The struggles for independence in Latin America during the first half of the nineteenth century were accompanied by a wide-ranging debate about political rights, nationality and citizenship. In South American Independence, Catherine Davies, Claire Brewster and Hilary Owen investigate the neglected role of gender in that discussion. Examining women writers from Brazil, Argentina, Chile, Peru, and Colombia, the book traces the contradictions inherent in revolutionary movements that, while arguing for the rights of all, remained ambivalent, at best, about the place of women. Through studies of both published and unpublished writings, South American Independence reveals the complex role of women in shaping the vexed ideologies of independence
Euclides da Cunha, the writer, was in 1904-1905 in a Brazilian-Peruvian diplomatic mission for reconnaissance of Purus River headwaters in the Amazon Region. Actually, the journey was part of the writer's planned project to know the Forest, where he would turn out to be a witty military strategist and give the intelligence a plotted conception of South American continent integration and a significant doctrinal summary for a Brazilian geopolitics against dominant nations. That journey would also consolidate the telluric view of nationality, in line with the style that had exalted him. ; Euclides da Cunha realiza em 1904-1905 uma missão diplomática, brasileiroperuana, para reconhecimento das cabeceiras do rio Purus, na Amazônia. Em verdade, a viagem faz parte de acalentado projeto do escritor, de conhecimento da floresta, por onde se revelaria um estrategista militar arguto, que veio a oferecer à inteligência uma urdida concepção estratégica para o continente sul-americano e importante suma doutrinária para uma geopolítica do Brasil em face das nações dominantes. The religious pregnancy attributed to the phenomenon of nationality is part of that scenery of genealogical proximity between the political and the religious. The founding myths through which nationalities legitimize and consecrate themselves are just one of the various ways of conferring religious dimension to the national reality. The stereotype of the Latin woman is commonly associated with sexuality. Brazilians seem to be particularly burdened by this stigma among Latin women worldwide. As immigrants, intersected by other matrices of oppression in addition to those of gender and race, for example, these women bear various marks remaining from Eurocentric coloniality that belittles and silences them (Mignolo, 2000/2003), a circumstance that is aggravated when the country of emigration is their coloniser. This article explores resorting to cyberspace as a forum for denunciation and feminist activism through a case study of the profile @brasileirasnaosecalam based on content analysis. The project appeared on the digital social network Instagram to anonymously report the harassment, discrimination and prejudice that Brazilian immigrant women suffer in Portugal, specifically for carrying their own nationality. Thus, through cyberactivism, which is also feminist activism, women are now experiencing a new cycle of political opportunities driven by the building and consolidation of ties among them around the globe, breaking down binarisms, including those between the first and the third world, in an appeal to cross-border articulation (Timeto, 2019). That shows the relevance of pursuing an ontological vision underpinned by a decolonial and intersectional feminist perspective that uses cyberfeminism as an ally to interconnect the digital and the real space. ; O estereótipo da mulher latina é comummente associado à sexualidade. Most empirical work in treasury auctions use aggregate auction results to examine bidding behavior. We investigate the strategies of bidders in Brazilian treasury auctions using both aggregate and bidder level data and find that more detailed information allows great improvements in the understanding of bidding behavior in treasury auctions. Classifying bidders according to characteristics regarding their institutional category and their nationality, we find evidence of distinct bidding behavior across types of bidders. Moreover, in line with previous evidence in auctions of Japanese government securities, we find that foreign bidders seem to obtain higher profits than those of national institutions. These results suggest that caution should be exercised in the interpretation of testes of bidding behavior that do not take differences in bidder's characteristics into account and (or) that assume that treasury securities are pure common-value goods. We find that Brazilian auctions are relatively illiquid as higher competition yields lower bidders' discounts. Contrary to theoretical predictions of both common- and private-value auctions, we also find that bidders obtain lower profits in auctions with higher dispersion in bidders' valuations. ; A grande maioria dos estudos sobre leilões de títulos governamentais utiliza dados agregados com respeito ao resultado dos leilões quando da análise do comportamento de licitantes. Neste estudo, além da abordagem tradicional, utilizam-se dados referentes às propostas de cada licitante (dados individuais) para investigar suas estratégias em leilões de títulos do tesouro brasileiro. O maior grau de detalhamento dos dados permite melhora substancial no entendimento do comportamento destes agentes. Evidências de comportamento distinto entre diferentes tipos de licitantes são encontradas ao classificá-los de acordo com características relacionadas a sua categoria institucional e nacionalidade. Além disso, em linha com resultados encontrados em leilões de títulos do governo japonês, a análise apresentada neste trabalho indica que licitantes estrangeiros alcançam maiores lucros em comparação aos obtidos por instituições nacionais. Estes resultados sugerem cautela na interpretação de testes sobre o comportamento de licitantes que não levem em conta diferenças nas características dos mesmos e (ou) que assumam que títulos do tesouro são bens de puro valor comum. O trabalho aponta, ainda, redução do lucro dos licitantes na presença de maior competição, sugerindo que leilões de títulos brasileiros possuem relativamente baixa liquidez. Em contraste aos preceitos teóricos de leilões, tanto de bens de valor comum como de privado, os resultados indicam que os licitantes obtém menores lucros em leilões com maior dispersão na precificação dos títulos.

This research focuses on the issue of surrogate motherhood in private international law and is justified because of intense medical and scientific progress in the area and conflicts and litigations proposals for recognition of the nationality of children from the surrogate motherhood procedures as each country legislates according to the national reality, requiring discussions about the harmonization of interests internationally. Thus, the research seeks to question the contributions of the Hague Conference on Private International Law to the harmonization of legal systems in the field of surrogacy and especially what are its effects to the Brazilian legal system. To this end, the first topic investigates advances in assisted human reproduction technique focusing on surrogacy in order to find out how comparative law has found answers to the questions arising from the procedure. Subsequently, the study focuses on the study of Brazilian law and the related international effort verified by the Hague Conference. Finally, the paper identifies the national law suffers limitations to solve the problems arising from transnational surrogacy, and therefore the need for multilateral cooperation is emphasized so that, in unison, children's rights are guaranteed. In this regard, we highlight the practical results obtained from the Hague Conference on resolving the problem of nonnationality. The theme also poses challenges for the future with regard to trafficking in children, the vulnerability of women involved in surrogate motherhood and the very burden of the contract. ; Esta pesquisa se debruça sobre a temática da maternidade de substituição no direito internacional privado e se justifica em razão do intenso progresso médico-científico na área e dos conflitos e lides propostas para o reconhecimento da nacionalidade de crianças oriundas dos procedimentos de maternidade substitutiva, dado que cada país legisla de acordo com a realidade nacional, necessitando-se discutir sobre a harmonização dos interesses no âmbito internacional. Assim, a pesquisa pretende questionar quais as contribuições da Conferência de Haia sobre Direito Internacional Privado para a harmonização dos ordenamentos jurídicos em matéria de maternidade de substituição e, especialmente quais os reflexos para o ordenamento jurídico brasileiro. Para tanto, investiga-se os avanços da técnica da reprodução humana medicamente assistida com foco na maternidade de substituição, de modo a averiguar como o direito comparado tem encontrado respostas para as questões oriundas do procedimento. Posteriormente, o estudo discorre sobre as disposições do direito brasileiro relacionado e o esforço internacional verificado pela Conferência de Haia. Ao final, o trabalho identifica que o direito interno sofre limitações para resolver os problemas oriundos da maternidade de substituição transnacional e, por isso, ressalta-se a necessidade de cooperação multilateral para que, em uníssono, sejam garantidos os direitos das crianças. Nesse aspecto, destacam-se os resultados práticos verificados a partir da Conferência de Haia na solução do problema da anacionalidade. A temática ainda impõe desafios para o futuro no que concerne ao tráfico de crianças, à vulnerabilidade das mulheres envolvidas na gestação de substituição e à própria onerosidade do contrato.

O objetivo deste artigo é discutir as origens, os desdobramentos e as permanências da prática de racialização dos corpos negros, por meio das políticas migratórias brasileiras, desde fins do século XIX até os dias atuais. Para tal, serão utilizadas as abordagens epistemológicas pós e decoloniais, com destaque para o pensamento afro-diaspórico. Esta investigação propõe a inclusão da "raça" como categoria analítica indispensável para o estudo das migrações no Brasil. A partir de uma abordagem inédita, será examinado como o Haitianismo deixou um legado que serviu de substrato para a formulação de legislações explicitamente racializadas sobre imigração. O primeiro tópico tematizará a nacionalidade e cidadania no Brasil a partir de sua independência, nos momentos iniciais de constituição do Estado imperial pós-colonial. O segundo tópico aborda as relações entre a raça e as normativas migratórias do século XX. Por fim, na última seção, será apreciada a atual Lei de Migração a partir das concepções de racismo estrutural e colonialidade do poder. ; El objetivo de este articulo es discutir los orígenes, los ramos y las permanencias de la practica de racialización de cuerpos negros, por medio de las políticas de migración brasileñas, desde fines del siglo XIX hasta los días actuales. Para esto, serán utilizadas los abordajes epistemológicos post y decoloniales, en especial el pensamiento o afro-diaspórico. Esta investigación propone la inclusión de la "raza" como categoría de análisis indispensable para el estudio de las migraciones en Brasil. A partir de un abordaje inédito, será examinado como el "Haitianismo" dejó un legado que sirvió de sustrato para la formulación de las legislaciones explícitamente racializadas sobre inmigración. El primer asunto traerá el tema de nacionalidad y ciudadanía en Brasil a partir de su independencia, en los momentos iniciales de su constitución del Estado imperial post colonial. El segundo tópico trata de las relaciones entre raza y las normativas migratorias del siglo XX. Por último, esta la sección en que será apreciada la actual "Lei de Migração" a partir de las concepciones de racismo estructural y colonialidad del poder. ; The aim of this article is to discuss the origins, expansion and permanences of the practice of racialization of black bodies, through brazilian migration policies, from the end of the 19th century to the present day. For this purpose, post and decolonial epistemological approaches, specially the afro-diasporic thinking, will be used. This research proposes the inclusion of "race" as an indispensable analytical category for the study of migrations in Brazil. From an unprecedented approach, it will be examined how Haitianism has left a legacy that served as a substrate for explicitly racialized legislation on immigration. The first topic will address the nationality and citizenship in Brazil starting from its independence, in the initial moments of constitution of the post-colonial Imperial State. The second topic addresses the relations between race and the migratory normatives of the 20th century. Finally, in the last section, the current Migration Law will be appreciated from the conceptions of structural racism and coloniality of power.

Refugees are forcibly displaced people who fled their home countries due to persecutions because of their religion, nationality, political opinion, race, or being part of a particular social group. Brazilian Law 9474/1997 recognizes people who are fleeing a situation of severe and generalized violation of human rights as refugees. According to Brazilian law and Constitution, refugees have the same rights as Brazilians. However, my research with 29 refugees living in the states of São Paulo and Rio de Janeiro shows that refugees are disproportionately affected by the Brazilian responses to the COVID-19 pandemic. This article discusses how refugees in Brazil are affected by federal responses to the pandemic. I conducted 29 semi-structured phenomenological interviews with refugees between March 27, 2020, and April 06, 2020. These interviews were analyzed considering responses adopted by the Brazilian government (at the federal level) to respond to COVID-19. I conclude that refugees are affected by the closure of the borders and their rights to documentation, healthcare, and social assistance (the emergency benefit) are violated. ; Los refugiados son personas desplazadas de manera forzada, que han dejado sus países de origen debido a persecuciones relacionadas con sus religiones, nacionalidades, opiniones políticas, razas y pertenencia a un grupo social específico. La ley brasileña 9474/1997 también reconoce como refugiados a las personas que han huido de una situación de violación grave y generalizada de los derechos humanos. Según la legislación y la Constitución brasileña, los refugiados tienen los mismos derechos que los brasileños. Sin embargo, mi investigación con 29 refugiados que viven en los estados de São Paulo y Río de Janeiro muestra que los refugiados son desproporcionadamente afectados por las respuestas brasileñas a la pandemia de COVID-19. Este breve artículo analiza cómo los refugiados en Brasil se ven afectados por las respuestas del gobierno federal a la pandemia. Realicé 29 entrevistas fenomenológicas semiestructuradas con refugiados entre el 23 de marzo y el 6 de abril de 2020. Esas entrevistas se analizaron considerando las acciones adoptadas por el gobierno brasileño (a nivel federal) para responder a la COVID-19. Concluyo que los refugiados son afectados por el cierre de fronteras y que se les violan sus derechos a documentación, a acceso a la salud y asistencia social (incluido el beneficio de emergencia). ; Refugiados são pessoas deslocadas de maneira forçada que saíram de seus países de origem por causa de perseguições relacionadas com suas religiões, nacionalidades, opiniões políticas, raças e pertencimento a um grupo social específico. A Lei Brasileira 9474/1997 também reconhece como refugiadas pessoas que fugiram de uma situação de grave e generalizada violação de direitos humanos. De acordo com a legislação e com a Constituição brasileira, refugiados possuem os mesmos direitos que os brasileiros. Contudo, minha pesquisa com 29 refugiados vivendo nos estados de São Paulo e do Rio de Janeiro mostra que refugiados são desproporcionalmente afetados pelas respostas brasileiras à pandemia da COVID-19. Esse artigo discute como refugiados no Brasil são impactados pelas respostas do governo federal à pandemia. Realizei 29 entrevistas fenomenológicas semiestruturadas com refugiados entre 23 de março de 2020 e 06 de abril de 2020. Essas entrevistas foram analisadas considerando as ações adotadas pelo governo brasileiro (no nível federal) para responder a COVID-19. Concluo que refugiados são afetados pelo fechamento das fronteiras e possuem seus direitos à documentação, acesso à saúde e assistência social (incluindo ao benefício emergencial) violados.

Torn between its European body and its atlantic/lusophone "soul", Portugal tries to strike a balance between the two dimensions of its identity as a polity and, in the process, claims a special role as mediator between north and south, Europe and the African continent. Although fully committed to the European immigration policy, with its restrictive dimensions and its focus on integration, Portugal purports to articulate the European demands with the special solidarity bonds that exist with the Portuguese speaking countries. It has been so for a number of years, but the recent developments in both the Portuguese nationality and immigration laws show that the fears expressed by many that Schengen would surpass the lusophone ties were well founded and that, no matter how well intended the Portuguese policies are in these matters, the result will be detrimental to the so-called lusophone citizens. They do enjoy a special status – encompassing voting rights and access to public office that is generally forbidden to all foreigners (a status unparalleled in the two other European countries under scrutiny, France and the United Kingdom) – but their access to the Portuguese territory has been curtailed. Even more than Portugal, which until recently was the last of the European "nation states" and only now faces visible cultural diversity in its society, the European Union and the Community of the Portuguese Speaking Countries (CPLP) struggle with the definition of their respective identities and sense of purpose, seeking to win the hearts and minds of their peoples. Commonly considered a natural spontaneous community, due to the existence of a common language, the CPLP faces the difficulties posed by mutual distrust and old grudges and the fear, by many, that it is only an expression of imperial nostalgia on the part of Portugal. Its member states show only a mild commitment, engaged as they all are in other regional communities of their own, as can be seen in the discussions on citizenship and free movement within the lusophone area. There are many similarities between the legal systems of the CPLP member states, which can be explained by the cooperation between lawyers and academics specially in Africa and East Timor, but some of those similarities are merely formal, with little correspondence in the law in action, and coexist with relevant differences due mostly to different levels of socio-economic development and political will. For the European Union the purpose of fostering a feeling of belonging and solidarity between the peoples of Europe is an ongoing struggle for legitimacy which has suffered major setbacks in recent years. After the constitutional momentum, the Union has adopted a more modest stance, but has by no means given up winning the support of the European citizens. One of the fields in which its intervention is demanded is directly linked with the identity quest in progress – border definition and control, policies towards illegal and legal aliens. Stressing the need to integrate the third country nationals who are legal residents and adopting the mantra of intercultural dialogue, the EU presents itself as a guardian for human rights and a fighter against racism, at the same time as it tries to keep Europe for the Europeans as much as possible. Its member states are willing, for European or domestic reasons, to go along and easily drop old preferences for extra-community bonds of solidarity. Portugal may again be the last of the empires, keeping a special status for the foreigners of lusophone origin, but it nevertheless keeps with the times when it comes to admission to its territory.
