In this article we try to show the troublesome relation between biopolitcs, biopower and human rights in Michel Foucault. The notion of right is a classical notion, insofar as it pertains to the juridical conception of politics and to the techniques of sovereign power. On the other side, the idea of the human animal as human being appears only in Modernity, within the different dispositives that constitute what Foucault called the modern biopower. Therefore, talking of human rights one puts together the idea of right and the idea of human being, i.e. two notions belonging to two historically distinct techniques of power. In the awareness of this distinction, one has to question why Foucault, in face of what was going on in his days, did nevertheless appeal – against governments – to the rights of those who are governed. Classical right may have nothing to do with biopolitics; however with regard to the so-called human rights we cannot claim the same.

The objective this article is to investigate the problem of the formalism in moral giving emphasis to G. W. F. Hegel and its Philosophy of Right as proposal of objectivation of the normative contents of acting. The intention is to present the version of Hegel for the problem of the formalism in relation the determination of acting in the sphere ethical, politics and legal. For the concretion of such task it is necessary to investigate the consideration concerning the 'Moralität and Sittlichkeit', estimated basic to build a project stuffed for a 'Philosophy of Right' and the figure of the State politician. The contributions of Hegel to effectuate the proposal of overcoming of the formalism if find in 'Grundlinien der Philosophie des Rechts: Über die wissenscaftischen Behandlungsarten der Naturrechts and Phänomenologie des Geistes'. The author apresents a clarification some of the main aspects in such a way of the objections how much of the attempts of reply to the problem.

The present article's main objective is to investigate the nuances of the relation established between the notion of love of fate and the thought of the eternal recurrence as they appear in book IV of "The gay science" (1882), work of Friedrich Nietzsche. The affirmative sense of this work, which is expressed in a poetic and artistic way, allows us to start the analysis of the questions to be explored from an aesthetic perspective. We intend, therefore, to approach the different meanings of the concept of art in Nietzsche's philosophy in order to better understand the concept of life as a work of art - from that, thinking possible ways of articulation between the notion of life as a work of art and the communication of love of fate and the eternal recurrence as constituent parts of the project of transvaluation of values. This research facilitates a better understanding of the possible relation that the philosopher establishes between the notion of love of fate - which takes place in the first aphorism of book IV - and the thought of the eternal recurrence - which is announced in the penultimate aphorism of the same book. Therefore, the article investigates to what extent and how the mutual crossing of both concepts occurs and its relevance in the general framework of Nietzsche's philosophy.

O direito de liberdade[1] à informação jornalística foi objeto de proteção específica pela nossa Constituição, que, no parágrafo lº, do artigo 220, vedou expressamente qualquer atividade que possa constituir obstáculo ou embaraço ao fluxo informativo. Nesse sentido, o mens constitutionem é clara e incontroversa ao estipular vedação, quer ao Poder Executivo, quer ao Legislativo, para edição de atos ou desempenho de atividades que obstaculizem ou, de alguma forma, embaracem a livre informação jornalística. Na verdade, a informação jornalística foi alçada a um patamar singular de proteção por razões bastante palpáveis. É que a informação jornalística constitui veículo da opinião pública livre. Esta, de sua vez, garantia institucional da democracia e do pluralismo político, indicados, pelo artigo 1º, caput e inciso V, da Constituição Federal, como, respectivamente, essência e fundamento da República Brasileira. O direito de informação jornalística, tal qual os demais direitos fundamentais, não é absoluto. Antes, é limitável, encontrando na existência e na observância dos demais direitos constitucionais as fronteiras demarcatórias da sua extensão. Em diversas situações, o exercício de um direito fundamental pode implicar a ofensa de outro, ou outros direitos, de igual ou diferente natureza. Essas hipóteses, concretizadas amiúde na fenomenilização dos preceitos constitucionais fundamentais, albergam diferentes soluções. Muitas vezes, por exemplo, a própria Constituição se preocupa com a compatibilização dos dois ou mais institutos envolvidos. Por um lado, por exemplo, prescreve o direito fundamental à propriedade privada. De outro, institucionaliza a desapropriação. Contudo, compatibiliza a aparente assincronia, disciplinando a prévia e justa indenização. Em outras ocasiões, o constituinte outorga ao legislador ordinário a faculdade de integrar em eficácia institutos constitucionais, ou ainda faculta a edição de diploma de eficácia de suas normas. O presente artigo problematiza a incorporação da promoção dos direitos LGBTI nas políticas externas dos EUA e da UE. Em primeiro lugar, examina os principais documentos, discursos e políticas dos dois atores sobre à promoção dos direitos LGBTI no estrangeiro, e as semelhanças e diferenças entre as abordagens de ambos, atendendo às tendências da sua evolução e desenvolvimento contínuo. Em segundo lugar, o artigo analisa as condições internas nos países alvo que são propícias ao sucesso e ao fracasso do apoio internacional aos direitos LGBTI. Finalmente, o estudo apresenta uma visão crítica das medidas que são consideradas necessárias para aumentar a eficiência da promoção dos direitos LGBTI em países com tendências atuais mais negativas e/ou com historiais mais pobres sobre os direitos LGBTI.

The last elections in Brazil have shown a growing participation of evangelicals in the political scenario and a majority identification with right-wing governments. A representative mark of this behavior occurred in the expressive support given to the presidential election of Bolsonaro and in the occupation of several positions in the exercise of his government. The article presents the historical trajectory of evangelical behavior in the political sphere and also the factors that historically configure theimagery of this religious segment, guiding its approaches to the right. Priority is given to the conceptual notion of "imaginary", as used by the so-called new political history. As sources of analysis, in addition to bibliographic texts, audiovisual resources, social media and lyrics from the Brazilian evangelical universe are used.

The article presents an analysis of ethnography carried out in the scene of lesbian parties that take place in Downtown São Paulo, where an eroticized funk circulates, as well as interviews with participants of the scene during the Covid_19 pandemic. The field comprehends two parties: "Sarrada no Brejo" and "Fancha", (local funk brazilian parties). Based on the notion of local musicking, as well as locality, displacement and intersectionality I analyze the ways of how funk promotes an engagement among the participants, supporting the processes of transformation and identification that configure the lesbian, fat and black bodies. Observing funk music, the performance and the localities involved, I identify in this way of musicking a set of actions that resignify stereotypes and the body considered as an abject, transforming it into a political body through fun, occupation and creation of spaces. ; O artigo apresenta análise sobre etnografia realizada na cena de festas lésbicas que ocorrem no centro da cidade de São Paulo, por onde circula o funk com teor erotizado, como também sobre entrevistas realizadas com participantes da cena durante a pandemia de Covid-19. O campo abrange duas festas: a "Sarrada no Brejo" e a "Fancha". A partir da noção de musicar local, como também de localidade, deslocamentos e interseccionalidades, analiso os modos como o funk propicia um engajamento entre as participantes, auxiliando nos processos de transformação e identificação que configuram o corpo lésbico e, também, gordo e negro. Observando o funk, a performance e as localidades envolvidas, identifico nessa forma de musicar um conjunto de ações que ressignificam estereótipos e o corpo considerado abjeto, transformando-o num corpo político por meio da diversão, ocupação e criação de espaços.

Executive Council Thirty-Fourth Ordinary Session 7 – 8 February 2019 Addis Ababa, Ethiopia ; The African Court on Human and Peoples' Rights (the Court) was established in terms of Article 1 of the Protocol to the African Charter on Human and Peoples' Rights on the Establishment of an African Court on Human and Peoples' Rights (hereinafter referred to as "the Protocol"), adopted on 9 June 1998, in Ouagadougou, Burkina Faso, by the then Organization of African Unity (OAU). The Protocol entered into force on 25 January 2004. The Court became operational in 2006 and is composed of eleven (11) Judges elected by the Executive Council and appointed by the Assembly of Heads of State and Government of the African Union. The Seat of the Court is in Arusha, the United Republic of Tanzania. Article 31 of the Protocol mandates the Court to "…submit to each regular session of the Assembly, a report on its work. The report shall specify, in particular, the cases in which a State has not complied with the Court's judgment.

Objective: to understand the access of lesbians, gays, bisexuals and transvestites/transsexuals to the Basic Family Health Units. Methods: qualitative research held with 54 patients. A semi-structured interview and the free association test were used. The data were processed by the software IRaMuTeQ® and submitted to the technique of Content Analysis in the thematic modality. Results:six categories emerged: Silencing regarding sexual orientation and gender identity – access is facilitated as they do not reveal themselves; Invisibility and indifference to legal political references - antagonism between the paradigm thought and executed; Homophobic manifestations and effects on access - restricted use of the service; Embarrassment and distancing - removal and search for private services; Des (humanized) and unethical practices - lack of awareness, secrecy; and Stigma and access - permanence of stigmata between Acquired Immunodeficiency Syndrome and homosexuality. Conclusion: the access to health services is limited with intolerance, constraints, exclusionary and aerial positions. ; Objetivo: compreender o acesso de lésbicas, gays, bissexuais e travestis/transexuais às Unidades Básicas de Saúde da Família. Métodos: pesquisa qualitativa, realizada com 54 usuários(as). Utilizou-se entrevista semiestruturada e o teste de associação livre de palavras. Os dados foram processados pelo software IRaMuTeQ®, submetidos à técnica de Análise de Conteúdo. Resultados: emergiram seis categorias: Silenciamento quanto à orientação sexual e identidade de gênero -o acesso é facilitado desde que não se revelem; Invisibilidade e indiferença aos marcos políticos legais- antagonismo entre o paradigma pensado e executado; Manifestações homofóbicas e efeitos no acesso - uso restrito do serviço; Constrangimento e distanciamento - afastamento e busca por serviços privados; Práticas des(humanizadas) e antiéticas - falta de sensibilização, sigilo; e Estigma e acesso - permanência de estigmas entre Síndrome de Imunodeficiência Adquirida e homossexualidade. Conclusão: o acesso desta população aos serviços de saúde é limitado, permeado por intolerância, constrangimentos e posicionamentos aéticos e excludentes.
