학위논문 (석사)-- 서울대학교 대학원 : 정치학과, 2012. 2. 박찬욱. ; 본 연구는 1970년대 이후 미국의 통상정책 결정과정에서 주된 절차적 기제로 작용해온 신속처리절차(Fast-track procedures)가 2002년 무역법을 통해 무역증진권한(Trade Promotion Authority; TPA)으로 재입법되는 과정의 동학을 의회-행정부 관계를 중심으로 설명하는 것을 목적으로 한다. 신속처리절차는 대통령이 비관세장벽 관련 내용이 포함된 무역협정을 체결하고 이행법안을 의회에 제출하면 양원은 수정안 제출 없이 가부만을 결정해서 90일내에 처리해야 한다는 규정으로 1974년 무역법에서 처음 도입된 이래 30년 간 미국의 무역정책결정과정에서 중요한 위치를 차지해왔다. 하지만 자유무역정책에 대한 양당의 합의가 약해지면서 1994년 만료되었고, 2002년 8월 6일 부시 대통령이 법안에 서명을 하면서 8년 만에 통상정책결정과정에 다시 등장했다. 그렇다면 어떠한 맥락에서 클린턴 행정부 시기에는 부결되었던 연장 법안이 부시 행정부 때는 성공할 수 있었을까? 기존의 연구들은 1997년과 2001년 표결 분석을 통해 의원 차원에서 이익집단ㆍ유권자들과의 관계, 정당 차원에서 단점정부를 그 요인으로 지적한다. 하지만 입법과정에서 의회의 행태는 의원 개인, 정당 두 차원 외에도 행정부와의 관계에서 입법부로서의 의회를 강화하고자 하는 유인의 영향을 받는데 본 논문은 마지막 차원에 주목한 설명을 제시하고자 한다. 즉 의회는 국내외 경제적 상황, 유권자와 이익집단에 대한 고려, 행정부 등 다양한 요구에 대응하는 과정에서 입법부로서의 지위 강화를 위해 행정부와의 관계에서 개입을 증대하는 동시에 실패했을 경우에 부담해야 하는 비난, 지지기반의 이탈과 같은 손실을 최소화하는 방향으로 정책을 입안하려고 했고, 그 결과로 2002년에 무역증진권한이 다시 입법되었다는 것을 보이고자 한다. 입법 과정을 보면 초기에는 기존 연구 결과에서 나타나듯 의원 개인의 차원에서는 재선을 위해 유권자와 이익집단을 고려했고 정당 차원에서는 다수당이 되려는 선거 정치에 대한 고려와 이익집단과의 관계에서 통과와 저지의 공을 주장하려는 의도에서 정당 간 대립이 나타나기도 했다. 하지만 입법과정이 본격화되고 상원에서 안데스 산맥 국가들에 대한 무역특혜협정, 무역조정지원과 포괄법안의 형태로 입법되는 것으로 논의되면서 양당의 지도부는 의회가 미국의 전반적인 무역정책의 수립에 어떻게 개입해야 하는가에 대한 고민을 시작했다. 의회는 무역개방이 필요하다는 방향성에는 전반적으로 동의하고 있었고 WTO Doha Round가 임박해오고 있는 상황에서 행정부에 권한을 위임하지 않았다가 미국의 무역과 경제 상황이 악화된다면 그에 대한 책임을 온전히 부담해야 하기 때문에 무역증진권한의 입법을 통해 책임을 공유할 필요가 있었다. 이 경우 직접적인 권한 행사 주체는 행정부이기 때문에 실패했을 때는 행정부에 책임을 전가할 수 있는데다 권한의 위임범위와 재량권을 더욱 축소하고 적극적으로 개입해 무역 정책을 수립할 수 있기 때문에 의회의 입장에서는 결과에 대한 직접적인 책임을 회피할 수 있다. 동시에 절차의 적용 요건을 강화하고 감독기구를 늘리고 등의 조치를 통해 협상과정에 의회가 능동적으로 개입할 수 있는 통로를 확대하고, 행정부가 의회의 의사와 반하는 협상을 할 여지를 줄이기 위해 재량의 범위를 제한했다. 하지만 2002년 무역법에서 의회의 무역정책수립에 대한 적극적인 개입 의지가 가장 강하게 드러난 부분은 주도적으로 무역개방으로 인해 피해를 입은 부문에 대한 보상정책을 수립했다는 점이다. 무역조정지원에서 규정한 정책들은 분배정책적인 특성으로 인해 수혜자들에게 공을 주장하기는 쉽지만 비난을 받거나 실패할 확률은 낮기 때문에 의회의 입장에서는 헌법상 수임기관으로서 무역정책을 적극적으로 수립하는 의무를 다하고 있다고 주장하기에 효과적인 조치였다. 의회는 이처럼 무역조정지원 법안을 통해 적극적으로 개입해 직접 무역정책을 수립하고 무역협정체결과정에서 개입을 증대하는 동시에 권한을 위임하지 않았을 경우 WTO Doha Round에서 미국의 협상지위 약화로 미국의 무역과 경제 상황이 악화될 수 있다는 우려 때문에 개입의 정도를 자제하고 행정부에 직접적인 무역협정체결권한을 위임하는 내용의 무역증진권한을 입법한 것이다. ; The purpose of this study is to analyze the dynamics of legislating the Trade Act of 2002 which granted Trade Promotion Authority, previously called fast-track negotiating authority, to the President of the United States focusing on the relations between the executive and Congress. Fast-track procedures were set forth in the Trade Act of 1974, stipulating that once the president formally submits a bill implementing a trade agreement concerning non-tariff barriers, both houses must vote on the bill without any amendments or filibusters. Being continuously in effect for 30 years, they have acted as a principal procedural mechanism for enacting trade agreements since 1970's. As the bipartisan consensus on free trade was eroded by the emergence of social issues like labor and environment in trade talks, however, they expired in 1994 due to failure to reach an agreement on how these issues should be handled. In 2002, a long and enthusiastic debate in both houses finally ended and the procedures were restored after a 8-year hiatus during the Bush presidency. If that is the case, in what circumstances was it possible for president Bush to regain the authority that president Clinton failed to win? The existing studies which conducted a comparative analysis on the roll-call voting that took place in 1997 and 2001 pointed out that representatives' consideration of constituents including pressure from interest groups and divided government had a noticeable effect in the different consequences. But besides these two, the respective members and party, a motive to reinforce the legislative branch as an institution has a impact on the behavior of Congress. This study aims to propose an explanation focusing on the third dimension from a view of interbranch politics. Then, responding to both domestic and international economic condition, demand from interest groups and constituents, and request from the executive branch, Congress approved the measure as a consequence of reflecting the intention to improve its status by increasing engagement with the process of decision making in the executive branch and minimize the loss such as the blame from the public or decrease in support accompanying failure of certain policy at the same time. In the early stage of legislation congressmen's consideration of constituents for winning reelection and partisan rivalry prevailed as other studies predicted. But as the actual legislative process progressed, the situation changed. With the Senate Democrats insisting on enactment of the omnibus trade bill incorporating TPA and two other bills, Andean Trade Preference Act and Trade Adjustment Assistance, concern over how Congress should engage with the establishment of generic trade policy spread throughout the party leaders. Congress agreed with the executive branch on the need of trade expansion and delegating the power to negotiate trade agreements for imminent WTO Doha Round because it would make them share the responsibility for possible deterioration in economy and trade in the future. The fact that the direct agent of exerting the authority was the executive branch had Congress make up its leeway as it could shift all the blame onto the other branch. Furthermore, when the economy got worse Congress could curtail the limit of the delegation and discretionary power given to the executive and establish trade policy firsthand. Delegating the authority, Congress expanded the means to actively involve in negotiating process by reinforcing its role of oversight, downsizing the discretionary power to prevent the executive from concluding the agreement despite congressional opposition, and tightening up the conditions to meet for the application of the fast-track procedures. But the most impressive part of the Trade Act of 2002 is TAA which reflected Congress's intension to play a leading role in making compensation policy for the people who got injured by trade. In conclusion, a broad agreement that TPA should be extended spread over Congress as it would consolidate the firm standing of the United States in trade talks including the upcoming WTO Doha Round. Moreover, Congress did not want to take full responsibilities or blame for the potential deteriorating economy. But at the same time Congress wanted to increase its engagement with trade policy making with the authority originally given to it by Constitution and its grown capabilities. The effort to restore the fast-track negotiating authority; TPA during the Bush presidency was feasible as it was linked to TAA bill, a measure taken by Congress to expand its involvement in trade policy making, and some steps to increase its engagement with the process of negotiation were taken. In other words, the Trade Act of 2002 was legislated as a result of Congress' struggle to balance between two motives, desire to avoid blame and increase its engagement with policy making. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 국제대학원 국제학과(한국학전공), 2020. 8. 박태균. ; 본 연구는 1953년 한국정전협정, 베트남의 1954년 제네바협정과 1973년 파리협정을 비교함으로써 당시 한국과 베트남 상황에 정전협정, 평화협정이 조인되는 조건이 마련되어 있었는지 재검토할 것이다. 평화협정이 체결되었다고 하더라도 반드시 평화가 보장되는 것은 아니다. 단순히 어느 하나의 평화협정을 통해 분쟁 상태가 종료된다기보다는 분쟁 해결의 과정 속에서 여러 협정이 체결되기 때문이다. 평화협정에 대해 분쟁을 종결하고 평화의 상태로 가는 과정적 관점으로 이해할 필요가 있다. 따라서 평화를 구축하는 과정에서 체결되는 평화협정들은 각각의 상황과 국면에 따라 그 속성이 다르게 나타날 수 있다. 1953년 체결된 정전협정으로 한국전쟁이 종결된 것으로 볼 수 있으나 현재 평화를 회복하지 못하였다. 평화가 회복되지 않았고 한반도 평화체제의 수립 문제는 한국의 국가안보에 있어서 당면한 가장 중요한 문제일 것이다. 베트남의 경우 1954년 제네바협정을 체결하였으므로 프랑스가 인도차이나에서 완전히 철수하였으며 베트남이 독립권을 가지게 되었지만 국가가 분단되는 비극에 빠졌다. 베트남의 양측은 대화로 갈등을 해결하지 못하여 결국 1963년 미국이 공식적으로 개입하며 전쟁이 재발발하였다. 1973년이 되어서야 베트남 전쟁을 마무리하기 위하여 파리협정이 체결되었는데 전투가 계속되었고 진정한 평화를 이룰 수 없었다. 위의 세 협정은 전쟁을 끝내고 평화 구축 토대를 마련하기 위하여 체결되으나 실제로 평화를 가져올 수 없었다. 분쟁을 해결하기 위하여 체결되는 평화협정을 유형화하려면 분쟁의 양상과 평화협정의 본질을 보다 명확히 파악하는 것이 필요하다. 어느 하나의 평화협정이 체결되었다고 하여 반드시 당사자 간 분쟁이 종결되는 것이 아니기에 평화를 구축하는 과정속에서 체결된 다수의 평화협정이 각각 어떠한 성격을 지니는지 탐색하는 작업이 필요하다. 본 연구는 한국정전협정, 제네바협정, 파리협정이 논의되는 과정 속에서 각 당사자가 협상을 통해 얻고 싶었던 것을 보여주며 정전협정 또는 평화협정의 본질을 명확히 파악할 것이다. 당시 위의 세 협정을 체결하기 위하여 유리한 조건이 마련되었는지 검토할 것이다. ; This paper compares the 1953 Korean Armistice Agreement, the 1954 Geneva Agreement and the Paris Agreement in 1973 to review whether the conditions of the Korean-Vietnam Armistice Agreement and the Peace Agreement were signed at that time. Even if a peace agreement was concluded, peace was not necessarily guaranteed. This is because a number of agreements are concluded in the process of resolving a conflict rather than simply ending the state of the conflict through any peace agreement. It is necessary to understand the peace agreement from a procedural point of view of ending the conflict and going to a state of peace. Therefore, the peace agreements concluded in the process of establishing peace may have different attributes according to each situation. Although the Korean War could come to an end with the Armistice Agreement signed in 1953, the current peace was not restored. Peace has not been circulated, and the issue of establishing a peace regime on the Korean Peninsula will be the most important issue facing Korea's national security. In Vietnam, due to the Geneva Agreement signed in 1954, France withdrew completely from Indochina and Vietnam gained independence, but the state fell into a dividing tragedy. The two sides of Vietnam did not resolve the conflict through dialogue, and in 1963 the US officially intervened and the war broke out. It was not ntil 1973 that the Paris Agreement was signed to end the Vietnam War, but the battle continued and no real peace could be achieved. The three agreements were concluded to end the war and lay the groundwork for peace, but could not actually bring about peace. If the peace agreements to be settled to resolve disputes are typified, it is necessary to understand more clearly the nature of the disputes and the nature of the peace agreements. The fact that any peace agreement is concluded does not necessarily end the dispute between the parties, so it is necessary to explore the nature of each peace agreement concluded in the process of establishing peace. This study shows what each party wants to obtain through negotiations during the process of discussing the Korean Armistice Agreement, the Geneva Agreement and the Paris Agreement, and will clearly grasp the nature of the Armistice Agreement or the Peace Agreement. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과, 2012. 2. 이승종. ; 민선 5기 지방선거 이후 우리나라 지방자치는 새로운 양상으로 진행되고 있다. 지방자치의 정치화, 지방정치의 중앙화가 가속화되었으며 특히 무상급식이라는 정책이슈가 지방자치의 주류 현안으로 등장하게 되었다. 이 논문은 무상급식 이슈가 대표적인 양대 지방자치단체인 서울시와 경기도에서, 유사한 정책 환경에도 불구하고 전혀 다른 정책결과를 낳은 점에 주목하였다. 이를 위해 서울시와 경기도의 무상급식과 관련된 정책 환경의 공통점과 차이점을 알아보고 어떤 요소에 의해 상이한 정책결과가 나타났는지를 분석하고자 하였다. 급식정책 실시 결과라는 종속변수에 영향을 주는 독립변수로는 지방선거 결과, 지방의회 특성, 자치단체 재정규모, 마지막으로 단체장의 특성을 설정하였다. 연구 결과 두 지방자치단체는, 단체장의 정당배경 및 무상급식에 대한 소신, 지방의회의 정당간 분점정도, 의회규모, 의원 보수, 자치단체 재정규모 면에서 극히 유사하였으나 단체장 특성 가운데 정당배경 및 성장배경 보다는 갈등해결 전략에서 차이가 있음을 알 수 있었다. 그 결과 경기도에서는 김문수 지사가 명분을 지키면서도, 의회와 타협하여 상생의 길을 모색하였고 서울시에서는 오세훈 시장과 의회가 강경대응으로 일관하여 시장 사퇴라는 나쁜 선례를 남기고 말았다. 또한 당초 설정된 '단체장의 특성에 따라 급식정책은 영향을 받을 것이다' 라는 가설이 확인되었다. 정책적 함의로 첫째는 '지방선거의 지방화'를 위해 정치권이 노력해야한다는 점을 들 수 있다. 6.2 지방선거에서는, 행정학자들이 우리나라 지방정치의 문제점으로 거론해 온 지방정치의 중앙화 현상이 더욱 극심해진 결과를 보여주었다. 중앙당은 지방선거를 중앙선거의 대리전 또는 전초전으로 간주하는 태도를 버려야 할 것이다. 둘째는 정당들이 더욱 정책개발에 노력할 필요가 있다는 것이다. 민선 5기 선거는 무상급식 이슈가 전국을 휩쓴 선거로서, 여야 정당들은 지방차원의 정책 개발보다는 선거이슈 선점에 따른 공세 및 방어에 급급한 모습을 보여 주었다. 교육정책에는 무상급식 외에 절실한 문제들이 많이 있음에도 불구하고 마치 과거 민주화항쟁 당시의 대통령 직선제 요구를 방불케 하는 양자택일 양상으로 진행되었다. 또한 근거 없이 무상급식 요구를 포퓰리즘으로 매도한다거나, 선별적 급식지원 정책이 아이들에게 눈칫밥을 먹이는 것이라고 선동하는 것은 지방선거에서 우선 승리하고 보자는 식의 후진성을 보여주는 사례라고 할 수 있다. 정치권이 더욱 성숙해질 필요가 있다. 셋째 복지정책은 개별 지방자치단체의 재정상황 여건에 따라 추진할 필요가 있다. 연구결과 복지 선진국들도 국가별, 지역별로 다양한 급식 정책을 실시하고 있음을 알 수 있었다. 또한 지방자치단체와 의회는 일방적인 '힘'의 논리만 앞세우지 말고 서로 화합하여 선진 지방자치 문화 정착에 기여하여야 할 것이다. ; After the 5th local election by popular vote, Korea's local autonomy is taking on a new aspect. Party politics and centralization of local politics are accelerating. Especially free meals policy has become the mainstream issue of local autonomy. This paper paid attention to the fact that free meals issue brought about different outcome in two big typical local governments such as Seoul city and Gyeonggi province. For this research, first I tried to discern similarities and differences related to free meals policy environment and to analyze what factors brought about different outcome. I set up the local election result, financial ability of local government, and characteristic of local government head as independent variables which have influence on school meals policy. This reserch finds out that there was significant difference in characteristic of local government head, particularly conflict solving strategy rather than political backgrounds although there were many similarities in their parties, belief on free meals policy, inter-party domination structure, size of assembly, annual salary, local finance of the two local governments. In Gyeonggi province, Governor Kim negotiated with local assembly for peaceful coexistence, in Seoul city Mayor Oh and city assembly called for tighter controls. Finally Mayor Oh resigned because of the low turnout in inhabitant's poll on free meals policy. This is a bad precedent in local autonomy history. Also the hypothesis that free meals policy will be influenced according to the characteristic of local government head was confirmed. This study implies, first, all politicians should make a greater effort for localization of local election. In the 5th local election by popular vote, centralization of local politics which many scholars have mentioned so far was intensified. Central parties have to come off regarding local elections as proxy war and skirmish of the central general election. Second, parties should develop policies. The 5th local election was only for free meals policy issue all over Korea. Most of parties manage to cope with electoral situation related to free meals issue rather than policy development of local level. Free meals policy was considered as the only matter like direct presidential election system issue in 1987 although there are other urgent matters except free meals policy in education policy field. Also the ruling party politicians denounced free meals policy as populism, otherwise the opposition party politicians condemn selective welfare policy for vulnerable groups as discrimination of the poor. These cases are backward behaviors which aim at short-term election victory. All politicians must be more mature. Third, welfare policy need to be carried out depending on each local government's financial conditions. As mentioned earlier, even advanced countries implement various school meals policy on a case by case basis. Between 1995 and 2011, Peruvian GDP grew by 4.9% each year, driven by exports and private investment's increase. However, it only grew by 3.3% in 2015 and by 4% in 2016 due to a reduction in the international price of metals that the country exports. In this scenario, the government elected in 2011 faced the challenge of replacing private investment with public investment as a growth engine. However, this decision revealed two structural problems of the Peruvian economy: 1) the limited spending capacity of central and regional governments; and 2) the difficulty of increasing tax collection due to a very significant informal sector in the country. However, trade liberalization, stability in domestic prices and reforms in public management are strengths of the Peruvian economy, which would enable it to return in the next few years to growth rates of around 4% or more.

학위논문 (석사)-- 서울대학교 대학원 : 철학과(서양철학전공), 2012. 2. 정호근. ; The objective of this thesis is to elucidate the concept of the general will and to make Rousseau's point clear by refuting criticisms which determine the general will as totalitarianism. To this end, I would like to reconstruct the concept of the general will by focusing on Rousseau's paradoxical expression of 'forcing to be free'. Because I think that it is possible to get a correct understanding of the general will through paying attention to this phrase. There are two kinds of 'forcing to be free' in the theory of Rousseau's General will. One is found in the notorious passage arguing that whoever refuses to obey the general will must be forced to be free in the Book 1 chapter 7 of On Social Contract. The other is implicit one in the passage discussing the conditions of the general will in the Book 2 chapter 3 and Book 2 chapter 7(part 4 chapter 8). I would like to examine these problems respectively and try to show that Rousseau's ultimate point consists in not 'forcing' but 'freedom'. Conclusively, the authentic difficulty of interpreting of Rousseau's logic is that nevertheless 'forcing to be free' is necessary to the production of the general will, he permit the possibility of failure of this process in practice. Rousseau's theory of the popular sovereignty argues that the foundation of legitimacy of the state does not consist in the divine or natural foundation but in the autonomous will of the people. Despite this theoretical postulate, the people appear to not only rational and social unity, but also always potentially the multitude as disordered gathering of individuals who are vulnerable to a capricious passion. On the one hand, the people's general will should make a society legitimate, particular deliberation of the people may be contingent and could make an erroneous decision on the other. As a result, Rousseau introduces the legislator or the civil religion which is external to a people in order to transform a multitude into unified people. However, because of the very reason that people are still and always multitude, they consequently could not obey this foreign authority so the problem regarding difficulty of self-ruling of the people remains unsolved. At a glance, Rousseau's theory of popular sovereignty seems to optimistic assertion that the people should and could govern itself. But Rousseau's pessimistic claim that the ideal people cannot be naturally given, but must be constructed by constant effort should not be overlooked as well. Finally, the introduction of the legislator or the civil religion is not contradictory to the principle of popular sovereignty because the success or failure of this heteronomous agency is uncertain and the popular sovereignty keeps still its autonomy. The problems are described as follows: the general will aiming at common good could fell to mere will of all by acquiring of a particular will possessed by some individuals. In the same way, the people who should be unitary and organic are degenerated into a blind multitude and the citizen who must be active and rational in the collective deliberation into a passive, passionate subject. The principle of the popular sovereignty claiming that good law makes a good people but the origin of the good law must be also the people, and the fact that primitive people does not have any capacity to legislate such good law is the source of the circular logic Rousseau engages. It also suggests that the self-ruling of the people is not easily attainable project by the introduction of the legislator or the civil religion because after the initial social contract, passionate, irrational and apolitical properties of the human being who had had those attributes in the state of nature cannot be completely eradicated. So the state of the society in Rousseau is more vulnerable than the traditional reading in that there is always the danger of reemergence of the state of nature. The fact that the sovereignty belongs to the people but the people do not have such capacity to exert the sovereignty is the central ambiguity derived from the theory of popular sovereignty in Rousseau. Rousseau's democracy as self-ruling of the people, therefore, remains always incomplete, contestable and unfinished democracy. This paradox of Rousseau is deduced from the consistent, thorough accomplishment of the principle of the freedom. In other words, Rousseau's premises arguing that the legitimacy of the politics does not have any transcendent and ultimate ground and its source is a unique source of will of the people as free being even permit the freedom to refuse their freedom. That is to say, individual citizens must be forced to be free but also can have the (natural) freedom not to be forced to have (civil and moral) freedom. In short, as though effective denaturalization is necessarily required to make man into citizen, it remains a process without a priori guarantee. Thus, the binary oppositions which support Rousseau's whole system, such as oppositions between the society and nature, the people and multitude and the general will and the will of all always have the possibility of confusion in practice. That danger renders the general will only transient or temporary in the conflictual process of politics. The fundamental problem of politics suggested by Rousseau is that the passage from the state of nature to the state of society is necessary, but is also very difficult and could not be achieved entirely. 학위논문 (석사)-- 서울대학교 대학원 : 환경계획학과, 2012. 2. 전상인. ; 경주지역의 고도보존법 개정과정 사례는 사회구조의 변화에 따른 문제점과 갈등의 원인을 공공부문과 시민들이 함께 인식하고, 다양한 이해관계자들이 참여와 협력을 통한 상호작용으로 합의를 도출한 협력적 계획사례로 평가할 수 있다. 따라서 경주사례를 협력적 계획의 구성요소를 통해 분석해 보는 과정은, 지방 환경에서 협력적 계획이론의 적합성과 현실에서의 적용에 있어 발생하는 문제들을 어떻게 개선하여 보완해야 하는지에 대하여 시사점을 제공한다. 협력적 계획이론에 대한 탐구를 바탕으로, 협력적 계획의 네 가지 구성요소들인 '제도적 맥락', '상호작용의 장', '사회적 학습', '참여 및 합의형성'을 도출하였고, 그중 제도적 맥락을 중심으로 분석을 진행하였다. 경주지역 고도보존법 개정과정에는 공공부문과 시민부문을 중심으로 하는 다양한 이해관계자들이 네트워크를 형성하고 있으며, 공유된 이해에 따라 네트워크는 변화하는 양상을 나타냈다. 개정과정의 이해관계자들은 공청회와 주민설명회를 중심으로 하는 상호작용의 장에서 유통되는 정보를 바탕으로 사회적 학습을 하고 있었으며, 이를 바탕으로 계획과정에 참여하여 개정안의 도출이라는 합의를 형성하였다. 분석의 결과를 종합하면, 경주의 사례는 협력적 계획의 외형은 갖추어져 있다고 평가할 수 있지만, 실제 과정에 있어서는 공공부문의 제한적인 정보공개 범위와 접근성의 문제, 참여자의 대표성과 권력의 비차별성이 부족, 상호작용의 장에서 공동학습이 이루어지기보다 소통의 방향이 일방적이라는 문제점을 가지고 있었다. 제도적 맥락으로 종합하면, 경주지역에 있어 위 문제들은 이해관계자들 간 신뢰저하의 원인으로 작용하였다. 경주지역의 이해관계자들은 정책의 목표달성을 위해 표면적으로 협력하고 있지만 서로를 신뢰하지 않았다. 지방환경에서 발생하는 공공부문과 시민들 간의 신뢰의 문제는 지속적인 합의형성의 학습에서 그 해답을 구할 수 있기에, 정책적 제언을 통해 제도적 보완과 사유재산권 제한에 대한 해법을 모색하고자 하였다. ; Gyeongju-city's preservation law revision process is evaluated as collaborative planning practices. On this case, first the public sector and citizens recognize social problem and conflicts, then various stakeholders are produced agreement with participation and interaction. Therefore, this analysis of cooperative Gyeongju case through the components of the collaborative planning theory provides implications for suitability of collaborative planning theory. It also provides the application of local environment and how to improve and supplement in real life problems. To precede the analysis, first I studied on collaborative planning theory and then derived four components of the collaborative planning theory that 'institutional context', 'field of interaction', 'social learning', 'participation and consensus-building'. Among these components, analysis was performed mainly on the institutional context. Various stakeholders to form a network and a shared understanding of the network showed a changing pattern in this revision process. Stakeholders are conducting social learning, based on the information that delivered by public-hearings and presentations around field of interaction. Based on this information, they involved in the planning process and derived the agreement. In sum, this case evaluated as collaborative planning case superficially. But there are some problems in process that information, participation and mutual understanding. Problem that listed above acts as the cause of deterioration of trust between stakeholders. On the surface, to achieve the goals of the policy is working, but stakeholders are did not trust each other. Through policy proposal, I tried to seek a solution on deterioration of trust problem. Continuous learning on public consensus is encouraging a social capital, such as trust. Study institutional complements on regional commission and find solution in private property limitation problem, are able to derive consensus making. ; Master

학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(정치학전공), 2020. 8. 안도경. ; 이 연구는 엘리너 오스트롬(Elinor Ostrom)의 사회생태체계(Social-Ecological System, SES)를 분석틀로 채택하여 완도군 노화와 보길 지역의 물 분쟁을 경험적으로 풀어냈다. 사회생태체계는 사회·경제·정치적 환경, 생태계, 사용자, 자원, 거버넌스, 제도의 총체적인 상호작용을 설명하려는 시도이다. 2017년 최악의 가뭄이 닥치면서 두 지역이 공유하는 유일한 상수원이 말라 주민들은 식수난에 시달렸다. 완도군의 사회생태체계에는 다중심성(polycentricity)이 부재하여 외부 환경 변화에 유연하게 대처하지 못했다. 완도군의 물관리 제도는 명시적인 규칙만으로는 다원적이며 다층적이다. 그러나 실제로 작동하는 규칙에는 군 의회, 사용자, 군청 어디에도 중심이 존재하지 않았다. 즉, 자원을 지속 가능하게 만들지 못했던 거버넌스와 사용자, 그리고 그들이 만들어 낸 제도가 모두 물 분쟁의 원인이었다. 물관리에서 정부 부처와 지방 자치 단체의 수직적인 관계는 상호의존적이면서도 위기에 대응할 만한 신속한 의사 결정 구조를 구축하지 못했다. 군 사업은 주민들과의 합의보다 정부 부처의 승인이 먼저 이루어져 주민들의 반발에 부딪힐 수밖에 없었다. 특히 완도군 의회는 물관리 제도를 변화시킬 수 있는 주요 행위자였지만 군정을 일회성으로만 감시하는 데 그쳤다. 노화와 보길의 물 분쟁은 기후 변화가 도화선이 되었을 뿐 궁극적으로는 완도군의 거버넌스와 제도에 대한 주민들의 불신이 표출된 결과였다. 2018년 제정된 「물관리기본법」은 물 관련 법률의 '헌법적 법률'로서 그동안 일관성 없었던 물 정책을 환경부를 중심으로 유지할 것으로 보인다. 법률의 제정으로 명시적 규칙은 만들어졌지만 제도의 발전은 오랜 시간을 두고 이루어지는바, 30년간 쌓인 완도군 물 분쟁의 불신을 해소할 수 있는 상위 규칙이 될지는 귀추를 지켜봐야 한다. ; This study shows empirical evidence of the water conflict between Nohwa and Bogil islands in Wando county, focusing on the social-ecological system (SES) framework proposed by Elinor Ostrom. A SES implies interactions among its social, economic, and political settings, ecosystem, users, resources, government, and institutions. Since people in Wando had suffered from extreme drought in 2017, their single water resource had dried up. Thus, a water conflict ensued. The lack of polycentricity has prevented the SES in Wando from dealing with external variables in an adaptable manner. There has been no centricity among the county council, users, and local government at the rules-in-use level. The governance and the users, along with the institutions that they formed, has made the water resource unsustainable. The strict, hierarchical, and interdependent relationship between the central and the local governments has not built up an immediate and accurate decision-making process that could contribute to overcoming the crisis. Since the local government should take permission regarding local businesses from the central government before reaching an agreement with the residents, it encounters opposition from the people. While the county council could be the main actor of a change among the institutions related to water management, it only monitors local businesses in a one-time manner. Since climate change effects, like a drought event, has triggered the water conflict between the two islands, this ultimately has showed people's skepticism toward the governance and institutions of the local government. After the Framework Act on Water Management of 2018, the Ministry of Environment has been able to maintain its consistency in water policy. While rules-in-form have been made, it will take a long time to evolve them into rules-in-use. 학위논문 (석사) -- 서울대학교 대학원 : 사회과학대학 정치외교학부(정치학전공), 2020. 8. 안도경. ; 이 연구는 엘리너 오스트롬(Elinor Ostrom)의 사회생태체계(Social-Ecological System, SES)를 분석틀로 채택하여 완도군 노화와 보길 지역의 물 분쟁을 경험적으로 풀어냈다. 사회생태체계는 사회·경제·정치적 환경, 생태계, 사용자, 자원, 거버넌스, 제도의 총체적인 상호작용을 설명하려는 시도이다. 2017년 최악의 가뭄이 닥치면서 두 지역이 공유하는 유일한 상수원이 말라 주민들은 식수난에 시달렸다. 완도군의 사회생태체계에는 다중심성(polycentricity)이 부재하여 외부 환경 변화에 유연하게 대처하지 못했다. 완도군의 물관리 제도는 명시적인 규칙만으로는 다원적이며 다층적이다. 그러나 실제로 작동하는 규칙에는 군 의회, 사용자, 군청 어디에도 중심이 존재하지 않았다. 즉, 자원을 지속 가능하게 만들지 못했던 거버넌스와 사용자, 그리고 그들이 만들어 낸 제도가 모두 물 분쟁의 원인이었다. 물관리에서 정부 부처와 지방 자치 단체의 수직적인 관계는 상호의존적이면서도 위기에 대응할 만한 신속한 의사 결정 구조를 구축하지 못했다. 군 사업은 주민들과의 합의보다 정부 부처의 승인이 먼저 이루어져 주민들의 반발에 부딪힐 수밖에 없었다. 특히 완도군 의회는 물관리 제도를 변화시킬 수 있는 주요 행위자였지만 군정을 일회성으로만 감시하는 데 그쳤다. 노화와 보길의 물 분쟁은 기후 변화가 도화선이 되었을 뿐 궁극적으로는 완도군의 거버넌스와 제도에 대한 주민들의 불신이 표출된 결과였다. 2018년 제정된 「물관리기본법」은 물 관련 법률의 '헌법적 법률'로서 그동안 일관성 없었던 물 정책을 환경부를 중심으로 유지할 것으로 보인다. 법률의 제정으로 명시적 규칙은 만들어졌지만 제도의 발전은 오랜 시간을 두고 이루어지는바, 30년간 쌓인 완도군 물 분쟁의 불신을 해소할 수 있는 상위 규칙이 될지는 귀추를 지켜봐야 한다. ; This study shows empirical evidence of the water conflict between Nohwa and Bogil islands in Wando county, focusing on the social-ecological system (SES) framework proposed by Elinor Ostrom. A SES implies interactions among its social, economic, and political settings, ecosystem, users, resources, government, and institutions. Since people in Wando had suffered from extreme drought in 2017, their single water resource had dried up. Thus, a water conflict ensued. The lack of polycentricity has prevented the SES in Wando from dealing with external variables in an adaptable manner. There has been no centricity among the county council, users, and local government at the rules-in-use level. The governance and the users, along with the institutions that they formed, has made the water resource unsustainable. The strict, hierarchical, and interdependent relationship between the central and the local governments has not built up an immediate and accurate decision-making process that could contribute to overcoming the crisis. Since the local government should take permission regarding local businesses from the central government before reaching an agreement with the residents, it encounters opposition from the people. While the county council could be the main actor of a change among the institutions related to water management, it only monitors local businesses in a one-time manner. Since climate change effects, like a drought event, has triggered the water conflict between the two islands, this ultimately has showed people's skepticism toward the governance and institutions of the local government. After the Framework Act on Water Management of 2018, the Ministry of Environment has been able to maintain its consistency in water policy. While rules-in-form have been made, it will take a long time to evolve them into rules-in-use. 학위논문 (석사)-- 서울대학교 대학원 : 행정학과(정책학전공), 2012. 2. 금현섭. ; 본 연구는 국회 법안 심사 소위원회를 분석대상으로 삼아, 국회의 법안 심의가 어떠한 행태를 기반으로 이루어지는지 살펴보았다. 최근의 국회 의사결정에 관한 연구가 대부분 상임위원회 위주였기에 실질적인 법안심의 과정을 살펴보기 힘들다는 한계를 극복하기 위해 500쪽 가량의 소위원회 회의록을 Atlas.ti 프로그램을 이용한 분석을 통해 의원들의 행태를 파악하였다. 법률안 통과에 있어 비교적 큰 차이를 보이고 있는 보건복지위원회와 산업자원위원회를 분석대상으로 삼았는데, 분석결과 두 위원회의 행태적 차이는 예상과는 다르게 크지 않았다. 두 위원회 모두 전문성 범주가 압도적으로 많았으며, 대표성, 타협성, 당파성의 행태로 의사결정의 특징이 나타나 전반적인 차이는 존재하지 않았지만 보건복지위원회는 전문성과 당파성이 상대적으로 높았으며, 산업자원위원회는 대표성과 타협성이 상대적으로 높은 것으로 나타났다. 이러한 분석은 의회의 위원회 의사결정이 정당의 이익을 대변하기 위한 것이라는 정당이익이론과 의원 본인의 정치적 자산을 취득하기 위한 것이라는 이익분배이론과는 조금 다른 결과로 상임위원회라는 회의체가 본회의에 대한 정보제공을 목적으로 이루어지기 때문에 의원들의 의사결정 행태의 바탕이 전문성이라는 정보가설이론이 본 연구에서는 크게 지지되었다. 그리고 이와 같은 행태가 법률안의 의사결정에는 어떠한 영향을 미치는지 실증분석을 통해 살펴본 결과 당파성과 대표성은 법률안의 의결에 부정적인(-) 영향을 미쳤으며, 전문성은 긍정적인(+) 영향을 미치는 것으로 나타났다. 하위범주별로 로짓분석을 수행했을 때, 통계적으로 유의미한 결과가 나온 것은 정부의 정책에 대한 비판과 반대가 높을 때 의사결정이 이루어지지 않는다는 것이다. 의원들은 강한 비판과 반대를 통해 정부를 압박하지만 정부측에서 이를 수용하지 않을 경우, 의안의 의결은 대부분 이루어지지 않았다. 이는 법안 심의에 있어서도 정부의 영향력은 사실상 막강하다는 것을 보여주는 것으로 의원들이 심의하고 결정하는 회의체라 할지라도 실제 집행을 담당하는 정부의 동의 없이는 의안의 통과는 어려웠다. 또한 위원회별로 각 행태요인의 특성이 있는지 상호작용 효과에 관한 분석을 실시하였으나 통계적으로 유의미한 차이는 도출되지 않았다. 결국 의원들의 행태적 특성이 상임위원회가 다루는 정책의 내용에 따라 크게 달라지지 않았다는 것이다. 하지만, 의안 심의에 있어 산업자원위원회보다 보건복지위원회가 훨씬 더 활발한 회의를 진행하고 있었으며, 한 의안에 대한 심의기간과 질의 빈도가 훨씬 높은 것은 확인하였고, 한 의안에 대한 심의기간이 길기 때문에 상대적으로 다루는 의안수가 적을 수밖에 없는 것도 확인할 수 있었다. 결론적으로 17대 국회 법안심의 의사결정이 소위원회 중심으로 이루어지는 것을 확인할 수 있었으며, 일반적인 법안심의에 있어서는 당파성보다 전문성이 훨씬 많이 나타나고 있으며 행정부의 영향이 실제적으로는 크게 미치고 있는 것으로 나타났다. ; This study has investigated the behavioral basis for the congressional deliberation of bills, targeting the congressional subcommittee for the deliberation of bills. In order to overcome the limit in investigating the process of practical deliberation of bills because most recent studies on the congressional decision-making was based on the National Assembly Standing Committee, about 500-page minute of the subcommittee was analyzed using Atlas.ti program and then the behaviors of the members of the National Assembly were investigated. The Health and Welfare Committee and the Industry Advisory Committee were targeted because of comparatively large difference in the passage of the bills between them. As a result of the analysis, the behavioral difference between them were not so different from the expectation. Both committees had overwhelmingly large amount of professional categories, and the attributes of their decision-making appeared as the behaviors of representativeness, compromise, and partiality. Thus, there was no difference in general, but the professionalism and the partiality of the Health and Welfare Committee, and the representativeness and the comprise of the Industry Advisory Committee appeared relatively high. This analysis was slight different from the theory of party's interest, 'the decision-making by the committee represents the party's interest', and the theory of interest distribution, 'the decision-making by the committee is for the member to acquire their own political asset'. Because, the board aims to provide the information for the full-dress session, the theory of information hypothesis, 'the behaviors of the congressmen are based on the professionalism' was greatly supported in this study. And then, as a result of an empirical analysis for investigating how these behaviors influenced the decision-making on the bills, the partiality and the representativeness had a negative effect and the professionalism had a positive effect on the vote for the bills. The statistically significant result was produced when a logit analysis by subcategory was conducted. This implies that the decision is difficult to be made when the criticism and the opposition to the government is strong. When observing the minute of subcommittees, the administrators from the government are likely participated in the subcommittee as attendees not as doers, but they, in general, are more influential than the members. The members of the national assembly oppressed the government through powerful criticism and opposition. However, if the government did not accommodate these criticism and opposition, in most cases, the vote for the bills were not materialized. This implies that the government has an enormous effect on the deliberation of bills. In fact, the passage of the bills was difficult without an agreement by the government in charge of practical implementation, even though the members deliberate and decide in the board. In addition, an analysis of the effect of interaction was conducted to find out whether there were some attributes of each behavioral factors, but no statistically significant difference has been derived. Resultingly, the behavioral attributes of the member did not significantly vary in accordance with the contents of the policies being dealt by the standing committees. However, it was identified that in respect of the deliberation of bills, than the Industry Advisory Committee, the Health and Welfare Committee were proceeding meetings more actively, the deliberation period was longer and the quality of the deliberation were hight and the number of the bills dealt with was comparatively smaller, due to it's long period for the deliberation of bills. In conclusion, it was identified that the decision-making on the bills at the 17th National Assembly was centered on the subcommittees, and in respect of the deliberation of general bills, the professionalism appeared more often than the partiality, and the administration was significantly influential to that. ; Master
