The problems of the anti-corruption strategy, issues of elimination of criminal factors, improvement of legislation and the activities of law enforcement agencies are analyzed. Anti-corruption problems should be solved systematically in a set of integrative measures of statepolitical, socio-economic, national-cultural, informational, criminological, legal and moral. The priorities of the implementation of such a course are the urgent implementation of such strategic principles as DE monopolization, DE offshorization, requisition of energy security facilities, demarcation of business and power, and ensuring effective tax and customs policy. The effective mechanism against corruption is the disengagement of power and business, the elimination of factors of political corruption. It is proposed in the Law on the Prevention of Corruption, as well as in the laws regulating the status of civil servants, to enshrine the requirement of impeccable business reputation and integrity. A system of new legislation should be developed and adopted: the Code of Evidence, the Code of Law Enforcement, the Investigator Status Function Act, the Detective Status Act, the Jury and World Court Act, and the Crime Detection, Prevention and Prevention Act. It is proposed to state the disposition of the law of the Criminal Code of Ukraine on illegal enrichment in accordance with Article 20 of the UN Convention against Corruption of 31.10.2003. In particular, it is proposed to consolidate the responsibility of officials for a significant increase in assets that exceed the total assets of zero declaration and legal wages in the public service. The mechanisms of the state government should provide for the function of prosecutorial supervision over the enforcement of anti-corruption legislation in the activities of enterprises, executive authorities and local government. Systemic proposals are being made for the formation of a strategy and a comprehensive anticorruption programed.

Under today's conditions, humanity and all social and state formations, including Ukraine, as part of the world order, is experiencing many changes: we are in a radically new political, economic, spiritual and ideological situation compared to the end of the twentieth century; its main features are socio-economic stagnation, political, cultural, educational and moral-psychological uncertainty, activation of old and the emergence of new stressors at the level of both individual and group (and even mass) consciousness. The complexity and contradictions of socio-economic and political development of our country necessitate the theoretical understanding and development of scientifically sound tools with which to make more effective the process of social interaction, non-criminogenic development of society, crime prevention and counteraction. Without theoretical knowledge that directly serves a specific state-building practice, it is impossible to fulfill a strategic task - to build a democratic state and civil society in Ukraine. Since Ukraine is passing not just a stage of democratization of the state system, but is carrying out a radical transformation of the economic and political system, the legal and social systems, the increase in the level of corruption is an objective conditioned factor. In Ukraine, corruption is one of the problems that needs immediate resolution. This poses a significant threat to democracy, the rule of law, social progress, national security, and the emergence of civil society. Therefore, creating an effective system for preventing corruption, developing and implementing a set of organizational and legal measures to counteract this phenomenon, identifying and overcoming its social preconditions and consequences should become one of the priorities of the state and its policy. The specificity of counteraction to corruption requires, first of all, the regulatory and legal establishment of a complex, harmonized system of preventive measures, which must be developed by various branches of legislation, including the administrative one. Therefore, the issue of counteracting corruption is extremely urgent, as it is also important to tackle one of the most urgent problems - overcoming corruption, as an extremely negative phenomenon in a society that undermines public confidence in the government, diminishes the prestige of the state in the international arena, distorts political competition. The article analyzes the notion of corruption. It has been established that scientific research and legislation have different approaches to the understanding of the notion 'corruption.' At the beginning the scholars defined corruption mainly by the methods of criminology which is explained by the first place of criminologists in the research of corruption. Unfortunately, national experts in civil, administrative and other branches of law referred and refer seldom to the research of corruption and corruption offences. At the same time, there were sporadic attempts to disclose the essence of corruption made by scholars of economic science and sociology. At the beginning of 90s of past century along with the opinion that 'the problem of corruption is beyond juridical science and is more sociological or political issue' there were views that corruption is an elementary bribery of public officials working at governmental and non-governmental structures or just an element of organized crimes or criminal nexus between public officials and organized criminal groups. Nowadays there are two main approaches to the essence of corruption. The first one says that corruption is bribery of its subjects and it is an agreement between the person who bribes and the person who is 'sold'. Other scholars think that corruption 'is not a primitive bribery particularly in the conditions of market economy, free trade and democracy' and 'mixing and, moreover, when the activities of the state is replaced by fight against bribery which is inherent to totalitarian states and complies with the interests of bureaucracy,' 'because one of the main sources of prosperity of corrupt officials is stealing of budget costs.' Practice shows that corruption is one of the global problems for all developing countries, including Ukraine. Its concept is given in Part 1, Article 1 of the Law of Ukraine "On the Prevention of Corruption". At the same time, it should be noted that a number of significant miscalculations have been made in this regulatory act, which have a great impact on the effectiveness of preventing corruption, as well as countering it as a whole. At the same time, despite the fact that scientists and practitioners constantly draw the attention of the domestic legislator to the need to improve the legal mechanism on these issues, in Ukraine the state of things in this direction is almost unchanged. First and foremost, we are talking about the fact that due to the lack of relevant legal norms and, in general, legal regulations, people's deputies of Ukraine are outside the law and responsibility for corruption acts, the order of their election is one of the main determinants of these offenses and the content of political corruption. Thus, it should be recognized that there is a serious practical problem that requires solution, including at the scientific level. The subject of the study – methodological aspects of corruption and inclusive development. The purpose of the study is how corruption dependence affects inclusive development. Corruption is one of the main problems of our time, which hinders both the economic and social development of society. Corruption, as an economic categorse, is not unique to underdeveloped countries. Annual losses from corruption, according to IMF estimates, account for about 2% of world GDP. In addition, corruption inevitably leads to a significant division of society and an increase in the proportion of poor people. All these barriers are in the way of inclusive growth as a fundamental concept of global development. Methods of research. Our study analysed a sample of 109 countries to provide an empirical assessment of the impact of corruption on inclusive development. The study assessed the relationship between the corruption perception index and the inclusive development index in 2018. The study was conducted using methods such as analysis and synthesis to identify prerequisites for inclusive development and basic principles for measuring corruption; Regression and correlation analysis to identify linkages between indicators of inclusive development and corruption; Tabular and graphical – for visual illustration of analysis The results of the work. The study found that corruption can affect inclusive development linearly and non–linearly. According to leading economists, corruption can deter the country 's development, not affect it, and even stimulate its growth somewhat. Solving the problem of preventing corruption at different levels and in different spheres of functioning of public authorities is one of the most pressing social problems of our time for many countries around the world, and for Ukraine in particular. As a result, issues related to corruption and identifying ways to prevent it are attracting increasing attention not only from research theorists and practitioners, but also from the public. The public danger of corruption is that those guilty of committing it encroach on social, cultural values, education and legal awareness of citizens. Thus, there is a need to take measures to prevent corruption not only by specially authorized entities in this area, but also by other government agencies. Analysis of the current state of corruption prevention in Ukraine, as well as the findings of sociological research on cooperation in this area, convincingly show the existence of numerous gaps in the regulation of interaction of corruption prevention entities and in the practice of its implementation. The article explores ways to overcome corruption and corruption in Ukraine through the prism of criminal law analysis.It was found that preventing and combating corruption is not only important but also a rather complex process of building a modern legal socially oriented state, due to the dynamism and multi-vector nature of social relations, as well as the constant improvement of forms and methods of criminal activity. The criminogenic situation that has developed in the last decade in Ukraine is characterized, in particular, by the unprecedented spread of corruption.It is determined that the effective fight against corruption requires a scientific concept of its prevention. One of the main principles of such a concept should be the understanding of corruption as a socially conditioned phenomenon. Based on this, it is necessary to develop a strategy and tactics to combat it, set appropriate goals, determine the means to achieve them, the level of material, financial, organizational and legal support. Криміногенна ситуація, яка склалась в останнє десятиліття в Україні, характеризується, зокрема, небувалим поширенням корупційних проявів.Визначено, що ефективна боротьба з корупцією вимагає наукової концепції її запобігання. Однією з основних засад такої концепції має бути розуміння корупції як соціально зумовленого явища. Виходячи із цього, необхідно розробити стратегію й тактику боротьби з нею, поставити відповідні цілі, визначити засоби їх досягнення, рівень матеріального, фінансового, організаційного та правового забезпечення. The article is devoted to the analysis of current regulations in the field of defense procurement. The importance of the problem of corruption for the people of Ukraine is highlighted.The threat to national security caused by high levels of corruption is mentioned. A number of studies on the spread of corruption in the defense sector are processed, in particular by such public organizations as the Independent Anti-Corruption Committee on Defense, Transparency International UK, Transparency International Ukraine and others.Attention is drawn to the presence of a large number of corruption risks in the defense sector. The Law of Ukraine"On Defense Procurement", adopted by the Verkhovna Rada of Ukraine on July 17, 2020, was analyzed.Attention is paid to the fact that the Law of Ukraine"On Defense Procurement"provides for the purchase of goods, works and services for defense purposes, which is a state secret, through closed procurement, and it also regulates the absence of competitive procedures for procurement by import by making purchases directly through electronic trading platforms. Some aspects of the Law of Ukraine"On Public Procurement"used in defense procurement are considered. Based on the results of the analysis, it was concluded that the Law of Ukraine"On DefenseProcurement"helps to overcome most of the corruption risks identified in the study of the Independent Anti-Corruption Committee on Defense, however, it also needs significant improvement, as some provisions contain gaps that lead to new corruption risks, if they are not corrected. ; У статті проведено аналіз чинних нормативно-правових актів у сфері оборонних закупівель, висвітлено деякі недоліки Закону України "Про оборонні закупівлі", а також проаналізовано корупційні ризики, які можуть з'явитися в результаті реалізації положень Закону "Про оборонні закупівлі".

Основою будь-якої діяльності є встановлення основних принципів її реалізації. Зрештою, вони визначають основні напрями такої діяльності, окреслюють її межі, допомагають будувати цілі. Належне формулювання принципів роботи є запорукою її ефективності. Звичайно, антикорупційна діяльність не є винятком. На нашу думку, в контексті комплексної протидії корупції в Україні законодавча консолідація основних принципів антикорупційної діяльності є важливою та актуальною. Основні принципи антикорупційної діяльності поділяються на загальні: верховенство права, законність , публічність та спеціальність: справедливість, принцип незалежності осіб, які мають повноваження у сфері боротьби з корупцією; принцип взаємодії силових структур з інститутами суспільства; наявність незалежних ЗМІ; принцип неминучості відповідальності за вчинення корупції та правопорушень, пов'язаних з корупцією; принцип інтегрованого та систематичного поєднання заходів щодо запобігання та боротьби з корупцією. ; The basis of any activity is the establishment of the basic principles of its implementation. Principles of anti-corruption activities are divided into general: the rule of law, legality, publicity and special: justice, the principle of independence of persons who are empowered in the field of combating corruption; principle of interaction of power structures with the institutes of society; availability of independent media; the principle of the inevitability of liability for the commission of corruption and corruption-related offenses; the principle of an integrated and systematic combination of measures to prevent and combat corruption.

Today, it is important to address the issue of illicit transplantation of human organs and tissues, as Ukraine is the last-place transplant in other countries. Unfortunately, there are no other methods currently available to save the lives of individuals, so it is very important to investigate and find out all the causes and ways to counteract corruption in this area. It should also be noted that one of the components of corruption in this area is the abuse of special subjects by the norms stipulated by the legislation that lead to socially dangerous consequences. This article provides statistics on organ transplantation needs in the world as a whole, as well as in Ukraine. Also, the article gives the main reasons for the illegal transplantation of human organs and tissues. The studies concerning this topic are analyzed and the most important theses are highlighted. A number of anti-corruption measures have also been proposed in this area. The author proposes to strengthen the control over the medical institutions that transplant organs and tissues; improve the mechanism of law enforcement interaction, migration and border control; to develop an effective unified system for keeping records of transplantation and to make sure that persons in need of transplantation are properly prioritized. It should be noted that it is difficult for law enforcement agencies to deal with the illegal transplantation of human organs and tissues, since police officers do not have sufficient knowledge in the field. The author underlines that the following state law enforcement agencies should counteract corruption in the mentioned sphere: the National Anti-Corruption Bureau of Ukraine, the National Agency for Prevention of Corruption and the Specialized Anti-Corruption Prosecution under the Prosecutor General's office. The article is devoted to consideration of modern tendencies of corruption criminality in Ukraine. It is established what exactly corruption is and different views on the definition of the mentioned concept are given in the article. It is noted that the divergent approaches to the definition of corruption and corruption criminality lead to the fact that scientists have only a par-tial idea of corruption as the object of scientific research. The author reveals the main modern tendencies concerning corruption crime in Ukraine and analyzes the reasons of this or that tendency. The article draws attention to the fact that in today's Ukraine more often artificial statistics are being created regarding the reduction of corruption crimes, while the overall situation with corruption does not change and anti-corruption reforms are not yet working at full capacity. It is noted that corruption in Ukraine is characterized by a high level of latency, which is explained by the increased desire of corrupt officials to protect them from possible liability. As a result, it has been determined that Ukraine is go-ing the right way making changes in its anti-corruption doctrine, which are necessary for successful European integration. With a systematic approach to eradicating corruption from its territory, Ukraine is able to overcome the negative trends in the spread of corruption and its dominance in political circles and gradually reach the level of development of the world's leading countries. ; Стаття присвячена розгляду сучасних тенденцій корупційної злочинності в Україні. Автором розкриваються головні тенденції щодо корупційної злочинності в Україні та аналізуються причини тієї чи іншої тенденції. У статі звертається увага, що в сучасній Україні дедалі частіше створюється штучна статистика щодо зменшення кількості корупційних злочинів, а загальна ситуація із корупцією не змінюється. Антикорупційні реформи ще не працюють на повну потужність. Зауважується, що корупційна злочинність в Україні характеризується високим рівнем латентності, що пояснюється підвищеним бажанням корупціонерів захистити себе від настання можливої відповідальності. Визначено, що Україна йде правильним шляхом, проводячи зміни в своїй антикорупційній доктрині, необхідні для успішної євроінтеграції. За умови системного підходу до викорінення корупційної злочинності зі своїх терен Україна зможе подолати негативні тенденції щодо поширення корупційної злочинності та її панівного стану в політичних колах та поступово дійти до рівня розвитку передових держав світу.

The provisions of Ukrainian current legislation, as well as the scientific approaches to determine the meaning of the «corruption» concept by identifying its content and scope are carefully considered.General and distinctive features of theoretical approaches by the scholars in different branches of law to define the above concept are determined. Particular emphasis is placed on the appropriate divarication regarding legislative unification of the «corruption» concept and its counterparts in the law theorist's scientific works.To understand the concept of «corruption», the singularity of knowledge regarding the phenomenon as a social, legal, moral and economic system that harms normal development of legal and ethical relations between the members of society and the state is researched in the light of different scientific approaches.Emphasis is placed on the lack of unanimity of the scientific understanding of actions, which are a part of corruption's nature. It does negatively affect not just the legislative unification of the concept of the phenomenon, but also complicates the law enforcement practice, creating certain inconveniences for the corresponding judicial and law enforcement authorities.The connection between the norms of criminal, labor, civil and administrative Ukrainian legislation on defining the content of the term «corruption offenses» is stated. Emergence of possible difficulties related to the application of the Law of Ukraine «On Prevention of Corruption» as well as the Criminal Code on liability for corruption is analyzed.The corruption phenomenon's features are defined on the basis of a study of the scientific approach to the definition of «corruption». Certain scholars' points of view on the provisions of the Law of Ukraine «On Prevention of Corruption» as well as other normative legal acts that define the enumeration of corruption or corruption-related actions are justified.It is substantiated that certain features of the phenomenon under consideration, listed in the Law of Ukraine «On Prevention of Corruption», were not taken into account by the scholars as important and, conversely, not all the features mentioned by them are a part of the legislative definition of «corruption».Taking into account the research of current anti-corruption legislation, as well as the scientific concepts of understanding corruption, it is found that the legislator partially ; Розглянуто підходи вчених, а також норми антикорупційного законодавства України, положення яких стосуються встановлення змісту та обсягу явища корупції. Окреслене спричинює невідповідність законодавчих закріплень як ознак самого явища, так і потенційних суб'єктів правопорушень. Як наслідок, виникають труднощі в частині засто-сування права представниками правоохоронних та судових органів.Враховуючи дослідження діючого антикорупційного законодавства, а також наукові концепції розуміння корупції, встановлено, що законодавець частково використовує кла-сичний та державно-управлінський підходи для визначення поняття корупції.
