With the Iast cut in world history occurring in 1989 and throughout the destruction of communist dictatorships and the Soviet World Empire, a new stage in the planetary process of globalization began, in which most countries in the world labelled themselves as democratic states, "ruled by the people". The increasing trend of 40 in 1972 up to the currently estimated 1 23 democratic countries of the 192 states registered in the United Nations may continue in the future. Speculation of various theories, such as Francis Fukuyama's The End of Hjstory and the Last Mon (1992)l , that liberal democratic nation-states were the universal standard form of human society has been disproved through the globalization process which abolished the boundaries and led liberal democracies over the state borders to a supranational world society. Transformation to global democracy threatens the fundamental principles of the former liberal nation-state democracy.

Bu makalede self determinasyon hakkının yirminci yüzyılda Milletler Cemiyeti ve Birleşmiş Milletler dönemleri uluslararası hukukunda geçirdiği aşamalar; hakkın, tarihsel, siyasal ve felsefi kökleri ile birlikte özellikle 1980'li yıllardan sonra self determinasyon hakkı konusunda akademik yazında geliştirilen bazı teoriler incelenecektir. Bu bağlamda, self determinasyonun uluslararası hukukta gözetilmesi istenen siyasal bir ilkeden 1960'lı yıllarda Birleşmiş Milletler bünyesinde yapılan çalışmalarla birlikte yükümlülük doğuran bir hakka doğru evrildiği gösterilecektir. Self determinasyonun bir hak olarak değerlendirilmeye başlanması ile birlikte iç ve dış self determinasyon ayrımları da yapılmaya başlanmıştır. Ancak meselenin, uluslararası hukukun diğer ilkeleri, güç ilişkileri, milliyetçilik, demokratik yönetim, kültürel haklar ve insan hakları ile olan ilişkisinden kaynaklanan çok boyutlu bir yapısı vardır. Özellikle hakkın kompleks yapısı ve dış self determinasyonun bir formu olan ayrılma hakkı ile mevcut uluslararası hukuk arasındaki uyumsuzluk nedeni ile akademik yazında self determinasyon hakkı üzerine bazı (liberal) teoriler geliştirilmiştir. Bu teoriler, bu hakkı gerekçelendirmeye, kapsamını belirlemeye ve pratik uygulamasına ilişkin kısıtlamaların neler olabileceği gibi konulara odaklanmıştır. The current political climate appears to create accentuated divisions among various incompatible world views. In a globalized world, faster dissemination of information is much faster via social media and other sources like has never experienced before. A local incident may rapidly turned into an international crisis. For instance, a civil war in Syria now has deeply impacted the politics and social structures of many counties around the world. In this social environment tacking with various types of violent extremism and radical popularism have become increasingly challenging. These radical worldviews may be manifested in either end of the political spectrum, namely right or left, based on ethnicity or exploitation of religion. Following the terror attacks of 9/11 security services and public have focused on the threat posed by terrorist groups such as DAESH and Al-Qaeda. However, threats of violence also remain significant in the case of violent extreme right as well as left group. Challenges in tackling violent right-wind extremism is a complicated matter as they may not be seen as a significant security threat in the west. For example, despite a number of terror attacks carried by right supremacists in the USA, this group has not been listed as a terror group by the state. Also, the terror suspects are more likely to be described as mentally disturbed and disgruntled people should they be white. In other to counter violent extremism, whether based on ideology, ethnicity, or exploitation of religion, we need to systematically examine the root cause of such violent tendencies. In this regard, rising radical right popularism in the West calls for a comprehensive examination of this social movement.

Siyasal haklar ve ödevler, vatandaşların siyasal iktidarın oluşumuna ve kullanılmasına, bir başka ifade ile devlet yönetimine katılmasını sağlar. Böylece vatandaşlar devleti denetler ve yönlendirir. Siyasal haklar, bu yönüyle demokratik sistemin temelini oluşturur. Bu çalışma, üç bölümden oluşmaktadır. İlk bölümde genel olarak insan hakları, tarihi gelişimi, ülkemizdeki gelişimi ve sınıflandırılması incelenmiştir. İkinci bölümde siyasi hakların diğer haklarla ilişkisi ve siyasi hakların Anayasamıza göre sınırlandırılması incelenmiştir. Üçüncü bölümde ise, Anayasamızın 66 ve 74. maddeleri arasında düzenlenen seçme hakkı, dilekçe hakkı gibi hakların tamamı tek tek incelenmiştir. Bu çerçevede doktrindeki tartışmalara, Anayasa Mahkemesi ve Yüksek Seçim Kurulu Kararlarına da yer verilmiştir. Sonuç bölümünde ise; siyasal hakların genel bir değerlendirilmesi yapılarak, getirilen eleştiriler ve yapılan analizler yer almıştır. ; Political rights and obligations not only provide for citizens to constitute the political autority and also provide them the usage and participation of the political authority. In this way, citizens control and affect political policies. So the political rights constitute the foundation of the democratic system. This thesis have three chapters. In the first chapter, human rights in a general perspective, historical background of the human rights in Turkey and in the other countries and the classification of human rights are studied. In the second chapter, the relationship between the political rights and the classification of the political rights according to the Tukish Constitution. In the third chapter, rights regulated between the 66 th and 74th sections of the Tukish Constiution, like the right to elect and right of petition, are observed. In this context, scientific argumantations and the decisions of the Constitutonal Court and the High Election Board are examend. A general appreciation of the political rights with their critics and the analysations take place in the Conclusion.

ÖZETTÜRKİYE'NİN AVRUPA BİRLİĞİ'NE KATILIM SÜRECİ BAĞLAMINDA TÜRKİYE'DE KÜRTÇE DİL HAKLARI: AVRUPA ULUS-DEVLET MODELİ VE AZINLIK HAKLARINA ELEŞTİREL BİR YAKLAŞIMDil haklarının kaydadeğer bir şekilde uluslararası gündemi meşgul etmeye başladığı Soğuk Savaş sonrası dönemden itibaren, uluslararası kuruluşlar ve Avrupa kuruluşları azınlıkların dil haklarının korunması üzerine önemli metinler yayınlamaktadır. Bu gelişme, 2000 yılından itibaren ivme kazanan Türkiye'nin Avrupa Birliği'ne katılım süreci sebebiyle Kürtçe dil haklarının güncel bir soruna dönüştüğü Türkiye'deki mevcut eğilime de denk düşmektedir. Bu çalışma, Avrupa diasporasındaki ve Türkiye'deki Kürt entelektüellerinin görüşlerini dahil ederek, bu sürecin Türkiye'deki Kürtçe dil hakları sorunu üzerindeki etkilerini incelemiştir. Avrupa diasporasında ve Türkiye'de ileri gelen Kürt entelektüelleriyle yapılan görüşmeler, bu sürece yönelik olarak Kürt dilsel topluluğunun takındığı farklı tutumları ortaya çıkarmıştır. Bu sürecin incelenmesi, azınlıkların dil haklarının korunması üzerine uluslararası ve Avrupalı mekanizmaları da sınırlayan liberal ulus-devlet söylemine içkin çelişkiler üzerine bir analizi de ihtiva etmektedir. Bu inceleme, aynı zamanda, azınlıkların dil hakları üzerine uluslararası ve Avrupalı metinlerin, dilsel azınlık toplulukların beklentilerini neden karşılayamadığını da açıklamaktadır. Bu bağlamda, bu çalışmanın kuramsal iskeleti, dile özel bir atıfla, çoğunluk ve azınlık, birey ve topluluk, kamusal ve özel alanlar arasındaki ikili karşıtlıklar üzerine yapısökümcü bir analiz yardımıyla, dil haklarının sorunsallaştırılmasına hasredilmiştir. ABSTRACTKURDISH LINGUISTIC RIGHTS IN TURKEY WITH REFERENCE TO TURKEY'S ACCESSION PROCESS TO THE EUROPEAN UNION: A CRITICAL APPROACH TO THE EUROPEAN MODEL OF NATION-STATE AND MINORITY RIGHTSInternational and European organisations have issued significant documents on the protection of the linguistic rights of minorities since the beginning of post-Cold War era, when the question of linguistic rights has started to remarkably occupy the international agenda. This development has been matched by a parallel trend in Turkey, where the Kurdish linguistic rights have become a topical issue since 2000 due to the acceleration of Turkey's accession process to the European Union. This study examines the implications of this process on the question of Kurdish linguistic rights in Turkey through the inclusion of the views of Kurdish intellectuals in European diaspora and Turkey. The interviews conducted with the prominent Kurdish intellectuals reveal the diversity of standpoints that the Kurdish linguistic community takes with regard to this process. The examination of this process also includes an analysis on the contradictions within the liberal nation-state discourse, which delimits the international and European mechanisms for the protection of the linguistic rights of minorities. This examination explains why the international and European documents on the linguistic rights of minorities cannot meet the expectations of the linguistic minority communities. In this sense, the theoretical backbone of this study is devoted to the problematisation of linguistic rights with the help of a deconstructivist analysis on the binary oppositions between the majority and the minority, between the individual and community, and between the public and private spheres with a special reference to language, which has been a significant constituent of the liberal nationalist discourse. Therefore, this study tries to become involved in contemporary critical approaches to the nationalist discourse through connecting the views of the Kurdish intellectuals in European diaspora and Turkey on the question of Kurdish linguistic rights in Turkey with a critical analysis on the liberal nation-state philosophy and minority rights.

Çalışmada, popülizmin esasen liberal demokrasinin iç krizi olduğu ve bu krizden çıkmak için türeyen yeni bir konuşma biçimi olduğu teziyle, radikal ya da aşırı-sağ hareketlerin ve partilerin güçlenme nedenleri ve sonuçları anlatılacaktır. Avrupa Parlamentosu veya ülkelerindeki seçimlerde oylarını artıran aşırı-sağ parti örneklerine ve bu partilerin etkisiyle merkez partilerin radikalleşme sürecine değinilecektir. Avrupalılaşma düşüncesinin gerilemesi, anayasa tartışmalarında AB'nin yeni bir aşamaya geçememesi ile birlikte ülkeler kendi iç siyasetlerinin belirleyiciliğine geri dönmektedir. Popülist sağ partiler bu süreçte yeni bir siyaset önerseler de önerilerinin evrensel insan hakları ile temel hak ve özgürlüklerin gerisine düşmeden serbest piyasacı bir versiyonun ötesine geçmesi gerekir. ; The study aims to analyze the reason and results of the radical or extremeright movement and parties in Europe in the framework of the thought that populism is the inner crisis of liberal democracy. This paper analyzes the extreme political party cases, which raise their voting rate in the European Parliament elections and national or local parliament elections and the radicalization of mainstream parties, which are under the effect of those parties, especially in Poland and Hungary. These countries have got back to domination of domestic politics in the process that declining of Europeanization and the failure of moving European Union to another stage in the constitution debate. Populist radical right has raised its power on this process. While these parties offer a new politics, new democracy have to go beyond free market-based version and not go back to basic universal human rights.
