Regionalizacija slovenije -- izzivi in dileme

The regionalization of Slovenia implies that it is about a demanding professional & political project, which is expected to be completed in 2008 by establishing the regions. The beginning of their functioning is planned as from 1 January 2009. In order to provide this process, some constitutional amendments were introduced in 2006 The regional legislation with its associated implementing regulations should implement them. The bills on regions, their financing, regional elections & establishment of regions (these bills are already being discussed in the National Assembly of the Republic of Slovenia) are a touchstone for introduction of regions & for a successful beginning of their functioning. There is a variety of challenges & dilemmas regarding regional competences & the number of regions, own tax resources, regional authority organization & other issues. Very few international standards & good local & regional self-government principles are adhered to in Slovenia. For this reason, some criticism has come from the Council of Europe & the European Union. Although regionalization is an internal matter of the states concerned, the European principles regarding the objectives of regionalization, division & sharing of powers between levels of government, the scope of regional self-government, sharing of tax revenues & public finance, the connection between the regionalization processes & European & world processes, etc. cannot be avoided. Zmožnosti artikulacije interesa kot predpostavka demokratične vladavine: pravnosociološka analiza ; The ability to articulate interest as a prerequisite for the democratic rule: a socio-legal analysis
Cilj magistrske naloge je prikaz manifestacije družbene moči skozi pravo, specifično v demokratičnih procesih ; demokracija je temelj razvitih družb ter točka, iz katere naj bi dandanes izviralo vso pravo, zato sem se osredotočila nanjo kot na izvor razlikovanja posameznikov na podlagi sposobnosti (abstraktne) artikulacije interesa v volilnih procesih. Obstajajo namreč določene skupine bitij, ki niso sposobne artikulirati svojega interesa abstraktno, na način, ki je značilen za današnje institucionalizirane volilne procese, zato so iz njih izključene. V tej nalogi sem se osredotočila na primere otrok, mentalno manj sposobnih posameznikov in nekaterih drugih subjektov, katerih interes se ne upošteva na enaki ravni kot interes drugih. Demokracija kot vladavina ljudstva se po mojem mnenju dandanes sprevrača v vladavino tistih, ki imajo golo fizično ter mentalno sposobnost oditi na volišče, brati, pisati, in abstrahirano, torej ne konkretno, izraziti svoj interes ; ne gre torej za vladavino, utemeljeno na ideji temeljne enakosti oziroma neizpodbojno jasnih ter enakovrednih interesov, temveč za vladavino tistih, ki so sposobni artikulirano ter dejavno delovati v družbi, ter zahtevati uveljavitev svojih interesov. Gre torej za neke vrste procesno, ne materialno enakost, zaradi katere tisti, ki niso sposobni artikulacije interesov v družbi, postanejo objekti prava. Ogledala sem si različne poglede na demokracijo, predpise, ki urejajo položaje omenjenih skupin, ter vprašanje (objektivnega ter subjektivnega) interesa, ki je ključno za mojo tezo, saj idejo obstoja diskriminacije utemeljujem na podlagi konkretnega interesa napram abstraktnemu. Poudarjam pa, da gre za pravno-sociološko, ne za primarno filozofsko delo, ki skuša torej zgolj naslikati dejanskost družbe in prava, ne pa ju tudi predpisovati. ; The goal of this paper is to showcase the manifestation of power within a society, specifically in democratic processes ; democracy is the foundation of developed societies and the supposed source of all of today's law, which is why I focused on it as the source of discrimination of individuals based on their ability to abstractly articulate their interest in voting processes. There are certain groups of people who are incapable of abstractly articulating their interest, in a way which is typical of today's institutionalised voting processes, which is why they are excluded from them ; I have focused on children and mentally handicapped individuals, who's interest isn't taken into account as much as other people's is. Democracy as the rule of the people is in my opinion now turning into the rule of those who have the mere physical and mental capacity to go to a voting booth, write and read, and abstractly (as opposed to concretely), formulate their interest ; it is therefore not a rule based on an idea of fundamental equality or clear and equal interests, but a rule of those who are capable of functioning in a society in an articulate and active way, and demand that their interests are enforced. It is therefore a procedural, not a material equality, because those who aren't capable of (abstractly) articulating their interests in this society become an object of the law. I have examined different views of democracy, regulation which deals with the status of the before mentioned groups, and the question of interest, which is crucial for my thesis, because I base my idea of the existence of discrimination on concrete interest versus the abstract one. I would like to point out that this is a legally-sociological, not a philosophical work, which therefore primarily tries only to paint the reality of society and law, not to prescribe them.

The discussion about the establishment of regions has been going on in Slovenia for some years. In addition, the regional legislation package has been in the parliamentary procedure for quite some time, too. The purpose of this paper is neither to analyze the proposed legislation nor to provide a detailed list of all the solutions the legislation can bring in. The real purpose of this paper is to analyze various existing regional divisions in the fields of the state administration, general public services & civil society. Some of these regional divisions are supposed to be adapted (according to the regional tasks presented in the legislative proposal) to the proposed dividing the country into fourteen regions. It interests us how the regionalization, taken into consideration by various institutions of the state administration, broader public sector & civil social organizations, complies with the proposals made in attempts to introduce a broader level of local self-government. Besides, we would also like to ascertain whether in already existing regional divisions in Slovenia there might be the predominant solution that could be the basis for the future dividing Slovenia into regions. Vse od snovanja Ustanovne listine Organizacije združenih narodov (OZN) je bilo sodelovanje med OZN in regionalnimi organizacijami predmet različnih razprav. Razprava med univerzalizmom in regionalizmom je bila, vsaj za nekaj časa, rešena v obliki VII. in VIII. poglavja Ustanovne listine OZN. Rezultat tega je bila primarna vloga Varnostnega sveta pri odzivih na vprašanja mednarodnega miru in varnosti. A razvoj dogodkov na tem področju zahteva vedno večjo vključenost regionalnih organizacij. Magistrsko delo je bilo osredotočeno na potencial, ki ga ima mehanizem hibridnih mirovnih misij na nadaljnje sodelovanje med OZN in regionalnimi organizacijami. Glavni prispevek magistrskega dela leži v analizi razmerja med OZN in Afriško unijo (AU) pri hibridni misiji Organizacije združenih narodov in Afriške unije v Darfurju (United Nations - African Union Hybrid Operation in Darfur – UNAMID), ki predstavlja prvo hibridno misijo v zgodovini. V več kot desetih letih svojega delovanja je imela mnogo težav, ki sta jih organizaciji večinoma premagali. Tako lahko skozi analizo uspeha misije sklepamo o potencialu tega tipa misije za nadaljnje sodelovanje med OZN in regionalnimi organizacijami. Zaradi togosti mehanizmov OZN hibridne misije predstavljajo najboljšo možnost sodelovanja – vse dokler OZN ne ustvari mehanizmov, ki bi predstavljali večjo komplementarnost sodelovanja med OZN in regionalnimi organizacijami. ; Since the drafting of the United Nations (UN) Charter, co-operation between the UN and regional organizations in the field of international peace and security has been subject to intense debates. The debate between universalism and regionalism was, for the time being, resolved in the form of Chapters VII. and VIII. of the UN Charter. This compromise resulted in the Security Council being at the forefront of responses in matters of international peace in security for some five decades. But recent developments in the field of international peace and security have exposed the need for greater involvement of regional organizations. This master thesis is focused on the potential of a hybrid type of peace operations for future co-operation between the UN and regional organizations. The value of the research lies in its analysis of the relationship between the African Union and the UN in the United Nations - African Union Hybrid Operation in Darfur (UNAMID), the first-ever hybrid peace operation. In more than ten years of its deployment, UNAMID has been plagued by problems that both organizations have had to overcome. In that regard, through the analysis of the success of UNAMID, we can draw conclusions regarding the potential that this type of peace operation has on the future co-operation between the UN and regional organizations. Until the UN develops better complementarity mechanisms for co-operation with regional organizations, hybrid missions represent the best way of co-operation.

The necessity of a master of science in midwifery in Slovenia ; Potrebe po magistrskem študiju babištva v Sloveniji
Bologna reform has brought about several changes for the Slovenian higher education; however, these implementations were not reflected to the same extent in all study programmes. Midwifery education in Slovenia is currently provided only at the Bachelor of Science level, and there is still no postgraduate programme available. The article presents the results of the empirical study, conducted by employing quantitative research paradigm when examining the study interests of midwives (within the BSc or MSc programmes). The results have shown that the interest in studying at the MSc level is higher than that of studying at BSc level. It would therefore be sensible to offer an upgrade to the career opportunities for midwives, consisting of an option of postgraduate study, which would follow examples of good practices of other European countries. Postgraduate study in midwifery is additionally justified by the complex and demanding nature of midwifery scope of practice. ; Bolonjska reforma je v slovensko visoko šolstvo prinesla številne spremembe, ki pri vseh študijskih programih niso povsem enoznačne in enosmerne. Študijski program babištva se v Sloveniji izvaja izključno na prvi stopnji, podiplomskega študija za zdaj ni. V raziskavi, ki je temeljila na empiričnem anketnem raziskovalnem pristopu in je bila zasnovana na kvantitativni raziskovalni paradigmi, nas je zanimal interes babic s srednjo izobrazbo za vpis v zdajšnji visokošolski strokovni študijski program babištva prve stopnje ter interes diplomantov in študentov za vpis na morebitni podiplomski magistrski študijski program babištva. Rezultati so pokazali, da je interes anketirancev veliko večji za vpis na podiplomski magistrski študijski program babištva, medtem ko je zanimanje za zdajšnji dodiplomski študijski program babištva nekoliko manjše. Smiselno bi bilo omogočiti nadgraditev kariernih poti diplomantov babištva z možnostjo podiplomskega študija. Ta težnja je upravičena tudi zaradi zahtevnosti babiške dejavnosti in jo potrjujejo tuje usmeritve.

Political and CulturalFoundations of Citizenship ; Političnokulturni temelji izobraževanja za državljanstvo
My thesis is based on the premise that the change of the political system from socialism to post-socialism was not based on the otherwise branched out political education in socialism, but rather, on other factors of which the essential one is the third wave of democracy that swept across the Central, South and East European countries. (Inter)active citizenship can develop synergistically together with a positive attitude towards one's own country and with a stimulative influence on the citizens; with co-operation among the various (civil) groups and with modern education for citizenship (not only as the school subject of Citizenship Education and Ethics) as well as with its alternative goals together with the democratic and spiritual political culture. In view of the projected deadline for stability of democracy, which is expected to last 50 to 60 years, both types of culture are only at the initial phase of development in the new Slovenian state. ; Izhajamo iz teze, da spremembe političnega sistema iz socializma v postsocializem niso temeljile na sicer razvejenem političnem izobraževanju v socializmu, temveč na drugih dejavnikih, med katerimi je bistven tretji val demokracije, ki je zajel tudi srednje-, južno in vzhodnoevropske države. (lnter)aktivno državljanstvo se lahko razvija sinergično s pozitivnim odnosom do lastne države in spodbudnim vplivom na državljane, s sodelovanjem med različnimi (civilnimi) skupinami, s sodobnim izobraževanjem za državljanstvo (ne le s šolskim predmetom državljanska vzgoja in etika) in njegovimi alternativnimi cilji hkrati z demokratično in duhovno politično kulturo. Obe vrsti kulture sta v novi slovenski državi glede na predvideni rok za stabilnost demokracije, ki naj bi trajal 50-60 let, šele na začetni razvojni stopnji.

ODNOSI MED POLITIKO IN UPRAVO V LOKALNI SAMOUPRAVI ; RELATION BETWEEN POLITICS AND POWER IN LOCAL GOVERNMENT
Magistrska naloga obravnava in analizira odnose med županom kot najvišjim političnim funkcionarjem in direktorjem občinske uprave kot najvišjim javnim uslužbencem. V prvem delu sta predstavljeni zgodovina lokalne samouprave v Sloveniji in Ustava Republike Slovenije, ki je najvišji splošni pravni akt in lokalni samoupravi posveča svoje poglavje. Načela, ki vodijo lokalno samoupravo in so pomembna za uspešno delovanje in razvoj lokalne samouprave, so načelo avtonomije, načelo subsidiarnosti in načelo regionalizacije. Slovenske občine se vedno bolj vključujejo v skupne občinske uprave za opravljanje posameznih nalog, saj so občinske uprave v manjših občinah kadrovsko nedohranjene. Prav tako se občine vključujejo v združenja občin, saj lahko na ta način bolje zagotavljajo svoj skupni interes na področju lokalne samouprave. Občine med seboj sodelujejo tudi na podlagi sporazumov o pobratenju, ki ima pozitivne učinke na lokalno samoupravo in lokalno okolje, saj gre za stik z mednarodnimi partnerji, izmenjavo izkušenj in pridobitev različnih novih znanj. V nadaljevanju naloge so predstavljene ravni lokalne samouprave v sosednjih državah Republiki Hrvaški in Republiki Avstriji. V drugem, raziskovalnem delu naloge je prikazana primerjava lokalnih skupnosti v dveh izbranih evropskih državah. Na podlagi intervjujev je bila izvedena primerjava odnosov med oblastjo v lokalni samoupravi in politiko. V intervjujih so sodelovali župani in direktorji občinskih uprav manjših slovenskih, hrvaških in avstrijskih občin. V nalogi so predstavljena tudi mnenja županov in direktorjev občinskih uprav o njihovih odnosih v občinah. ; This research work discusses and analyses the relationship between the mayor, as the highest political official and the director of municipal administration as senior civil servant. The first section presents the history of local government in Slovenia and the Constitution of the Republic of Slovenia, which is the highest general legal act and the local government has its own chapter in the Constitution. Principles that lead local government and are important for a successful operation and development of local self-government is the principle of autonomy, the principle of subsidiarity and the principle of regionalization. Slovenian municipalities are increasingly involved in Joint Municipal Administration to perform specific tasks, as the municipal administration in small municipalities are understaffed. In addition, the municipalities integrate themselves in the Association of Municipalities to ensure their common interests better in the field of local self-government. Municipalities cooperate with each other based on agreements of town, which has a positive impact on local government and the local environment, because of the contact with international partners, exchange of experience and the acquisition of various new skills. In the following part of the work levels of local government in the neighbouring countries, the Republic of Croatia and the Republic of Austria are presented. The second part of the research work, a comparison of local communities in the two selected European countries, is presented. A comparison was made about relations between the authorities and the local government policy based on interviews. In the interviews, the mayors and directors of municipal administrations of small Slovenian, Croatian and Austrian municipalities participated. The thesis also shows the opinions of mayors and the directors of municipal administrations of their relations in the municipalities.

PRIMERJALNA ŠTUDIJA IN ANALIZA RAZVITOSTI E-UPRAVE ; Comparative study and analysis of e-government development
Obstaja veliko študij, ki se ukvarjajo s primerjalnim vrednotenjem e-uprave. Razlog za tako popularnost primerjalnega vrednotenja je interes različnih držav za boljši vpogled v trenutno specifično fazo razvoja e-uprave na nacionalni ravni. Ta vpogled hkrati razkriva pozitivne in negativne plati razvoja v primerjavi z drugimi državami ter tiste vidike, ki jih je treba izboljšati. Namen naše študije, ki vsebuje analizo razvitosti e-uprave v Sloveniji, Avstriji, Hrvaški, Danski in Estoniji v letih 2014, 2015 in 2016, je ugotoviti, ali v izbranih državah obstaja povezanost med stopnjo razvitosti e-uprave in drugimi izbranimi dejavniki razvitosti države (višina bruto domačega proizvoda, stopnja izobrazbe in stopnja interakcije z javnimi organi). Za opisovanje ključnih pojmov e-uprave in kazalnikov razvitosti smo uporabili metodo deskripcije, s komparativno in statistično metodo pa smo primerjali izmerjene vrednosti izbranih kazalnikov. Ugotovitve analize ne nakazujejo povezanosti med višino BDP in stopnjo razvitosti euprave. Pri nižji in srednji stopnji izobrazbe obstaja negativna povezanost, kar pomeni, da manjši kot so deleži prebivalstva z nižjo oziroma srednjo izobrazbo, bolj se povečuje stopnja razvitosti e-uprave. Delež prebivalstva z visoko izobrazbo pa je pozitivno povezan s stopnjo razvitosti e-uprave. Močna pozitivna povezanost je prav tako prisotna med stopnjo interakcije z javno upravo in stopnjo razvoja e-uprave. Izjema je le Slovenija, kjer se stopnja interakcije z javnimi organi znižuje s povečevanjem stopnje razvitosti e-uprave. S primerjalno analizo smo pridobili boljši vpogled v stanje e-uprave v izbranih državah ter s tem prispevali k boljšemu razumevanju obravnavanega področja in k identifikaciji povezanosti razvitosti e-uprave z drugimi kazalniki razvoja države. ; There are many studies dealing with comparative evaluation of e-government. The reason for such popularity of comparative evaluation is the interest of different countries for a better insight into the current, specific phase of e-government development at the national level. At the same time, this insight reveals positive and negative aspects of development in comparison with other countries and emphasizes those aspects that need to be improved. The purpose of our study, which includes the analysis of the development of e-government in Slovenia, Austria, Croatia, Denmark and Estonia in 2014, 2015 and 2016, is to determine whether a correlation between the level of development of egovernment and other selected factors of the country's development (amount of gross domestic product, level of education, level of interaction with public authorities) exists in selected countries. In order to describe the key concepts of e-government and development indicators, a descriptive method was used, and with the comparative and statistical method we compared the measured value of the selected indicators. The findings of the analysis do not indicate the correlation between the level of GDP and the level of development of e-government. At the lower and middle level of education, there is a negative correlation, which means that smaller the proportions of the population with lower and secondary education are, higher is the level of development of e-government. The proportion of the population with higher education positively correlates with the level of e-government development. A strong positive correlation is also present between the level of interaction with public authorities and the level of egovernment development. The only exception is Slovenia, where the level of interaction with public authorities is decreasing by increasing the level of e-government development. With our comparative analysis we gained a better insight into the condition of egovernment in selected countries and thus contributed to a better understanding of the area as well as identified the connection between the development of e-government and other indicators of the country's development.
