This paper attempts to find a much-needed balance between data protection rights and trade secret rights on customer information in the European Union framework. Our analysis proposes a "shared management" of secret data between businesses and customers based on an operation of de-contextualization of customer databases. Several rights are in conflict in these two legal domains. For instance, the right to access to personal data and the new proposed right to "data portability" conflict with the interests of trade secret holders. What is even more problematic is that both analyzed legal frameworks are more and more based on a "proprietary" approach to data: they are both a form of abstract "monopoly". In a first step we analyze, in comparison with USA law, when and how the scope of data protection and trade secret protection coincide in practice, according to the proposed EU reforms in the field. As illustrated by literature, balancing rules in these two frameworks are vague and schizophrenic. However, from a literal interpretation of the analyzed it is possible to understand a "favor" for data protection rights. In analyzing the apparent favor to personality rights compared to other (e.g., economic) rights we investigate (both in USA and selected European states) trade secrets in the perspective of personality rights and data protection rights. As a result of our study we propose a change in perspective from the contrast between customers and businesses, to the conflict between customers and businessmen that enables us to verify whether and when personality rights of data subjects affect the above-mentioned personality rights of businessman in practice. the paper proposes to "decontextualize" secret data so that customers can access only data strictly related to their biographical information while trade secret holders can be free not to disclose the output of their data processing (behavior evaluation, forecast, studies on life expectancy, personalized marketing plan, pricing, etc.) if disclosure can adversely affect their interests. In this framework the "proprietary" approach of European laws must be caught as an opportunity, not as an obstacle: we can consider secret data as a "shared good" of customers and businessmen. A multi-level management of data should be based on interests that are common to customers and trade secret holders (secrecy and data updating).

Edward Said was a versatile intellectual, anchored in a solid humanistic culture, who, in his career as a public figure as a university Professor at Columbia (N.Y.), placed at the center of his reflections the sense of commitment of the man of culture. His multifaceted education and his interests (from literature to politics, to music, up to the problems of teaching) are the summit of an attention to the generative issues of pedagogical and educational culture, aimed at redefining a new "radical humanism." For Said, however, the commitment and careful examination of texts and reality can only pass through an effort of critical thinking, capable of acquiring its own autonomy of judgment and, for this reason, point out and highlight the differences of all forms of power and coercion. ; Edward Said è stato un intellettuale poliedrico, ancorato ad una solida cultura umanistica, che, nel suo percorso di figura pubblica e di docente universitario presso la Columbia University, ha posto al centro delle sue riflessioni il senso dell'impegno dell'uomo di cultura. La sua formazione poliedrica e i suoi interessi (dalla letteratura alla politica, alla musica, fino alle problematiche dell'insegnamento) sono il vertice di un'attenzione alle problematiche generative della cultura pedagogica ed educativa, volte alla ridefinizione di un nuovo "umanesimo radicale". Per Said, tuttavia, l'impegno e la disamina attenta dei testi e della realtà non può che passare attraverso uno sforzo del pensiero critico, capace di acquisire una propria autonomia di giudizio e, per questo, segnalare ed evidenziare le difformità di ogni forma di potere e di coercizione.

Intellectual freedom has a continual implementation at library, particularly in collection development.This article first examines intellectual freedom and censorship in some statements of IFLA, of few European library associations and, last, of ALA. The ALA's tools to defend intellectual freedom are then analyzed, focusing in particular, compliant to the specific ALA "manual", on collections development and selection policies and on resources reconsideration procedure, as tools for prevention and defense policies against challenges to intellectual freedom in library. Then this article explains the main types of censorship concerning library collections, including the self-censorship, also called "silent censorship", its characteristics and strategies against it; furthermore this paper deals with a particular type of commercial pressure in the process of selection, with the risk of overlapping collections. Finally, this article exposes the position of Michael Gorman in relation to intellectual freedom, reaffirming again: intellectual freedom is a value also for collections development and selection. ; La libertà intellettuale ha una continua applicazione in biblioteca, particolarmente nell'ambito dello sviluppo delle collezioni. Questo articolo in primo luogo esamina la libertà intellettuale e la censura nelle dichiarazioni dell'IFLA, di alcune associazioni bibliotecarie europee e, infine, dell'ALA. Quindi vengono analizzati gli strumenti dell'ALA a difesa della libertà intellettuale, soffermandosi in particolare, seguendo lo specifico "manuale" dell'ALA, sulle politiche di sviluppo e di selezione delle collezioni e sulla procedura di riconsiderazione dei materiali, in quanto policies fondamentali a prevenzione e difesa dagli eventuali attacchi alla libertà intellettuale in biblioteca. Vengono poi esaminate le principali tipologie di censura che riguardano le collezioni delle biblioteche ed anche l'autocensura, detta anche "censura sileziosa", le sue caratteristiche e le strategie di difesa, e si fa riferimento ad un particolare tipo di pressione commerciale nel processo di selezione, tendente all'omologazione delle collezioni. Infine viene presa in considerazione la posizione di Micheal Gorman relativamente alla libertà intellettuale, riaffermando ancora la libertà intellettuale come un valore anche per la selezione e lo sviluppo delle collezioni.

L'elaborato si occupa della disciplina penalistica dei diritti di proprietà intellettuale, analizzando la vasta e stratificata legislazione in materia di marchi, denominazioni d'origine, Made in Italy e diritto d'autore. Alla luce delle trasformazioni dei fenomeni contraffattivi e in ossequio al principio di sussidiarietà lo studio si propone di vagliare l'efficacia delle molteplici misure di carattere repressivo recentemente introdotte in un ambito soggetto ad intense spinte di criminalizzazione, promuovendo altresì una maggiore razionalità dell'intervento punitivo unitamente ad una più spiccata sensibilità tanto sui confini dei comportamenti penalmente rilevanti, tanto sulla prevedibilità delle decisioni giudiziarie. Tra le research questions del lavoro si pongono anche la necessità di verificare l'esistenza di uno statuto penale degli Internet Service Provider, nonché la valutazione della posizione del singolo consumatore/acquirente grazie a un approccio "giurisprudenziale" e casistico. Un ampio interesse è inoltre dedicato alla comprensione dei modelli di common law e in particolare del diritto federale statunitense favorendo un'analisi comparatistica e orientata alle fonti sovranazionali oramai ineludibile, specialmente nella materia in esame. ; The paper deals with the criminal regulation of intellectual property rights, analyzing the huge and layered legislation on trademarks, appellations of origin, "made in Italy" and copyright. Having considered the transformations of counterfeiting phenomena and in accordance with the principle of subsidiarity, the study aims to investigate the effectiveness of various repressive measures recently introduced in an area subject to intense pressures of criminalization, in order to encourage greater rationality in punitive intervention together with a more marked sensibility on the predictability of judicial decisions. Among the research questions of the work, and thanks to a 'case law' approach, there are: the need to verify the existence of a criminal statute of Internet Service Providers, as well as an evaluation of the individual consumer / buyer position. A broad space is also devoted to the understanding of the common law models and in particular the US federal law encouraging comparative analysis between Italian and European standards.

Under Nero Roman society faced the First Imperial Crisis: the consequence of an unprecedented power and welfare, which was mainly due to the lack of clear political and cultural guidelines after Augustus' death. Instead of convenientia, or πρέπον, intellectuals privileged novitas and exhibitionism, thereby creating the poetics of the awesome. The more the imperial power went assuming absolutistic and despotic connotations, the less the intellectual's social role and contribution seemed to be worthy of consideration. Therefore, intellectuals suggested a new concept of the man of letters. They focused on the psychological aspects of the human behavior, as in Seneca's case. The possible alternative, consciously adopted by Lucan in Pharsalia, was to commit oneself to a macabre and slander gender of poetry: the expression of a common condition of mind weakness. In this regard, Lucan's stylistic solutions are worth of consideration: via his modus scribendi ardens and concitatus, Lucan expressed his tragic view of reality and diverted from the Roman literary tradition, which lent little space to irrationality. Under Nero there was a revival of philosophical interests, but the traditional philosophies looked not to be any more believable. The persistence of crisis led intellectuals first to passively accept the status quo, then to proudly estrange from the public scenes. Consequentemente, os intelectuais sugeriram um novo conceito de homem de letras, concentrando-se nos aspectos psicológicos do comportamento humano, como é o caso de Sêneca. A alternativa possível, conscientemente adotada por Lucano na Farsália, foi empenhar-se num gênero de poesia macabro e difamatório: a expressão de uma condição comum de fraqueza mental. Nesse sentido, as soluções estilísticas de Lucano são dignas de consideração: por meio de seu modus scribendi ardens e concitatus, Lucano expressou sua visão trágica da realidade e se desviou da tradição literária romana, que concedia pouco espaço para a irracionalidade. Sob Nero, houve uma renovação do interesse filosófico, mas já não parecia possível acreditar nas filosofias tradicionais. A persistência da crise levou os intelectuais de início a aceitar passivamente o status quo, mas depois passaram a se afastar dignamente da cena pública. Os hexâmetros de Pérsio nas Sátiras são emblemáticos a esse respeito.

Come furono percepiti e commentati, dai collaboratori del settimanale londinese The New Age, gli avvenimenti che interessarono l'Impero Ottomano e i suoi possedimenti europei, nel periodo compreso tra la rivoluzione dei Giovani Turchi (estate 1908) e l'estate del 1914? Quali furono le principali posizioni che emersero tra gli intellettuali britannici? In quale misura tali posizioni rappresentavano il pensiero del resto dei sudditi di sua maestà? Ma soprattutto in quale maniera è possibile legare le opinioni e i pensieri degli intellettuali britannici - che prenderemo in esame - con il più ampio e complesso sistema dell'identità culturale? In altre parole, attraverso quali strumenti e categorie concettuali si è strutturata l'identità britannica negli anni immediatamente precedenti il deflagrare della prima guerra mondiale? L'obiettivo del presente lavoro è quello di dare risposta ai quesiti appena elencati. Si è deciso di prendere come punto di riferimento, nell'analisi della società britannica, lo studio del settimanale The New Age per una serie di fattori interdipendenti. In primo luogo perché nonostante abbia ricoperto un ruolo «importante all'interno del panorama politico e culturale britannico pre-guerra» sono stati pochi gli studi storici che lo hanno preso in considerazione in virtù, a detta dello storico dell'economia John Finlay, del fatto che si tratta una rivista «troppo difficile da classificare». La natura eterogenea della rivista può presentare dei rischi nel riuscire a giungere al necessario grado di generalizzazione teorica. Tuttavia, se adottate le dovute precauzioni metodologiche, credo che offra la possibilità di fare emergere con chiarezza tutta la complessità e la molteplicità delle visioni politiche, ideologiche e culturali della società edoardiana e dei suoi osservatori. Per quanto riguarda l'analisi dell'identità culturale il punto di partenza risiede nella convinzione che non si possono comprendere appieno i discorsi strutturanti l'identità culturale limitandosi ad analizzare solo quelli prodotti all'interno della comunità, per quanto eterogenea e sfaccettata essa sia. Di conseguenza appare indispensabile studiare i processi e i discorsi fondanti la costituzione identitaria passando anche attraverso l'incontro/scontro con l'alterità. Con ciò che è distante fisicamente, geograficamente e - soprattutto - culturalmente. Si tratterà, in conclusione, di favorire una visione olistica della società attraverso una descrizione storica che tenda a privilegiare le sfumature, e i punti di contatto, tra i diversi elementi costitutivi della società; piuttosto che considerare ciascun aspetto come un unicum a sé stante slegato dal resto

Situated between Aosta and Turin, this small rural town had little industry when, in the early twentieth century, his father Camillo Olivetti founded a typewriters' factory. Camillo was a socialist of Jewish origin, whose wife was Waldensian, and his son was educated in religious freedom and would become a Catholic. As an engineering student, Adriano Olivetti supported the principles of autonomy and of federalist socialism, before focusing on scientific management which he had observed in the USA. In the early '30s he became the director of the company, where he inaugurated the scientific management of mass production. He subsequently noticed that the modernization of industry, conceived as the only means to generalize the well-being, generated serious social and urban problems. As a result, as the company grew larger and conquered foreign markets, he coordinated an urban plan of the Val d'Aosta. Public policies on libraries and copyright are aimed at fostering knowledge and protecting everyone's freedom of expression. However, in the digital environment, copyright policies acquired a major role on library services resulting in severe constraints to their normal operation. While EU strategies in support of libraries are mainly based on incentives and non-binding recommendations, exclusive intellectual exploitation rights are very strictly regulated, with the result of preventing the natural spread of knowledge both at a national and international level. As a consequence of these policies, libraries today face complex negotiations to get licence agreements often inadequate to their mission.The paper points out the major problems to be solved, and clarifies the reasons behind the reforms that have been proposed in WIPO and in the European Union in order to harmonize, expand and strengthen the limitations and exceptions to copyright: to promote access to cultural and creative content and foster the production of new knowledge. ; Nell'ottica dei diritti fondamentali, le politiche pubbliche in materia di biblioteche e di diritto d'autore rispondono a finalità di promozione culturale e di tutela della libertà di manifestazione del pensiero. In ambiente digitale, i diritti di privativa hanno però assunto un peso preponderante sui servizi bibliotecari, determinando forti condizionamenti al loro normale esercizio. Mentre le strategie dell'Unione Europea a sostegno delle biblioteche, confidando nella capacità di autoregolazione del mercato, si basano prevalentemente su incentivi e raccomandazioni non vincolanti, i diritti esclusivi di utilizzazione economica di autori e loro aventi causa fanno leva da decenni su una produzione normativa intensa e incessante che ha finito per condizionare pesantemente la diffusione della conoscenza a livello nazionale, europeo e internazionale. Per effetto di queste politiche le biblioteche oggi devono affrontare complesse negoziazioni per ottenere contratti di licenza d'uso spesso non soddisfacenti in rapporto alla loro missione di servizio.L'articolo evidenzia le principali criticità da risolvere e le ragioni a sostegno delle riforme che sono state proposte – sia in ambito OMPI sia nell'Unione Europea – al fine di armonizzare, ampliare e rafforzare il sistema delle «eccezioni e limitazioni» al diritto d'autore, in modo da garantire un accesso più ampio possibile alla produzione culturale e incoraggiare la produzione di nuova conoscenza favorendo il confronto culturale e creativo.

Le associazioni sorte dopo la seconda Guerra mondiale erano state fondate per creare legami tra intellettuali e promuovere la discussioni intorno alla loro funzione nella società. Lo studio investiga le ragioni che hanno condotto alla fondazione di queste associazioni e analizza la percezione che gli intellettuali avevano del proprio ruolo e degli strumenti adatti al loro compito civile. La Société européenne de culture (SEC), fondata da Umberto Campagnolo nel 1950, è stata scelta come caso di studio. La tesi di dottorato è divisa in un'introduzione metodologica, in una storia dell'organizzazione culturale tra la fine dell'Ottocento e la seconda guerra mondiale e nell'analisi del caso di studio. L'indagine prende le mosse da una prospettiva transnazionale e comparativa, facendo un uso critico della metodologia introdotta da Pierre Bourdieu e Gisèle Sapiro. È stato compiuto uno spoglio approfondito su riviste culturali e su rilevante materiale archivistico. Campagnolo concepiva la cultura come creazione di valori: in quanto responsabili della concezione di idee e simboli, gli intellettuali avrebbero dovuto mantenere l'autonomia nel campo letterario. Era proprio nel dualismo tra autonomia ed eteronomia che si può rintracciare l'originalità della SEC. L'associazione fu fondata nella convinzione che gli intellettuali avrebbero guadagnato influenza nella società solamente unendo le loro forze, sebbene spettasse al singolo impegnarsi in prima persona. Il compito della SEC è stato definito 'metafisico', in quanto legato allo spirito che avrebbe dovuto accompagnare ogni azione culturale. Si è dedotto che la SEC e il Congress for cultural freedom (CCF) non erano in competizione per motivi politici. La SEC, infatti, intendeva salvaguardare l'autonomia delle relazioni intellettuali, mentre il CCF sosteneva l'eteronomia, utilizzando arte e letteratura per un preciso scopo politico. Il contrasto tra le due istituzioni era quindi dovuto alla diversa concezione che gli intellettuali avevano del proprio ruolo. Per questo motivo ...

Pasolini departs from the diagnosis of a problem: the critical quest stage in contemporary literature, centered on the 1950s; he points out the author´s inability to create the design for a national language. He goes on to analyze the deep mutation in Italian Society, which determineted a new socio-linguistic outlook; to wit, a language clearly marked by strong technicality and instrumentation. Drawing examples from newspapers, TV features, official political speeches and commercials, Pasolini demonstrates that factual communication takes precedence over formal expression. This is ascribed to one principle which sets both rules and approvals for all forms of national language. This fact, according to Pasolini, is the result of an industrial and technological transformation process, which would permite advent of a new linguistic bourgeoisie.
