Le aziende di credito italiane negli ultimi decenni si sono sottoposte ad un processo di ristrutturazione e di conseguenza hanno cambiato il loro modo di essere, di operare e competere. Per molto tempo il mercato bancario è stato caratterizzato da una notevole stabilità, resa possibile dall'aver vissuto per decenni in condizioni di mercato chiuso, in un regime protezionistico tale da garantire costi e profitti elevati; ritardi nell'innovazione organizzativa e dei prodotti; costi elevati degli stessi; mancanza di trasparenza nei rapporti con i clienti. il sistema bancario, cioè, per molto tempo è stato caratterizzato da una staticità di comportamento e da una scarsa propensione al cambiamento e da una forte concentrazione sui soli aspetti quantitativi (costi, prezzi, volumi di attività) tralasciando quelli qualitativi. La nascita di un mercato unico europeo per i servizi finanziari e il conseguente accresciuto livello di competizione e globalizzazione; la comparsa e lo sviluppo di nuovi intermediari finanziari; la revisione del quadro normativo ed istituzionale di riferimento; l'evoluzione culturale del consumatore con il conseguente sviluppo di nuovi bisogni e preferenze; l'evoluzione tecnologica; la nascita di nuovi fattori di competizione sono tutti eventi che hanno determinato una "turbolenza ambientale" tale da smantellare le barriere che per decenni hanno lasciato la banca al di fuori della competizione. Le banche in un ambiente di agguerrita concorrenza, con un numero più alto di operatori e caratterizzato da numerose innovazioni nei prodotti bancari devono riuscire tramite un posizionamento strategico a confermare il ruolo che hanno detenuto per anni. I cambiamenti avvenuti nel sistema bancario sono stati di tale rilevanza da costituire gli elementi formatori di un nuovo sistema di controllo, di nuove regole di mercato, di nuove modalità organizzative, offrendo la possibilità di svolgere la propria attività con criteri innovativi. L'entrata nel nostro Paese delle banche estere ha imposto alle aziende di credito italiane di iniziare un processo di rinnovamento strutturale, organizzativo e culturale; per molti decenni le banche hanno operato in un ambiente altamente protetto che esaltava il ruolo di intermediari aumentando notevolmente la loro forza contrattuale nei confronti della clientela permettendo a queste aziende di vivere periodi di floridezza, ma nel contempo ha disincentivato la ricerca continua al miglioramento dei servizi alla clientela. La nuova realtà di mercato originata dai fattori sopra menzionati ha indotto le banche ad abbandonare la loro staticità e a rivedere comportamenti ormai consolidati, spostandosi verso strategie caratterizzate da una maggiore articolazione delle relazioni prodotto-mercato. Le aziende di credito si devono impegnare ad elaborare politiche di sviluppo che privilegino il rapporto con l'utente, i cui bisogni e le cui aspettative devono essere costantemente tenuti presenti nella definizione dei prodotti e nell'offerta dei servizi. In questa nuova realtà fattore critico di successo delle aziende di credito è la capacità di soddisfare al meglio e prima della concorrenza i bisogni dell'utenza. Il cliente ha, oggi, una maggiore forza contrattuale e una maggiore volontà negoziale; si assiste ad un'accentuata domanda di assistenza, consulenza finanziaria nelle scelte di investimento pertanto le aziende di credito devono impegnarsi molto nel produrre/offrire prodotti e servizi sempre più diversificati e aggiornati.

Renaissance Padua as Kunstwerk: Policy and Custom in the Governance of a Renaissance City
One of the thorniest issues in the recent historiography of Venice's mainland empire is the quality and justice of its governance. Michael Knapton has depicted the Terraferma cities — Vicenza, Verona, and especially Padua — as dominated by the Dominante, which governed harshly, and taxed heavily for the benefit of the capital, while others have viewed the mainland state as a patchwork of jurisdictions, with Venice retaining local custom and leadership wherever these served the interests of the central government. This paper argues that Venice's policy was in large measure the affirmation of custom, using the ancient institutions of the commune of the mainland cities as the basis for its rule, and confirming the remnants of the signorial élites as its new aristocratic governing class, which filled the offices of local government, especially the councils and judiciary. Fifteenth-century Padua prospered under this arrangement.

This work aims at analysing the way Machiavel used words and concepts from the legal tradition of Antiquity and Middle Age in his political thought. Preference was given to the "ius non scriptum" in order to measure the direct influence of Latin categories such as "mores" and "consuetudo" elaborated by the Roman Law and the Canon Law and reemployed by Machiavel in a (much)more common form in all his writings. More broadly, it consists in a genealogy of the political vocabulary of the Italian Renaissance which is born in the Latin language borrowed from its Latin roots to highlight the logic of formation of modern political languages. In our research, we try to reconsider the modernity of Machiavel by contextualizing his thought in the medieval tradition which ends with Machiavel himself. First of all, we had to identify the main uses of the word "costumi" in Machiavel's writings in order to emphasise its theoretical and major practical meaning in his thinking. By taking a short step back from the Machiavellian corpus, we tried to rebuild a history of the "ius non scriptum" doctrine from two medieval sources: The Corpus Iuris Civilis (VI century) and the Decretum Gratiani (XII century). At this point, we had to go back to the Machiavellian corpus to show the importance of the notion of "consuetudine" in his political vocabulary. It qualifies the people's identity, the relation to orders, and more than everything it is the basis for the existence of Republics. ; Ce travail de thèse a pour ambition d'étudier le statut et la fonction des termes et concepts issus de la tradition juridique antique ainsi que médiévale dans la pensée politique de Machiavel. L'angle d'analyse adopté est celui du « ius non scriptum » et permet de mesurer l'influence des notions latines de « mores » et de « consuetudo » élaborées par le droit romain et le droit canon sur les formes vulgaires de « costumi » et de « consuetudine » que Machiavel mobilise dans l'ensemble de ses écrits. Plus largement, la recherche esquisse une généalogie du lexique politique de la Renaissance italienne à partir de ses antécédents latins pour mieux comprendre la logique de formation des langages politiques modernes. Le travail de recherche consiste à réinterroger la modernité de Machiavel en procédant à une contextualisation historique de sa pensée dans la longue tradition médiévale qui s'achève avec lui. Customer Satisfaction e Creazione del Valore: Il caso Starwood e dello Sheraton Diana Majestic di Milano
L'argomento centrale della tesi è la soddisfazione del cliente con riferimento al settore delle imprese ricettive; l'elaborato è nato sulla base di un'esperienza di tirocinio di sei mesi allo Sheraton Diana Majestic di Milano, nel quale è stato possibile capire da vicino come si svolge effettivamente l'attività alberghiera, come si mantiene la qualità in un Hotel e come viene monitorata la soddisfazione del cliente. La tesi è suddivisa in una parte teorica ed una parte pratica. Per quanto riguarda la parte teorica, nel primo capitolo verrà approfondito il fenomeno della customer satisfaction con particolare riferimento alle componenti fondamentali che stanno alla sua base: le relazioni con i clienti ed il valore per il cliente; il secondo capitolo, invece, tratterà dei metodi di misurazione e monitoraggio della soddisfazione del cliente. Anche la parte pratica si compone di due capitoli che daranno una visione reale degli argomenti trattati nella parte teorica portando come esempio la compagnia alberghiera internazionale Starwood Hotels&Resorts e lo Sheraton Diana Majestic.

Innocenzo III tra diritto e società: consuetudini, scandali e consenso popolare ; Innocent III between law and society: customs, scandals and the popular consent
Nel diritto canonico classico, la necessità di evitare scandali nelle comunità e, dunque, di scongiurare turbamenti dell'ordine sociale giustificò la disapplicazione di norme giuridiche. Con riguardo alla consuetudine, la regola fu declinata, in base alle contingenze politiche e religiose, per riconoscere ovvero negare efficacia alle norme consuetudinarie, adottando soluzioni diverse per acquisire il consenso della società: occorreva, infatti, tenere conto tanto della volontà popolare manifestata nell'adesione agli usi quanto della coscienza sociale espressa nella reazione all'applicazione o alla mancata applicazione di essi. Innocenzo III contribuì a definire la rilevanza giuridica della nozione di scandalo, ora estirpando le consuetudini contrarie agli usi della Chiesa romana che più rischiavano di frammentare l'unità della fede, ora garantendo il rispetto dei riti a cui le popolazioni mostravano maggiore attaccamento, attraverso il principio per cui occorreva evitare a tutti i costi manifestazioni di dissenso o opposizione nella comunità cristiana. La politica di Innocenzo III sollecitò, su tale punto, le riflessioni della scienza giuridica canonistica: le sue decretali e le costituzioni del quarto concilio lateranense furono, infatti, utilizzate nel periodo del grande scisma, per argomentare la necessità di mantenere l'unità all'interno della Chiesa, pur nel rispetto dei diversi riti religiosi. ; According to medieval canon law, legal rules could be waived, thus avoiding any scandals and therefore preventing a motive for public discord. As regards the custom, this principle was shaped according to the religious and political contingencies, in order to recognize or deny any effects to customary rules. Different solutions were adopted with a view to maintaining social support towards the institutions: it was necessary to take into account both the popular spirit expressed abiding by the customs and the reactions of public opinion to the application or non-application of them. Innocent III helped to figure out the legal relevance of scandals, through the principle that it was essential to avoid at all costs dissents or oppositions in the Christian community: sometimes he uprooted the customs contrary to that of the Roman Church, which were considered dangerous to the unity of faith; other times he secured the application of the rites to which the population showed the greatest attachment. The policy of Innocent III urged, on this point, the remarks of the canonical doctrine: his decretals and the fourth Lateran council constitutions were utilized in the period of the great schism, in order to balance out the need both to maintain the unity within the Church and to respect the different ceremonial practices. ; Ciencias Religiosas ; Derecho
