Pur partendo dall'analisi delle differenti modalità di gestione di un pubblico servizio, la tesi si concentrerà sull'evoluzione dell'istituto dell'in house providing che rappresenta una modalità di affidamento diretto di un servizio. La gestione in proprio si presenta, da subito, come un fenomeno problematico, in quanto costituisce una deroga alle regole del mercato e al principio di libera concorrenza. Tanto la giurisprudenza e il diritto europeo, quanto quelli nazionali, hanno alternato nel tempo prospettive tra loro contrastanti in relazione all'istituto dell'in house: fasi in cui era visto come una modalità ordinaria, pari-ordinata all'outsourcing, e fasi in cui era visto in chiave del tutto eccezionale al ricorso al mercato. Questa contrapposizione è ancora oggi presente e, sebbene siano state recepite le tre Direttive del 2014 con il nuovo Codice dei contratti pubblici, il Decreto legislativo n. 50 del 2016, e pur prevedendo una disciplina normativa dedicata all'in house providing, la nostra giurisprudenza con una pronuncia del Consiglio di Stato del 2021 ha riaffermato l'eccezionalità dell'istituto.
Il mio lavoro di tesi è finalizzato ad evidenziare il ruolo e le competenze dell'Assistente Sociale nel Comune. Partendo dall'esperienza professionale della candidata come Assistente Sociale in diversi Comuni della Sardegna, l'obiettivo principale della tesi, è quello di individuare quale sia il ruolo del Comune in relazione ai servizi sociali ed al diritto all'assistenza dei cittadini. Il Comune infatti, in virtù del principio di sussidiarietà tipico dei sistemi di "welfare mediterraneo", in cui rientra anche l'Italia, rappresenta l'Ente più vicino al cittadino, ma anche, in un'ottica assistenziale, " il centro integrato di interventi e servizi sociali" . E' interessante pertanto, partire dall'inquadramento dei diritti sociali a livello Comunitario e Costituzionale, per poi passare ad un'analisi generale sul lavoro sociale ed il servizio sociale in Italia, giungendo poi ad argomentare il ruolo del Comune ed infine dell'Assistente Sociale quale dipendente dell'Ente Locale. La tesi pertanto è costituita da una parte teorica e da una parte specificamente legata alla pratica professionale.
The essay describes the school institution as a social device. The school works systemically, as a field of strength in which conflicting instances, passivation or subjectivism, are encountered. Beginning from this, the work analyzes the current forms of adolescent discomfort, not from an oedipal point of view but from a narcissistic one. The Italian school is more and more subordinate to the appeals of the economic world and doesn't seem to be able to intercept and to face the condition of social renouncement of the young people. Finally, the formation and transmission of knowledge is not neutral but is linked to the way we look to the world: this awareness is a possible way to remedy the laceration of contemporary identity and to realize a new emancipation. ; Il lavoro analizza l'istituzione scolastica come dispositivo sociale. Il funzionamento del mondo della scuola è di natura sistemica e si configura come un campo di forze nel quale si scontrano istanze contrapposte, di passivizzazione o di soggettivazione. A partire da questo presupposto si analizzano le attuali forme di disagio adolescenziale, non più edipico ma narcisistico. La scuola italiana, subordinata sempre di più alle istanze dell'economico, non sembra essere in grado di intercettare e fare fronte alla condizione di rinuncia sociale del mondo giovanile. Infine si indica nella consapevolezza che la formazione e la trasmissione dei saperi non è neutra ma è connessa al senso con il quale guardiamo al mondo, una possibile strada per rimediare alla lacerazione dell'identità contemporanea e realizzare nuove forme di emancipazione.
This thesis aspires to establish a detailed theoretical comparison between the thought of G. W. F. Hegel and that of Thomas Hobbes. It is my contention that the two thinkers have a common starting point on many fundamental problems of human practical life, such as the account of desire and self-consciousness, the role of passion and happiness in human agency, the phenomenon of right and the nature of the political sovereignty of the State. One of my central points will be the deep connection of Hegel's practical thought with two points of the Hobbesian criticism of ancient ethics: namely, the refutation of the classical question of the good life as the basis of human conduct and association, and the superiority of art over nature. Hence, desire is described by both thinkers as a movement of individual self-affirmation and causality over the world, not as a teleological tension towards different kinds of goods; and the human will becomes, for both equally, the source of all practical, juridical and political normativity. Nonetheless, the account of these similarities will be preparatory to the analysis of the crucial differences between Hegel's and Hobbes' solutions. Whereas for Hobbes the limitation of the natural desire of man is the prerequisite for all order, Hegelian Bildung [education] is the mean of the rationalization of desire. This paper presents Spinoza's reflection on the relationship between the concepts of slavery, conatus and desire. According to Spinoza, the man is not available at the command of others. This requires an investigation into the mode of subjection and slavery condition, defined as inability to achieve its useful and to act freely from the negative emotional constraints. In the description of slavery, and the use of historical examples that exemplify it, it is found a classical aristotelian source. The french debate in recent years focused on the political value of desire and conatus, concepts that are fundamental to interpret the condition of slavery and the domain of the minds.
This article aims to compare the heuristic potentials of two different theories of desire, with reference to Shakespeare's Julius Caesar. The first theory is that of mimetic desire, proposed by René Girard; the second theory is the one elaborated by Freud and Lacan, a theory of which we emphasize the conception of identity in terms of identification and the distinction between the Imaginary and Symbolic registers (conversely, Girard's mimetic desire corresponds to the Imaginary register only). The crisis of the Degree together with the unleashing of rivalry represent a war between "doubles", whose only solution would be the killing of Caesar, accomplished with purity of hearts («Let us be sacrificers, but not butchers», says Brutus to Cassius and to the other conspirators); the failure of the sacrificial rite would be due to the prevalence of envious violence. Dottorato di ricerca in Storia d'Europa: società, politica, istituzioni (19.-20. secolo) ; Lo scopo della ricerca è di promuovere una riflessione sulla famiglia come privilegiato luogo di osservazione attraverso cui raccontare la storia degli anni Cinquanta del Novecento (1946- 1962). Una particolare attenzione è stata riservata al sistema di connessioni della famiglia con le istituzioni politiche: l'universo dei due grandi partiti (Dc e Pci), della società e della cultura di massa, in una realtà come quella italiana in cui lo spazio privato e domestico rappresenta non solo il fulcro dell'elaborazione del pensiero politico e religioso, ma anche un fattore essenziale per la costruzione d'identità sociali, di genere e generazionali. Il percorso di ricerca si avvale dei materiali audiovisivi come fonte principale; prodotti sia da enti statali e pubblici che da grandi partiti e militanti di base. Dimensione sociale e culturale della ricerca si coniugano pertanto con quella istituzionale, allo scopo d'individuare il ruolo della famiglia sia nella mentalità collettiva del tempo che nella configurazione del sistema politico della Prima Repubblica. In una prospettiva d'analisi di tipo interdisciplinare, lo studio intende ricostruire le diverse rappresentazioni dell'universo familiare fornite dalla propaganda, decostruendone allo stesso tempo i principali linguaggi. ; The research aims to promote a reflexion on the family as a priviledge observation place through which it is possible to narrate the history of the 50's (1946-62). Particular attention has been attached to the family connexion system with the political institutions: the universe of two major political parties (Dc and Pci), with mass-society and mass-culture, in a reality such as the italian one where the private and domestic space represents not only the center of the political and religious thought but also a main factor for the construction of social, gendre and generational identities. The research uses audiovisual materials as main sources; produced by public and government agenzie and also by big parties and militant base. The social and cultural dimension of the research is therefore combined with the institutional one, in order to point out the role of the family in the collective mentality of the time and also in the configuration of the political system of the first Republic. In an interdisciplinary type of analysis, the study trie sto reconstruct the different reppresentations of the familiar world provided through propaganda, while deconstructing its main languages.
What are the motivations, ideas, and expectations of young people regarding the future during the Covid-19 pandemic? This was the central question in the survey we conducted, and which led to various findings. There were those who paint the future in an apocalyptic way, others who see a world of hope, of social and economic reconstruction that will put solidarity, the environment and work at the center. A moral dimension also emerged from the responses of the interviewees, social responsibility towards human values, respect for others, and above all the desire to participate in political choices. The answers also show a good degree of awareness of the current political difficulties and of the current condition of youth in Italy. ; Quali sono le motivazioni, le idee, le aspettative dei giovani riguardo il futuro al tempo della pande-mia? Questa è la domanda che ci siamo posti nella nostra ricerca, che ha condotto alla rilevazione di atteggiamenti molto diversi: da quelli che dipingono il futuro in modo apocalittico, ad altri che intravedono un mondo di speranza, di ricostruzione sociale ed economica che metterà al centro la so-lidarietà, l'ambiente e il lavoro. Dalle risposte degli intervistati emerge anche una dimensione morale, la responsabilità sociale verso i valori umani, il rispetto dell'altro. Accanto a questa anche, e soprat-tutto, la volontà di partecipazione alle scelte politiche. Dalle risposte si evince inoltre un buon grado di consapevolezza verso le attuali difficoltà politiche e soprattutto verso la situazione in cui versano i giovani oggi in Italia.
Recently, a significant part of the psychoanalytical world, especially the psychoanalysts belonging to the Lacanian orientation, under the guide of J.-A. Miller, has committed to the project of "making psychoanalysis exist in the political field". In this article, first I reconstruct and discuss the ways in which contemporary Lacanian psychoanalysts tried to realize this project; second, I illustrate some of the past political inventions of radical feminism that could constitute as many symbolic and practical resources to develop that project more consistently.
