotami z Polski i Niemiec. Omówione zostaną zarówno regulacje prawa polskiego i niemieckiego dotyczące mediacji, jak i ramy i uwarunkowania instytucjonalno-prawne postępowania mediacyjnego w UE w zakresie sporów gospodarczych o charakterze transgranicznym. Ponadto analizie poddane zostaną dane empiryczne dotyczące zakresu upowszechnienia mediacji w obu krajach, stosunku polskich i niemieckich przedsiębiorców do mediacji jako metody rozwiązywania sporów gospodarczych pomiędzy podmiotami z obu krajów oraz trudności w jej zastosowaniu wynikające z różnic kulturowych. ; This paper aims to outline the specificities of cross-border economic disputes and to present mediation as a means of solving them as an alternative to common courts, giving the parties the opportunity to settle their dispute faster and cheaper. Mediation also allows the involved parties to continue their economic relation and further develop their co-operation. In a first step the constitutive characteristics of mediation are determined and the specificity of cross-border mediation with particular emphasis onintercultural aspects is explained. In this context, the paper presents specific mediator competences necessary for effective mediation proceedings. Furthermore the legal basis for applying mediation to disputes between Polish and German entities will be described followed by the discussion of applicable regulation in both countries as well as the institutional and legal framework for mediation proceedings in the EU on cross-border economic disputes. In addition, empirical data on the scope of dissemination of mediation in both countries, the attitude of Polish and German entrepreneurs towards mediation and the difficulties of applying it due to cultural differences will be analyzed. The conclusions of the above analysis will be presented in the final section of the paper, which will provide a model of the Polish-German mediation center which aims, besides broad information activities, to create a network of professional intercultural mediators and to promote mediation as an alternative method of conflict resolution between Polish and German business entities.

The objective of this paper was to analyze the sociocultural and personal reasons pivotal to the openness of the conflicting parties to a dialogue in the framework of family mediation. In the quest to answer the question what factors can influence the development of the family mediation in Poland and its acceptance both by the society and the families in conflict, the author presented the results of international and Polish research on the efficacy of the family mediation process and the readiness of the parties to use the mediation in family conflicts. Two theoretical concepts characterizing the sociocultural origins of resistance to mediation were analyzed in detail, namely that of the social resistance proposed by B. Mayer and that of the moral resistance by R. Benjamin. Moreover, the paper addressed the issue of the promotion of mediation together with the unrealistic expectations as to what can be achieved through mediation, mythologization of mediation and dilemma connected with the neutrality of the mediator. Finally, an integrated systemic approach to family mediation was proposed, which could enhance the chances of acceptance of the mediation by the parties in conflict. In essence it is proposed that the promotion of mediation should be exercised on three levels: (1) general societal level (to promote the winwin solutions in family conflicts), (2) level of specific educational activities for the conflicted parties (e.g. organization of premediation consultative meetings), and (3) level of specific actions targeted at various professional groups (e.g. judges, lawyers, probation officer, employees of the family support centres, etc).
The validity of mediation in the dispute promoted in the mass media as an example of government awareness campaign: You have the right to mediationAlternative dispute resolution (ADR) are becoming increasingly popular. One of the methods of ADR are mediations. They consist in making an attempt to reach a settlement or a mutually satisfactory resolution of a conflict through mediation – a third party, which is neutral towards all parties and subject of the conflict, designed to help work out a compromise. The survey conducted by the Ministry of Justice proved that mediation is not very well known by the Poles. The main reason for the lack of interest in this method of dispute resolution is insufficient knowledge among justice practitioners and the general public. In the absence of sufficient knowledge, lack of social acceptance for the extra-judicial settlement of disputes is also apparent. The Ministry of Justice decided to change this state in the government of PO in late 2011 and 2012, emphasizing the importance of this problem with a national, educational and informational social campaign, which circulated in the mass media and was entitled: You have the right to mediation.

The country gained independence in 1975, but remained culturally diversified. The basic identity for most of the citizens is still related to the tribal level. Political conflicts, corruption, abuse of alcohol and narcotics resulted in the past decades in several outbursts of violence among tribes of the Southern Highlands Province. Since the central government was unable to answer this challenge, the Catholic organizations of the Mendi diocese became very much involved in the peace-making process and other social initiatives.
