The aim of this short paper is to show that the relations between Ukraine and Russia are extremely complex as they are built on a shared history, religion, language, and culture and they should not, therefore, be gauged by Western standards. Evaluating the current situation from a broader perspective, the fact that Ukraine plays a significant role in Russia's foreign policy needs to be emphasized. Ukraine is considered the key post-Soviet state, a significant "near abroad" country, whose position, potential, and geopolitical location are vital for the balance of power in both Eastern Europe and Europe in general. The research project aims at a synthetic examination of the current Russia-Ukraine war from the point of view of Ukraine striving for full independence, memory, and identity. Will the war of the brotherly nations wreck Russia's long-term policy towards Ukraine? Will the conflict ruin Russia's plans of post-Soviet space reintegration, whose pivot is set on Ukraine? Will the war stimulate Ukraine to deal with the issue of its identity, post-Soviet legacy, and collective memory?
Peace is conditioned by independence. This affirmation has its origin in Church's teaching. The independence of states is based on the subjective nature of nations and ultimately on the right to freedom enjoyed by all citizens. The development of political communities which is built upon the subjectivity their members can be achieved when the normative moral order is observed, most importantly the personal responsibility. The independence of nations fosters the international peace, especially taking into account the two state constituting factors: nation and power. The first one, namely the nation, shapes the spiritual element of the state. In order to promote the peace in the world, we must respect the national rights that include the right to recognition, sovereignty, autonomy, national culture and language as well as the integrated growth. The latter one, the power, is a necessary condition for the political communities to function and strive towards the common good. The political power which observes the normative moral order gives incentives and support for the citizens to progress and to introduce the principle of solidarity on the global scale. Therefore, it can be concluded that the national independence stimulates the peace on the national as well as the international level. ; Niepodległość jest warunkiem pokoju. Owa zasada ma swoje źródło w dokumentach nauczania społecznego Kościoła. Niepodległość poszczególnych państw jest ukonstytuowana na podmiotowości narodów, a ostatecznie – na prawie do wolności poszczególnych obywateli. Rozwój wspólnot politycznych, oparty na podmiotowości obywateli, jest możliwy przy zachowaniu obiektywnego porządku moralnego, ze szczególnym uwzględnieniem odpowiedzialności. Niezależność sądów i niezawisłość sędziów stanowią jedną z podstaw państwa prawnego, należącego do podstawowych wartości Unii Europejskiej. Do zasad państwa prawnego należy zasada trójpodziału władz, stanowiąca równocześnie istotną gwarancję niezależności władzy sądowniczej. Zasada podziału władz oznacza, że do wyłącznej kompetencji władzy sądowniczej należy sprawowanie wymiaru sprawiedliwości i organy innych władz nie mogą ingerować w wykonywanie funkcji orzeczniczych przez sądy. W państwach demokratycznych istnieje potrzeba gwarancji niezależności władzy sądowniczej na poziomie norm konstytucyjnych. Podstawową funkcją niezależności sądów i niezawisłości sędziów jest zapewnienie obywatelom prawa do sądu w rozumieniu art. 6 Konwencji o ochronie praw człowieka i podstawowych wolności oraz art. 45 Konstytucji RP. Z punktu widzenia prawa do sądu ważne jest istnienie związku między niezależnością sądów i niezawisłością sędziów a gwarancją bezstronności sądu oraz gwarancją do sprawiedliwego rozpoznania sprawy przez sąd. Niezależność sądów i niezawisłość sędziów są ściśle powiązane z zasadą odpowiedzialności władzy sądowniczej. ; The independence of the courts and the judiciary constitutes one of the foundations of the rule of law and is one of the basic values of the European Union. Judicial independence is also guaranteed by the principle of the separation of powers. According to this principle courts are the only competent body to execute judiciary powers and no other organs may be permitted to interfere in judicial decisions or their making. Democratic states must have the independence of the courts ensured in their constitutions. The basic function of judicial independence is ensuring citizens the right to a fair trial as provided in Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Article 45 of the Constitution of the Republic of Poland. From the point of view of the right to a fair trial the relationship between the independence of the courts and judicial independence on the one hand and the guarantee of the impartiality of the courts and of a fair trial on the other, is important. The independence of the courts and the judiciary is closely related to the principle of the responsibility of judicial authority.
The aim of the article is to analyze how the concept of sovereignty (the main theoretical category of this text) has been conceptualized/criticized/interpreted during the recent Scottish independence debate, which took place in the period preceding the independence referendum of 18 September 2014. This concept is closely related to the categories of independence and sovereign. The pronouncements on sovereignty present in the intellectual output of three groups are discussed: academics; politicians and political activists; and public intellectuals. An analysis of each type of discourse is produced with a concise partial conclusion, which in the final part are synthesized into a general thesis of the article. The majority of the discussed sources had been made public (i.e. published or presented) no earlier than in the Autumn of 2012. Among these sources there are non-fiction books (academic and essays), academic articles and presentations. This analysis has led to the following conclusions: sovereignty is perceived as relevant in the interdependent 21st century world, as states still remain capable (international pressures and cooperation notwithstanding) of shaping their internal and external policies. It is also generally accepted that the holder of sovereignty, especially in the Scottish case, is the Scottish nation. This assumption leads to calls for the reform of the British constitution, reconciling the existence of various sovereign nations in the United Kingdom, with the sovereignty of parliament. Celem badawczym artykułu jest przeanalizowanie, w jaki sposób pojęcie suwerenność (główna kategoria teoretyczna tekstu) było konceptualizowane / krytykowane/ interpretowane podczas niedawnej szkockiej debaty niepodległościowej, trwającej w okresie poprzedzającym referendum z dnia 18 września 2014 roku. Pojęcie to jest ściśle powiązane z kategoriami niepodległość oraz suweren. Analizie poddane zostały wypowiedzi na temat suwerenności sformułowane przez przedstawicieli trzech grup: badaczy, polityków i osób zaangażowanych w politykę oraz liderów opinii. Analiza poszczególnych typów dyskursów została zakończona zwięzłymi wnioskami cząstkowymi, które w części końcowej zostały ujednolicone, przyjmując postać zasadniczej tezy artykułu. Zdecydowana większość wykorzystanych źródeł została upubliczniona (tj. opublikowana lub wygłoszona) nie wcześniej niż jesienią 2012 roku. Wśród nich znajdują się druki zwarte (książki akademickie i eseistyczne), artykuły akademickie oraz teksty wystąpień. Podjęte badania przyniosły następujące wnioski: suwerenność zachowuje swe znaczenie w realiach gęstej globalizacji pierwszych dekad XXI wieku, gdyż państwa wciąż dysponują (niezależnie od konieczności współpracy międzynarodowej czy presji czynników zewnętrznych różnego typu) instrumentami umożliwiającymi kształtowanie ich polityki zewnętrznej i wewnętrznej. Szeroko akceptowane jest także twierdzenie wskazujące, że suwerenem w warunkach szkockich jest szkocki naród. To pociąga za sobą głosy opowiadające się za reformą brytyjskiego ustroju, godzącą zasadę suwerenności parlamentu z suwerennością poszczególnych brytyjskich narodów.
The aim of the article is to analyse the state control function over the activity of local self-governments in the field of their finances. The analysis is based on empirical data of the Regional Accounting Chambers (RACs), which is a special body created for control and supervision in the field of local government finances. Attention is paid to the question of financial independence of the local powers and how it is influenced by the state's external supervision. In this context both too strong and too weak control has negative consequences for prudent funds usage by local government. The research indicates a decrease in law infringement by local authorities in the financial sphere. However, there are still cases of inefficient and irrational budget usage by local powers, which does not contradict the law, yet exerts a negative impact on their financial independence and performance of public tasks. Possible solutions of the indicated problems are outlined at the end of the article.
The article aims at presenting basic problems of decision-making independence of an enterprise arising in connection with the present (instituted in 1982) economic reform which opened new and hitherto unknown possibilities for an enterprise to shape independently its own activity at short and long range. The considerations are laid in a historical background, helping to accentuate innovatory and progressive conceptions of the reform and to expose the facts of retaining or rejecting some solutions introduced by previous reforms. The starting point has been provided by the thesis about limied decision-making independence of an enterprise as long as the national economy functions under the conditions of socialized basic means of production and the active role of the central plan. However, the above does not settle explicitly the question of the range and types of independence; the latter may be shapd in various ways. Accepting fully an extensive, and as broad as possible, independence of an enterprise in current and developmental matters, the author carried out the detailed analysis of three main decision-making spheres: 1) the decisions concerning production and exploitation, 2) the decisions concerning supplies and sales, 3) the decisions concerning property and income. Ćwierćwiecze polskiej suwerenności – od upadku komunizmu – było sukcesem Polski zarówno w sferze przemian wewnętrznych, gospodarczych i politycznych, jak i sferze jej polityki zagranicznej i osiągniętej pozycji międzynarodowej. Osiągnięcia nie eliminują wyzwań. Żaden naród w żadnym momencie swego istnienia nie jest od nich wolny. Wśród wyzwań wewnętrznych, przed którymi stoi Polska, autor wymienia zapewnienie funkcjonalności systemu politycznego, europeizację Polski w sensie europejskich standardów życia społecznego oraz powstrzymanie zapaści demograficznej. Do europejskich wyzwań Polski autor zalicza przede wszystkim włączenie się do strefy euro, która staje się twardym rdzeniem integracji europejskiej. Ponadto ważna będzie jej aktywność na rzecz takiego kształtu instytucjonalnego i tożsamości UE, która zapewni jej witalność i zdolność do wpływania na jej otoczenie. Wreszcie, Polska musi zabiegać o europejski charakter Europy Wschodniej, która jest częścią jej historii i geopolitycznego sąsiedztwa. ; The twenty five years of sovereignty after the fall of the communist system has been Poland's success both in terms of internal, economic and political transformation as well as foreign policy and its role in international politics. These achievements, however, have not changed the fact that there is still much more to do. No nation, at no moment of existence is free from new challenges. The internal challenges that Poland must face today include ascertaining the functionality of the political system, further Europeanisation of Poland and implementation of European living standards, or taking necessary measures to prevent a demographic collapse. Among the externalchallenges, the joining of the Eurozone which is currently becoming the nucleus of European integration is of foremost priority. Poland will also have to play an active role in the shaping of the future identity of the European Union as an institution, and actively promote the European character of Eastern Europe as part of its history and consequence of its geopolitical location.
Ukraine, as a prominent republic of the Soviet Union, and - after disintegration of the USSR - a sovereign country playing a significant role in the geopolitics of the Central Eastern Europe, has been an important object of Polish journalists' interest. The analysis of the texts and comments in the Polish press between 1988 and 1994 about emancipation transformations in Ukraine and social, political and economic issues of this country in the first period of its independence leads to conclusion that the public discussion participants have had positive and corroborative attitude towards the emancipation of the Ukrainians. Providing opportunities and threats in achieving the actual and solid independence of that republic the commentators express their opinions carefully. As the main obstacles they stress the imperialist ambitions of Russia, the problem of maintaining the territorial integrity of the state, the economic crisis related to the collapse of the Soviet economy and the consequences of exercising power by the postSoviet party apparatus representatives. The publicists claim, the first period of Ukrainian's independence closed the conversion of Ukraine to the integration with Russia. ; Ukraina, jako ważna republika Związku Radzieckiego, a następnie niepodległe państwo odgrywające znaczną rolę w geopolityce regionu Europy Środkowo-Wschodniej, stanowiła istotny przedmiot zainteresowania polskich publicystów i komentatorów. Analiza tekstów publicystycznych oraz opinii ukazujących się w polskiej prasie między 1988 a 1994 r. na temat przemian emancypacyjnych na Ukrainie oraz problemów społecznych, politycznych i gospodarczych tego kraju w pierwszym okresie niepodległości pozwala stwierdzić, że uczestnicy publicznej debaty entuzjastycznie odnosili się do dążeń Ukraińców do utworzenia samodzielnego państwa. Trafnie diagnozując szanse i zagrożenia dla uzyskania przez tę republikę faktycznej niepodległości, formułowali ostrożne oceny na temat ostatecznego powodzenia planów utworzenia przez Ukraińców samodzielnego i demokratycznego państwa. Jako główne przeszkody wymieniali przede wszystkim imperialistyczne ambicje Rosji, problem zachowania integralności terytorialnej państwa, kryzys gospodarczy wynikający z krachu radzieckiej gospodarki, a także konsekwencje związane z utrzymaniem się przy władzy przedstawicieli postsowieckiej nomenklatury. Pierwszy okres niepodległości państwa zamknął w opinii publicystów zwrot Ukrainy w kierunku integracji z Rosją.
Polish national parishes of the Roman Catholic Church in the United States of North America were the most important institutions in exile in this country. The greatest development occurred during farmers' emigration from Poland's land (1870-1914). The first Polish parish was created in 1854 in Panna Maria in Texas. In 1870 there were 10 such parishes, and in 1910 over 500. Each parish had from over a dozen families to several tens of thousands of the faithful. In 1880 there were around 2 thousand faithful to one priest, and in 1910 – around 4 thousand. From 1870 onwards, there were two clashing trends attempting to unify American Poles: one (Polish Roman Catholic Union of America) strove to integrate social and political activity around church institutions (parishes, Catholic associations), the other one – Polish National Alliance, did it concentrating on national organizations. Both fractions trying to maintain the cultural integrity of Poles – the Republic of Poland's independence – were very popular with Polish clergy. In December 1912, the leaders of the largest Polish organizations established the National Defense Committee. On 8 June 1913, the Polish National Council was created, 2 October 1914 – the National Council and the National Defense Committee appointed the Central Polish Committee. After 1900 two political trends developed in Poland, and each of them sought support among American Poles. Both Roman Dmowski and Józef Piłsudski attempted to receive financial aid. In the mid-1913, Dmowski established the Polish National Committee, which was later transformed into the Polish National Department. Similarly, the Polish community in the USA, due to different attitudes to Poland's independence was divided into two fractions. The National Department shared Dmowski's views while the National Defense Committee shared Piłsudski's views. Ignacy Paderewski, who came to the United States in May 1915 tried to reconcile both parties. From 1 July 1917 onwards, he was formally authorized to represent the organization of the Polish community while talking to the authorities of the United States. American Poles, irrespective of their views, tried to achieve their goals by being active in various fields and striving to influence President Thomas W. Wilson. All efforts made by Ignacy Paderewski and the Polish National Committee based in Paris proved to be effective. Polish parishes became the basis for the recruitment to the Polish Army. In November 1917, 35 395 people declared their readiness to join the army. President Wilson gave in to the pressure of the Polish community, and on 8 January 1918, he issued the fourteen-point resolution, in which the 13th point of the peace program devoted to Poland stated that: 'An independent Polish state should be erected(…)which should be assured a free and secure access to the sea.' ; Polskie parafie narodowościowe Kościoła rzymskokatolickiego w Stanach Zjednoczonych Północnej Ameryki były najważniejszą instytucją wychodźstwa polskiego w tym kraju. Największy ich rozwój nastąpił w czasie emigracji chłopskiej z ziem polskich (1870-1914). Pierwsza polska parafia powstała w r. 1854 w Pannie Marii w Teksasie. W r. 1870 takich parafii było ok. 10, w r. 1910 ponad 500. Wielkość tworzonych parafii wahała się od kilkunastu rodzin do kilkudziesięciu tys. wiernych. Na jednego duszpasterza w 1880 r. przypadało ok. 2 tys. wiernych, w 1910 r. - ok. 4 tys. Od 1870 r. wśród Polonii amerykańskiej ścierały się dwa kierunki starające się jednoczyć Polaków amerykańskich: jeden (Zjednoczenie Polskie Rzymsko Katolickie) dążyło do zintegrowania działań społeczno-politycznych wokół ośrodków kościelnych (parafii, towarzystw katolickich), drugi - Związek Narodowy Polski robił to w oparciu o organizacje narodowe. Obydwa odłamy dążąc do zachowania integralności kulturowej rodaków, ze względu na cel nadrzędy - niepodległość Rzeczpospolitej - cieszyły się poparciem polskiego duchowieństwa. W grudniu 1912 r. przywódcy największych polskich organizacji utworzyli Komitet Obrony Narodowej. 8 czerwca 1913 r. powołano Polską Radę Narodową. 2 października 1914 r. - Rada Narodowa i Komitet Obrony Narodowej powołały Centralny Komitet Polski. Po r. 1900 rozwinęły się w Polsce dwa zasadnicze nurty polityczne, z których każdy szukał poparcia wśród Polaków amerykańskich. Zarówno Roman Dmowski, jak i Józef Piłsudski zabiegali o ich wsparcie finansowe. W połowie r. 1913 Dmowski założył Komitet Narodowy Polski, który później przemianowany został na Wydział Narodowy Polski. Podobnie Polonia amerykańska ze względu na różnicę poglądów co do sprawy niepodległości Polski podzielona była na dwa zasadnicze odłamy. Wydział Narodowy podzielał pogląd Dmowskiego. Komitet Obrony Narodowej podzielał pogląd Piłsudskiego. Zwaśnionych od maja 1915 r. próbował godzić przybyły do Stanów Zjednoczonych Ignacy Paderewski. Od 1 lipca 1917 r. legitymował się on formalnym pełnomocnictwem liczących się w strukturze Polonii organizacji do reprezentowania ich wobec władz Stanów Zjednoczonych. Polacy amerykańscy bez względu na przekonania, starali się osiągnąć swoje cele poprzez rozwijanie aktywności na wielu płaszczyznach, usiłując wpłynąć na prezydenta Thomasa W. Wilsona. Skuteczne okazały się wysiłki podjęte przez Ignacego Jana Paderewskiego i Komitet Narodowy Polski z siedzibą w Paryżu. Polskie parafie stały się podstawą akcji rekrutacyjnej do Armii Polskiej. W listopadzie 1917 r. gotowość do wstąpienia do Armii Polskiej we Francji zgłosiło 35 395 osób. Prezydent Wilson ulegając presji Polonii, 8 stycznia 1918 r. sformułował czternastopunktową rezolucję, w której trzynasty punkt programu pokojowego poświęcił Polsce, stwierdzając, iż: "ma być utworzone niepodległe państwo polskie z wolnym dostępem do morza".
Celem niniejszego artykułu było ujęcie referendum niepodległościowego w ramach obecnych w nauce definicji i typologii oraz ukazanie głównych wątpliwości dotyczących politologicznych uwarunkowań oraz funkcji referendum niepodległościowego. Referendum niepodległościowe w większości przypadków uchodzi za szczególny instrument demokracji bezpośredniej i kluczowy etap procesu uzyskiwania własnej państwowości przez ruchy etnoregionalistyczne. Należy je zdefiniować jako głosowanie o charakterze powszechnym, w którym obywatele danego terytorium posiadający czynne prawo wyborcze mogą zadeklarować wolę utworzenia nowego państwa poprzez secesję. Referendum niepodległościowe jest pojęciem, w odniesieniu do którego widoczna jest istotna dysproporcja między liczbą badań empirycznych w formie studium przypadku a liczbą studiów o bardziej generalnym charakterze i teoretycznych ambicjach. Kluczowe problemy dotyczące analizy tej kategorii referendów to: określenie procedury referendum – sposobu inicjacji, warunków wstępnych, osób uprawnionych, treści pytania czy interpretacji wyników. Pamiętać należy o możliwości ustrojowego umocowania instytucji referendum, choć jej realizacja podlega wpływowi czynników bieżących oraz taktycznych decyzji politycznych aktorów, tak jak zwykłe głosowania powszechne. ; The aim of this article was to present the referendum on independence within the framework of the current definitions and typologies of referendum, and to present the main doubts concerning the political conditions and the function of the independence referendum. The referendum on independence in most cases is considered to be a particular instrument of direct democracy and a key step in the process of gaining statehood by the ethno-regional movements. Such a type of referendum should be defined as popular vote in which citizens (with voting rights) of a certain territory may declare their will to establish a new state through secession. The independence referendum is a concept in relation to which there is a significant disproportion between the number of empirical studies in the form of a case study and the number of studies of more general character and theoretical ambitions. The key issues concerning the analysis of this category of referenda are: the referendum procedure - the way of referendum initiative, the preconditions, the persons entitled, the content of the question or the interpretation of the results. It is important to remember about the possibility of a constitutional regulations of referendum, although its implementation is influenced by current factors and tactical political decisions by actors, just like ordinary public votes.
Celem niniejszego artykułu było ujęcie referendum niepodległościowego w ramach obecnych w nauce definicji i typologii oraz ukazanie głównych wątpliwości dotyczących politologicznych uwarunkowań oraz funkcji referendum niepodległościowego. Referendum niepodległościowe w większości przypadków uchodzi za szczególny instrument demokracji bezpośredniej i kluczowy etap procesu uzyskiwania własnej państwowości przez ruchy etnoregionalistyczne. Należy je zdefiniować jako głosowanie o charakterze powszechnym, w którym obywatele danego terytorium posiadający czynne prawo wyborcze mogą zadeklarować wolę utworzenia nowego państwa poprzez secesję. Referendum niepodległościowe jest pojęciem, w odniesieniu do którego widoczna jest istotna dysproporcja między liczbą badań empirycznych w formie studium przypadku a liczbą studiów o bardziej generalnym charakterze i teoretycznych ambicjach. Kluczowe problemy dotyczące analizy tej kategorii referendów to: określenie procedury referendum – sposobu inicjacji, warunków wstępnych, osób uprawnionych, treści pytania czy interpretacji wyników. Pamiętać należy o możliwości ustrojowego umocowania instytucji referendum, choć jej realizacja podlega wpływowi czynników bieżących oraz taktycznych decyzji politycznych aktorów, tak jak zwykłe głosowania powszechne. ; The aim of this article was to present the referendum on independence within the framework of the current definitions and typologies of referendum, and to present the main doubts concerning the political conditions and the function of the independence referendum. The referendum on independence in most cases is considered to be a particular instrument of direct democracy and a key step in the process of gaining statehood by the ethno-regional movements. Such a type of referendum should be defined as popular vote in which citizens (with voting rights) of a certain territory may declare their will to establish a new state through secession. The independence referendum is a concept in relation to which there is a significant disproportion between the number of empirical studies in the form of a case study and the number of studies of more general character and theoretical ambitions. The key issues concerning the analysis of this category of referenda are: the referendum procedure - the way of referendum initiative, the preconditions, the persons entitled, the content of the question or the interpretation of the results. It is important to remember about the possibility of a constitutional regulations of referendum, although its implementation is influenced by current factors and tactical political decisions by actors, just like ordinary public votes.
Wszystkie państwa członkowskie Unii Europejskiej zostały zobligowane przez Traktat ustanawiający Wspólnotę Europejską oraz Protokół w sprawie Statutu Europejskiego Systemu Banków Centralnych i Europejskiego Banku Centralnego do zapewnienia swoim bankom centralnym wysokiego poziomu niezależności oraz wprowadzenia zakazu bezpośredniego finansowania sektora publicznego przez banki centralne. Osiągniecie standardów nakreślonych przez prawo unijne w tym zakresie jest także jednym z warunków, które, przed dniem akcesji, muszą spełnić kraje kandydujące do członkostwa w Wspólnotach Europejskich. Bułgaria, Rumunia i Chorwacja osiągnęły już wysoki poziom zbieżności swojego prawa z wymogami stawianymi przez Unię Europejską. Zakres niezbędnych zmian w zakresie regulacji dotyczących banków centralnych jest nieduży i łatwy do przeprowadzenia. Zupełnie inaczej, mimo podjęcia pierwszych reform, przedstawia się sytuacja Turcji. Niezależności banku centralnego tego kraju wymaga wzmocnienia niemal we wszystkich aspektach. ; After the enlargement of the European Union to ten new Member States on 1 May 2004, they are four candidate countries: Bulgaria, Romania, Croatia and Turkey. In order to join the Union, they need to fulfil the economical and political conditions known as the Copenhagen criteria. Especially, the candidate States must adopt the common rules, standards and policies that make up the body of European Union law. European Union legislation on Economic and Monetary Union (EMU) contains specific rules requiring the independence of central banks in Member States and prohibiting direct financing of public sector by the central banks. These rules must have been implemented by the date of accession. Bulgaria, Romania and Croatia have taken major steps forward and have achieved a high level of alignment with the EMU-related acquis. However, some aspects of legislation on central bank independence need to be further corrected. Turkey's overall alignment concerning the EMU acquis is limited. The independence of the central bank should be further strengthened, particularly on the determination of the inflation target, on in the area of personal and institutional independence.
