Durkheim hat in seinem Werk versucht, die Spannung zwischen Zwang und Selbstbestimmung in einer modernen säkularisierten Moral zu überbrücken. Dazu entwickelte er erstens die Idee einer moralischen Teilautonomie, bei welcher die Individuen aufgrund der Komplexität der modernen arbeitsteiligen Gesellschaft die vorgegebenen moralischen Regeln selbst kreativ auslegen müssen. Durkheim entwickelte zweitens die bekannte Idee der sozialkulturellen Individualisierung, die mit dem Begriff vom "Kult des Individuums" zusammengefasst werden kann. Um den Gegensatz zwischen Zwang und autonomem Handeln zu überwinden, setzte Durkheim drittens die moralische Autonomie mit rationalem Einverständnis gleich und postulierte viertens die These, dass die modernen Menschen der Illusion einer moralischen Autonomie folgen müssen. Durkheim machte mit seiner Gleichsetzung von Selbstbestimmung und dem individuellen Einverständnis in die moralischen Regeln insgesamt einen zentralen Weg deutlich, auf welchem die Autonomie-Illusion entsteht. Betrachtet man gleichzeitig Durkheims Thesen zu den Gelingensbedingungen von Zwang, können ferner Erkenntnisse darüber gewonnen werden, warum diese Autonomie-Illusion in der modernen Gesellschaft genauso notwendig ist wie der Zwang, der hinter ihr steht. In the face of evil, there is no room for relativism. Hamas's deliberate attack against innocent civilians is absolutely wrong. Therefore, it should be universally condemned. I agree with the above conclusion. However, I wonder how a universal recognition of an absolute duty of respect for human dignity can help solving the existential conflict confronting Israelis and Palestinians. Ideally, a two-state solution proposed by the international community can be seen as a reasonable and fair compromise. Nevertheless, the reality on the ground is different. Through implicit learning processes, in particular, (e.g. telling: from moral linguistic usage or from interactive experience) children from an early age acquire an appropriate cognitive understanding of moral target values. The acquisition of formally operational cognitive competences during adolescence allows for an increasingly more appropriate moral judgement, however, it simultaneously promotes an - initially; radically exaggerated - moral relativism. Moral motivation is built up only slowly. A committment to morals developed within the family does not remain stable throughout a person's life. Other influences (such as the composition of the circle of friends, the democratic participation in school affairs, the moral integration of the community, expectations related to sex roles, a political life free of corruption) decide on how important morals are to an adolescent. A moral Historiography without Moralism. Critical views on modern Church History Efforts for realism without moral judgments have identified morals with present law. This leads to positivistic positions, where moral questions are being answered with references to historical legal situations only, without moral implications. With the political changes 1989–1990 a change in historiography followed. This became a problem to historians who saw their task not only in judgment, but in understanding and explaining history. A reverse danger is re-perspectivation and political instrumentalisation. Post-modern theories may not excuse historical relativism. To avoid moralism, we must understand the difference between theological and political discourses. Moralism may be regarded as a secular confessionalism. Moralism in historiography will lead to immoral consequences. In moral historiography without moralism I find a position between moralism and relativism. Moral principles may be found in Natural theology or in the Declaration of Human Rights. We may encounter moral dilemmas both in history and in future. While making moral judgments, we must understand history as a moral problem with several possibilities.

Within the last twenty or so years a lot has changed in bioethics that is worthy of a serious re-writing of its history. Namely, up to the end of the 20th century Anglo-American "biomedical ethics" (often borrowing the name "bioethics" coined by V. R. Potter but deliberately ignoring Potter's concept), launched from Georgetown University and narrowed down to four principles, was a globally predominant doctrine, propagated by the Kennedy Institute of Ethics, its students, financial resources, and political power. Up to then, most of Europe had been very slowly accepting the notion of "bioethics", perceiving it correctly as an unnecessary American "import", while attempts to Europeanise the idea by revising the set of principles had not proven to be particularly successful. With the discovery of the work of Fritz Jahr in 1997, however, European bioethics regained its lost genealogy and found the courage to claim respect for values other than the American ones. Within the bioethics defined by the Jahrian "Imperative", a place could have been found not only for the colourful, philosophical, religious and cultural legacy of Europe, but also for the newly evaluated Potter's work. This "fusion", a substantial and methodological deepening and broadening of the discipline, soon revealed its attractiveness to Latin-American and Asian centres and individuals also. Today we can talk with certainty about the end of "bioethics in Europe" and the beginning of "European bioethics" with all the complexity and interdependence of its variations – Mediterranean, German, French, Central and Eastern European, and others. By finding similarities among them, we might eliminate fear from "insurmountable" moral relativism, but also avoid the mistake of understanding global bioethics as a list of national bioethics. Der Umgang mit Flüchtlingen stützt sich oft auf die Annahme universeller Menschenrechte. Es ist daher interessant, wie sich Positionen, die einen normativen Universalismus ablehnend gegenüberstehen, gegenüber Fragen in Bezug auf Flüchtlinge verhalten. In der vorliegenden Arbeit wird auf den Kommunitarismus eingegangen, der universale Prinzipien der Gerechtig-keit bekanntlich ablehnt. An deren Stelle treten partikuläre, gemeinschaftsspezifische Vorstellungen des Guten. Diese definieren sich durch die jeweilige Kultur der Gemeinschaft. Die Vorstellung des Staates im Kommunitarismus ist daher durch eine Ethik, die von einem Gemeinwohl der jeweiligen Gemeinschaft bestimmt wird, und die Annahme kultureller Homogenität gekennzeichnet. Die Partikularität der Moral und die Annahme einer schützenswerten Leitkultur von Staaten hat Konsequenzen für den Umgang mit Flüchtlingen, besonders in Be-zug auf ihre Aufnahme. Die vorliegende Arbeit analysiert und kritisiert die dahinter liegenden Argumente und Annahmen. So ist die Annahme kultureller Homogenität von Staaten, das die Basis eines Arguments für Einwanderungsbeschränkungen zur Bewahrung einer Leitkultur bildet, auf Grund der gegebenen kulturellen Diversität in modernen Gesellschaften nicht haltbar. Der moralische Partikularismus führt dazu, dass die Interessen der Mitglieder der nationalen Gemeinschaft über die Interessen von Flüchtlingen gestellt werden. Jedoch hält der kommunitaristische Partikularismus einer Kritik nicht stand. So ist der Umstand hervorzuheben, dass eine Kritik an politischen Systemen auf Grund des moralischen Relativismus, nur intern möglich wäre. Insgesamt zeigt die Untersuchung, dass kommunitaristische Positionen zu einem restriktiven Umgang mit Flüchtlingen führen, und von einer liberalen, universalistischen Perspektive aus auch in Hinblick auf die dahinter stehenden Grundannahmen kritisierbar sind. ; The interaction with refugees is often based on the acceptance of universal human rights. It is interesting, therefore, how positions that reject normative universalism respond to refugee issues. The topic of this master thesis is communitarianism, which is known to reject universal principles of justice. Instead communitarian philosophers argue for particularistic, community-specific conceptions of the good. These are determined by the respective culture of the community. The idea of the state in communitarianism is therefore characterized by an ethics, determined by the common good of the community, and by the assumption of cultural homogeneity. Because of the particularity of morality and the assumption of a dominant culture, that is particularly worthy of protection, the question arises if refugees and economic refugees can expect reception and help based on communitarian positions. The particularity of morality and the adoption of a culture of states worthy of protection have consequences for the treatment of refugees, especially with regard to their reception. This thesis analyses and criticizes the underlying arguments and assumptions. Thus, the assumption of cultural homogeneity of states, which forms the basis of an argument for immigration restrictions to preserve a guiding culture (Leitkultur), is not tenable due to the given cultural diversity in modern societies. Furthermore moral particularism leads to a preferential treatment of the interests of community members above the interests of refugees. However, the communitarian particularism does not withstand criticism. Particularly noteworthy is the fact that criticism of political systems based on moral relativism would only be possible internally.
