The article looks into the peculiarities of economical effect of the Brexit for the EU countries and Great Britain. The main data as for the trade of goods and services and also an investment climate between two sides proves the essential costs have been caused by the Brexit. The trade between the EU and the United Kingdom is great and according to its size is equal the transatlantic trade (between the EU and the USA). The essence and form of the future trade agreement is still been discussed. But all this problem researchers agree that the main violation of trade ties and agreements will result in economical losses from both sides. Nevertheless, the EU will have only disproportionately small part of general loss and not only because its economical position is five times bigger then Great Britain, but also from the view of the fundamental reasons with the market increase potential of the own enterprises being the dominant one. Other reseaches of different free trade agreements confirm the general assumption about the smaller side been able to get more from the trade barriers elimination and lose more because of their creation. It means that the EU will have stronger positions during negotiations.
This paper investigates bilateral trade between Ukraine and the European Union in agricultural goods. The possible scenarios of agri-food market development in terms of a free trade area creation (FTA) between Ukraine and the European Union (EU) were analyzed, using a general equilibrium model. This pepper also evaluates a possible influence of trade liberalisation in terms of a free trade area creation (FTA) between Ukraine and the European Union (EU) on the main branches of the economy. Changes in production indexes, welfare, costs of production factors for the main commodities were estimated The suggestions for choosing the optimal format of an FTA between Ukraine and the EU in order to minimize adverse effects on the agri-food sector in the Ukraine and to increase its export potential have been developed.
В статье рассмотрен вопрос влияния инвестиционных споров «инвестор-государство» на национальные системы правовой охраны и защиты прав интеллектуальной собственности государств, ставших стороной таких споров; пути решения такого влияния, предложенные Европейским Союзом в соглашениях о свободной торговле с, соответственно, Канадой и Тунисом. This Opinion may become the first step towards the creation of a Multilateral Investment Court, the project, which is preliminary promoted by the European Union through the conclusion of bilateral trade agreements.While Ukraine is no alien to investment disputes over intellectual property rights, the interplay between investment law and intellectual property rights has received limited attention among local scholars. Consequently, this article starts with introducing the reader to the key elements of existing international investment treaties that are relevant for the intellectual property regime. It is followed by an overview of main investment disputes, involving intellectual property rights, with a view of mapping potential issues such a dispute may present to the Ukrainian system.The third part of the article analyses the European Union's new generation of international investment agreements. Although Ukraine has not yet been involved in such negotiations, art. 89 of the EU/Ukraine free trade agreement allows for its review to include provisions on investment protection and investor-to-state dispute settlement procedures. Consequently, two recent investment chapters are contrasted, the one included in the Comprehensive Economic and Trade Agreement with Canada, as a developed-to-de- veloped country negotiations model; the one included in the draft of the Deep and Comprehensive Free Trade Agreement with Tunisia, as a developed-to-developing country negotiations model.Such comparative analysis has allowed me to discern both common and diverging provisions, relevant for the national intellectual property systems, which, in turn, will allow Ukraine to adopt informed decisions during a potential negotiation with the European Union.
В статье рассмотрен вопрос влияния инвестиционных споров «инвестор-государство» на национальные системы правовой охраны и защиты прав интеллектуальной собственности государств, ставших стороной таких споров; пути решения такого влияния, предложенные Европейским Союзом в соглашениях о свободной торговле с, соответственно, Канадой и Тунисом. The structure of Ukraine's exports to the EU is estimated and the problems and opportunities for domestic exporters under the impact of the Free Trade Area Agreement between Ukraine and the EU are defined. It is indicated that trade liberalization does not allow free access to the EU market for Ukrainian exporters; Ukraine must adopt the EU legislation in the field of technical standarts.The reasons for increasing the intensity of Ukraine-EU trade, including the elimination of customs duties, the reorientation of trade flows from the Russian Federation to the EU, the growth in the purchasing power in the EU and decline in it as a result of the economic crisis in Ukraine, were determined. Particular emphasis was placed on the progress in meeting EU technical and environmental regulations.Ukraine has the lowest position of eco-innovative efficiency in comparison with the EU members. Therefore, taking into account the negative structure of domestic exports and EU technical standarts and norms, an urgent transition to a deep eco-innovative development of export industries is highly required.The implementation of eco-innovative projects and technologies by Ukrainian producers of different sizes (small, medium, large) is analyzed. The study shows that eco-innovative activities of Ukrainian enterprises is directly related to their size: the large enterprises have large funds, produce more products, are more interested in entering the EU market, and therefore have more opportunities and needs to meet EU technical (ecological) requirements.It is concluded that the FTA Agreement should become an additional stimulus for the eco-innovative activities of Ukrainian expoters due to the need of their meeting the European standards of quality and criteria of eco-production. The major barriers to the development of the enterprises' eco-innovative activity have been identified as the lack of capital, lack of motivation, lack of knowledge and experience, lack of technical knowledge, lack of cooperation between the research institutions and enterprises, unfavorable political, informational and social environment, corruption.Key words: eco-innovative activities; exporters; eco-innovations; Ukraine-EU association agreement; Free Trade Area Agreement between Ukraine and the EU. ; У статті оцінено структуру українського експорту до ЄС та окреслено проблеми і можливості, відкриті для вітчизняних виробників-експортерів під впливом Угоди про зону вільної торгівлі між Україною та ЄС. Вказано, що сама лібералізація умов торгівлі не надає можливості українським експортерам вільного виходу на ринок ЄС; Україна повинна прийняти регулятивні норми законодавства ЄС.Визначено причини зростання інтенсивності торгівлі України з ЄС, серед яких відміна мит, переорієнтація торговельних потоків з РФ на ЄС, зростання купівельної спроможності в ЄС та її спад внаслідок економічної кризи в Україні. Особливий наголос зроблено на поступі у виконанні технічних та екологічних вимог ЄС.Визначено, що Україна має найнижчий рівень екологічної інноваційності порівняно з країнами-членами ЄС. Тому з огляду на негативну структуру вітчизняного експорту та на технічні регламенти ЄС, необхідним є терміновий перехід на глибокий еколого-інноваційний розвиток експортних галузей.Проаналізовано впровадження еколого-інноваційних проектів та технологій українськими виробниками в розрізі малих, середніх та великих підприємств. Аналіз показує, що еколого-інноваційна діяльність українських підприємств прямо залежить від їхнього розміру: великі підприємства володіють більшими коштами, виробляють більшу кількість продукції, частіше зацікавлені у виході на європейський ринок, а відтак мають більше можливостей і потреб відповідати технічним (екологічним) вимогам ЄС.Зроблено висновки, що Угода про ЗВТ повинна стати додатковим стимулом для еколого-інноваційної діяльності українських виробників-експортерів через необхідність підтвердження відповідності їхньої продукції європейським стандартам якості, критеріям екологічного виробництва. Виділено бар'єри на шляху еколого-інноваційної активності підприємств, зокрема відсутність капіталу, мотивації, знань, досвіду, технічних знань, недостатня співпраця між науково-дослідницькими установами і підприємствами, несприятливе політичне, інформаційне та соціальне середовища, корупція.Ключові слова: еколого-інноваційна діяльність; виробники-експортери; екологічні інновації; Угода про асоціацію України з ЄС; Угода про зону вільної торгівлі України з ЄС.
The article clarifies that in the modern world the most influential driving force of economic development is the various forms of international trade, which covers the sphere of international economic relations and is represented by the aggregate of foreign exchange of goods, services, intellectual property with other countries. For international trade, the existence of the world market, which is the sphere of formation of commodity-money relations between a number of countries, is based on the principles of the international division of labor and a number of other factors of production. A product that is sold within the global market is a kind of informational tool, because it carries information about the magnitude of aggregate supply and demand in the world. With this in view, countries can analyze and evaluate the parameters of manufactured products in comparison with international standards and quality standards. Each country, taking part in the process of international trade, acquires the status of a seller, that is, trade takes place between individual countries, which exchange counter-flows of goods and services, namely: export and import. The peculiarities of functioning of the European Free Trade Association have been characterized and it is found that it unites the customs territories of the Republic of Iceland, the Principality of Liechtenstein, the Kingdom of Norway and the Swiss Confederation. It was clarified that the Free Trade Agreement between Ukraine and the EFTA was signed on June 24, 2011 and ratified by the Law of Ukraine «On ratification of the Free Trade Agreement between Ukraine and the states of the European Free Trade Association». The basics of the creation of the Free Trade Area for Ukraine are determined. The possible risks for Ukraine when creating the Free Trade Area with the EU are outlined. Among the most effective measures that should be foreseen in the context of the implementation of the strategy and which will have a positive effect on improving the qualitative development of foreign trade with the cranes of the European Union, include: to implement the plan for the implementation of the World Trade Organization Agreement on Trade Facilitation of the TFA; create a system for financing export activities, including the establishment of an export credit agency (ESA); to implement the Comprehensive Strategy for the Implementation of Chapter IV of the Association Agreement with the European Union in order to overcome the technical non-tariff barriers to the implementation of domestic export activities. ; У статті з'ясовано, що в умовах сучасного світу найбільш впливовою рушійною силою розвитку економіки є різні форми міжнародної торгівлі, яка охоплює сферу міжнародних економічних відносин і представлена сукупністю зовнішнього обміну товарами, послугами, інтелектуальною власністю з іншими країнами. Для міжнародної торгівлі характерне існування світового ринку, який є сферою формування товарно-грошових відносин між низкою країн, що базується на засадах міжнародного поділу праці та низці інших виробничих чинників. Товар, який реалізується в межах світового ринку, є своєрідним інформаційним інструментом, оскільки несе в собі інформацію про величину сукупного попиту та пропозиції у світі. З огляду на це країни можуть здійснювати аналіз та оцінку параметрів виробленої продукції порівняно з міжнародними нормативами та стандартами якості. Кожна країна, беручи участь у процесі міжнародної торгівлі, набуває статусу продавця, тобто торгівля здійснюється між окремими країнами, які обмінюються зустрічними потоками товарів і послуг, а саме: вивезення (експорту) та ввезення (імпорту). Охарактеризовано особливості функціонування Європейської асоціації вільної торгівлі та виявлено, що вона об'єднує митні території Республіки Ісландія, Князівства Ліхтенштейн, Королівства Норвегії та Швейцарської Конфедерації. З'ясовано, що Угоду про вільну торгівлю між Україною і ЄАВТ було підписано 24 червня 2011 року й ратифіковано Законом України «Про ратифікацію Угоди про вільну торгівлю між Україною та державами Європейської асоціації вільної торгівлі». Визначено основні цілі створення Зони вільної торгівлі для України. Виокремлено можливі ризики для України у разі створення Зони вільної торгівлі з ЄС. До найбільш ефективних заходів, які варто передбачити в контексті реалізації стратегії та які здійснять позитивний влив на підвищення якісного розвитку зовнішньої торгівля з кранами Європейського Союзу, можна віднести: реалізувати план імплементації УгодиСвітової організації торгівлі про спрощення торговельної діяльності (TFА); створити систему фінансування експортної діяльності, включаючи створення експортно-кредитного агентства (ЕКА); втілити Всеохоплюючу стратегію імплементації Глави IV Угоди про асоціацію з Європейським Союзом для того, щоб подолати технічні нетарифні бар'єри на шляху здійснення вітчизняної експортної діяльності.
The article is devoted to the study of click-wrap license agreements as a type of wrap license agreements and to the elucidation of the offer and acceptance features in such agreements. The author analyzes the evolution of wrap license agreements in the context of the click-wrap license agreements formation. Careful attention is given to the research of foreign judicial practice concerning a range of issues related to the validity of click-wrap license agreements, the procedure for their conclusion. At the same time, the provisions of national legislation on the outlined topics, as well as a number of scientific works of domestic and foreign legal scholars were studied. It was found that click-wrap license agreements are a special contractual structure with a simplified conclusion procedure, which means that click-wrap license agreements are adhesion contracts, so their terms are set in standard forms and the agreement can be concluded only by joining to its conditions as a whole. Taking into account that click-wrap license agreements are electronic contracts, certain features of the offer to enter into an agreement and the acceptance of such an offer or its rejection are highlighted. It is concluded that pressing a certain button, clicking on a special field, etc. is considered to be an acceptance of the offer to enter into an agreement if the content of these actions is clearly described in the proposal. Based on the findings, the author has developed recommendations for optimizing the functioning of click-wrap license agreements as a regulator of relations of the intellectual property rights disposal. Moreover, the research creates a framework for further study of wrap license agreements in general.
У статті розглянуто основні положення Паризької угоди, зобов'язання, які беруть на себе країни при підписанні Угоди та санкції у випадку їхнього недотримання. Простежується динаміка зростання викидів парникових газів, що визначає важливість цієї Угоди. Основними емітентами парникових газів у світі є Китай, США, ЄС та Індія. Висвітлено деякі політичні аспекти Паризької угоди, зокрема рішення США вийти з Угоди. Від часу підписання угоди відбувся значний прогрес в узгодженні механізмів, процедур та інших практичних питань для забезпечення функціонування Паризької угоди. Було узгоджено питання фінансової прозорості, функціонування Адаптаційного фонду, визначено кількісні фінансові цілі. Попри те, що міжнародна торгівля має значний потенціал у боротьбі зі змінами клімату, на цьому етапі в рамках Паризької угоди ніяких конкретних торговельних заходів не передбачено, хоча імовірність таких заходів зазначено. ; The Paris Agreement came into force on November 4, 2016. Now already the third part of the first session of the Conference of the Parties serving as the meeting of the Parties to the Paris Agreement (CMA 1-3) has taken place in Katowice, Poland. The article analyses the main provisions of the Paris Agreement, the obligations assumed by the Parties to the Agreement and sanctions in case of non-compliance. Greenhouse gas emissions continue to grow and this fact determines the importance of the Agreement. The Paris Agreement has become a significant breakthrough after the Kyoto Protocol, which, given the limited number of participating countries, did not succeed in sufficiently reducing greenhouse gas emissions. However the Paris Agreement was signed by the major greenhouse gas emitters – China, the US, the European Union and India. Some political aspects of the Paris Agreement are highlighted, in particular, the US decision to withdraw from the Agreement. The peculiarity of the new agreement is the voluntary nature of nationally determined contributions. Nevertheless countries are obliged to inform about the measures taken to achieve them and increase the ambitiousness of their nationally determined contributions over time. The financial mechanism of the Convention will serve as the financial mechanism of the Paris Agreement, the contributions of the countries will be based on the United Nations scale. Developed countries are obliged to provide help to the developing countries. Since the Agreement was signed, significant progress has been made in settling mechanisms, procedures and other practical issues of the Paris Agreement functioning. The financial transparency issues, the Adaptation Fund functioning, and the quantitative financial objectives were agreed upon. At this stage under the Paris Agreement, no specific trade measures are defined although the probability of such measures is indicated. Parties to the Paris Agreement may, if they wish, pursue trade measures to reach their nationally determined contributions, but the mechanism is not defined. In general, trade can contribute to the achievement of Paris Agreement objectives by promoting the spread of "green" goods and technologies, by imposing restrictions on "dirty" goods, reducing economic losses through emission trading schemes, etc. In addition, trade can be an instrument of pressure on countries that set too low environmental targets or refuse to sign the Agreement. However, this issue remains yet unsettled.
The nature of RTA is discussed, which are not new for the international economic order. They have been subject to regulation within the General Agreement on Trade and Tariffs (GATT) and the General Agreement on Trade in Services (GATC) since the multilateral trade system was established in 1947. Yet, spread of RTS in the latest two decades has raised important problems related with evolution from non-discriminatory liberalization of trade towards bilateral and regional preferential (discriminatory) trade in frames of economic integration at free trade zone or customs union level. In the latest 15 years, regional trade agreements have become an instrument for neo-protectionism in the context of international trade liberalization. Potential effects of RTA as an instrument going contrary to the multilateral approach declared by the World Trade Organization (WTO) are analyzed. The occurring effects of "stowaway", demonstration and economy of scale help in evaluating RTA advantages and weaknesses from the perspective of economic security of a country. The increasing use of RTA, especially by the U.S. and the EU, may appear as an articulated neo-colonialist agenda, intended to impose and expand the spheres of their influence worldwide. However, it is argued that given the nature of RTA, they should be seen as a flexible tool for negotiations, combining various schemes under the disguise of trade liberalization, rather than a neo-colonialist instrument of influence. It is argued that RTA have been a tool for more privileged choice of trade policy by the U.S., the EU and many other countries, not only for taking prevalence over smaller partners, but also because they allow for more flexible control compared with the multilateral trade system of WTO. The problem of how correlation between the pace of competitive growth and the pace of liberalization could be secured triggers theoretical controversy between the advantages of trade on multilateral, regional and bilateral basis. The article puts emphasis on a kind of rivalry between multilateral and regional/bilateral patterns. It is argued that analysis of RTA signed by the U.S. and the EU may be a tacit evidence of their intention to alleviate other countries' influences on the area of their economic interests. Moreover, control of public purchases and regulation of intellectual property rights, which is a foremost concern for the U.S. and the EU, can be easily regulated at bilateral or regional level than at multilateral basis. Also, considering that RTA, by their legal origin, are exclusive preferential trade agreements between countries that sign them, an obvious point is striving for leadership when signing agreements at new markets, supposed to guarantee the primacy of leader's interests over others'. Such interpretation of RTA allows for assuming its singular role in seeking for economic security of a country. ; В статье рассматривается характер РТС, которые не являются новыми для международного экономического порядка. С момента создания многосторонней торговой системы в 1947 году, они регулировались в рамках Генерального соглашения по тарифам и торговле (ГАТТ) и Генерального соглашения по торговле услугами (ГАТС). Тем не менее, распространение РТС в последние два десятилетия поднимает актуальные вопросы о трансформации парадигмы от недискриминационной либерализации торговли в сторону двусторонней и региональной преференционной (дискриминационной) торговли в рамках экономической интеграции на уровне зон свободной торговли и таможенных союзов. Формирование региональных торговых соглашений за последние 15 лет стало инструментом нео-протекционизма в условиях либерализации международной торговли. В статье рассматриваются потенциальные эффекты РТУ как инструмента, противоречащего задекларированному в рамках СОТ многостороннему подходу. Возникающие при этом эффект безбилетника, демонстрационный эффект и эффект масштаба помогают оценить преимущества и недостатки РТУ с точки зрения достижения экономической безопасности страны. ; У статті розглядається характер РТС, які не є новими для міжнародного економічного порядку. З моменту створення багатосторонньої торговельної системи в 1947 році, вони регулювалися в рамках Генеральної угоди з тарифів і торгівлі (ГАТТ) та Генеральної угоди про торгівлю послугами (ГАТС). Водночас, поширення РТС в останні два десятиліття піднімає актуальні питання про трансформацію парадигми від недискримінаційній лібералізації торгівлі в бік двосторонньої та регіональної преференційної (дискримінаційної ) торгівлі в рамках економічної інтеграції на рівні зон вільної торгівлі та митних союзів. Формування регіональних торговельних угод за останні 15 років стало інструментом нео-протекціонізму в умовах лібералізації міжнародної торгівлі. У статті розглядаються потенційні ефекти РТУ як інструменту, що суперечить задекларованому в рамках СОТ багатостороннього підходу. Виникаючі при цьому ефект безбілетника, демонстраційний ефект і ефект масштабу допомагають оцінити переваги та недоліки РТУ з точки зору досягнення економічної безпеки країни.
The proper legal and regulatory framework for the operation of the Customs SFS is a prerequisite for the effective implementation of customs policy in Ukraine. Despite the constant evolution of customs legislation, the current Customs Code of Ukraine leaves insufficiently regulated aspects of the implementation of the customs business. Among other things, it concerns the legal regulation of the customs duty free trade regime, the activities of duty-free shops, which requires urgent improvement. Consequently, it became necessary to investigate in detail the main structural elements of the Customs Code of Ukraine in order to identify gaps and contradictions in legal regulation. The article describes the economic feasibility of the customs duty free trade regime in order to further study the problem. Also, a comparative analysis of some norms of the national legislation of Ukraine and the EU is conducted, which allowed to reveal certain differences in the application of customs regimes. In addition, some aspects of the legal regulation of the customs duty free trade regime and the activities of duty-free shops are discussed in the article. Chapter 22, Chapter 60 of the Articles 336, 341, 344 and 354 of Chapter 49 etc. of the Customs Code of Ukraine are analyzed for this purpose. The final part of the article refers to the existence of differences between customs and tax laws related to the subject of the study, namely: inconsistencies in the interpretation of measures of non-tariff regulation of foreign economic activity, as well as the definition of the term «duty-free shop», which does not contribute to the adoption of the principle of legal certainty regulatory and legal acts. On the basis of the study, it is found that solving problems with the duty-free customs regime and the activities of duty-free shops requires an integrated approach in order to balance the interests of business entities and the state in the formation of a new economic policy that is friendly to the business environment, in particular by making appropriate changes to the legal acts. ; Передумовою ефективної реалізації митної політики в Україні є належне нормативно-правове забезпечення діяльності митниць ДФС. Незважаючи на постійну еволюцію митного законодавства, чинний Митний кодекс України залишає недостатньо врегульованими окремі аспекти здійснення митної справи. Серед іншого, це стосується правового регламентування митного режиму безмитної торгівлі, діяльності магазинів безмитної торгівлі, що потребує нагального удосконалення. А отже, постала необхідність детально дослідити основні структурні елементи Митного кодексу України на предмет виявлення прогалин і протиріч правового регулювання. З метою глибшого вивчення проблеми у статті охарактеризована економічна доцільність митного режиму безмитної торгівлі. Також проведений порівняльний аналіз деяких норм національного законодавства України та ЄС, що дозволило виявити певні відмінності у застосуванні митних режимів. Крім цього, постатейно розглянуті деякі аспекти правового регулювання митного режиму безмитної торгівлі і діяльності магазинів безмитної торгівлі. З цією метою проаналізовано Глави 22, Глави 60, статей 336, 341, 344 і 354 Глави 49 тощо Митного кодексу України. У прикінцевій частині статті вказано на існування розбіжностей митного і податкового законодавства, пов'язаних з предметом дослідження, а саме: неузгодження у трактуванні заходів нетарифного регулювання зовнішньоекономічної діяльності, а також визначення терміну «магазин безмитної торгівлі», що не сприяє утвердженню принципу правової визначеності нормативно-правових актів. На підставі проведеного дослідження встановлено, що вирішення проблем щодо митного режиму безмитної торгівлі та діяльності магазинів безмитної торгівлі потребує комплексного підходу задля забезпечення балансу інтересів суб'єктів господарювання та держави під час формування нової економічної політики, дружньої до підприємницького середовища, зокрема шляхом внесення відповідних змін до нормативно-правових актів.
The legal regulation of the license agreement is considered. Its contractual construction is investigated. The norms of the Civil Code of Ukraine and other normative legal acts on determining the essential terms of the license agreement are analyzed and it is clarified, which conditions must be agreed by the parties in order for the license agreement to be considered concluded. The scientific analysis of the legal nature of the license agreement in the system of civil law agreements is carried out. The objective essential conditions and features of concluding a license agreement are revealed. The subject and terms of the contract are considered. The rights and responsibilities of the licensor and the licensee are analyzed. The advantages of each party of the contract are determined. The civil law aspects of regulation of contractual license relations are investigated. The legal nature of the license is determined. The classification of license agreements has been carried out. The analysis of the current legislation in the field of granting property rights to the results of intellectual activity is carried out. The essential conditions of the agreement on creation on the order and use of the object of intellectual property rights and the agreement on transfer of exclusive property rights of intellectual property are investigated. The relationship between the license and the license agreement has been clarified. Recommendations on the structure of license agreements and advice on their content and method of presentation are provided. Conclusions and proposals, aimed at improving civil legislation in the field of legal regulation of license agreements, are formulated. It is concluded, that the license agreement is a fair mechanism for obtaining remuneration for the creation or acquisition of intellectual property
The master's thesis examines the civil law regulation of the commission agreement as a type of service agreement. The genesis of the commission agreement, its concepts and features, parties, subject and other conditions of the agreement are investigated. The procedure for concluding and the dynamics of the commission agreement are analyzed. The basic rights and obligations of the parties under the commission agreement are defined. The issue of liability of the parties for breach of their obligations is considered. Based on the generalization of normative material, analysis of literature sources and materials of judicial practice, conclusions and recommendations for further improvement of civil legislation on the conclusion and implementation of the contract of the commission are formulated. ; У роботі досліджено цивільно-правове регулювання договору комісії як виду договору про надання послуг. Досліджено ґенезіс договору комісії, його поняття і ознаки, сторони, предмет та інші умови договору. Проаналізовані порядок укладення і динаміка договору комісії. Визначені основні права та обов'язки сторін за договором комісії. Розглянуто питання відповідальності сторін за порушення своїх обов'язків. На підставі узагальнення нормативного матеріалу, аналізу літературних джерел й матеріалів судової практики сформульовані висновки й рекомендації щодо подальшого вдосконалення цивільного законодавства з питань укладення й виконання договору комісії.
Introduction. Ukraine's membership in the world trade organization since 2008 certainly affected the development of foreign trade with regional trading groups like the EU and the custom Unions of Russia, Kazakhstan and Belarus. Despite the fact that the process of Ukraine's accession lasted for 8 years, the government of Ukraine prior to 2008 signed a number of agreements with the WTO, which are asymmetrical at all levels of the foreign trade regulation.Purpose of the study is the consideration of asymmetries of the General terms of agreements of Ukraine with the WTO and with the EU Association for agricultural and food products, the creation of scientific and practical recommendations for the development of foreign trade and increase exports of agricultural products in the conditions of modern integration processes.Results. In the article it is considered the estimation problem of influence of foreign trade agreement conditions of Ukraine with the WTO and the EU on prospects of agricultural goods production. It was determined that Ukraine within the framework of the WTO agreement adopted asymmetric obligations in respect of export of agro-industrial complex, which significantly limit the ability of domestic enterprises regarding the export of agricultural products to international markets.Conclusion. Thus it can be stated that the Agreement of Ukraine with the WTO and the the EU Association Agreement with Ukraine (including the Agreement on the FTA+ with the EU) creates certain imbalances in the levels of domestic market protection and foreign trade between Ukraine and the EU, which directly influence on the external trade, both in general and on foreign trade of the agricultural products of Ukraine, as a consequence, requires further analysis and study.
The article studies modern trade measures applied by national governments for the implementation of trade and economic policy in crisis and post-crisis conditions for the world trade development and defines the enlargement of trade barriers and intensification of protectionist tendencies of national trade and economic policies. The author proves that in terms of new economic reality restrictive measures in trade are frequently applied by both developed and developing countries. Non-tariff barriers and limitations impose more and more influence on market segmentation, which every negotiations seek to coordinate at both regional and multilateral levels. New mechanisms for cooperation should based on transparent mechanism for development of regional trade agreements in terms of multilateral trade system.
