El objetivo de esta reflexión es explicitar nuestras dudas sobre la utilidad de la prohibición del velo en las escuelas francesas para la no discriminación de la mujer. Por otra parte, nos parece adecuado aprovechar la oportunidad del debate para analizar el carácter aconfesional de nuestro sistema educativo y de nuestra sociedad. Por último, postulamos que la solución no pasa exclusivamente por la legislación de pautas de comportamiento sino por la educación y el onvencimiento de la sociedad en su conjunto. ; The aim of this article is to present our caveats concerning the usefulness of the prohibition of wearing the Islamic veil in French schools in order to avoid discrimination against women. This topic will also lead us to further discussion and analysis of the non-religious nature of our educational system and society. We will come to the conclusion that legislation about standards of behaviour cannot possibly be the only means of reaching a solution; instead, education seems the best way of accomplishing the social conviction that is required.
Europe is a place with an important cultural diversity where social cohabitation and cohesion is one of the main objectives of the European Union. As a result, there are diversity of religions that has to be strongly respected in every area. For example, education is one of these areas that has to be respected and protected as the religion is an important part of it. Therefore, this research is an attempt to analyze freedom of religion and education in the European Union and the laws of these countries. In order to do so, the education system of several countries such as the United Kingdom, France, Spain and Finland has been studied and compared. Additionally, the laws of the European Union have been assessed, drawing on Islam as a reference. As a consequence of this, this research is documental and qualitative approach as correlational methodology has been used. Finally, the main conclusion of this research is that Islam is protected as the rest of religions in the European Union. ; Europa es un territorio con una gran diversidad de culturas donde la convivencia y cohesión social es uno de los principales objetivos de la Unión Europea. La principal consecuencia es la coexistencia de una gran diversidad de religiones y por ello el respeto al principio de libertad religiosa debe ser un derecho blindado en todos sus ámbitos. La educación es una de esas vertientes donde el respeto al principio de libertad religiosa debe ser respetado y protegido. El islam es una de las religiones más importantes que subyacen dentro de la sociedad europea y a su vez un colectivo que se encuentra en europea desde sus inicios. Por ello, los objetivos de esta investigación pasan por ejecutar un análisis jurídico comparativo de principio de libertad religiosa y educación entre el ordenamiento jurídico de la Unión Europea y la legislación de sus estados miembros. Para poder analizar el mayor número de situaciones posibles se han seleccionado los países de Reino Unido, Francia, España y Finlandia, por sus diferentes sistemas educativos representativos de los sistemas existentes en el resto de los estados miembros de la Unión Europea. Asimismo, se analizará el respeto a la libertad religiosa en la legislación educativa europea e interna de dichos estados miembros, así como el análisis se ejecutará bajo el prisma del Islam. Todo ello para posteriormente evaluar tanto si el ordenamiento jurídico de la Unión Europea y la legislación de los citados estados miembros protegen correctamente el derecho a la libertad religiosa de los que profesan el Islam dentro del ámbito educativo. Para desarrollar estos objetivos, he recurrido a una metodología de estudio correlacional con investigación documental y cualitativa. En el presente artículo se estudia el papel esencial que la educación debe desempeñar en los procesos democratizadores en las sociedades islámicas. Con tal fin, en primer lugar, se desmonta uno de los elementos principales del discurso hegemónico de raíz orientalista: la idea de que el individuo oriental, debido a su sumisión ontológica, es incapaz de construir sociedades regidas por pautas democráticas de conducta. Posteriormente, se analizan las causas que han ocasionado la situación de sometimiento a regímenes autoritarios y se demuestra que acontecimientos como los de la "Primavera árabe" manifiestan la existencia de principios de ciudadanía activa que pueden propiciar el surgimiento de regímenes democráticos. Finalmente, se concluye que, para que estos movimientos de emancipación sigan la senda democrática, es necesario modificar las estructuras educativas heredadas de los regímenes autoritarios coloniales y poscoloniales. ; This paper examines the role that education must play in the processes of democratization in Islamic societies. For this purpose, first, is dismantled one of the main elements of the hegemonic orientalist discourse: the idea that the oriental individual, because of its ontological docility, is incapable of building societies governed by democratic standards of conduct. Subsequently, we analyze the causes that have led to the situation of subjection to authoritarian regimes and we shows that events such as the "Arab Spring" declare the existence of principles of active citizenship which may Foster the emergence of democratic regimes. Finally, we conclude that, in order that these movements of emancipation can follow the democratic way, it is necessary to change the educational structures inherited from the colonial and postcolonial authoritarian regimes.
Este artículo analiza el discurso antiamericano y anti-israelí característico los medios de comunicación y el estamento intelectual árabes, tomando como punto de partida el examen de dos obras recientes de Mahdi Elmandjra. Intenta poner de manifiesto cómo dicho discurso se nutre en buena parte de mitos y falacias. Su arraigo resulta preocupante porque: 1) hace el juego a la estrategia de "choque civilizacional" y "ataque al enemigo lejano" diseñada por Al-Zawahiri y otros ideólogos yihadistas; 2) distrae la atención del público árabe, contribuyendo al eterno aplazamiento de las reformas que aquellas sociedades necesitan (democratización, eficiencia económica, derechos de la mujer, tolerancia religiosa, secularización, educación, etc.). ; This article analyses the anti-American and anti-Israeli discourse so characteristic of the Arab media and academy , instantiated in two recent works of the Moroccan scholar Mahdi Elmandjra. The article attempts to show how this discourse relies largely on myths and fallacies. Its widespread acceptance is worrying because the anti-Western discourse plays along -intentionally or not- with the strategies of the "clash of civilisations" and "strike the distant enemy" designed by Al-Zawahiri and other yihadist ideologues; it does, furthermore, divert the Arab opinion's attention, thus favouring the endless postponement of the reforms that those societies so badly need: democratisation, economic efficiency, women's rights, religious tolerance, secularisation, education etc.

The running and organization of the education system of a country are a reflection of the social system which is immersed. That is one of the most useful tools used by the society and the established power to transmit their values and maintain its status quo, favoring its cohesion, continuity and permanence. Through the Protectorate, the French government tried to seize the Moroccan people controlling the economy, society, education, etc. To achieve this purpose he used various means, including the education system. It imposed a series of reforms tending to perpetuate its rule, strengthening their power and hegemony. With the independence, the power changes and, therefore, their interests and aims. It is introduced a new dynamic school, which is not beyond the previous system. Some aspects are taken as reference, to imitate or eliminate, to build the new school system. On this basis, the newly established monarchy exercised their power taking into account the new balance of forces, and incorporating as emerging element a nationalist perspective, based on an ideology rooted in Arab-Islamic traditions. ; El funcionamiento y la organización del sistema escolar de un país no son sino un fiel reflejo del sistema social donde se encuentra inmerso. Aquel es uno de los instrumentos más útiles que emplea la sociedad y el poder establecido para transmitir sus valores y mantener su statu quo, favoreciendo su cohesión, continuidad y permanencia. El presente artículo analiza en profundidad el contexto general en el que se encuentra la enseñanza de las religiones minoritarias en el Estado español. Centramos nuestra atención en el caso concreto de andalucía (extensible al caso español) y, en dos de las tres religiones que han firmado acuerdos de Cooperación con el Estado español: la evangélica y la islámica. El marco político y legislativo garantiza el derecho de los padres a que sus hijos reciban formación religiosa y moral, acorde a sus convicciones, en la escuela pública. Sin embargo, la puesta en práctica de los derechos de estos grupos, está siendo insignificante en una sociedad española cada vez más plural y multirreligiosa. ; This article analyzes in depth the general context of the teaching of the minority religions in the Spanish State. We focus on the specific case of andalusia (extensible to the Spanish case), and on two of the three religions that have signed Cooperation agreements with the Spanish State: the Evangelical and the Islamic religions. The legislative framework guarantees the parents the right to religious and moral education for their children, according to their beliefs, in public schools. However, putting these rights in practice is being insignificant in the more and more plural and multireligious Spanish society.
El terrorismo de inspiración islámica se ha convertido en una de las principales amenazas para la paz y la convivencia a nivel internacional. Constituye, además, la principal amenaza terrorista para España. Partimos del convencimiento de que las medidas militares y las basadas en la seguridad son necesarias, pero en absoluto suficientes, siendo indispensables medidas socioeducativas a medio y largo plazo que, además, son las más valoradas por los musulmanes participantes en nuestro estudio para prevenir este fenómeno. En la presente tesis doctoral abordamos el terrorismo de inspiración islámica desde tres ejes: a. El mensaje formativo/persuasivo que Daesh y Al Qaeda transmiten a las mujeres musulmanas a través de sus revistas digitales oficiales; b. La opinión del profesorado de Religión Islámica en España y; c. La opinión de la comunidad musulmana en España. Utilizamos una metodología de investigación de enfoque mixto, con técnicas de recogida de datos cuantitativas y cualitativas. Analizamos la narrativa de Daesh y Al Qaeda haciendo uso del análisis de contenido cualitativo, con un sistema de dimensiones y categorías ad hoc. Calculamos la confiabilidad mediante Alpha de Krippendorff. Estudiamos todos los artículos de las revistas digitales oficiales de ambos grupos (Inspire, Dabiq y Rumiyah) destinados a las mujeres musulmanas y aquellos donde se refieren específicamente a ellas. Para abordar la opinión del profesorado de Religión Islámica nos basamos en un diseño explicativo secuencial. En una primera fase, recogemos los datos cuantitativos a través de un cuestionario ad hoc y, en una segunda fase, realizamos entrevistas semiestructuradas con el fin de profundizar en las respuestas obtenidas a través del cuestionario. La muestra participante en la fase cuantitativa está conformada por el 78% de los docentes que impartieron la asignatura en centros escolares públicos de España durante el curso académico 2018/19. En la fase cualitativa entrevistamos a un total de 13 docentes, siendo este el punto en el que alcanzamos la saturación teórica. Para conocer la opinión de la comunidad musulmana en España, empleamos un diseño descriptivo tipo encuesta con un cuestionario ad hoc. La muestra está conformada por un total de 1157 musulmanes. Para su selección, diseñamos nuestro propio marco muestral y utilizamos un muestreo polietápico. Ambos cuestionarios alcanzaron niveles óptimos de fiabilidad (Alpha de Cronbach), de validez de contenido (juicio de expertos y confiabilidad a través de Alpha de Krippendorff) y de constructo (Análisis Factorial Exploratorio con rotación Varimax y Escalamiento Multidimensional-No Métrico). Para el análisis de los datos cualitativos utilizamos la técnica de análisis de contenido cualitativo, siguiendo un criterio temático. Para la narrativa de Daesh y Al Qaeda empleamos una codificación mixta y para el análisis de las entrevistas y preguntas abiertas de los cuestionarios una codificación inductiva. Utilizamos el programa Atlas.ti versión 7.5. Los datos cuantitativos son analizados mediante análisis descriptivos (porcentajes, moda, media y desviación típica), correlacionales (Pearson, Spearman y Contingencia) e inferenciales (pruebas no paramétricas H de Kruskal-Wallis y U de Mann Whitney, y tamaño del efecto mediante coeficiente de correlación al cuadrado). Utilizamos el programa SPSS versión 26. Con respecto al mensaje que Daesh y Al Qaeda transmiten a la mujer musulmana, los resultados obtenidos permiten inferir factores que pueden hacerla más influenciable a la ideología de estos grupos. El profesorado de Religión Islámica es desconocedor de la introducción del terrorismo en el currículum de la asignatura. La mayoría no lo considera adecuado, al fomentar la idea de que solo los musulmanes son vulnerables al terrorismo. La mayoría del profesorado y de la comunidad musulmana en España indican el desconocimiento del islam como el motivo principal por el que se produce este fenómeno. Obtenemos una abrumadora oposición por parte de la comunidad musulmana en España a la justificación de la violencia en defensa propia ante injusticias cometidas contra los musulmanes. Tener un nivel formativo inferior, sentir que no pertenecen ni a España ni a su país de origen o al de sus padres, percibir mayor injusticia hacia los musulmanes como grupo, otorgar menos importancia al islam en su vida y estar en paro, se asociaron con una mayor justificación de la violencia. Propugnamos medidas educativas preventivas que, lejos de enfocarse en detectar posibles extremistas violentos, se centren en enseñar los fundamentos del islam. Especialmente, estimamos imprescindible la enseñanza contextualizada del concepto de yihad menor. También son ineludibles medidas sociales que presten atención, entre otras cuestiones, a posibles conflictos de identidad, sentimientos de injusticia percibida y de desarraigo entre los musulmanes en España, evitando el popular discurso del "choque de civilizaciones". Alertamos sobre el peligro de implementar medidas para prevenir este fenómeno sin tener en consideración la opinión de los implicados. De lo contrario, los efectos pueden ser contraproducentes. ; Islam-inspired terrorism now poses one of the main threats to peaceful coexistence at an international level. Furthermore, it is currently the main terrorist threat to Spain. We are convinced that military and security measures are necessary, but by no means sufficient, it being essential to adopt mid- and long-term measures which, moreover, are the most highly valued by the Muslims participating in our study for preventing this phenomenon. In this PhD thesis, we approach Islam-inspired terrorism from three perspectives: (a) The formative/persuasive message that Daesh and Al Qaeda convey to Muslim women through their official online magazines; (b) The views that Islamic religion teachers in Spain hold in this respect; and (c) The perception that the Muslim community in Spain has of this phenomenon. To this end, we employed a mixed model research methodology, with quantitative and qualitative data collection techniques. Specifically, we performed a qualitative discourse analysis on the subject matter of Daesh's and Al Qaeda's official online magazines, employing a specially designed system of dimensions and categories, while interrater reliability was calculated with Krippendorff's alpha coefficient. We examined all the articles published in the official online magazines of both groups (Inspire, Dabiq and Rumiyah) tailored to Muslim women and those in which specific reference was made to them. In order to become acquainted with the views of the Islamic religion teachers, we employed a sequential explanatory design. In the first stage, we collected quantitative data by administering a specially designed questionnaire and, in the second stage, we conducted semi-structured interviews with an eye to fleshing out the replies obtained in the questionnaire. In the quantitative stage, the sample was made up of 78 per cent of the Islamic religion teachers who were working at Spanish state schools during the academic year 2018/2019. In the qualitative stage, we interviewed 13 teachers, this being the point at which theoretical saturation was reached. In order to sound out the opinions of the Muslim community in Spain, we employed a survey-style descriptive design with a specially designed questionnaire. The sample was made up of 1,157 Muslims, who were selected on the basis of a multistage sampling frame. Both questionnaires reached optimal levels of reliability (Cronbach's alpha), content validity (expert judgements and Krippendorff's alpha coefficient) and construct validity (exploratory factor analysis with a varimax rotation and non-metric scaling). For the data analysis, we employed a qualitative content analysis technique, following a thematic criterion. As to the analysis of the discourses of Daesh and Al Qaeda, we used a mixed coding method, and as to that of the interviews and the open-response items in the questionnaires, an inductive coding method. The Atlas.ti programme (version 7.5.) was used for conducting all the analyses. ~ 14 ~ The quantitative data were analysed by means of descriptive (percentages, modes, medians and standard deviations), correlational (Pearson, Spearman and contingency coefficients) and inferential methods (Mann-Whitney U and Kruskal-Wallis H non-parametric tests, the effect size being calculated using the squared correlation coefficient). All these analyses were performed with the SPSS programme (version 26). With respect to the messages that Daesh and Al Qaeda transmit to Muslim women, the results obtained allow for identifying factors that may make them more susceptible to the ideology of these two groups. The Islamic religion teachers are unaware of the introduction of terrorism in the module's curriculum. Most consider it to be inadequate, insofar as it fosters the idea that only Muslims are vulnerable to terrorism. By and large, the Islamic religion teachers and the members of the Muslim community in Spain believe that a lack of knowledge of Islam is the main reason behind this phenomenon. We have observed that the vast majority of the members of the Muslim community in Spain are against the justification of violence in self-defence against the injustices to which Muslims are subjected. Possessing lower academic qualifications, feelings of not belonging in Spain or in their country of origin or in that of their parents, the perception of a greater level of injustice against Muslims than against other groups, attaching greater importance to Islam in daily life and being unemployed are associated with a greater justification of violence. We advocate for preventive educational measures that, rather than placing the accent on the detection of violent extremists, focus on the teaching of the foundations of Islam. Above all, we believe that a contextualised teaching of the concept of lesser jihad is imperative. Those social measures addressing, among other issues, possible identity conflicts, feelings of perceived injustice and rootlessness among Muslims in Spain are also essential, since this would help to avoid the 'clash of civilisations' discourse. We feel that it is necessary to warn against the implementation of measures for preventing this phenomenon, without first taking into account the views of the stakeholders. On the contrary, the results could be counterproductive.

The Congress approved the Document of Recommendations included in the Report of the Parliamentary Commission of Investigation on the terrorist attacks of March 11, 2004. In this Document a series of proposals are gathered on the Islamic community. This article studies, not only these proposals, but also others directly related to the preservation of public safety & religious freedom; so the abuse in the exercise of this religious freedom, as made clear by some judicial decisions, has served as an alibi for the commission of Islamist terrorists attacks. Centramos nuestra atención en el caso concreto de Andalucía (extensible al caso español) y, en dos de las tres religiones que han firmado acuerdos de Cooperación con el Estado español: la evangélica y la islámica. El marco político y legislativo garantiza el derecho de los padres a que sus hijos reciban formación religiosa y moral, acorde a sus convicciones, en la escuela pública. Sin embargo, la puesta en práctica de los derechos de estos grupos, está siendo insignificante en una sociedad española cada vez más plural y multirreligiosa. ; This article analyzes in depth the general context of the teaching of the minority religions in the Spanish State. We focus on the specific case of andalusia (extensible to the Spanish case), and on two of the three religions that have signed Cooperation agreements with the Spanish State: the Evangelical and the Islamic religions. The legislative framework guarantees the parents the right to religious and moral education for their children, according to their beliefs, in public schools. However, putting these rights in practice is being insignificant in the more and more plural and multireligious Spanish society.
The aim of this research is idenify comprehensive view of Al-Taher bin Ashour's educational reforms, both theoretical and practical. This is an analytical-logical research done by content analysis method. the paper critiques reductionist approaches to this book by showing that Ibn Ashour's educational reforms are part and parcel of his larger reformist project delineated in Maqasid Al-Sharia Al-Islamiah (The Objectives of Islamic Sharia) and Usul Al-Nitham Al-Ijtimai fi Al-Islam (The Foundations of the Social System in Islam). This paper claims that Ibn Ashour had pioneering reformist views in education relative to the era he had inhabited. His family connections made the political environment conducive to his reforms, and he made use of the varied and multifarious knowledge he had accumulated, which made him more than a mere individual and more of a powerful force in the Tunisian and Arab-Islamic reformist process.
En los matrimonios con disparidad de culto las cuestiones relativas a los hijos y su educación pueden ser especialmente delicadas e importantes, porque van unidas a otros aspectos del hecho interreligioso e intercultural que resultan transversales en el matrimonio y la familia. Por ello, la Iglesia insiste en que no deben ser pospuestas para abordarse en la vida conyugal, y requieren una especial atención, valoración y diálogo previos a la decisión matrimonial. Así se comprenden las interpelaciones del canon 1125 respecto de los hijos. También se entiende el cambio de disciplina respecto al código anterior, atendiendo a la doctrina conciliar sobre ecumenismo y al aumento de estas uniones debido a fenómenos como la inmigración y la mundialización. En el desarrollo legislativo y pastoral de esta normativa han tenido una especial incidencia los matrimonios entre cristianos e islámicos. Esto se ha debido tanto al número de estos matrimonios como a las diferentes costumbres en materia religiosa, cultural y en las relaciones familiares. Presentamos un estudio de los documentos y orientaciones pastorales a la luz de la legislación canónica, pero atendiendo también a las diferencias de las distintas tradiciones islámicas, legislaciones civiles y cambios de contextos sociales y políticos. ; In marriages with disparity of cults the questions concerning of the children and their education may be especially sensitive and important, because they come together other aspects of interreligious and intercultural fact. Therefore, The Church insist that should not be postponed to be discussed in married life, and require special attention, appreciation and dialogue previous to the marriage decision. This need permits understand the norm of c. 1125. It also means the change of discipline with respect to the previous code, based on the Council's teaching on ecumenism and the increase of this marriages produced to events such immigration and globalization. In the legislative and pastoral development of this legislation has had a special impact marriage between Christian and Islamic. This has occurred by the number of such marriages as different customs in religion, culture and family relationships.
