It is therefore detached from EU citizens. Enhancing the comprehensibility of EU legislation can forge a direct channel of communication between the EU and its citizens, thus strengthening their trust and loyalty to the organization and its ideals. This can nurture sustainable integration for the longevity and prosperity of the EU.
In this paper an index of financial competitiveness is calculated that corresponds to the market-to-book ratio of inward FDI stocks. For a panel of five advanced economies from 1980 to 2006 it is shown that price competitiveness, stable inflation rates and registered patents have a positive impact on the index. Institutional factors like EMU membership or Anglo-Saxon legislation also play a role. Financial competitiveness in turn encourages FDI inflows whereas it benefits fixed investment relative to M&A. There is also some evidence inflows whereas it benefits fixed investment relative to M&A. Leistungen des Sozialrechts werden grundsätzlich auf Antrag gewährt. Die Arbeit beschäftigt sich mit der Frage der rechtlichen Bedeutung des Leistungsantrags in den einzelnen Bereichen des Sozialrechts. Dabei beschränkt sie sich auf rechtstheoretische Darstellungen in Zusammenhang mit dem sozialrechtlichen Leistungsantrag, der auf den Erlass eines Verwaltungsaktes bzw. den Abschluss eines öffentlich-rechtlichen Vertrages zielt. Voraussetzung ist, dass der Antrag von einer Privatperson an einen Träger öffentlicher Gewalt gerichtet ist. Nachdem zunächst auf die Dispositionsmaxime in Abgrenzung zur Offizialmaxime und das Opportunitätsprinzip (Kapitel II) in Zusammenhang mit der Eröffnung des Verwaltungsverfahrens eingegangen wird, soll nach der Klärung des rechtlichen und außerrechtlichen Antragsbegriffs (Kapitel III) der Antrag als Willenserklärung des öffentlichen Rechts charakterisiert werden (Kapitel IV). In Kapitel V erfolgt unter Berücksichtigung der Sozialgesetzbücher eine Abgrenzung der Leistungen, die von Amts zu erbringen sind, zu denjenigen, die vom Leistungsträger aufgrund eines Antrages erbracht werden. Die Darstellung der einzelnen Sozialrechtsbereiche orientiert sich dabei an der Einteilung in Vorsorgesysteme, soziale Entschädigungssysteme und in allgemeine Hilfs- und Fördersysteme. In Kapitel VI wird im Hinblick auf die antragsabhängigen Sozialleistungen untersucht, ob den verschiedenen sozialrechtlichen Anträgen nur verfahrenseinleitende formell-rechtliche Wirkung oder auch anspruchsbegründender materiell-rechtlicher Charakter zukommt. Diese Problematik hat erheblich Auswirkungen auf den Zeitpunkt der Entstehung und der Fälligkeit des einzelnen Leistungsanspruchs aber auch Fragen der Rechtsnachfolge hängen hiervon ab. Auf die Gesetzeshistorie wird ergänzend eingegangen. In Kapitel VII wird der Frage nachgegangen, welche Informationspflichten, d.h. Auskunfts-, Beratungs- und Aufklärungspflichten, die Sozialleistungsträger im Vorfeld der Antragstellung, aber auch während des laufenden Verwaltungsverfahrens zu beachten haben. In Kapitel VIII geht es um die Wirksamkeitsvoraussetzungen eines Leistungsantrags. In diesem Zusammenhang werden Fragen der Handlungsfähigkeit des Antragstellers, die Problematik der Verwaltungssprache, inhaltliche Mindestanforderungen, die an einen Leistungsantrag gestellt werden müssen und die verschiedenen Auslegungs- und Umdeutungsmöglichkeiten des vom Antragsteller ausgedrückten Begehrens den Schwerpunkt darstellen. Im weiteren soll dann der Umfang der gesetzlichen und außergesetzlichen Mitwirkungspflichten, die den Antragsteller regelmäßig als Folge des Leistungsbegehrens treffen, untersucht und dargestellt werden. (Kapitel IX) An diesen Problemkreis anschließend werden die Rechtsfolgen einer wirksamen Antragstellung erläutert, wobei insbesondere der Problemkreis der Verjährungsunterbrechung, das Entstehen des Sozialleistungsanspruchs und seine Fälligkeit sowie die Besonderheiten der gesetzlichen Rentenversicherung dargestellt werden. (Kapitel X) Das XI. Kapitel beleuchtet die Antragsrücknahme, die wesentlich von der Dispositionsbefugnis des Antragstellers abhängt. Ausgehend davon, dass der sozialrechtliche Leistungsantrag von dem tatsächlich Leistungsberechtigten unter Berücksichtigung der rechtlichen Vorschriften gestellt worden ist, ist im XII. Kapitel die Frage aufzuwerfen, welche Folgen Willensmängel in Zusammenhang mit der Antragstellung haben. Dabei sind zunächst offensichtliche Willensmängel zu berücksichtigen. Fraglich ist des weiteren, ob und unter Beachtung welcher rechtlichen Grundsätze und mit welcher rechtlichen Konsequenz der Leistungsantrag als Willenserklärung des öffentlichen Rechts angefochten werden kann. In Kapitel XIII sollen die Auswirkungen einer Übertragung bzw. eines Übergangs des sozialrechtlichen Leistungsanspruchs auf den Leistungsantrag dargestellt werden. Bei dieser Betrachtung wird unterschieden, ob der Rechtsübergang vor oder nach wirksamer Antragstellung durch ; Benefits of social legislation are fundamentally granted on application. This thesis deals with the legal importance of the application for benefits in the areas of social legislation. It confines itself to theoretical legal elaborations connected with social benefit – applications aiming at administrative measures or the conclusion of contracts under public law, which requires the application of an individual addressed to the respective department of public administration. Chapter II deals with the maxim of disposition as distinguished from the legal maxim in general and the principle of opportuneness in connection with the opening of administrative measures. Chapter III explains the legal and extralegal term of application and Chapter IV characterizes the application as professed intention within the public law. In Chapter V follows a distinction between the benefits granted by the responsible authorities on their own and the benefits granted on application. This includes references to various systems of social help. Chapter VI analyzes the different applications for social benefits and describes if they only open procedures formally or if they already establish claims materially. This question has a direct bearing on the time when the payment begins and on its legal consequences. Additionally historical aspects will be dealt with. Chapter VII refers to the applicants right to be fully informed, not only before his application but also during the respective administrative procedures. Chapter VIII points out the conditions to make an application valid. It refers to the power to act, necessary contents and different interpretations and explanations of the claimants/applicants wishes. Chapter IX looks into the legal and extralegal duties of cooperation the claimant/applicant must provide. Chapter X deals with the legal consequences of a valid application/claim, particularly problems of the limitation period and its interruption, the settlement date and the peculiarities of the legal pension scheme. Chapter XI enlarges on taking back the application, which mainly depends on the claimant´s/applicant´s power to act. Assuming that the application for social benefits has been made out correctly by the person who is legally entitled to them, Chapter XII deals with uncertainties in connection with the act of application. First there are obvious faults, then there is the question if, based on which legal principles, and with which legal consequences the application for benefits can be contested as an act of will within the public law. Chapter XIII deals with the consequences following the transition of a right to receive benefits to the application/claim itself and makes a distinction if the legal transition precedes or follows the effective application of the entitled person.
People's legislation is entrenched in the constitutions of all federal states in Germany. The strategies associated with executing these initiatives have, in recent history, shown a rising trend toward change. The procedural requirements for the collection of signatures play an important role in the modernization of the people's legislation design. Consideration has to be paid to conflicting interests between the organizers, interested people who are entitled to vote, administrative authorities, & legislature. Time limits for the collection of signatures need to do justice to the tension between the need for a procedure that is clear & legally compliant, but at the same time practically relevant & participation-friendly, & they may not unduly complicate the popular initiative. In particular, the 14-day deadlines, which are the relics of the Weimar & early Federal Republics, are no longer just. In contrast, a six-months period is long enough for public discussion to support the democratic articulation & integration function of direct democracy & yet remains manageable without weakening the intensity & relevance test of the qualification quorum, the minimum threshold of signatures. The time span creates a fair playing field (not just for the established lobby groups) & provides to all interested citizens the option of registration for the initiative without affecting the capability of the local authorities & the parliamentary legislature disproportionately. Since the PISA Study in 2000, the German school system has been under constant pressure. Since party politics involving school policy tend to be clearly differentiated, the school reforms proposed in the different Lander after PISA vary strongly: while some focus on the quality of the school system, others see more need for change to improve equal access to education for all social groups. In Hamburg, the newly elected black-and-green Government in 2008 decided to go for a major reform that -- as its most important feature -- changed elementary school from four to six years and renamed them Primarschule. This reform was meant to improve significantly the equal access to education. Yet, the reform that had been accepted by all parties represented in the Hamburg Parliament (in the earlier Burgerschaft bill) was defeated in a referendum that took place in summer 2010. The paper not only aims at explaining why the reform failed but also seeks to identify structural effects of direct democracy on school reforms that entail a redistribution of chances. This would challenge those studies which see direct democracy primarily as a means to empower minorities which have been discriminated against ("outgroups"). In conclusion -- even though the Hamburg Case displays some peculiarities -- the authors believe that school reforms with a redistributive focus are likely to be challenged by well-organized "Ingroups" with the help of procedures of direct democracy. Durch den Anstieg der Bestände fischfressender Vogelarten seit den 1970er Jahren kommt es europaweit zu Konflikten zwischen den Nutzergruppen von Gewässern. In Österreich werden Maßnahmen gegen Kormorane (Phalacrocorax carbo), Graureiher (Ardea cinerea) und Gänsesäger (Mergus merganser) ergriffen. Diese Maßnahmen beziehen sich auf Artikel 9 der Vogelrichtlinie 2009/147/EG, der den Mitgliedsstaaten der EU unter bestimmten Voraussetzungen erlaubt, Ausnahmen von den Schutzbestimmungen der Vögel zu erlassen. Da in Österreich keine bundesweiten Naturschutz-, Jagd- oder Fischereigesetze in Kraft sind, erfolgt die rechtliche Umsetzung von Artikel 9 auf Bundesländerebene. Durch Gespräche mit den zuständigen Behörden und Analyse der betreffenden Gesetzestexte wird die gesetzliche und praktische Handhabung der Thematik auf internationaler (europäischer) und nationaler (österreichischer) Ebene dargestellt. Die Vorgehensweisen der Bundesländer werden einzeln vorgestellt und anschließend verglichen. Trotz der gleichen rechtlichen Grundlage fällt die praktische Umsetzung der Maßnahmen zur Vertreibung der Vogelarten in den Ländern unterschiedlich aus. In Oberösterreich und Kärnten werden Kormorane und Graureiher im Gegensatz zu den restlichen Bundesländern in verschiedenen Gesetzen behandelt. Bei den Entscheidungsträgern der Maßnahmen lässt sich ein Ost-West-Trend erkennen: Im Westen wird eher auf Bezirksebene, im Osten auf Länderebene entschieden. Die Umsetzung von Maßnahmen erfolgt mittels Bescheid, Verordnung oder direkter Gesetzgebung und wird in Österreich unterschiedlich angewandt. Auch die Vorgaben zur Limitierung von Abschusskontingenten, die Schusszeiten und die Vorgangsweisen bei der Erfassung von Bestandszahlen werden unterschiedlich gehandhabt. Grundsätzlich besteht ein beträchtliches Potenzial in der Förderung der Kommunikation und des Datenaustauschs zwischen den zuständigen Behörden und einer Veröffentlichung der gewonnenen Informationen. ; Due to increased numbers of fish-eating birds since the 1970s, conflicts between user groups of aquatic ecosystems are rising throughout Europe. In Austria, various derogation measures are in place to control the presence as well as total numbers of cormorants (Phalacrocorax carbo), grey herons (Ardea cinerea) and common mergansers (Mergus merganser). These measures are based on Article 9 of the Birds Directive 2009/147/EG, which, under certain circumstances, allows EU member states to make exceptions to the general bird protection schemes. As there are no national laws concerning nature conservation, hunting and fishing in Austria, Article 9 is implemented in the legislation of the Austrian provinces. Based on interviews with the authorities in charge and analyses of the laws in question, the legal basis and practical implementation of the issue are presented for the international (European) and national (Austrian) level. The Austrian provinces are introduced individually and compared subsequently. Despite the common legal basis, the practical implementation of measures to control bird populations varies in the different provinces. In contrast to the rest of Austria, Upper Austria und Carinthia handle cormorants and gray herons in separate laws. In terms of decision-making, Austria is roughly split into east and west: In the west, decisions are mostly made on the district level but on the province level in the east. The implementation of measures is handled differently throughout Austria and is accomplished through notifications, regulations or direct legislation. Similarly, culling quotas, hunting times and procedures for counting the birds are different, depending on the province involved. The suitability of the parliamentary system of government in Germany's states was already debated in the 1950s. Due to the establishment of direct democratic procedures that can also be employed for the purpose of amending state constitutions, the debate has come to the fore again since the 1980s. The direct election of state premiers cannot be justified by claiming that such a change would lead to more democracy or re-establish the separation of powers. A more appropriate argument in favour of such a change to a presidential form of government can first of all be based on the assertion that the existing procedures of popular legislation in the states tend to dovetail poorly with a parliamentary system based on a fusion of executive and legislative powers. At the same time the establishment of a form of government at the state level that differs from the system used at the federal tier would serve to highlight the independence of state politics. Any implementation of such a reform would have to bear in mind the institutional path dependence. In lieu of a pure presidential system the most prudent solution therefore appears to be a hybrid of the parliamentary and presidential systems in which the directly elected head of government is incorporated into the will of the parliamentary majority. The article reconstructs the development of the Swiss welfare state against the background of the transformation of trade unions' social policy activities. It detects a sequence of trade unions' activities in social policy which runs uniformly to the development of the welfare state. While in the liberal phase of the Swiss welfare state trade unions were sceptical of national social policy and preferred mutual insurance and collective bargaining, in its post-liberal phase they have become proponents of national social policy legislation.
