<p><span class="fontstyle0">La literatura de movilización legal se ha apoyado en el concepto de "marco maestro" para comprender la definición de las demandas basadas en derechos de los movimientos sociales. Entrado el siglo xxi, en diferentes latitudes de América Latina, los movimientos LGBT presentaron un manejo discursivo y estrategias basadas en derechos, a pesar de que en sus contextos no se encontraba disponible un marco maestro legal. Mediante el estudio de caso de la movilización por el reconocimiento de las uniones entre parejas del mismo sexo en la Ciudad de México (2000-2006) este artículo tiene como objetivo comprender el proceso de definición de la disputa realizada por el movimiento. La comparación e interacción entre los movimientos LGBT y de mujeres permite sostener que por medio de "difusión relacional" los activistas concretaron un discurso y estrategias legales. Al seleccionar el caso de estudio por muestreo teórico esta investigación contribuye ampliando las categorías de análisis relacionadas con las definiciones legales de los movimientos LGBT latinoamericanos, y en general, es de utilidad para reconsiderar las categorías articuladas al concepto de enmarcamiento legal.</span> <br /><br /></p>
The aim of this article is to present a renewed reading of ethical-normative debates on recognition of cultural differences, by interrogating the initiatives that have constituted the international minority rights framework. The article is divided into three sections: 1. The first section approaches an introductory definition of minority rights. 2. The second section presents the philosophical reading of Charles Taylor on minority rights, within the ethical framework of his communitarian conception of freedom and individual development. 3. The third section presents the philosophical reading of Bhabha on minority rights, within the ethical framework of his humanistic critique to the political construction of cultural differences. ; El objetivo de este artículo es presentar una lectura actualizada de los debates ético-normativos sobre el reconocimiento de las diferencias, a propósito de las iniciativas que han configurado el marco legal internacional de derechos de las minorías. Para ello, el artículo se organiza en tres apartados: 1. El primer apartado está dedicado a presentar una definición introductoria de los derechos de las minorías. 2. El segundo apartado presenta la lectura ético-filosófica que plantea Charles Taylor sobre el derecho de las minorías, en el marco de su concepción comunitarista de la libertad y el desarrollo individual. 3. El tercer apartado presenta la lectura ético-filosófica que plantea Bhabha sobre el derecho de las minorías, en el marco de su crítica humanista a la construcción política de la diferencia.
The linguistic diversity within the European Union is an expression of the multiculturalism and plurality which is the basis of today's Europe. That is why the EU institutions have adopted various regulations aimed at the promotion, preservation and protection of the languages used by EU citizens, especially those of so-called regional or minority groups. Though implementing this protection is delegated to Member States themselves, the EU authorities for their part have also taken decisive steps in order to ensure the continued health of the languages that enrich the idiosyncrasies of both the Member States and of the Union itself. While the protection of minorities at a Community level was not an initial priority at the outset of the EU given the greater importance of economic and political considerations. However, with the entry into force of the Treaty of Maastricht there has been a significant change in this respect; the recognition of minority rights has now become a reality. This recognition is now given due consideration as evidenced by the provisions of both the Charter of Fundamental Rights and the Treaty of Lisbon. This paper has outlined the progress that has been made in the protection of linguistic minorities at the EU community level, without forgetting the work within other extra-Eu institutions, as it is the case of the Council of Europe, among others, without whose work the levels of protection of existing minority languages not have reached today. ; The linguistic diversity within the European Union is an expression of the multiculturalism and plurality which is the basis of today's Europe. Es por ello que desde las instituciones han sido adoptadas distintas normativas tendentes a la promoción, conservación y protección de la lenguas utilizadas por los ciudadanos comunitarios, especialmente de las denominadas regionales o minoritarias, ya que si bien es verdad, que esta protección ha de ser llevada a cabo por los propios Estados miembros, las autoridades comunitarias han dado pasos decisivos en aras a garantizar la no desaparición de las lenguas que enriquecen la idiosincrasia tanto de los Estados como de la propia Unión. La protección en el ámbito comunitario de las minorías no supuso en los indicios de la andadura comunitaria un hecho prioritario, pues en aquellos primeros momentos se incidió en otros aspectos, como el económico o el político que se consideraron más importantes. Sin embargo, con la entrada en vigor del Tratado de Maastricht se produjo un cambio significativo en este aspecto, ya que el reconocimiento de los derechos de las minorías va a convertirse en una realidad. Desde entonces se va a incidir mucho en su protección como queda patente en el tratamiento que de él hace la Carta de los Derechos Fundamentales o el Tratado de Lisboa. En este trabajo vamos ha hacer un recorrido por la evolución que ha sufrido la protección de las minorías lingüísticas en el ámbito comunitario, sin olvidar la labor realizada en el seno de otras instituciones extracomunitarias, como es el caso del Consejo de Europa entre otras, sin cuya labor no se hubieran alcanzado los niveles de protección de las lenguas minoritarias existentes en la actualidad.

The last 15 years have seen an explosion of efforts to develop international norms of minority rights, both at the global level & at regional level. These developments offer the promise of protecting some of the most vulnerable groups in the modern world from serious injustices. Ethnic minorities have not fared well under the Westphalian system of sovereign "nation-states." Various policies of assimilation & exclusion have been directed at minorities in the name of constructing homogenous nation-states, & the international community has historically turned a blind eye to these injustices. Today, however, there is a growing commitment to remedy this situation, & it is increasingly accepted that the treatment of minorities is a matter of legitimate international concern & monitoring. At a minimum, these evolving norms set limits on the means that states can use to pursue their visions of national homogenization. But they also, implicitly at least, offer a competing vision of the state, one which views diversity as an enduring reality & defining feature of the polity, & which views tolerance as a core value. Viewed in this light, the trend towards codifying international norms of minority rights is surely a desirable & progressive one. And yet it raises a number of moral dilemmas & ambiguities. This paper wants to explore some of these dilemmas through a close examination of recent attempts to codify the "rights of national minorities" in Europe. The European experience provides a fascinating, if flawed, experiment in developing international norms of minority rights, one with lessons for other contexts. References. La financiación de las confesiones religiosas ha sido objeto de debate constante en España desde el siglo XIX. Un debate que se intensifica en las deliberaciones de la comisión constituyente de la Constitución Española de 1978, en el que se discute sobre la relación del Estado y las diferentes confesiones religiosas. En el año 1992 se firman los Acuerdos de Cooperación entre el Estado español y la CIE, la FEREDE y la FCIE, que unido a la promulgación de las leyes de fundaciones y mecenazgo establecen la vía de financiación de las confesiones minoritarias. En el año 2004 el gobierno crea la FPC que completa el sistema de financiación. En este trabajo analizaremos las vías de financiación de las confesiones minoritarias y detallaremos los beneficios fiscales y el acceso a las subvenciones directas por parte del Estado para el fomento del derecho a la libertad religiosa, como consecuencia del desarrollo del contenido del artículo 16 de la Constitución Española. ; The financing of religious confessions has been the subject of constant debate in Spain since the 19th century. A debate that intensifies in the deliberations of the constituent commission of the Spanish Constitution of 1978, in which the relationship between the State and the different religious confessions is discussed. In 1992, the Cooperation Agreements were signed between the Spanish State and the CIE, the FEREDE and the FCIE, which together with the enactment of the laws on foundations and patronage, establish the means of financing minority confessions. In 2004 the government created the Pluralism and Coexistence Foundation, which completes the financing system. Mientras para muchos liberales el nacionalismo representa una amenaza a la democracia, otros filósofos multiculturalistas, entre ellos Will Kymlicka, defienden que las reivindicaciones nacionalistas pueden ser consistentes con los principios liberales de libertad y justicia. El argumento central para proteger a las minorías nacionales es que los principios liberales de libertad y justicia están íntimamente vinculados a la cultura societal propia, de modo que las democracias occidentales deberían permitir y proteger las minorías nacionales. No obstante, la política multicultural tiene dos límites de tolerancia: primero, los derechos de las minorías no deben permitir que un grupo oprima a otros grupos; y segundo, tampoco deben permitir que un grupo oprima a sus miembros. ; While for many liberals nationalism represents a threat to democracy, other multicultural philosophers, Will Kymlicka among them, defend the idea that nationalist demands can be consistent with the liberal principles of freedom and justice. However, multicultural politics has two tolerance limits: firstly, the rights of the minority must not allow one group to oppress other groups; and secondly, the rights of the minority must not allow a group to oppress its own members.
La Constitución de la República Bolivariana de Venezuela contempla desde 1999 en su artículo 81: "Se les reconoce a las personas sordas o mudas el derecho a expresarse y comunicarse a través de la lengua de señas" y en el Artículo 119. "El Estado reconocerá la existencia de los pueblos y comunidades indígenas, su organización social, política y económica, sus culturas, usos y costumbres, idiomas y religiones, así como su hábitat y derechos originarios sobre las tierras que ancestral y tradicionalmente ocupan y que son necesarias para desarrollar y garantizar sus formas de vida". El presente trabajo pretende que reconozcamos los derechos expuestos en el articulado, de venezolanos con idénticos derechos a los nuestros, que hasta ahora no habían podido manifestarlos de manera permanente y natural porque, sin proponérnoslo, los manteníamos en un auténtico silencio social. Se pretende en un análisis muy general, ilustrar el reto que representa para la mayoría hablante del español venezolano entender que convivimos con compatriotas que tienen una forma particular de concebir la vida, de entenderla y de nombrarla, venezolanos y venezolanas con una impronta particular biológica y cultural que, muy por encima de esas diferencias, comparten una misma patria y un mismo patrimonio moral con el resto de la población. ; The Constitution of the Bolivarian Republic of Venezuela states since 1999 in its Article 81 that: "Deaf or mute people are recognized as having the right to express and communicate through sign language", and in Article 119: "The State shall recognize the existence of indigenous towns and communities, their social, political and economical organization, their cultures, uses and costumes, languages and religion, as well as their habitat and originary rights over the lands they inhabit ancestrally and traditionally that are necessary to develop and guarantee their ways of living." The following paper aims to recognize the rights expressed on these articles about Venezuelans with identical rights to ours, which could not have been exercised in a permanent and natural way because, without intending it, we kept them in an authentic social silence. The practice of multiculturalism in Colombia is exercised within complex disputes and claims arising among many social actors, beneficiaries or not of differential rights. This article addresses two paradoxes of the political arrangements of multiculturalism in Colombia related to the spatialization of indigenous difference and its political implications. The first one refers to the way in which a legal indigenous subject is shaped, using the fact that an indigenous person lives in "his/her" rural reservation as one of the main features. The second paradox is the political isolation that has taken shape between indigenous peoples and peasants. In this way, I try to prove the importance of studying not only the cultural policies, but also the political culture which enables and builds multiculturalism. ; La práctica del multiculturalismo en Colombia se ejerce en el contexto de complejas disputas y reclamos provenientes de diferentes actores sociales, beneficiarios o no de derechos diferenciales. En este artículo se estudian dos paradojas de los arreglos políticos del multiculturalismo en Colombia, relacionadas con la forma como se espacializa la diferencia indígena; y con ellas, se examinan sus implicaciones políticas. La primera paradoja es la forma como se juzga quién es o no un sujeto indígena legal, utilizando como una de las características predominantes el que un indígena viva en "su" resguardo rural. La segunda paradoja es el aislamiento político que se ha configurado entre indígenas y campesinos. De esta forma, se pretende demostrar la relevancia de estudiar no solo las políticas culturales, sino también la cultura política que posibilita y construye el multiculturalismo.
In the present article, first of all, some of the most frequent objections against the programs of affirmative action are analysed, followed by an examination of the reasons stated by those who plead for them. Finally, are presented the criteria which have to be fulfilled within their implementation in order to meet the requirements of the diverse dimensions of justice. The theoretical framework which comes up meets, on the one hand, the criteria of a normative theory of justice, and, on the other hand, the update of a republican tradition which understands the political association as a community of free and equal citizens.
La tesis que se pretende desarrollar en este escrito, busca abordar el siguiente interrogante: ¿los artículos constitucionales que establecen cláusulas de intangibilidad como procedimientos agravados de reforma de los derechos fundamentales son garantías a la intromisión desmedida del legislador derivado cuando restringe, desarrolla o limita en exceso derechos fundamentales?Responder a esta pregunta será uno de los objetivos de este escrito. Inicialmente se expone que las cláusulas de intangibilidad consagradas en los ordenamientos jurídicos, son entendidas como límites materiales expresos que buscan garantizar derechos fundamentales mediante zonas exentas a la intervención del legislador derivado, tal como acontece en diversos ordenamientos jurídicos como España, Alemania, Brasil o Chile. La Constitución de Alemania, por ejemplo, diseñó una cláusula de intangibilidad consagrada en el Art. 79 - 3 de la Ley de Bonn de 1949, como un mecanismo especial de protección de los derechos fundamentales y del modelo de Estado Federal y Social.Desde este punto de vista, este artículo busca analizar las cláusulas de intangibilidad de los derechos como límites al poder en tanto consagran mecanismos agravados que no pueden ser modificados arbitrariamente y por mayorías legislativas, por venir diseñados previamente dentro del mismo ordenamiento jurídico, tales como la forma de gobierno, el sistema democrático, los principios constitucionales o los derechos fundamentales. ; The thesis to be developed in this paper, seeks to address the following question: constitutional provisions that establish clauses intangibility and procedures aggravated reform of fundamental rights guarantees to the excessive interference of the legislature derived by restricting develops or limits I too fundamental rights?Answering this question will be one of the objectives of this work. The Constitution of Germany, for example, designed a intangibility clause enshrined in Art. 79-3 Bonn Act of 1949, as a special mechanism of protection of fundamental rights and model of Federal State and Social.From this point of view, this paper analyzes the clauses of the inviolability of rights as limits to power as enshrined aggravated mechanisms that cannot be changed arbitrarily by legislative majorities come previously designed within the same legal system, such as form of government, the democratic system, the constitutional principles or fundamental rights.
The alleged legitimacy of democracy is founded on the legislative and executive representative power. But, the voters sometimes are ignored by their representatives and the negative results of public policies question the ability and honesty of political representatives; particularly when these have been incomplete facing oppressed or minority groups. Who should define public policy? This query reveals the need for establish non-recognized rights, apparently illegitimate ones that require becoming the legal framework and will have to operate in parallel to all the general rights. Thus, the right to demand rights and the non-legalized ones are exemplified with the differentiated rights. The proposal is that these rights should be promoted the platforms of the new electronic technologies. ; La representatividad de los poderes legislativo y ejecutivo da legitimidad a la Democracia. Pero en ocasiones los electores son ignorados por sus representantes políticos y los resultados negativos de las políticas públicas cuestionan la capacidad y honradez de los gobernantes; particularmente cuando éstas han sido incompletas de cara a grupos minoritarios o en opresión. ¿Quién debe entonces definir las políticas públicas? Este interrogante devela la necesidad de establecer derechos no reconocidos, derechos aparentemente ilegítimos que requieren devenir al marco legal y tendrán que operar paralelamente al conjunto de derechos generales. Así, el derecho a exigir derechos y los derechos todavía no legalizados, se ejemplifican con los derechos diferenciados. Se propone que estos sean promovidos a partir de las plataformas de las nuevas tecnologías electrónicas.
