Eine Vielzahl von Staaten hat im Rahmen des BEPS-Projekts der OECD die Umsetzung des Country-by-Country Reportings (CbCR) vereinbart. Das in BEPS-Aktionspunkt 13 zur Verrechnungspreisdokumentation aufgeführte CbCR wurde über die EU-Amtshilferichtlinie in § 138a AO normiert. Mithilfe des CbCR sollen Finanzbehörden ein Big Picture multinationaler Großkonzerne erhalten, um Verrechnungspreis- und andere Base Erosion and Profit Shifting (BEPS)-Risiken aufdecken zu können. Fabian Lutz hat eine Methode entwickelt, mit der er untersucht, ob auf Grundlage von Country-by-Country Reports (CbC Reports) steuerliche Gestaltungen erkannt werden können, die nach Ansicht der OECD zu »anderen BEPS-Risiken« führen. Anhand der Methode nimmt er für drei Bereiche (hybride Gestaltungen, Hinzurechnungsbesteuerung und Zinsabzug) eine Analyse der Aussagekraft von CbC Reports vor. Das Ergebnis ist, dass CbC Reports derzeit (2019) nicht für eine erste Risikoeinschätzung geeignet sind, weshalb er Verbesserungsvorschläge ableitet. / »Suitability of the OECD's Country-by-Country Reporting for a High-Level Assessment of Selected BEPS Risks and Derivation of an Approach Regarding the Improvement of the Country-by-Country Reporting« -- The OECD's Country-by-Country (CbC) Reporting (§ 138a AO) should provide tax administrations a big picture of large multinational enterprises to detect transfer pricing and other Base Erosion and Profit Shifting (BEPS) risks. Fabian Lutz investigates whether CbC Reports are suitable to detect tax structures, which according to the OECD lead to »other BEPS risks«. In summary, CbC Reports are currently (2019) not suitable for a high-level risk assessment, which is why he derives suggestions for improvements.
