The article is devoted to the problem of determining the legal nature of the acts of the Constitutional Court of Ukraine and the possibility of their attribution to the sources of national law, given their significance and role in regulating relations in the state. The positions of comparison of acts of the Constitutional Court of Ukraine with normative-legal acts, constitutional court cases have been analyzed. It is noted that there are grounds to say that the legal acts of the Constitutional Court of Ukraine concerning the official interpretation of the Constitution and the laws of Ukraine are significant, they have a significant influence on the regulation of social relations, but they are not able to implement it on their own as normative legal acts, and therefore they are not can be attributed to normative legal acts in the full sense of the definition of this concept. Considering the position of comparing the acts of the Constitutional Court of Ukraine with a legal precedent, it should be noted that despite the fact that in the legal system of Ukraine, a judicial precedent is not a source of law, but judicial litigation is prohibited, in the current conditions of integration processes, features of the national legal system of a mixed type are manifested, since in fact the courts, when considering cases, take into account the decisions of the European Court of Human Rights and national judicial practice. In relation to the case law, the laws of the Constitutional Court of Ukraine are difficult to argue, since it is not enshrined in the current national legislation, but its decisions are final and binding for execution throughout the territory of Ukraine.
It can be concluded that the main purpose of the implementation of both criminal procedural and international criminal law as a form of influence of international law on national law is to change the current legislation to meet international obligations taking into account the criminal law system, the structure of current sectoral legislation, legislative technique. This allows the legislator to implement the provisions of the international agreement and improve the quality of legislation, and the provisions of international criminal law are the impetus that initiates the revision of national legislation in cases where it is expressly provided in the text of the international agreement or required by law. The effectiveness of implementation is directly affected by the quality of national legislation, as well as the legislator's choice of methods of implementation: reception, adaptation, transformation and referral. Despite the different doctrinal approaches to the definition of "implementation", the most accurate should be considered the definition of national legal implementation as a process involving the implementation of international criminal law in the state in the field of domestic law with its help and in accordance with the established procedure. legal activity of state bodies aimed at the actual implementation of international obligations assumed by the state. The opinion of A.L. Luchinin that the concept of "implementation" is not synonymous with the concept of "execution", because implementation is a process, while execution is a possible result of this process. The Council of Europe Convention for the Protection of Human Rights and Fundamental Freedoms of 1950, as well as other international treaties, the rules of which refer to the self-fulfilling, are directly applicable, they do not require the adoption of domestic legislation for their implementation. Usually, the constitutions of states contain provisions that are an example of a general reference rule, authorizing the application of international agreements binding on the state, duly ratified and published, or generally accepted principles and norms of international law, or determine the place of international acts within the legal system of a particular state. ; У статті досліджуються особливості імплементації міжнародних кримінально-процесуальних та кримінально-правових норм як форми впливу міжнародного права на національне право. Можна зробити висновок, що основною метою реалізації як кримінального процесуального, так і міжнародного кримінального права як форми впливу міжнародного права на національне право є зміна чинного законодавства для виконання міжнародних зобов'язань з урахуванням кримінально-правової системи, структури чинного галузевого законодавства, законодавчої техніки. Це дозволяє законодавцю реалізувати положення міжнародної угоди та покращити якість законодавства, а положення міжнародного кримінального права є поштовхом, який ініціює перегляд національного законодавства у випадках, коли це прямо передбачено в тексті міжнародної угоди або вимагається законом. На ефективність реалізації безпосередньо впливає якість національного законодавства, а також вибір законодавцем методів реалізації: прийому, адаптації, трансформації та направлення. Незважаючи на різні доктринальні підходи до визначення поняття «імплементація», найбільш точним слід вважати визначення національної правової імплементації як процесу, що передбачає реалізацію міжнародного кримінального права в державі у сфері внутрішнього права з його допомогою та зі встановленим порядком; юридична діяльність державних органів, спрямована на фактичне виконання міжнародних зобов'язань, взятих на себе державою. Підтримую думку А.Л. Лучиніна про те, що поняття «реалізація» не є синонімом поняття «виконання», оскільки реалізація - це процес, а виконання - можливий результат цього процесу. Конвенція Ради Європи про захист прав людини і основоположних свобод 1950 року, а також інші міжнародні договори, норми яких стосуються самореалізації, безпосередньо застосовуються, вони не потребують прийняття внутрішнього законодавства для їх реалізації. Зазвичай у конституціях держав містяться положення, які є прикладом загального довідкового правила, що дозволяють застосовувати міжнародні угоди, обов'язкові для держави, належним чином ратифіковані та опубліковані, або загальновизнаних принципів і норм міжнародного права, або визначають місце міжнародного права в межах правової системи конкретної держави.

The author of the article studied the draft Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on the Application of International Criminal and Humanitarian Law". This bill proposes to exclude certain articles on military crimes and to introduce new articles on war crimes into the Criminal Code of Ukraine. The new war crimes articles contain a list of war crimes. This list is substantially similar to the list of war crimes contained in the Rome Statute of the International Criminal Court. The concept of war and military crimes is given. The main differences between military and military crimes are revealed. Identical signs of war and military crimes have been studied. The article examines the peculiarities of law and legal security in modern Ukrainian realities. It is determined that law is a mechanism which, through the application of legal norms of which it is a part, should ensure the effective functioning of democracy and democracy in the state and the functioning and further development of the social system. It is established that the Ukrainian legal system is undergoing a reconstruction phase, in which administrative and legal mechanisms are being transformed into mechanisms of self-regulation and self-organisation. The author establishes that essential factors of law stability are correct definition and certainty of each element, completeness and absence of contradictions. It is established that the basis of the concept of legal security is the conditions, sources, methods and mechanisms of negative impact (falsification of legal provisions, conflicts of provisions, legal gaps, inadequate implementation procedures, neglect of the effect of provisions, substitution of concepts, corruption, etc. The author determines that legal security is a component of national security. Its content consists of the implementation of national interests in all areas of national security, protection of national interests in the security sector, as well as legal regulation of legal relations and legal protection of the creation of state and non-state institutions with the necessary and sufficient conditions for the effective functioning of law and legal order as a crucial regulator of social relations. It is noted that legal security is one of the constant needs caused by the natural conditions of life of a person, society and mankind. It should also be considered a universal human value designed to ensure a person's existence as a public good. The author identifies the factors that significantly impact the institutionalisation process of an individual's legal security.

The paper deals with a research of Tort law school development in St. Volodymyr's University – Taras Shevchenko National University of Kyiv. The purpose of the research is to analyse the development of the Tort law school and to study the main trends and key directions of the development. The author applied lots of different research methods, among which were historical and legal method (for the analysis of the works from the past), analysis and synthesis (for stating the peculiarities of the research approaches in different studies' periods). Also, such methods as philosophy methods (dialectic and hermeneutic), general research methods (systemic and structural-functional), general logic methods (induction and deduction, analogy, abstraction, generalization, formalization, and modelling) were used. The topic of civil torts was interesting for the researchers from Kyiv University law school any time while the depth of interest and research approaches differed depending on the historical period. Before the revolution of 1917 the researchers mostly looked on the torts as on the type of civil obligation and the reward for damage caused. No one treated the torts from the standpoint of a type of civil liability at that time. The Soviet period of the Tort law School development was characterized by a change of the research vector. The researchers started focusing on civil torts as liability rather than civil obligations. Tort liability is a type of civil liability and the latter is a type of legal liability. That causes a regime when the researchers (some well-known names of that time are: Gennadiy Matveev, Yuriy Matveev, Dina Bobrova, Yaroslavna Shevchenko etc.) mostly analyse civil tort as a civil liability. They focused their attention on the foundations and the conditions of tort liability. Precisely at that time, the theory of "civil wrong compound" as the main foundation of civil liability appeared. Independent Ukraine spawned a new pleiad of researchers whose research interest was civil torts. Modern civil law doctrine started refusing the understanding of civil tort as a type of civil liability. It comes back to the tort as a type of obligation. Moreover, modern researchers look on the tort's issues much wider – through the prism of legal regulation mechanism. Constantly, modern researchers of Taras Shevchenko National University Law School pay great attention to the new topical spheres of torts, particularly to non-pecuniary damage compensation, damage compensation caused by the State and State agencies and product liability together with digital product liability. Any branch of law, private or public, has a system of sources of law, which is somewhat standard. This system became "set in stone" for many law systems around the world, starting with Constituion, legal acts of goverment and ending with brief overview of legal traditions in some branches of law. However, this system completely forgets about legal doctrine. But after legislation took over, legal doctrine lost meaning which it had before and was cast aside into shadow of legislation and basic system of sources of law. Furthermore, legal doctrine was an instrument which provided unity for any law system. The idea in its core is simple – greatest and most known legal works of different authors became rulebooks for diffenret branches of law, which were used not only for education, but as a source of law to resolve dispute, when there was missing link in legislation and when judge cannot settle dispute using law of state. This is the case, when doctrine was used as a source of law and a source for regulation. Same can be said about legal doctrine, as core for any law, passed by a parliament. In ideal case, scientists and authors of legal dontrine works should consult lawmakers regarding theoretical and doctrinal basis of any decision or action they are planning to take. So, any legal action will have strong core in it and won't be decided only on experience and opinions of lawmakers, but also with strong theoretical background for such decision. In conclusion, we think that legal doctrine requires further analysis and this topic is very important for legal studies in Ukraine. Core of legal doctrinal works becomes bigger and bigger with increasing number of scholars in this sector of science. From the nature of legal doctrine, it is clear that it can provide better understanding of law and improve connection between scientists and lawmakers. The analysis of the relationship between law and policy is based on current legal theories, which build their models on the basis of the interaction of these two phenomena as in the process of state formation, so in the management of the state and the civil society. Legal theories correlate with the constitutional process in Ukraine, which gives reason to speak about the growing of the influence of political mechanisms on national legislation, the state, society and citizens' justice. This raises the question of the relation of the archetypes of legal culture with the direct political and legal experience of the nation-state, which over time is crystallized into theoretical doctrines and the corresponding political and legal practice of their implementation. Legal theories, as well as the positions of national scholars regarding the law and politics, also did not go beyond the definitions of the influence of national factors on the interaction of law and policy. The autonomous model (legal positivism), the insertion model (natural law theory), and the intersection model (American and Scandinavian legal realism) always had a common field from which different (in our case Ukrainian) national systems of law development ware sprouted. In this field law and politics are two (to a greater or lesser extent) different phenomena that interact with one another (with lesser or greater frequency) in the light of national interests and what the social sciences call the «spirit of the nation». In a transitional period, the positioning of the law in Ukraine is too closely linked to the political realities and interests of the political elites, which in most cases are still very far from the generally accepted principles of law. The purpose of writing this article is to provide a conceptual overview of the main ideas and doctrines in the field of land law, which were being researched and substantiated by employees of the Faculty of Law / Institute of Law of Taras Shevchenko National University of Kyiv during 30 years of independence, outlining the main achievements of land law and their practical implementation during this period. The main research method was the analysis and systematization of scientific research at the institutes of land law as a branch of law, science and academic discipline. The method of historical analysis helped to understand the historical and legal preconditions for the formation of a team of specialists who during the times of independent Ukraine were successfully working in land and related branches of law at Taras Shevchenko National University of Kyiv. In conclusion, it is noted that scientists of the Faculty of Law / Institute of Law of Taras Shevchenko National University of Kyiv worthily have represented and developed land law as a branch, science and academic discipline since the very beginning of Ukraine's independence. Within the limits of this article it is not possible to show in full the scientific achievements of the employees of the Faculty of Law / Institute of Law of Taras Shevchenko National University of Kyiv and their students during the time of independent Ukraine. But the described main scientific achievements emphasize the significant contribution of land law science of the Faculty of Law / Institute of Law of Taras Shevchenko National University of Kyiv to the development of the science of land law of independent Ukraine. Due to the active position of the teaching staff at the Faculty of Law / Institute of Law of Taras Shevchenko National University of Kyiv, there grew a worthy scientific constellation of researchers, teachers, practitioners and statesmen, whose main scientific interest was land law with its practical implementation and improvement. The article considers the theoretical foundations of the relationship between national and international law in the context of integration processes. The peculiarities of interaction of norms and principles of international and domestic law, conditioned by the need to clearly define the place of international law in the national legal system and in the hierarchy of legal sources, the practice of their application in case of conflict with domestic law. Emphasis is placed on the importance of international law for the system of sources of national law, the dominance of international law and the principles of recognizing its priority. The starting point for considering this issue is national and international law are interrelated in their origin and development. The place of international law in the national legal system and its relationship with domestic law is revealed by analyzing traditional ("monistic" and "dualistic") and radical ("radical monism" and "radical dualism", "moderate dualism" and "moderate monism", "restrained dualism" etc.) concepts. The interrelation of international legal norms and norms of national legislation in the conditions of integration processes is analyzed. After all, in modern conditions, the recognition of the rules of international law of dominance in comparison with the rules of national law acquires special significance, because the law, as a regulator of social relations in the context of globalization, is important. However, such dominance of international law over national law should be considered only as a certain special result of such an impact of globalization on national law. The effective purpose of legal provisions of international law in the mechanism of legal regulation of the national legal system depends on how they are implemented and used by legal practice in the state, how perfect are the forms and methods of their objectification in public relations. Місце міжнародного права в національній правовій системі та його співвідношення з внутрішнім правом розкрито шляхом аналізу тради- ційних («моністичної» та «дуалістичної») та радикальних («радикального монізму» і «радикального дуалізму», «помірного дуалізму» і «помірного монізму», «стриманого дуалізму» тощо) концепцій. Проаналізовано взаємо- зв'язок міжнародних правових норм і норм національного законодавства в умовах інтеграційних процесів. Адже в сучасних умовах визнання за нормами міжнародного права домінування порівняно з нормами національного законодавства набуває особливого значення, це пояснюється тим, що праву, як регулятору суспільних відносин в умовах глобалізації світу, належить вагоме значення. Проте таке домінування міжнародного права над націо- нальним належить розглядати тільки як певний особливий результат такого впливу глобалізації на національ- не право. Ефективність правових приписів міжнародного права в механізмі правового регулювання національ- ної правової системи залежить від того, як вони втілені та використовуються юридичною практикою в державі, наскільки досконалими є форми та методи їх об'єктивації в суспільних відносинах.
