Under uncertain conditions, the introduction of a state of emergency and quarantine measures, the scope of human rights may be subject to state interference and some rights cannot be exercised at all. The aim of the work is to examine the problem of the exercise of the right to freedom of movement and personal integrity in the context of COVID-19 through the practice of the European Court of Human Rights ECTHR. The theme of the study is the social relations that arise in the exercise of the right to freedom of movement and personal integrity in the COVID-19 pandemic. Research methods are the dialectical method, the method of system analysis, synthesis, induction, deduction, modeling, comparison, generalization, and formalization. As a result of the study, the problems of the realization of the right to freedom of movement and personal inviolability in COVID-19 were analyzed through the prism of ECtHR decisions. The international experience of regulating the right to circular under quarantine conditions was clarified and suggested ways to solve this problem to protect human dignity.

This paper aims at analyzing, on the one hand, the territorial and time limitations of the freedom of movement imposed in Spain due to the Covid-19 pandemic on the basis of the health legislation. On the other hand, it also aims at studying the new authorization and ratification mechanism of health measures. The purpose of that all is to check the legal viability of that measures imposed outside of the law of exception and the problems it has recently raised. ; Este trabajo trata de analizar, por un lado, la cobertura jurídica de las limitaciones generalizadas de la libertad de circulación, espaciales (cierres perimetrales) o temporales (confinamientos nocturnos) impuestas con ocasión de la pandemia del Covid-19 al amparo de la legislación sanitaria especial sobre salud pública. Por otro, estudia el mecanismo de autorización y ratificación de medidas sanitarias por parte de la jurisdicción contencioso-administrativa, todo ello en aras de comprobar la viabilidad de la imposición de dichas medidas al margen del Derecho de excepción y los problemas que ésta plantea.

The free movement of workers, in more than half a century of existence, has faced a number of obstacles. Few have been on the scale of the Covid-19 pandemic, which revealed unsuspected difficulties. This paper aims to analyse the solutions to these difficulties, both in terms of the restrictions arising from tools such as the Covid Passport and the possible guarantees for the future. Vaccination certificates, derived from a regulation that seeks to ensure free movement, have a dual nature as a restriction that deserves to be analysed. On the other hand, the consolidation of the idea of critical occupations is set to be of great importance but requires a final effort in its effective implementation. In addition to these issues, the work also studies the adaptation of existing legislation to the new family models, including considerations on the case law of the Court of Justice and same-sex marriages and their clash with certain legislations. Theoretical attention is also paid to the possible problems arising from marriages in non-recognised forms. Finally, some possibilities are raised with regard to platform work and digital teleworking. ; La libre circulación de trabajadores, en más de medio siglo de existencia, se ha enfrentado a diversos obstáculos. Pocos han tenido las dimensiones de la pandemia de la Covid-19, que puso de manifiesto dificultades insospechadas. El presente trabajo pretende analizar las soluciones a esas dificultades, tanto desde el terreno de las restricciones derivadas de herramientas como el Pasaporte Covid como de las posibles garantías de futuro. Los certificados de vacunación, derivados de una normativa que busca asegurar la libre circulación, presentan una doble naturaleza como restricción que merece ser analizada. Por otra parte, la consolidación de la idea de las ocupaciones críticas está llamada a tener una gran importancia, pero exige un último esfuerzo en su puesta en práctica efectiva. Junto a estas cuestiones, el trabajo estudia también la adaptación de la normativa existente a los nuevos modelos de familia, incluyendo consideraciones sobre la jurisprudencia del Tribunal de Justicia y los matrimonios del mismo sexo y su choque con determinadas legislaciones. Son objeto de atención, además, de forma teórica, los posibles problemas derivados de matrimonios a través de formas no reconocidas. Por último, se plantean algunas posibilidades a propósito del trabajo en plataformas y del teletrabajo digital.

In recent times, Spain has approached the percentage of foreign population of the other EU member states. The accession of Spain to the European Communities as a member state with full rights, and while no kind of uniform regulation is achieved, makes it necessary to establish the legal regimen for EU nationals on our soil. Spain, in recent times a host country to EU nationals, has been involved in establishing administrative criteria for the exercise of the rights of entry, exit, and residency in Spain for the citizens of its member states for the realization of activities as an employed or freelance person. ; España, en los últimos tiempos, se ha aproximado a los porcentajes de población extranjera de los demás Estados miembros de la Unión Europea (UE). La adhesión de España a las Comunidades Europeas como Estado miembro de pleno derecho, mientras no se logre algún tipo de normativa armonizada de origen comunitario, le obliga a fijar el régimen jurídico aplicable a los nacionales comunitarios en nuestro territorio. Desde ese momento, España -en los últimos tiempo, país receptor de ciudadanos comunitarios-, se ha ocupado de fijar las formalidades administrativas para el ejercicio de los derechos de entrada, salida y permanencia en España por parte de los ciudadanos de sus Estados miembros para la realización de actividades por cuenta ajena, o por cuenta propia.

ABSTRACT The purpose of this study is to analyze the conflict management that has been carried out by the government through the integrative framework of Collaborative Governance. The research method used was the deductive Post-Positivist paradigm by collecting data through interviews, focus group discussions, and surveys regarding the implementation of Special Autonomy Policy. The results of the study based on the integrative framework of collaborative governance model showed that the process of collaboration in implementing the Special Autonomy policy has not been successful and is less effective. RESUMEN El propósito de este estudio es analizar la gestión de conflictos que ha llevado a cabo el gobierno a través del marco integrador de la Gobernanza Colaborativa. El método de investigación utilizado fue el paradigma deductivo post-positivista mediante la recolección de datos a través de entrevistas, discusiones de grupos focales y encuestas sobre la implementación de la Política de Autonomía Especial. Los resultados mostraron que el proceso de colaboración en la implementación de la Política Especial de Autonomía no ha sido exitoso y es menos efectivo.

The steady expansion of the internal market of the European Union is overflowing the strict provisions that would be deducted for the right to freedom of movement and residence regulated in the Treaty on the Functioning of the European Union and legislation. Thus, the primal connection of the right to freedom of movement and residence with the elimination of controls on persons at internal borders have happened today the multiple connections of this right with the tax law, rights of personality, the education and health, as proving the Court of Justice of the European Union. These are the new frontiers that must be addressed by EU law to achieve full citizenship. ; La constante expansión del mercado interior de la Unión Europea está desbordando las estrictas previsiones que se deducirían para el derecho a la libertad de circulación y residencia regulada en el Tratado de Funcionamiento de la Unión Europea y en el derecho derivado. Así, a la primigenia conexión del derecho a la libertad de circulación y residencia con la eliminación de las fronteras interiores han sucedido en la actualidad las múltiples conexiones de dicho derecho con el derecho fiscal, los derechos de la personalidad, la educación y la sanidad, tal y como acredita la jurisprudencia del Tribunal de Justicia de la Unión Europea. La sentencia de 5 de junio de 2018 del TJUE en el asunto Coman y otros exige a los Estados miembros que reconozcan el matrimonio entre personas del mismo sexo contraído entre un ciudadano de la Unión y un nacional de un tercer Estado conforme al derecho nacional de cualquiera de los Estados miembros, si bien a los efectos exclusivos del derecho a la libre circulación y residencia. Cuando el derecho de la UE estipula que el disfrute de la libertad de circulación de un ciudadano de la UE con un miembro de su familia que le acompañe depende de la existencia de una relación jurídica como el matrimonio, y olvida que ciertos Estados no permiten el matrimonio del mismo sexo, se impide que las parejas del mismo sexo puedan ejercer el derecho de libre circulación debido a las restricciones que los Estados establecen a través de su derecho de familia. El reconocimiento de los cónyuges del mismo sexo como «cónyuges» en virtud de la Directiva 2004/38 es esencial para garantizar el disfrute efectivo del derecho de la libre circulación y residencia, pero también para prevenir la discriminación por orientación sexual y garantizar el respeto de su vida familiar. La conexión entre la libre circulación, en tanto derecho individual que deriva directamente del art. 21 TFUE, y la no discriminación por orientación sexual constituyen el elemento central para los ciudadanos afectados, y también nos sirve para evaluar hasta qué punto se puede afirmar la supremacía de ciertos derechos fundamentales que la UE pretende reconocer. ; ECJ Ruling of 5 June 2018 in Coman and others case requires that all Member States recognise same-sex marriages for the purposes of EU free movement where that marriage involves an EU citizen and was legally conducted in one of EU Member States. When EU law stipulates that the enjoyment of freedom of movement with a family member is made conditional upon the existence of a legal relationship such as marriage, and then forgets that certain Member States prevent same-sex couples from marrying, the inevitable consequence is that same-sex couples cannot exercise their right of free movement due to restrictions posed by the Member States through their domestic family law rules. Mutual recognition of same-sex spouses as "spouses" under Directive 2004/38 is crucial, not only to ensure the effective enjoyment by Union citizens of their right to free movement, but also to prevent discrimination on the basis of sexual orientation and to ensure respect for their family life. The foreign regulation is not applied to every non-national. EU nationals and their assimilates are excluded. They have a regulation of their own, based on EU citizenship and free movement of persons. There is a beneficiary group whose link is not nationality but family. They are third-country nationals and family members of EU citizens. Only a few of them can be considered in that way within the Spanish and European legislation in force —the recent RD 178/2003—. While this status is not proved, the general regulation derived from the Migration Policy in force, must be applied. Never- theless, the EU legal instruments in preparation impose an enlargement of the relatives admitted. ; El régimen general de extranjería no se aplica a todos los no nacionales. Los primeros en quedar excluidos son los nacionales comunitarios y sus asimilados, que gozan de un régimen propio basado en los principios de la ciudadanía y libre circulación de personas en la Unión Europea. Existe un grupo de beneficiarios de ese régimen en virtud no de su nacionalidad sino de su vínculo familiar con los comunitarios. Se trata de los familiares que son nacionales de Terceros Estados. Sólo determinados miembros de la familia pueden ampararse en el régimen vigente interno —el reciente RD 178/2003— y comunitario. El presente estudio, encargado por el Departamento Temático de Derechos de los Ciudadanos y Asuntos Constitucionales del Parlamento Europeo a petición de las Comisiones LIBE y PETI, analiza el estado actual de transposición de determinadas disposiciones de la Directiva 2004/38/CE en España y determina los principales obstáculos que persisten a la libre circulación de los ciudadanos de la UE y sus familiares en la legislación y la práctica españolas. El estudio examina también las restricciones discriminatorias a la libre circulación, las medidas para luchar contra el abuso de derecho y las denegaciones de los derechos de entrada y residencia, además de las expulsiones. ; This study, commissioned by the European Parliament's Policy Department for Citizens' Rights and Constitutional Affairs at the request of the LIBE and PETI Committees, analyses the current status of transposition of selected provisions of Directive 2004/38/EC in Spain and identifies the main persisting barriers to free movement for EU citizens and their family members in Spanish law and practice. The study also examines discriminatory restrictions to free movement, measures to counter abuse of rights and refusals of entry and residence rights, in addition to expulsions.

The principle of mutual recognition concerning the free movement of goods has played a key role for the development of doctrine in European Union Law. With the cases Dassonville, Keck and Cassis de Dijon the European Court of Justice has founded this principle of mutual recognition which has been more and more in competition with direct regulations of European bodies. The principle has often been questioned due to a large amount of problems resulting from this non-regulative principle whose legal bases are not even clearly defined and require a judicial interpretation. ; El principio del reconocimiento mutuo relativo a la libre circulación de mercancías ha tenido un rol clave en el desarrollo de la doctrina en el Derecho de la Unión Europea. Con los casos Dassonville, Keck y Cassis de Dijon, la Corte Europea de Justicia ha dado lugar a este principio, el cual ha entrado más y más en competencia con las regulaciones directas emitidas por los órganos europeos. This article analyses the ways in which artists who choose to license their works are linked and associate with Copyleft or Creative Commons. They thus include the Free Culture Movement, which proposes the free movement of symbolic goods without subscribing to the strictest copyright standards in terms of prohibitions on circulation and copying. While these ideas of the free movement of works are residual, as they have their basis in a pre-modern (or pre-empitalist) period in which works were shared socially without paying royalties, it is in this context that the logic of the internet and digital technologies become more accessible and this debate on intellectual property takes effect. In this context, groups and groups of artists decide to make their productions available to others, allowing copying, but also the derivation of their materials. The Andean Court of Justice (ACJ) and the Permanent Tribunal of Review (PTR) of Mercosur have used the European Court of Justice (ECJ) case law to define the principle of free movement of goods enshrined in the Cartagena Agreement and the Treaty of Asuncion. This paper seeks to analyze the manner in which the ACJ and the PTR have applied the ECJ case law in order to determine the existence of trade restrictions. It is argued that there is a need to developed a contextual interpretation of the principle of free movement of goods in the Andean Community and Mercosur that clarifies and develop the concepts of the Cartagena Agreement and the Treaty of Asuncion in the light of their own integration processes, of which the ACJ and the PTR are part. ; El Tribunal de Justicia de la Comunidad Andina (TJCAN) y el Tribunal Permanente de Revisión (TPR) del Mercosur han utilizado la jurisprudencia del Tribunal de Justicia de la Unión Europea (TJUE) para definir el principio de libre circulación de mercancías consagrado en el Acuerdo de Cartagena y el Tratado de Asunción. Este artículo busca analizar de qué manera el TJCAN y el TPR han aplicado dicha jurisprudencia para determinar la existencia de restricciones al comercio. Se plantea que existe la necesidad de desarrollar una interpretación contextualizada del principio de libre circulación de mercancías en la Comunidad Andina y el Mercosur que aclare y desarrolle los conceptos incluidos en el Acuerdo de Cartagena y el Tratado de Asunción a la luz de los propios procesos de integración de los que el TJCAN y el TPR forman parte.

The process of securitization of migration should be explained in a general context of crisis of globalization and the international liberal order. There are mainly two main current political views regarding globalization and mobility: the globalist position and the skeptical position. In this crisis scenario, there is a boom in policies aimed at restricting the free movement of people promoted by radical rightwing populist forces. We deal in this study of the process of securitization of the United States migration policy during the Trump Administration and, in particular, the relations with Mexico. Finally, we analyze the Global Compact for Safe, Orderly and Regular Migration, signed by the United Nations in 2018, as a desecuritization alternative of migration policies. We study the limits and potential of this agreement for the global governance of migration. ; El proceso de securitización de las migraciones debe explicarse en un contexto general de crisis de la globalización y del orden liberal internacional. Son principalmente dos las visiones políticas actuales al respecto de la globalización y la movilidad: la posición globalista y la posición escéptica. En este escenario de crisis se está produciendo un auge de las políticas orientadas a la restricción de la libre circulación de las personas impulsadas por fuerzas de la derecha radical populista. Nos ocupamos en este estudio del proceso de securitización de la política migratoria de Estados Unidos durante la Administración Trump y, en particular, en las relaciones con México. Finalmente, analizamos el Pacto Mundial para una Migración Segura, Ordenada y Regular, firmado por Naciones Unidas en 2018, como alternativa de desecuritización de las políticas migratorias. Estudiamos los límites y las potencialidades de este acuerdo para la gobernanza global de las migraciones.
