After the Lisbon Summit of 2009, the whole matter of fundamental rights in the European Union has taken a new connotation. Local economic interests and social protests – in opposition to the "neoliberal agenda" of EU institutions – have played an important role in stopping the enforcement of the "Constitutional Treaty" and boosted an anti-Euro mobilization. In the meanwhile, the European bodies and transnational corporations have continued to settle a new and alternative basis for the integration. A radical shift can be observed, from the research of synthetic set of principles – as those established on the EU Charter of Fundamental Rights – to a deeply technical and detailed normative production. The regulation on safety and healthy workplaces is one of the best point of view to study this change. Far from calling into question the unbalanced positions between the parties in contemporary labour relationships, the European strategy for workers' protection move through procedural issues and voluntary obedience to the soft law instruments. In the past, the legal doctrine described the creation of a multilevel architecture of institutions, sometimes implemented in a top-down approach. Along with this, recently, it was implemented the establishment of common organizational standards associated to a specific system of corporate governance to pursue a better integration between business and fundamental rights. ; Após o Summit de Lisboa de 2009, toda a questão dos direitos fundamentais na União Europeia tomou uma nova conotação. Os interesses econômicos locais e os protestos sociais – em oposição a "agenda neoliberal" promovida pelas instituições europeias – têm desempenhado um papel importante em parar a execução do "Tratado Constitucional" e impulsionaram uma mobilização anti-Euro. No enquanto isso, os organismos europeus e as empresas transnacionais instalaram uma base nova e alternativa para a integração. Uma mudança radical pode ser observada, a partir da pesquisa de um conjunto (ainda) sintético de princípios – como os estabelecidos na Carta dos Direitos Fundamentais da União Europeia – para uma produção normativa profundamente técnica e detalhada. A regulação da segurança no lugar de trabalho é um dos melhores pontos de observação para estudar a transformação mencionada. Longe de pôr em causa as posições desequilibradas entre as partes nas relações de trabalho contemporâneas, a estratégia europeia para a proteção da saúde dos trabalhadores prefere as questões procedimentais e a adesão voluntária aos instrumentos de soft law. No passado, a doutrina jurídica descrevia a criação de uma arquitetura multi-nível de instituições, as vezes implementada por meio de uma abordagem de cima para baixo (top-down approach). Junto com isso, recentemente, teve a implementação de padrões organizacionais comuns para a criação de um sistema específico de governança corporativa, finalizado a buscar uma melhor integração entre os negócios e os direitos fundamentais.

O trabalho analisa as interpretações dadas à Lei de Responsabilidade Fiscal nos 19 anos de sua implantação. Como uma instituição que procura regular a gestão fiscal de governos por todo o País, parte significativa da coerção da Lei no nível regional e local cabe aos Tribunais de Contas de Estados e Municípios. Adotou-se o modelo teórico de mudança institucional de Mahoney e Thelen (2009), com evidências coletadas por questionário, para dar uma primeira explicação para a mudança incremental na legislação fiscal. A Lei de Responsabilidade Fiscal tem sido interpretada pelos órgãos de auditoria, de tal forma que, em alguns casos, surgem práticas de contabilidade criativa, diminuindo a contenção do gasto excessivo e gerando sobre-endividamento. ; The paper analyzes the interpretations given to the Fiscal Responsibility Law after 19 years of its implementation. As an institution that seeks to regulate the fiscal management of governments throughout the country, a significant part of the enforcement of the law at the regional and local level rests with the State and Municipal Courts of Accounts. We adopted the theoretical model of institutional change by Mahoney and Thelen (2009), with evidence collected by questionnaire, to give a first explanation for the incremental change of such fiscal legislation. The Fiscal Responsibility Law has been interpreted by the auditing bodies, in such a way that, in some cases, creative accounting practices emerge, reducing the containment of excessive spending and generating over-indebtedness.

Kosovo is the largest per capita recipient of EU financial aid in the world, and is home to the largest civilian crisis management mission ever launched by the EU (EULEX). However, it is questionable whether or not this assistance has been sufficiently effective. The judiciary continues to suffer from political interference, inefficiency and a lack of transparency and enforcement. The Kosovar authorities do not prioritize sufficiently the rule of law and the disagreement over the recognition of Kosovo jeopardizes the incentive for EU accession. This paper considers the EU's assistance to Kosovo in the field of the rule of law and assesses its success in achieving its intended results. A refundação do regulamento n.º 44/2001 pelo regulamento n.º 1215/2012 pautase pela observância, em absoluto, no espaço da União Europeia, dos princípios da confiança recíproca entre Estados-Membros na administração da justiça e do acesso à justiça dos cidadãos que nela residem e circulam. Numa União marcada pelas liberdades fundamentais de circulação e pela existência de um mercado interno, estes princípios justificam que as decisões judiciais proferidas num Estado-Membro sejam automaticamente reconhecidas e executadas, noutro Estado-Membro, exceto em caso de impugnação por parte do demandado. Seria difícil imaginar a prossecução de uma cooperação e uma integração judiciárias sem confiança – esta tem de ser criada entre tribunais de diferentes Estados-Membros, e de ser sentida pelos próprios cidadãos europeus, de modo a que possam ver que a Europa está ativamente à procura de melhorar as suas condições de vida e de trabalho. A Comissão Europeia envidou esforços construtivos para uma supressão do exequatur, querendo que o processo de reconhecimento e de execução ora previsto no regulamento n.º 1215/2012 fosse mais simplificado (até propôs a exclusão da cláusula de ordem pública, o que não foi adotado). É necessário analisar como o Tribunal de Justiça interpreta as regras relativas à recusa de reconhecimento ou de execução de sentenças emanadas noutros Estados-Membros, para perceber se a tutela jurisdicional efetiva é observada pelo regulamento n.º 1215/2012. ; The Brussels I Regulation's re-foundation by the New Brussels I Regulation was thought to secure reciprocal trust on justice administration among Member States and to grant full access to justice for those who inhabit and circulate in its territory. In a Union characterized by circulation freedoms and an internal market existence, those principles justify a situation in which judgments ruled by a Member State's court are automatically recognised and enforced, in other Member-State, except when the defendant evokes the rules on denial of judgments' recognition and enforcement. There would not be judicial cooperation and integration's prosecution without trust – trust must exist among Member States' courts and it must be felt by EU citizens so they can acknowledge that EU is actively seeking to improve their life and working conditions. The European Commission made constructive efforts to promote an exequatur's abolition, making recognition and enforcement proceedings on the New Brussels I Regulation simpler (it even proposed to remove the "public policy" clause, which was not accepted). It is necessary to analyse howthe CJEU applies the rules on denial of judgments' recognition and enforcement to perceive if the principle of an effective judicial protection is fulfilled under New Brussels I Regulation.

The constitutional role and authority of the Public Prosecutor's Office (MP) as an enforcer of law warranted the MP protagonism in the enforcement of environmental legislation and accountability of environmental agencies in Brazil. The MP instituted regional offices to tackle the environmental issue and established a team of experts to provide technical support. This research analyzes the participation of the São Paulo State Public Prosecutor's Office (MPSP) and the Federal Public Prosecutor's Office (MPF) experts in the environmental licensing of the Mexilhão Project. The project was located in the coastal region of the state of São Paulo and initially aimed to reduce by half the volume of natural gas imported by the country. Based on the analysis of documents and interviews, this paper shows that there were different interpretations and framings among the MP experts concerning environmental impacts and risks of the project. This paper is the result of the study Apreensões de drogas no estado de São Paulo: Um raio-x das apreensões de drogas segundo ocorrências e massa [Drug Seizures in the State of São Paulo: An In-Depth View of Drug Seizures Broken Down by Number of Incidents and Drug Amounts], conducted by Instituto Sou da Paz to encourage a discussion about Brazil's drug policy. The study focuses on drug incidents in the state of São Paulo, the richest and most populous in Brazil, which accounts for 28% of all drug incidents in the country. São Paulo is also the state with the largest police force—about 100,000 policiais militares [ostensible police officers] and 30,000 policiais civis [investigative police officers]. São Paulo law enforcement seized over 100 MT [metric tons] of drugs in the state in 2015. In 2016, drug seizures totaled over 160 MT.1 Data on drug seizures in Brazil are still scarce. It is crucial to have those data to assess the performance of the institutions comprising the criminal justice system as far as drugs are concerned. Based on statistical resources, we found that a large number of drug incidents involve small amounts of drugs, whereas large seizures account for a significant share of the total amount of drugs seized. By comparing those data, we show police resources are largely used in incidents that have no impact on the drug trafficking chain and in which only drug users and small drug dealers are charged. Este artigo deriva da pesquisa "Apreensões de drogas no estado de São Paulo: Um raio-x das apreensões de drogas segundo ocorrências e massa", realizada pelo Instituto Sou da Paz para fomentar a discussão sobre a política de drogas no Brasil. O trabalho se debruça sobre as ocorrências de drogas do Estado de São Paulo, o mais rico e populoso da federação, que responde por 28% de todas as ocorrências do país. São Paulo é também a unidade federativa com o maior efetivo policial, com aproximadamente 100 mil policiais militares e 30 mil policiais civis. Em 2015, as forças de segurança de São Paulo ultrapassaram a marca de 100 toneladas de drogas apreendidas em seu território. No ano seguinte foram mais de 160 toneladas .Os dados sobre as apreensões de drogas no Brasil ainda são escassos. Esses dados são fundamentais para analisarmos a atuação das instituições do Sistema de Justiça Criminal no que concerne à questão das drogas. Utilizando recursos estatísticos, observamos que grande parte das ocorrências envolve quantidades pequenas de droga, ao passo que as grandes apreensões têm significativa participação no total de quantidade de drogas apreendidas. Com esses cruzamentos, demonstramos que boa parte dos recursos policiais são empregados em ocorrências que não impactam na cadeia de tráfico de drogas, autuando usuários e pequenos traficantes. The study intends to analyze the role of ombudsman agencies in the enforcement of the personal data protection in the public sector, based on their legal attributions and procedures provided for in the applicable legislation, in particular Law n. 12,527 of 2011, Law No. 13,460 of 2017, and Law No. 13,709 of 2018, and their respective regulations. To this end, three issues emerging as central are discussed: (i) what are the legal characteristics and attributions of public ombudsman offices in Brazil?; (ii) what are the legal assignments of the ombudsman's agencies after Law No. 13,709 and the ANPD ombudsman's office and how should both contribute to data protection effectiveness in the public sector?; and, (iii) how to consider the functions of the ombudsman, the data protection officer (DPO) and the controller in the implementation of LGPD standards in the public sector? The analysis of these themes allows an interesting approximation of the practical reality of the data protection in the public sector, from the conception that the public ombudsman is a central link of communication between citizen and State and as an instrument of control over violations of this right and the regulatory functions. The methodology adopted is deductive and the research technique is indirect with bibliographic source. ; O estudo pretende analisar o papel das ouvidorias na efetivação da proteção de dados pessoais no setor público, a partir das suas atribuições legais e dos procedimentos previstos na legislação aplicável, em especial a Lei 12.527, de 2011, a Lei 13.460, de 2017, e a Lei 13.709, de 2018, e seus respectivos regulamentos. In the current globalized world, the individualism is emphasized, threatening human values to capitulate within market relationships. In this context, education emerges as a powerful tool to revalue the human being as a person and in the relationship with others. Therefore, this essay aims to explore LGBTI groups' human rights and analyze how these rights of sexual diversity work as a necessary analytical approach to promote tolerance, as well as respect, through education. To do this, it will be studied how the international scenario is channeled into the local level through the Ley 26150 de Educación Sexual Integral, 2006 (Argentinian law on Integral Sexual Education), and its compliance will be tested implementing surveys and semi-structured interviews. In this regard, specific analytical criteria have been used, such as the level of education of teachers, the existence of real situations of discrimination based on sexual motivations within school facilities, and the boundaries and resistances that come from other social environments. Therefore, we prove that, despite the new legal progressive advances, the daily enforcement of the sexual education law shows limits that derive from the cultural context, as well as from the lack of training of teachers. ; En el mundo globalizado actual se profundiza el individualismo en el que los valores humanos están expuestos permanentemente a capitular dentro de las relaciones de mercado. En este contexto, la educación emerge como la herramienta idónea para revalorizar al sujeto como persona en sí misma y en su relación con las otras. En este sentido, el objetivo de este trabajo consiste en explorar los derechos humanos de las personas LGBTI y cómo estos derechos de la diversidad sexual operan como un enfoque analítico necesario para fomentar la tolerancia y el respeto por los otros seres a través de la educación. Para ello, se analiza la canalización del escenario internacional hacia el nivel local dentro de la República Argentina por medio de la Ley de Educación Sexual Integral Ley 26150 (2006) y se toman datos cualitativos y cuantitativos sobre la implementación de esta norma por medio de encuestas y entrevistas semiestructuradas a docentes. En este punto, se utilizan como criterios de análisis el grado de capacitación de docentes, la existencia de situaciones reales de discriminación por motivos sexuales en ámbitos educativos y la presencia de límites que provienen del entorno a la hora de aplicar estas políticas. De tal manera, se demuestra que a pesar de los avances legislativos progresistas, la aplicación cotidiana de la educación sexual presenta ciertas resistencias que provienen del entorno cultural como así también de la falta de capacitación del personal docente. ; No atual mundo globalizado, o individualismo se aprofunda; neste individualismo os valores humanos estão permanentemente expostos dentro das relações de mercado. Nesse contexto, a educação se apresenta como a ferramenta ideal para reavaliar o sujeito como pessoa em si mesmo e em sua relação com os demais. Nesse sentido, o objetivo deste trabalho é explorar os direitos humanos das pessoas LGBTI e como esses direitos da diversidade sexual operam como uma abordagem analítica necessária para promover a tolerância e o respeito entre as pessoas, através da educação. Para fazer isso, é feito um análise da canalização do contexto internacional ao nível local dentro da República Argentina, através da Lei de educação sexual integral 26150 (2006), por meio de dados qualitativos e quantitativos sobre a implementação desta norma, utilizando enquete e entrevistas semiestruturadas com professores. Nesse ponto, é tomado em conta o grau de formação dos professores como parte dos critérios de análises, a existência de situações reais de discriminação por motivos sexuais em ambientes educacionais e a presença de limites provenientes do ambiente na aplicação dessas políticas. Desta forma, demonstra-se que, apesar dos avanços legislativos progressistas, a aplicação cotidiana da educação sexual apresenta certas resistências originadas do contexto cultural, bem como a falta de capacitação do corpo docente.
