Resumo: O controle das políticas públicas, por parte dos tribunais de contas, sempre ensejou muitos debates jurídicos acerca de seus pressupostos e limites, principalmente, em razão de albergar um campo maior para o exercício da discricionariedade administrativa na definição de metas, diretrizes, prioridades e planos de governo para a consecução do interesse público. O exercício dessa importante atividade de controle não é o cerne do problema, considerando que no atual modelo de Estado de Direito não existem mais campos imunes à incidência do direito, o que inclui a própria política, em especial quando se estiver tratando de políticas públicas deficitárias, também chamadas de falhas estruturantes, decorrente do próprio estado de coisas. O mérito das discussões está na efetivação dessas intervenções e ativismos estruturais quando realizados de forma unilateral e antidialógica, sem a realização de um amplo debate democrático, com a utilização de instrumentos de controle consensuais, sob o viés da consequencialidade, oportunizando o alcance de bons resultados práticos e privilegiando o equilíbrio institucional próprio de um governo democrático e com poderes constitucionalmente separados. ; Abstract: The control of public policies by the courts of audit has always given way to countless legal debates regarding their assumptions and limits, mainly in order to encompass a larger field for the exercise of administrative discretion in the definition of goals, guidelines, priorities and government plans to attain the public interest. Executive Council Thirty-Fourth Ordinary Session 7 – 8 February 2019 Addis Ababa, Ethiopia ; The African Court on Human and Peoples' Rights (the Court) was established in terms of Article 1 of the Protocol to the African Charter on Human and Peoples' Rights on the Establishment of an African Court on Human and Peoples' Rights (hereinafter referred to as "the Protocol"), adopted on 9 June 1998, in Ouagadougou, Burkina Faso, by the then Organization of African Unity (OAU). The Protocol entered into force on 25 January 2004. The Court became operational in 2006 and is composed of eleven (11) Judges elected by the Executive Council and appointed by the Assembly of Heads of State and Government of the African Union. The Seat of the Court is in Arusha, the United Republic of Tanzania. Article 31 of the Protocol mandates the Court to "…submit to each regular session of the Assembly, a report on its work. The report shall specify, in particular, the cases in which a State has not complied with the Court's judgment.

O orçamento é o ato jurídico em que se faz a previsão da receita, autorizando a sua arrecadação, e a fixação da despesa, autorizando, outrossim, a sua execução, relativas a determinado exercício financeiro. Embora o conteúdo do orçamento diga respeito à matéria de Direito Financeiro, pertinente à disciplina da receita e da despesa, a natureza jurídica da fiscalização da execução do orçamento se mantém no campo do Direito Administrativo, não obstante se utilize das normas de contabilidade pública e de técnica econômico-financeira para levá-la a cabo. Destarte, permanece no Direito Administrativo o estudo dos órgãos de controle do Estado quanto a atividade dos ordenadores da despesa e pagadores de contas, e os atos jurídicos de efetivação desse controle.Esse controle da execução do orçamento se faz através do Poder Executivo, por órgão do Ministério da Fazenda ou das Finanças, que acompanham a gestão financeira dos diferentes órgãos do Estado, e se denomina fiscalização interna; e, através do Poder Legislativo, valendo-se de pareceres de suas Comissões de Finanças ou Tomadas de Contas, e, especialmente, de órgão administrativo, autônomo, de cúpula colegiada ou individual, seu delegado, e auxiliar, ou melhor, colaborador, na verificação das contas dos órgãos do Estado, independente do Poder Executivo, e esse controle se denomina fiscalização externa.Ao Legislativo compete não só a aprovação do orçamento como a fiscalização última da sua fiel execução. The Brazilian federal judiciary offers an interesting riddle to scholars of judicial politics and policy change. While the courts have played a major policy role over the past two decades, constraining and altering federal policy across a range of subjects, the court system has simultaneously been labeled "dysfunctional." This paper investigates this riddle: a system plagued by major systemic flaws in its day-to-day operations, which nonetheless still manages to exert a powerful influence on public policy in Brazil. The author adopts a new institutional perspective, focusing on how the institutional and normative structure within which judges and other legal actors operate affects policy outcomes. ABSTRACT Introduction: This article deals with the Supreme Federal Court's empowerment trajectory, exploring exogenous variables in order to explain what made the Supreme Court so institutionally powerful, and how it happened. After the classic studies on the global expansion of the judicial power, that pointed to a myriad of causes as a result of the phenomenon, several recent researches have indicated the political-party fragmentation as the main cause of judicial empowerment. Seeking to corroborate these analyses, the present work analyzes the institutional empowerment of the Brazilian Judiciary from 1945 to 2015, testing the hypothesis the greater the party fragmentation, more institutional power the STF holds. Materials and Methods: As a dependent variable, a synthetic indicator was created to measure the institutional power of the Federal Supreme Court year by year. The independent variables measure the party composition of the Chamber of Deputies annually for the same period. In addition to these variables, other measures were imported from the V-Dem database. For this analysis, simple linear, generalized linear and multinomial models were used. Results: We identified significant impact of party fragmentation on institutional empowerment of the Supreme Court. In all tests, party fragmentation increased the chances of institutional empowerment of the Brazilian judiciary. Discussion: The exogenous reforms that generated this empowerment took place with the support of the Executive and the leniency of the Legislative, transforming the Brazilian Supreme Court into the Queen of the Chess.KEYWORDS: Judiciary Power; Partisan Fragmentation; judicial empowerment; Supreme Federal Court; multinomial; factorial analysis.

Os atuais 33 Tribunais de Contas regionais brasileiros são responsáveis por acompanhar o ciclo de gestão financeira de governos estaduais e municipais e a legalidade dos atos de mais de 20.000 organizações públicas vinculadas a esses Estados e municípios. Este artigo tem como objetivo analisar a diversidade da configuração interna desses Tribunais de Contas regionais e discutir possíveis associações com a qualidade da auditoria financeira realizada por suas equipes. Foram realizadas entrevistas com auditores externos e diretores de tecnologia da informação de 18 tribunais, trianguladas com documentos oficiais disponibilizados pelos Tribunais de Contas, como relatórios anuais de atividades e manuais de auditoria. Partindo de fatores determinantes da qualidade da auditoria externa identificados na literatura, a análise de conteúdo das entrevistas identificou as características formativas da configuração de cada tribunal analisado. Apesar de todos os tribunais no Brasil terem como origem comum o modelo napoleônico de corte de contas, a análise traz como resultado que suas configurações variam quanto à organização e formação das equipes, ao uso de rodízio na alocação das tarefas de auditoria e à automatização dos sistemas de coleta de dados de jurisdicionados. Discute-se que a diferença na configuração dos tribunais, dada a demarcação de sua área de jurisdição, contribuiria a diferentes níveis de coerção em governos estaduais e municipais, à medida em que a configuração apresenta uma combinação de características que inibe ou amplia a qualidade da auditoria. A partir da literatura de alinhamento organizacional, o artigo alerta sobre o uso de variáveis para tratar o efeito da qualidade da auditoria nos estudos em finanças municipais. ; Currently, the 33 regional audit courts are responsible to monitor the public financial management cycle for states and municipalities and to judge the compliance of governors' acts to the laws regarding procurement and civil servants' employment from more than 20,000 governmental entities under their jurisdiction. This article aims to analyze the diversity of internal configuration of these regional audit courts and to discuss the potential associations with the financial auditing quality their teams usually run. We conducted interviews with external auditors and IT directors from 18 courts, followed by triangulation to official documents from the audit courts, such as audit manuals and activities reports. The audit quality drivers were identified within the governmental auditing literature, supporting the evidences collected by the interviews content analysis. Despite all regional auditing bodies in Brazil were based on the Napoleonic model, the analysis indicates the identified configurations vary according to the team's organization and size, auditor rotation and use of data reporting systems. The discussion shows that dissimilarities on the courts' configurations, as they are responsible to audit a specific country area, will contribute to a different coercion level on fiscal and accounting issues to state and municipalities, due a combination of characteristics which could mitigate or improve the audit quality. This paper additionally suggests some precautions, based on the organization alignment literature, for the use of proxies to control audit quality effects in the public finance studies in Brazil.

O trabalho analisa as interpretações dadas à Lei de Responsabilidade Fiscal nos 19 anos de sua implantação. Como uma instituição que procura regular a gestão fiscal de governos por todo o País, parte significativa da coerção da Lei no nível regional e local cabe aos Tribunais de Contas de Estados e Municípios. Adotou-se o modelo teórico de mudança institucional de Mahoney e Thelen (2009), com evidências coletadas por questionário, para dar uma primeira explicação para a mudança incremental na legislação fiscal. A Lei de Responsabilidade Fiscal tem sido interpretada pelos órgãos de auditoria, de tal forma que, em alguns casos, surgem práticas de contabilidade criativa, diminuindo a contenção do gasto excessivo e gerando sobre-endividamento. ; The paper analyzes the interpretations given to the Fiscal Responsibility Law after 19 years of its implementation. As an institution that seeks to regulate the fiscal management of governments throughout the country, a significant part of the enforcement of the law at the regional and local level rests with the State and Municipal Courts of Accounts. We adopted the theoretical model of institutional change by Mahoney and Thelen (2009), with evidence collected by questionnaire, to give a first explanation for the incremental change of such fiscal legislation. The Fiscal Responsibility Law has been interpreted by the auditing bodies, in such a way that, in some cases, creative accounting practices emerge, reducing the containment of excessive spending and generating over-indebtedness.

O objetivo deste trabalho foi identificar as trajetórias de automatização da coleta de dados em diversos Tribunais de Contas, as características comuns aos sistemas que emergiram e os impactos para os controles fiscal e contábil no Brasil. A automação de coleta de dados é parte da transformação digital no campo de auditoria, porém, as literaturas de auditoria pública no Brasil, de transformação digital ou de infraestrutura digital, não analisam como tal transformação se dá e como as infraestruturas se estabilizam e moldam o campo de auditoria. A automação da coleta de dados traz implicações inesperadas para o conteúdo da auditoria pública e de gestão financeira dos órgãos fiscalizados. A identificação das trajetórias dessa automatização permite discutir as diversas soluções presentes no campo e como isso afeta a uniformização da auditoria de governos. A automatização da coleta de dados pelos Tribunais de Contas, sobretudo o escopo e a frequência dessa coleta, induz como os órgãos fiscalizados priorizam a adoção e a manutenção de políticas e processos contábeis, orçamentários e de planejamento financeiro. As infraestruturas digitais que emergem desses sistemas moldam todo o campo de auditoria, enraízam-se e aumentam o custo de mudança futuro, perpetuando a heterogeneidade na fiscalização e na administração financeira de governos na federação. O artigo apresenta um estudo de caso longitudinal (1994 a 2020), com narrativas construídas a partir de questionários e entrevistas com analistas de controle externo de 26 Tribunais de Contas. A automatização da coleta de dados orçamentários e contábeis pelos Tribunais de Contas tem alterado a lógica do campo de auditoria de governos no Brasil. As infraestruturas digitais que emergem ao conectar Tribunais e seus jurisdicionados enraizaram conceitos, definições e expectativas implícitas na lógica de auditoria remota. ; This study aimed to identify the trajectories for data collection automation in various Courts of Accounts (Tribunais de Contas), the standard features of the systems that have emerged, and the impacts on fiscal and accounting oversight in Brazil. Data collection automation is part of the digital transformation in the field of auditing; however, the literature on public sector auditing in Brazil, on digital transformation, or digital infrastructure, does not analyze how this transformation occurs and how the infrastructures are stabilized and shape the field of auditing. Data collection automation has unexpected implications for the content of public sector audits and the financial management of the public sector auditees. Identifying the trajectories for digital tools of data collection automation enables a discussion on whether currently adopted solutions vary and the effects on the standardization of government audits. The automation of data collection by the Court of Accounts, particularly its scope and frequency, affects how the audited public organizations prioritize the adoption and maintenance of accounting, budgeting, and financial planning policies and processes. The digital infrastructures that emerge from these digital tools shape the entire field of auditing, they become embedded, and they increase the cost of future changes, perpetuating the heterogeneity in the auditing and financial management of governments in the Brazilian federation. The article presents a longitudinal case study (1994 to 2020), with narratives built based on questionnaires and interviews with auditors from 26 Courts of Accounts. The automation of budgetary and accounting data collection by Courts of Accounts has changed the logic of the field of government auditing in Brazil. The digital infrastructures that emerge by connectingCourts and the audited public organizations under their jurisdictions have embedded concepts, definitions, and implicitexpectations in a remote auditing logic.

Fundamental na criação de um espaço europeu de liberdade, segurança e justiça é o princípio do reconhecimento mútuo, de que a decisão-quadro 2002/584/JAI do Conselho, de 13 de junho de 2002, constitui a primeira grande concretização no domínio da cooperação judicial em matéria penal. A jurisprudência do Tribunal de Justiça da União Europeia tem contribuído de modo relevante para a compreensão da decisão-quadro, acentuando os seus objetivos e reforçando os seus princípios orientadores, que são o reconhecimento mútuo das decisões proferidas nos diferentes Estados-Membros da União Europeia e a confiança mútua que deve instalar-se entre estes, a bem da criação do referido espaço. O acórdão West, de 28 de junho de 2012, proc. C-192/12 PPU, proferido em processo de reenvio prejudicial urgente, ilustra pertinentemente o impacto daquela jurisprudência, sublinhando o papel deste procedimento, implementado em 1 de março de 2008. ; A key factor in the creation of a European area of freedom, security and justice is the principle of mutual recognition, which the Framework Decision 2002/584/JHA of 13 June 2002, for the first time, comprehensively implemented in the field of judicial cooperation in criminal matters. The Court of Justice of the European Union has greatly contributed to the understanding of the Framework Decision, accentuating its goals and enhancing its guiding principles, which are the mutual recognition of judgments in the different Member States of the European Union and mutual trust that should settle among them, for the creation of the said area. The West judgment of 28 June 2012, C-192/12 PPU, on urgent preliminary ruling procedure, aptly illustrates the impact of this case law, highlighting the role of this procedure, implemented on 1 March 2008.

The interrelationships between regulatory agencies and judicial courts generally have a high impact on social relations. However, there is little empirical research and a need for greater systematization of knowledge from a multidisciplinary perspective. This essay discusses the main tensions between the executive and judicial branches of government in decisions about the regulatory activity. The discussion is facilitated through the main theoretical lenses and previous studies on the application to the phenomena. The relationship between agencies and courts is marked by divisions, and the institutional approach to the regulatory space and reflections stimulated by law and economics theory, among other theoretical approaches, are very useful for interpreting institutional tensions in this relationship. The literature on judicial review of regulatory agency decisions points to factors that explain judicial deference or motivate a more prominent role of courts, as well as on topics related to: a) court involvement with technical and scientific issues; b) efficiency and performance; c) calculated behaviors; d) transaction costs; and e) cost-benefit analysis. A research agenda is suggested to explore the perceptions of key players about regulatory disputes, and factors and conditions that explain judicial deference in different contexts. ; Las interrelaciones entre las agencias reguladoras y los tribunales judiciales son un tema de alto impacto en las relaciones sociales en general, pero aún carecen de investigación empírica y una mayor sistematización del conocimiento desde una perspectiva multidisciplinaria. En esta línea, este ensayo tiene como objetivo llevar a cabo una discusión articulada de las principales tensiones entre el Poder Ejecutivo y el Judicial en las decisiones inherentes a la actividad reguladora, con el apoyo de las principales lentes teóricas y el estado de la cuestión aplicable al fenómeno. La relación entre agencias y tribunales se caracteriza por las dicotomías y el enfoque institucional del espacio regulatorio, y las reflexiones aportadas por el análisis económico del derecho, entre otras lentes de análisis, son muy útiles para interpretar las tensiones institucionales existentes en esta relación. La literatura sobre la revisión judicial de las decisiones de las agencias reguladoras apunta a la investigación de factores que explican la deferencia judicial o motivan un papel más prominente de los tribunales, así como de temas relacionados con: a) participación de los tribunales en cuestiones técnicas y científicas; b) eficiencia y performance; c) comportamientos calculados; d) costos de transacción; y e) análisis de costo-beneficio. Se propone una agenda de investigación que explore las percepciones de los actores clave sobre disputas regulatorias, así como estudios sobre factores y condicionantes que expliquen la deferencia judicial en diferentes contextos. ; As inter-relações entre agências reguladoras e tribunais judiciais constituem tema de alto impacto nas relações sociais em geral, porém, ainda carecem de pesquisas empíricas e maior sistematização do conhecimento, sob uma perspectiva multidisciplinar. Nessa linha, este ensaio tem por objetivo realizar uma discussão articulada das principais tensões entre o Poder Executivo e o Poder Judiciário em decisões inerentes à atividade regulatória, apoiada nas principais lentes teóricas e no estado da arte aplicáveis ao fenômeno. O relacionamento entre agências e tribunais é marcado por dicotomias e a abordagem institucional do espaço regulatório e as reflexões trazidas pela Análise Econômica do Direito, dentre outras lentes de análise, revelam-se bastante úteis para a interpretação das tensões institucionais existentes em tal relacionamento. A literatura sobre revisão judicial de decisões de agências reguladoras aponta pesquisas sobre fatores que explicam a deferência judicial ou motivam um papel mais proeminente dos tribunais, passando também por temas relativos a: a) envolvimento de tribunais com questões técnicas e científicas; b) eficiência e desempenho; c) comportamentos calculados; d) custos de transação; e e) análises de custo-benefício. Propõe-se uma agenda de pesquisa que explore percepções de atores-chave desse ambiente acerca de litígios regulatórios, bem como estudos sobre fatores e condicionantes que explicam a deferência judicial em diferentes contextos.

Examining some recent examples from the Court of Justice of the European Union case law, this article intends to unravel the direction to which the European courts turn towards in times of crisis. The fiscal restraint and socioeconomic restructuring dictated by considerations of public debt reduction affect the daily lives of European citizens. However, the crisis and the austerity measures framed by Union law follow the new visibility that fundamental rights assumed in the integration process with the entry into force of the Charter of Fundamental Rights of the European Union. Therefore, in accordance to the moto proclaimed by Cunha Rodrigues, the crisis highlights the role of jurists and, in particular, the judges while guardians of democracy – understood as the safe exercise of fundamental rights. This paper therefore considers the transformative potential of the current crisis and its implications on the deepening of citizenship rights in the European Union. ; A partir de alguns exemplos recentes da jurisprudência do Tribunal de Justiça da União Europeia, o presente texto pretende desvendar a direção para a qual avançam os tribunais europeus em tempos de crise. As medidas de contenção orçamental e de reestruturação socioeconómica ditadas por imperativos de desendividamento público afetam o quotidiano do cidadão europeu. Contudo, a crise e as medidas de austeridade enquadradas pelo direito da União são contemporâneas da nova visibilidade que os direitos fundamentais assumiram no processo de integração com a entrada em vigor da Carta dos Direitos Fundamentais da União Europeia. Por isso, e indo ao encontro do mote lançado por Cunha Rodrigues, a crise acentua o papel dos juristas e, em especial, dos juízes enquanto garantes da democracia – entendida como o exercício seguro de direitos fundamentais. O presente texto considera, assim, o potencial transformador da atual crise e suas implicações no aprofundamento de uma cidadania de direitos na União Europeia.

The specificity of the Strasbourg judgments is versatile and concerns many different areas of social life that it is not possible to effectively adapt legal norms and apply their interpretation by one entity of public authority. It can be said with full conviction that the execution of judgments is a continuous process and will last as long as the European Court of Human Rights is functioning; surely it will not end with the completion of the most difficult cases. It is important for the national system for the protection of human rights to be very efficient in the context of the protection of human rights. If, however, there is a violation of the norms of international agreements, Poland must be effective in meeting obligations such as the judgments of the European Court of Human Rights. There are two aspects involved in fulfilling obligations under international law arising from the European Convention for the Protection of Human Rights and Fundamental Freedoms. The first one is the introduction of appropriate standards of respect for the rights and freedoms enshrined in the treaty, and the second one is the obligation to enforce judgments of the European Court of Human Rights in the case of a stated infringement of the Convention. Both obligations must be carried out simultaneously by the state – which, as a party to the Convention, respects its provisions and fulfills the required international legal obligations. The subject of this paper is to present the powers and legitimacy of the body of the executive in Poland in connection with the execution of the judgments of the European Court of Human Rights. ; A especificidade dos acórdãos de Strasburg é versátil e diz respeito a muitas áreas diferentes da vida social, e não é possível adaptar eficazmente as normas jurídicas e aplicar suas interpretações por uma única entidade de autoridade pública. Pode-se dizer que a execução das sentenças é um processo contínuo e durará enquanto o Tribunal Europeu dos Direitos do Homem estiver em atividade; seguramente não terminará com a conclusão dos casos mais difíceis. É importante que o sistema nacional de proteção dos direitos humanos seja eficiente no contexto da proteção dos direitos humanos. Se, no entanto, houver violação das normas dos acordos internacionais, a Polônia deve ser eficaz no cumprimento de tais obrigações, como as sentenças da Corte Europeia de Direitos Humanos. Existem dois aspectos envolvidos no cumprimento das obrigações decorrentes do direito internacional da Convenção Europeia para a Proteção dos Direitos Humanos e das Liberdades Fundamentais. A primeira é a introdução de padrões apropriados de respeito aos direitos e liberdades consagrados no tratado, e a segunda é a obrigação de executar sentenças da Corte Europeia de Direitos Humanos no caso de uma violação declarada da Convenção. Ambas as obrigações devem ser cumpridas simultaneamente pelo Estado que, como parte da Convenção, respeita suas disposições e cumpre as obrigações legais internacionais exigidas. O tema deste artigo é apresentar os poderes e a legitimidade do órgão do Poder Executivo na Polônia em conexão com a execução das sentenças da Corte Europeia de Direitos Humanos.
