Genel idari yargı Danıştay, bölge idare mahkemesi, idare ve vergi mahkemesinden oluşmaktadır. İdare ve vergi mahkemeleri ilk derece mahkemeleridir. Bölge idare mahkemesi istinaf mahkemesi iken, Danıştay hem ilk derece mahkemesi hem de temyiz merci, idare ve vergi mahkemeleri ise ilk derece mercileridir. Bu mahkemeler arasında görev uyuşmazlığı, olumlu görev uyuşmazlığı ve olumsuz görev uyuşmazlığı olarak görülebilmektedir. İlk derece mahkemeleri olan Danıştay, idare ve vergi mahkemeleri arasında, istinaf merci olan bölge idare mahkemesi ile temyiz merci olan Danıştay arasında, Danıştay daireleri arasında ve bölge idare mahkemesi daireleri arasında görev uyuşmazlıkları çıkabilmektedir. İdari yargıda çıkan bu görev uyuşmazlıklarının çözümü ve çözümünde yetkili olan makamların tespiti önem arz etmektedir. ; The general administrative judiciary consists of the Council of State, the district administrative court, the administrative and tax courts. Osmanlı Devleti 19. Yüzyılın başında hemen her kurumunda yenilik/reform hareketi başlatmıştır. Bu hareketler kısa süre sonra Batılılaşma isteğine dönüşmüştür. Eski günlere geri dönme arayışları içinde, en sonunda "Batı gibi olmak zorundayız" şeklinde özetlenen bir politika benimsenmiştir. Batı'nın geldiği medeniyet seviyesine gelmenin, kurtuluşun anahtarı olacağını savunan devlet adamlarının öncülüğünde, hemen her padişah, Batı medeniyetinin ulaşmış olduğu seviyeye gelme arzusuyla, birtakım reformlar yapmıştır. Bu doğrultuda Batı'dan bilim adamları getirtilmiş, Batı'yı gözlemlemesi için devlet adamları yurt dışına gönderilmiş, elçi ve diplomatlardan raporlar hazırlamaları istenmiş, Batı medeniyeti ithal edilmiş, Batılı devlet adamlarının ve ülke içindeki elçi ve diplomatların görüşleri dikkate alınmış ve en nihayetinde devletin yönü Batı'ya çevrilmiştir. Batılılaşma, medenî olmayla eşanlamlı görülmüş ve yapılan yeniliklerle Batı'nın ulaşmış olduğu seviyeye gelebilmek hedeflenmiştir. 19. yüzyıl reformları tek tek incelendiğinde, Batı'nın etkili olduğu veya Batı eksenli bir anlayış göze çarpar. The agenda for the fight against corruption has become a prominent part of the relationships of international organizations with nation-states. This article analyses the fight against corruption as a vital topic in Turkey's bid for European Union (EU) membership. It also assesses the EU's approach and framework for the candidate countries. For this purpose, qualitative document analysis is carried out on 80 EU documents on Turkey for the years between 1998 and 2021, based on process tracing. The analysis demonstrates that corruption is a persistent issue in Turkey across multiple fields. Progress is still slow, and Turkey is far from fulfilling the membership requirements for the fight against corruption. The EU has advocated for political will and a new strategy to address corruption in Turkey, focusing on institutional capacity and governance, international commitments, the fight against clientelism and political corruption, and the independence of the judiciary.

In this study, the newspaper headlines in three days following the meeting of the National Security Council on February 28, 1997 have been examined by using the method of critical discourse analysis; and thus, it has been attempted to reveal relations among political actors behind the ideological structures of the news.
Alternative dispute resolution and mediation has been on the agenda of the law and judiciary for the last twenty years in our country, and for sixty years in the world. It is expressed in the doctrine that the case procedure, which is the classical judicial system, is no longer the only way for dispute resolution in the globalizing world. According to dominant trend, problems such as the long duration of the lawsuits in the courts, the cost of the trial costs, the cumbersome way of the lawsuit are the problems that need to be solved radically. While the current problems are correct, the way they are handled and the prescriptions for them are quite parallel to the dynamics of the neoliberal transformation. In this direction, as a public service, dispute resolution is increasingly privatized and transferred to the markets. Judgement is now transforming into a commodity like most relations and objects in the capitalist mode of production. The achievement of justice for those who have money is getting easier through alternative dispute resolution and mediation. ; Alternatif uyuşmazlık çözümü ve arabuluculuk ülkemiz özelinde yaklaşık son yirmi, dünyada ise altmış yıldır hukuk ve yargı gündemini meşgul etmektedir. Klasik yargılama sistemi olan dava usulünün artık küreselleşen dünyada uyuşmazlık çözümü için tek yol olmadığı doktrinde dile getirilmektedir. Hakim eğilime göre mahkemelerde davaların çok uzun sürmesi, yargılama masraflarının pahalılığı, dava yolunun hantallığı gibi sorunlar kökten halledilmesi gereken problemlerdir. Mevcut sorunlar doğru olmakla birlikte, bunların ele alınış biçimi ve bunlara getirilen reçeteler, neoliberal dönüşümün dinamikleriyle oldukça paralel yürümektedir. Bu doğrultuda bir kamu hizmeti olarak uyuşmazlık çözümü gittikçe özelleşmekte ve piyasalara devredilmektedir. Yargılama da artık kapitalist üretim tarzındaki çoğu ilişki ve nesne gibi bir metaya dönüşmektedir. Parası olanın adalete kavuşabilmesi, alternatif uyuşmazlık çözümü ve arabuluculuk vesilesiyle daha da kolaylaşmaktadır.
Bu tez, demokratik geçiş döneminde bulunan melez rejimlerden kayda değer bir kısmının hem otoriter hem de demokratik bazı özellikleri barındıran bir yapıya bürünerek yeni bir rejim tipi oluşturduğu iddiasındaki rekabetçi otoriteryanizmi teorik çerçeve olarak benimsemektedir. Bu çerçevede Rusya Federasyonu'nun siyasal tecrübesi ilk devlet başkanı Yeltsin ve 2000 sonrası Putin dönemleri üzerindenincelenmiştir. Her iki dönemde de iktidarın hem rejimin rekabetçi özelliğinin korunması hem de otoriter yapının tesisini sağlamaya çalışması rekabetçi otoriteryan rejimin özelliklerinin tespit edilmesine imkân veren seçimler, medya, parlamento, yargı, protestolar, elitler ve ülkenin siyasal kültürü gibi platformlar incelenerek ortaya konulmuştur. Bu teorik çerçevenin tercih edilmesinde geçiş dönemi ülkelerinin bir kısmı demokratikleşmesini tamamlar veya tam otoriter rejime dönüşü tecrübe ederken Rusya Federasyonu'nun rekabetçi otoriter rejim özelliklerini çeyrek yüzyıl boyunca istikrarlı bir şekilde sürdürmesi etkili olmuştur. Ayrıca basın özgürlüğü alanında Reporters Without Borders, hukukun üstünlüğü alanında Rule of Law Index ve yolsuzluk alanında Transparency International verilerinden de destek alınarak Rus siyasal rejimi Yeltsin ve Putin dönemleri üzerinden daha anlaşılır bir şekilde analiz edilmiş ve somut bilgilerle zenginleştirilmiştir. --- This thesis accepts competitive authoritarianism as a theoretical framework which claims that significant number of hybrid regimes created a new regime type having both democratic and authoritarian peculiarities. Within this framework the political experience of the Russian Federation is analyzed through Yeltsin and Putin periods. President's endeavor to keep the regime both competitive and authoritarian in both periods is revealed through analyzing elections, media, parliament, judiciary,protests, elites and the political culture of the country which are the platforms for the evaluation of a competitive authoritarian regime. The continuation of the stable hybrid regime in Russia for a quarter of a century while some other hybrid regimes democratized or adopted full authoritarian rule became effective in the preference of this theoretical framework. In this context, the authoritarian peculiarities such as conducting free but unfair elections, taking media under control of the government, bringing the parliament and the judiciary under the influence of the government, controlling the protests, government's usage of the political culture of the country in addition to the competitive peculiarities of the Russian political regime is tried to be determined in this study. The adoption of the Western world's political features depending on the need to be accepted in the international arena, the weakness of the Russian state and the influence of the 'family' and the oligarchs in the 1990s necessitated to analyze Yeltsin and Putin periods in different sections. By conducting this study, it is determined that the Russian political regime has gradually been losing the competitive peculiarities of the regime from 1990s to March 2018 presidential elections and assumed a more authoritarian regime. However, since it is not true to name it as full authoritarian, I researched that how the internationalinstitutions studying on the evaluation of the regime types examine the situation. Within this framework, data from Freedom House's Nations in Transit, Countries at the Crossroads, Political Rights and Civil Liberties indexes and Polity IV, Sustainable Governance Indicators (SGI), The Economist Intelligence Unit (EIU), World Governance Indicators and The Bertelsmann Transformation Index (BTI) is used. In addition, data of the Reporters Without Borders working on the press freedom, Rule ofLaw Index working on evaluation of the countries based on the rule of law and Transparency International producing corruption indexes is used in order to make the evaluation of the Yeltsin and Putin periods more concrete and comprehensible.
Bu makalenin amacı Azerbaycan ve Türkiye'nin yabancı yatırım hukuku ve siyasal yapısını mukayeseli açıdan değerlendirmektir. Geçilen on yılı aşkın zaman içerisinde, Azerbaycan ve Türkiye hükümetleri hem siyasal istikrar ve hem de teşvik edici yatırım ortamı kurmuş ve bunları da gerek iç hukukları üzerinde yapmış oldukları düzenlemeler aracılığıyla, gerekse de ikili ve çok taraflı anlaşmalara taraf olarak gerçekleştirmişlerdir. Türkiye, sınırlayıcı yapıya haiz olan önceki yabancı yatırım kanunu ve politikasını özgürleştirerek yabancı yatırımcıyı teşvik eden bir politika izlerken, benzer bir şekilde Azerbaycan ise yabancı yatırımcıyı teşvik amaçlı birçok kanun ve yasal düzenlemeleri, kanun çıkarmaya yetkili otoriteleri vasıtasıyla gerçekleştirmiştir. Bu çalışma gösterdi ki, yabancı yatırımcı için Azerbaycan ve Türkiye'de yatırımcı dostu bir ortam bulmasına rağmen, bu ülkelerdeki bazı problemler, yatırım yapılabilirliği hususunda engel teşkil etmektedir. Bürokratik verimsizlikler, yetersiz şeffaflık ve yüksek derecede ki yolsuzluk Azerbaycan'da yatırım açısında problem teşkil etmektedir. Türkiye'nin yabancı yatırımcı açısından başlıca sorunu ise, yargı sistemindeki aşırı iş yükü ve ağır bürokrasidir. ; The purpose of this article is to examine Foreign Investment Laws, and Political Structure of Azerbaijan and Turkey from a comparative perspective. The governments of Azerbaijan and Turkey have both secured political stability and established an appealing investment environment via adjustments to their domestic law, as well as signing up to bilateral and multilateral international investment treaties over the past decade. Turkey has liberalised its previously restrictive foreign investment law and policy to give encouragement to international investors. Similarly, since the establishment of the Republic of Azerbaijan, its legal authorities have been active in passing various laws with regard to foreign direct investment. The work has provided that although foreign investors seem to have found a friendly investment environment in Azerbaijan and Turkey, there are some major problems which render doing business problematic. Inefficient bureaucracy, a high level of corruption and a lack of transparency in legal and political processes are the major problem for Azerbaijan. From the perspective of investors, Turkey's chief weaknesses lie in its overburdened judiciary system and its cumbersome bureaucracy.

The agreement in which our country made reservation for some of its articles due to our unitary structure seems quite far away from realizing its objectives under the adopted form. Although it was attempted to make arrangements specific to autonomy with various local government reforms in 2000s, it resulted in cancellation by the judiciary. Special Provincial Administration Law No 5302 released in 2005; comprises similar localization cores in respect of followed judicial process and directions of changes made. Some changes in the relationship between provincial general council and governor body draw attention; the head of provincial general council, centralized control method that can be made against the decisions of the head, duration and frequency of assembly etc. evolving situation of provincial general council which is a body established after election will outline the scope of the study. İl genel meclisi ile valilik organı arasındaki ilişkide bazı değişiklikler dikkat çekmektedir; il genel meclisi başkanının kim olduğu, kararlarına karşı yapılabilecek merkezi denetim şekli, toplanma süresi ve sıklığı gibi. Seçimle gelen bir organ olan il genel meclisinin evrilen durumu çalışmanın kapsamını çizecektir. Savunma harcamaları ile ilgili bugüne kadar birçok çalışma yapılmıştır. Bu çalışmanın temel amacı özgürlüklerin ve kurumsal faktörlerin savunma harcamaları üzerindeki etkisini incelemektir. Özgürlük göstergeleri; güçlendirme hakları endeksi, toplanma ve örgütlenme özgürlüğü, konuşma özgürlüğü, seçimde öz tayin, din özgürlüğü, işçi hakları, kadının ekonomik hakları, kadının siyasi hakları, kadının sosyal hakları, yargının bağımsızlığı on farklı değişken çalışmaya dahil edilmiştir. Kurumsal faktör göstergesi olarak dokuz farklı değişken kullanılmıştır. Bu değişkenler; ifade özgürlüğü ve hesap verebilirlik, siyasi istikrar ve şiddetin yokluğu, devlet etkinliği, idari kalite, hukukun üstünlüğü, yolsuzluğun kontrolü, hukuk ve politikaya askeri müdahale, toplumsal cinsiyet eşitsizliği, hukuk sistemi ve mülkiyet hakları şeklinde çalışmaya dahil edilmiştir. Bu çalışmada özgürlüklerin ve kurumsal faktörlerin savunma harcamaları üzerindeki etkisi 1990-2017 yılları arasında 151 ülke için çalışma yapılmış olup ampirik olarak dengesiz panel veri setinden yararlanılmıştır.Kurumsal faktörler ile savunma harcamaları arasında negatif ve istatistiksel olarak anlamlı bir ilişki olduğu sonucuna varılmıştır.Ancak kurumsal faktör değişkeni olan yolsuzluğun kontrolü ve savunma harcamaları arasında pozitif ve istatistiksel olarak anlamlı bir ilişki olduğu sonucu tespit edilmiştir.Özgürlükler ile savunma harcamaları arasındaki ilişki tüm değişkenler için negatif ve istatistiksel olarak anlamlı bir ilişki olduğu ve tüm sonuçların beklenti ile paralel olduğu sonucuna ulaşılmıştır. ; There have been many studies on defense expenditures until today. The fundamental objective of this study is to analyze the impact of freedom and institutional factorson defense expenditures. Freedom indicators; the empowerment rights index, freedom of assembly and association, freedom of speech, self-determination in elections, freedom of religion, workers' rights, women's economic rights, women's political rights, women's social rights and independence of the judiciary have been included in the study. Nine different variables have been used as indicator of institutional factor. These variables which are voice and accountability, political stability and absence of violence/terrorism, government effectiveness, regulatory quality, rule of law, control of corruption, military intervention in law and politics, gender ınequality, legal system and property rights. In this study, the effects of freedoms and institutional factors on defense expenditures were studied for 151 countries between 1990 and 2017, and empirically unbalanced panel data set has been used. It was concluded that there is a negative and statistically significant relationshipbetween institutional factors and defense expenditures. Nevertheless, it was determined that there is a positive and statistically significant relationshipbetween the control of corruption and defense expenditures, which is a variable of institutional factor. It has been attained that there is a negative and statistically significant relationship for all variables and that all results are in line with expectations.
Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu, uyuşmazlıkların çözülerek toplumsal barış ve istikrarın sağlanması zaviyesinden yardımcı ve ikmal edici bir fonksiyonu haiz olup, yargılama yetkisine yardımcı ve seçimlik bir düzenlemedir. Nitekim arabuluculuk faaliyeti bir yargılama işi değil, temelinde, gönüllülük, eşitlik ve gizlilik ilkelerini de barındıran, tarafların sulh ve tasarrufuna tabi uyuşmazlıklarda haklılık vaziyeti tespit edilmeden, menfaat dengelenmesi üzerine kurgulanmış bir hukuki çözüm yoludur. Alternatif çözüm yolu olmasından dolayı, gönüllü katılım, bağlayıcı olmayan tavsiyelerde bulunma ve tatmin olmama halinde taraflara yargıya başvurma hakkında muhtariyet hakkı tanımaktadır. Arabulucu, arabuluculuk faaliyeti kapsamında uyuşmazlık hak-kında karar vermek sureti ile çözüm üretmeyi değil, ikna ve telkin marifeti ile tarafların yeniden müzakerelere girişmesini ve bir anlaşma sağlanmasına imkân veren bir ortam oluşturmayı hedefler. Haklıyı ya da haksızı bulmak değil, tarafların her ikisinin de menfaatlerini iki ayrı kefede dengelemek, her ikisinin de memnuniyetini öngören bir anlaşma zemini oluşturup, uyuşmazlığın çözüme kavuşturulmasına katkı sağlar. Toplumda kişiler arasındaki uyuşmazlıkların nihayete erdirilip, hukuki barışın tesisinin yegâne aracı yargılama yetkisini haiz devlet mahkemeleri değil, geleceği ve menfaatlerin dengelenmesini hedef alan arabuluculuk marifetiyle de çözüme kavuşturulması mümkündür. Nitekim yargılamanın da nihai amacı kesin hüküm elde etmek değil, uyuşmazlığın bütün bir gelecek için söndürülmesidir. Zira uyuşmazlığın biteviye tevali etmesinde toplumun, tarafların ve kamunun hiçbir menfaati olmayacaktır. ; Mediation has an auxiliary and supplementary function, rather than the function of ensuring social peace and stability by resolving disputes, and is an optional and auxiliary arrangement to judicial power. As a matter of fact, mediation is not a matter of judgment, but a legal solution that includes the principles of volunteering, equality and confidentiality, and is based on balancing the interests of disputes subject to the settlement and disposition of the parties, without determining the situation of justification. Since it is an alternative solution, voluntary participation gives the parties autonomy to make non-binding recommendations and to apply to the judiciary in case of dissatisfaction and reach an agreement by persuasion and suggestion. Within the scope of mediation, the mediator does not aim to resolve the dispute by making a decision on it, but to create an environment that allows the parties to re-negotiate and reach an agreement by persuasion and suggestion. Not finding the right or wrong, but balancing the interests of both parties on two separate scales, creates an agreement ground for the satisfaction of both and contributes to the resolution of the dispute. It is possible to end disagreements between individuals in the society and to resolve them not only by state courts with jurisdiction as the only means of establishing legal peace, but also through mediation aimed at balancing the future and interests, not the past and the facts. As a matter of fact, the ultimate aim of the trial is not to obtain a final judgment, but to extinguish the dispute for the whole future. Because the society, the parties and the public will not have any interest in the continuation of the dispute.
Yüksek Lisans Tezi ; Demokrat Parti'nin kurulması ve iktidara gelmesi Türk demokrasi tarihinin dönüm noktasıdır. 14 Mayıs 1950 seçimleri sonrası Demokrat Parti'nin iktidara gelmesiyle, 27 yıllık tek partili dönem sona ermiş, 1925 ve 1930'da başarısız olan çok partili demokrasiye geçiş çabaları başarıyla sonuçlanmış ve ulu önder Atatürk'ün ideallerinden birisi daha gerçekleşmiştir. Demokrat Parti, Cumhuriyet Halk Partisi'nin din üzerindeki baskısına son verme ve ekonomide liberalleşme vaatleriyle ezici bir çoğunlukla iktidarı elde etmiştir. Günün koşullarında askeri ve sivil bürokrasiye hâkim olan bir tek partiden iktidarı zor kullanmadan demokrasinin meşru kuralları içinde devralmasında şüphesiz CHP'nin savaş kahramanı karizmatik lideri İsmet İnönü'nün de büyük payı vardır. Cumhuriyet Halk Partisi'nin 14 Mayıs 1950 seçimlerine kısa bir süre kala seçim kanunlarında demokratik birçok değişikliğe gitmiş olması ve bu çerçevede seçimlerin yargı güvencesine bağlanması şüphesiz seçim güvenliğini olumlu yönde etkilemiştir. Nitekim bu seçimler sonrasında Atatürk'ün Başbakanlarından Celal Bayar'ın Cumhurbaşkanlığında 20 yıla yakın bir süredir TBMM'de milletvekilliği yapan etkileyici ve güçlü hatip Adnan Menderes'in Başbakanlığında 10 yıl sürecek olan Demokrat Parti iktidarı başlamıştır. Tezin konusunu oluşturan I. ve II. Menderes Hükümetleri Döneminde (1950-1954) demokratik hak ve özgürlükler alanında ağırlıklı olarak oldukça olumlu gelişmeler yaşanmıştır. ; The establishment and accede of the Democratic Party is a milestone in the history of Turkish democracy. When the Democratic Party came into power after the elections of May 14, 1950, the 27-year one-party period came to an end. Thus, after several failed efforts in transition to the multi-party democracy in 1925 and 1930, the process finally resulted in success meaning that one of the ideals of the great leader Atatürk was realized. The Democratic Party gained power by an overwhelming majority, promising to put an end to the pressure of the Republican People's Party on religion and bring liberalization in the economy. Ismet Inonu, the war hero of Republican People's Party, undoubtedly played a major role in taking over power under the legitimate rule of democracy and without using force from a single party dominating military and civil bureaucracy. The fact that Republican People's Party made many democratic changes in the election laws shortly before May 14, 1950 elections attaching the electoral rules to the rules of judiciary branch undoubtedly affected the security of the elections positively. As a matter of fact, it was after May 14, 1950 elections that the Democratic Party rule started under the presidency of Adnan Menderes, an impressive and powerful orator who had been a member of Parliament for nearly 20 years under the presidency of Celal Bayar, one of Atatürk's prime ministers and lasted for 10 years. During the period of I. and II. Menderes Governments (1950-1954), which is the subject of this thesis, quite a lot of important developments took place in the field of democratic rights and freedoms.
ÖZETTarihte gerçekleşmiş teknolojik devrimler arasında en büyük sosyal ve kültürel değişiklikleri meydana getiren ve kendini sürekli artan bir hızla yenilemeyi sürdüren, dijital devrim olmuştur. Egemenliğin bileşenlerinden olan siyasal iktidar da insan yaşamındaki ve paradigmasındaki bu global ölçekli ve bütüncül değişime karşı kayıtsız kalamamaktadır. Dijital devrimin siyasal iletişim ve siyasal katılım alanındaki katkılarının, anayasal fonksiyonları yerine getiren kişi ve kurumlar üzerinde de etki yaratması beklenmekte ve hâlihazırda gözlemlenmektedir. Bunun yanında yurttaşlar da kolektif karar alma süreçlerine etki edebilecek yeni teknolojik olanakları gözlemleyerek artık daha aktif katılımcılar olabileceklerini düşünmekte ve hatta çoğu zaman kamusal kararlara doğrudan yön verebileceklerine inanmaktadır. Bu tez yasama, yürütme ve yargı organlarının yapısının ve işleyişinin bilişim teknolojilerindeki gelişmeler ile birlikte dönüşümünü incelemeyi amaçlamaktadır. Bu dönüşüm incelenirken ayrıca bilişim teknolojilerinin siyasal iktidarın kullanılmasına ve denetlenmesine yurttaşları dâhil etme biçimine de değinilecektir. Çalışma boyunca Türkçe ve İngilizce literatürün yanı sıra karşılaştırmalı hukuktan uygulamalı örneklere de başvurulacaktır. Political power as a component of sovereignty also fails to ignore this holistic shift in human life and paradigm. It is expected and already observed that the contribution made by the digital revolution to political communication and political participation is soon to have an impact on the persons and institutions practicing the constitutional functions as well. At the same time, citizens, as they observe the new technological opportunities that may affect collective decision-making processes, assume that they can become more active participants and often believe that they can dominate public decisions. This dissertation aims to examine the structural and functional transformation of the legislative, executive and judicial bodies along with the developments in information technologies. At the same time, it will be explained how information technologies support citizens' participation in processes of enjoying and controlling the political power. Besides applied examples from comparative law, references will also be made to the reviewed literature in Turkish and in English throughout the study.
