The Mediation Act has been applied in the Republic of Serbia since 2005. In the past period, the application of this Act has pointed out to a number of drawbacks and deficiencies in the system of resolving disputes through mediation. The dominant features of the current mediation system are some inadequate legal solutions, poor organization and insufficient preparation of the courts to internalize mediation, failure to provide relevant information about mediation to litigants and other participants in the judicial process, insufficient judicial training and education of lawyers and parties on mediation and other ADR methods, etc. Considering that the primary purpose of mediation is to diminish the litigation caseload and reduce the costs of court proceedings, the basic goal of introducing mediation into the Serbian legal system has not been accomplished. In order to improve the mediation system, the Serbian authorities launched a public debate in 2010 on designing a new legislative act which would eliminate the shortcomings of previous act and improve the efficiency of mediation. After nearly four years, the extensive debate and confrontation of different mediation concepts led to adopting a new Draft Mediation Act in 2013. As compared to the applicable 2005 Mediation Act, the Draft Mediation Act contains some innovations, such as the enforceability of a mediation agreement under specific conditions and the opportunity of introducing mandatory mediation in some cases. In this paper, the author analyzes the above issues on the basis of findings of economic theory and the results of the empirical study on the efficiency of mediation in Serbia in civil matters. In this context, the author argues that the achievement of the above objectives (to reduce the caseload and legal costs] calls for establishing a sustainable mediation system. In addition to instituting good legal solutions (such as mandatory mediation], the system should be supported by joint efforts and financial resources of responsible institutions and individuals. In a nutshell, mediation may come to life only if the legislative efforts are accompanied by a large-scale social action aimed at promoting this form of dispute resolution.

The ultimate goal of game theory is to provide a theoretical model for strategic situations' analysis, i.e. for situations where one actor's choice depends on the behavior of other players in the game. As a concept, game theory is also applicable to the legal context. Legal dialectics and processes are often conducted in some form of strategic interactions. Game theory is a way to see how legal rules affect particular actors' behavior. International Economic Law has its own dynamics which makes the process similar to the analysis through the game theoretical tools. Therefore, the rules of international law are considered as the rules of the game that are taking place among different actors. Game theoretical considerations clarify the substance of the interaction and cooperation of players involved (states, international organizations and other actors). Game theory provides a basis for normative analysis of the issue of implementation of the rules of international law and improves understanding of those rules. The topic of the paper is the application of the game theory in the context of the legal framework established by the World Trade Organization. The member states' dilemma between using the advantages and liberalization options provided by the WTO on the one hand, and joining the regional trade agreements, on the other one, is strategic by nature. Therefore, game theory can contribute to understanding and resolving, using the game of 'prisoner's dilemma' as a model. It is the game which clearly shows that a group of rational egoists can end up worse than a group of actors that acts prima facie contrary to their own interests. 'Prisoner's dilemma' demonstrates why society and law has the need for coordination as well as mechanisms for co-operation. WTO member states put emphasis on the process of liberalization conducted in the framework of regional trade agreements (RTAs); at the same time, their participation in WTO negotiations is not effective and efficient enough to make a breakthrough in the multilateral framework. A solution of the game for Member States is not to cooperate: i. e, liberalization is primarily achieved through regional agreements rather than within the WTO. The rational decision of the Member States (opting for a regional approach) has resulted in a suboptimal result, which is a basic characteristic of the game model based on a prisoner's dilemma: in this case, the optimal solution would be cooperation through a multilateral framework (World Trade Organization).

Predmet istraživanja doktorske disertacije odnosi se na analizu značaja i mehanizama na koji institucionalna obeležja utiču na efikasnost nacionalnih ekonomija. Pritom, cilj je da se istraživanjem identifikuju relevantne normativne i pozitivne pozicije u pogledu uloge koju institucije imaju u ekonomskim procesima, kao i njihov međusobni odnos i relativna važnost pri uticaju na ekonomske performanse, sa posebnim osvrtom na iskustva privrednih sistema zemalja u tranziciji. Iz tog razloga, analizirane su osobenosti institucija kao jedinica ekonomske analize, raznovrsnost elemenata institucionalne strukture, kroz, naročit, osvrt na interakciju koja se pojavljuje između formalnih i neformalnih institucionalnih pravila. Uslovljenost ekonomskih performansi institucionalnim svojstvima analizirana je iz perspektive teorije transakcionih troškova, kao i teorije vlasničkih prava i mehanizmima kojima oni ostvaruju uticaj na ekonomske performanse. Iz razloga što značajan deo institucionalne strukture nastaje, ali se i menja, u okviru političkog sistema, efekti na ekonomsku aktivnost posmatrani su kroz uticaje koji nastaju kao posledica specifičnosti političkih institucija, odnosno, njihove stabilnosti, forme i centralizovanosti, kao i kvaliteta javnog upravljanja, uticaja rent-seeking-a i političkih konjunkturnih ciklusa. S obzirom da su postojanost i dinamika integralna svojstva svakog segmenta institucionalne strukture, deo istraživanja je orijentisan na analizu osnovnih elemenata, tipova i teorija institucionalnih promena, zavisnost promene institucija od istorijskog institucionalnog, formalnog i neformalnog, nasleđa, kontroverzi u pogledu transplantacije institucija, kao i uzroka institucionalne histereze i neuspeha. Na osnovu empirijskog istraživanja odnosa ekonomskih performansi i institucionalnog kvaliteta, utvrđeno je da nivo per capita dohotka odlučujuće zavisi od kvaliteta institucionalne strukture, efikasne zaštite vlasničkih prava, usklađenosti između formalnih i neformalnih pravila, čime institucionalne promene u pravcu unapređenja svih institucionalnih segmenata predstavljaju neophodnu pretpostavku efikasnijoj ekonomskoj aktivnosti. ; This paper refers to the analysis of the importance of the institutions and the mechanisms through which the institutional characteristics influence the efficiency of national economies. In this context, the main goals of the research are to identify and explain relevant normative and positive aspects of institutional theory, the way in which institutions affect economic processes, as well as the interrelation and relative importance of different institutional units in their influence on economic performance, with special emphasis on the experience of transition countries. For this purpose, the author has reviewed the uniqueness of institutions as units of economic analysis, the diversity of the elements of institutional structure, with the particular accent on interaction between formal and informal institutional rules. Dependence of economic performance upon the institutional characteristics has been analyzed from the perspective of transaction-cost theory, as well as the theory of property rights. Special attention is paid to the mechanism through which the property rights exercise their influence upon the efficient operation of economic system. Bearing in mind the fact that the important part of institutional structure is made within a political process, the effects of institutions are observed through the influences derived from political stability, political regime and the level of administrative and fiscal centralization. The quality of governance, the impact of rent-seeking activities and the influence coming from political and business cycles are additional important features in this regard. Since the institutions display the persistence and changeability at the same time, the important part of the research is dedicated to the analysis of different types and theories of institutional changes, the dependency of changes on the past formal and informal institutional development, the issues related to the transplantation of institutions and the causes of institutional hysteresis. Based on the empirical part of the thesis, we have reached the conclusion that the level of per capita income largely depends on the quality of institutions, especially the protection of property rights, as well as the harmonization between formal and informal institutions. This makes good institutions a decisive and long-lasting factor of the success and efficiency of national economies.

The theory of public choice is a major link between political science and economic science. It includes economic research into the issue of non- market decision-making i.e. the application of economic analysis to political decision-making. The champions of the theory of public choice have most confidence in the market and the market institutions. They try to explain political decision-making by means of the standards operating on the market. The public choice theory approach is based on the concept of methodological individualism and homo oeconomicus, since individuals try to promote their own interests both on the market and in politics. Theoreticians of public choice investigate voters' behaviour, the roles of politicians, political parties, and interest groups in complex democratic societies. Central for their research is the political process in which voters behave as buyers, politicians as entrepreneurs, while bureaucrats are prone to self-aggrandisement and their ambition is to boost the significance of their office. The theory of public choice emphasises the category of exchange (political exchange) and the catalectic approach to economy. (SOI : PM: S. 100)

The author gives a short account of his broadly-based studies on the theory of public choice and the financing of the public sector in the industrialised countries of the world. In this context, first the definition of the theory of choice an relation to the financing of the public sector is given. Then there is a short review of the evolution of the theory of public choice in the history of human development, with special focus on the latest trends. Then the author explores fundamental principles of public choice in the functioning of the contemporary state and its consequences for the economic and social development of the developed countries. In the end, the author lists the essential requirements regarding the possibility of the implementation of the theory of public choice in the Croatian theory and practice when making the collective decisions regarding the financing of public needs. In this paper, we consider the relationship between the entrepreneurial state and the crisis (caused by economic and non-economic reasons and vice versa). Thus, it is about the interactive attitude of the entrepreneurial state in resolving the crisis and the impact of the crisis on the further development of new economic competencies and competencies of the state in the economy. The entrepreneurial state is seen as an entrepreneur and one of the most important economic actors, which accepts long-term investment risks, bearing in mind the broader picture and the common good. The development of new technologies and new technology companies in the United States and other developed countries has been possible, thanks to the investment of the American entrepreneurial state and its agencies. We start from the assumption that the American crisis, in 2008. caused by high debts, the private sector, not the US public debt, which today is enormously high and skyrocketing. At the heart of this consideration is the thesis that the classical economic theory of non-interference of the state in economic life, which stands aside in the recent era of the development of global capitalism, does not hold water. On the contrary, it turns out that government risky investment in the long run is the basis of a modern economy in which the private sector can develop only on the premises of this huge investment in the development of modern new technologies. Most innovation today and research institutes in the United States are due to the investments of the American state. The paper discusses the impact of the crisis on the understanding of the entrepreneurial state and its role in innovation, the role of new technologies and innovations in economic growth, entrepreneurial state and risks, entrepreneurial state and knowledge economy, entrepreneurial state in "pushing" versus "pulling" the green industrial revolution and the cost of investment, innovation, and development of the American entrepreneurial state. ; U ovom radu razmatramo odnos preduzetničke države i krize (izazvane ekonomskim i neekonomskim razlozima i vice versa). Dakle, riječ je o interaktivnom odnosu preduzetničke države u rješavanju krize i uticaju krize na dalji razvoj novih ekonomskih ingerencija i nadležnosti države u ekonomiji. Preduzetnička država se posmatra kao preduzetnik i jedan od važnijih ekonomskih aktera, koji prihvata rizike ulaganja na dugi rok, imajući na umu širu sliku i opšte dobro. Razvoj novih tehnologija i novih tehnoloških kompanija u SAD i drugim razvijenim zemljama bio je moguć zahvaljujući investiranju američke preduzetničke države i njenih agencija. Polazimo od pretpostavke da su američku krizu 2008. godine izazvali visoki dugovi privatnog sektora, a ne javni dug SAD, koji je danas enormno visok i vrtoglavo raste. U osnovi ovog razmatranja stoji teza da klasična ekonomska teorija o nemiješanju države u privredni život, koja stoji po strani u najnovije doba razvoja globalnog kapitalizma, ne drži vodu. Naprotiv, pokazuje se da je državno rizično investiranje na dugi rok u osnovi savremene ekonomije u kome privatni sektor može da se razvija samo na premisama tog golemog ulaganja u razvoj modernih novih tehnologija. Većina inovacija danas i istraživačkih instituta u SAD duguje ulaganjima američke države. U radu razmatramo uticaj krize na shvatanje preduzetničke države i njene uloge u inovacijama, ulogu novih tehnologija i inovacija u privrednom rastu, preduzetničku državu i rizike, preduzetničku državu i ekonomiju znanja, preduzetničku državu u "guranju" nasuprot "podbadanju" zelene industrijske revolucije, koristi i cijene investiranja, inovacije i razvoj američke preduzetničke države.

Joint effect of 2008 economic crises and continous world-wide present deficite of political legitimacy have in 2011 given birth to global resistance, but also facilitated development of its new strategies and tactics. Aldough we are still by large able to understand these contemporary models of collective action with help of New Social Movement Theory, today they objectivelly grasp a wider field of meaning, mainly for reason of their demands for radical transformation of both economic and political system. Contemporary social movements are still struggling for re-interpretation of meaning, and identity issues, but not any more for any particular goal. Instead, they seek systemic change. This extremelly important shift of strategic orientation, which makes new movements a bit old – that is classical, remains in our oppinion, undervalued both in academic, and general public for the reasons that we will try to comprehend, in this writing. ; Sadejstvo udara ekonomske krize iz 2008. i kontinuiranog deficita političkog legitimiteta dovode 2011. do pojave globalnog otpora, ali i do razvoja njegovih kvalitativno novih strategija i taktika. Iako je savremene modele kolektivne akcije dobrim delom i dalje moguće razumeti uz pomoć teorije novih društvenih pokreta, oni danas objektivno zahvataju jedno šire polje, najpre zbog zahteva za radikalnom promenom u ukupnom ekonomskom i političkom sistemu. Savremeni društveni pokreti i dalje se bore za reinterpretaciju značenja i priznanje sopstvenog identiteta, ali ne više za bilo koje pojedinačno pitanje, već za sveobuhvatnu promenu sistema. Ta izuzetno važna promena strateške orijentacije, koja nove pokrete čini pomalo starim – upravo klasičnim, ostaje, čini nam se, nedovoljno primećena iz razloga koje ćemo pokušati da rasvetlimo.

The author studies the specific features of formation of cluster structures, which allow to identify economic and social preconditions for the emergence and development of cluster relations. The development of any cluster formation should be viewed as the process of interaction between opposite sides and trends arising from the intrinsic characteristics of these opposites. The author considers that cluster relations should be viewed as a system of relations on the formation and use of all types of resources aimed at the implementation of the expanded reproduction with the purpose of receiving profits systematically. Under present conditions the development of cluster relations occurs with participation of actors of economic ensuring of cluster formations' activity. On the basis of a systematic approach the author identifies and structures internal and external economic and financial conditions and factors of cluster relations. Cluster development theory is complemented by justification of key features and economic elements of cluster relations. The author looks into the methodological features of public choice theory. On the example of James Buchanan's contribution, he demonstrates the differences between that kind of approach (often dubbed political economy) versus welfare economics and mainstream economics. Unlike welfare economics, which tries to work out the optimal state of allocation and distribution of economic resources by using certain logical rules based on Pareto's principles, or mainstream economics, which tries to identify the improvements in observable economic categories (such as national income or investment consumption), political economy encompasses the process of collective decision-making i.e. politics. In this, the efficacy criterion is t extent of consent (consensus) in collective decisionmaking. On the example of Buchanan's and Tullock's joint contribution in the book "The Calculus of Consent", the author concludes that this paved the way for introducing a legitimate categorial mechanism for investigating the costs of political decision-making into political science.
