This doctoral thesis seeks to make a comprehensive analysis of neoconstitutionalism, studying their manifestations in constitutional law and doctrine. Neoconstitutionalism, as a new manifestation of constitutional phenomenon that emerged after World War II, is characterized by the need to take any legal possession of certain premises, materials of an immovable, coinciding with the fundamental human rights, which will fall outside the potential political majorities, and become its cornerstone. These assumptions are intended as safeguards needed to protect human dignity and the democratic system itself against anyone, even taking advantage of a power obtained democratically which intends to demolish the pillars of democracy and to establish tyranny. The Constitution is enshrined as a basic rule of real system, a repository of these fundamental rights, the observance by public authorities becomes inexcusable. This will involve a role for judicial review in its protection. Thus, supremacy of the constitution, deepening respect for and promotion of fundamental rights and role of constitutional judge as the guarantor of its validity are the bases of neoconstitutionalism, a legal phenomenon not only current, but evolving.
In this paper, the author introduces and elaborates on the most relevant differences between neoconstitutionalism and a version of constitutionalism that is essentially defined in terms of garantism. Firstly, he argues that constitutionalism can be conceived in two opposite ways: as a way to overcome legal positivism, thus with a certain tendency towards Iusnaturalism, or as the expansion or improvement of the former; for these purposes he commits himself to a revision of the standard terminology. Secondly, the author maintains that were the constitution to embody principles of justice of an ethical-political nature, then it will disappear the main distinctive feature of legal positivism: the separation between Law and morality or the separation between validity and justice. He considers that essentially garantist constitutionalism is a strengthened version of legal positivism: it completes a rule of Law system since it implies both submission to the Law and judicial review. Fourth, the author maintains that the argument that any legal system objectively meets some «ethical minimum» is nothing more than the old iusnaturalist claim. Ethical constitutionalism, for which constitutional principles are intended to be objectively fair, is thus the current version of ethical legalism. Fifth, the author objects to the distinction between principles and rules that underlies a conception of the constitution and of constitutionalism opposite to the positivist and garantist one. Sixth, the author claims that constitutional principles' being always weighted and not only applied threatens the independence of the jurisdiction and its political legitimacy. En este artículo, el autor presenta las diferencias más relevantes entre el neoconstitucionalismo y el constitucionalismo garantista. En primer lugar, afirma que el constitucionalismo puede ser concebido de dos formas opuestas: como una superación del positivismo jurídico en sentido tendencialmente iusnaturalista o como su expansión o perfeccionamiento, realizando para llevar a cabo esta labor una revisión terminológica. En segundo lugar, el autor considera que si las constituciones incorporan principios de justicia de carácter ético-político desaparece el principal rasgo distintivo del positivismo jurídico: la separación entre Derecho y moral o entre validez y justicia. A continuación, considera al constitucionalismo garantista como un iuspositivismo reforzado, completando al Estado de Derecho porque comporta el sometimiento al Derecho y al control de constitucionalidad. En cuarto lugar, el autor afirma que la tesis de que todo ordenamiento jurídico satisface objetivamente algún «mínimo ético» no es más que la vieja tesis iusnaturalista, que termina por convertirse en la actual versión del legalismo ético que es el constitucionalismo ético, en virtud del cual los principios constitucionales se pretenden objetivamente justos. La Constitución de los Antiguos puede considerarse básicamente una situación institucional en la cual a un centro de poder soberano que tiene su propia ontología y dinámica, y en cierta medida su propia justificación, se acompaña un cuerpo de reglas dirigidas a limitar, a controlar y a racionalizar las actuaciones de aquel poder soberano. Éste preexiste a la constitución, y es además su garante fáctico. El constitucionalismo de los Modernos hace que el contraste tradicional entre constitucionalismo y democracia resulte en gran medida obsoleto ya que la comunidad política y con ella el Estado y el Derecho son el producto de una acción de los ciudadanos. El constitucionalismo es el proceso de tal iniciativa "desde abajo". En este artículo se distinguen estas dos visiones del constitucionalismo y su posición respecto al estado de excepción ; Ancient constitution could be considered basically an institutional situation where a center of sovereign power, with its own ontology and dynamics, and in certain extent its own justification, is enclosed in a body of rules addressed to limiting, controlling and rationalizing the actions of that sovereign power. This one pre-exists to the constitution and it is also its factual guarantor. Modern constitutionalism makes the traditional contrast between constitutionalism and democracy obsolete to a great extent because the political community and with that also the State and the Law are the output of citizens' participation. Constitutionalism is the process of that initiative "from the bottom". This is the view defended by neoconstitutionalism. This article antlines and discusses that stance in relation to the state of emergency.
Habiéndose generalizado desde hace algunos años, en la filosofía política y en la reflexión iusfilosófica, el término 'garantismo', el objetivo del autor es contribuir a individualizar sus usos lingüísticos consolidados tanto en su acepción penal, la más acreditada, como en su significado más general de garantismo de los derechos, a partir del examen de los escritos de Luigi Ferrajoli y de Norberto Bobbio, estudiosos a quienes se les atribuye la paternidad, respectivamente, de una y otra acepción. Un objetivo más ambicioso, además, es identificar –con la intención de presentar el garantismo como una idea general del Derecho y de la política– los nexos entre ambas nociones del garantismo y lo que se ha dado en llamar neoconstitucionalismo, o sea el movimiento teórico –pero también su consolidación en la praxis constitucional concreta– que a partir de la Segunda posguerra ha modificado radicalmente las estructuras del Estado mediante el constitucionalismo rígido y el control de constitucionalidad. La intención del autor, claramente normativa, es aportar razones en favor de la idea de que la conexión teórica entre garantismo y neoconstitucionalismo resulta de fundamental importancia tanto para una mejor garantía de los derechos de las personas como para la afirmación del Estado constitucional de Derecho. ; Having generalized for some years, both in Legal theory and in Political philosophy, the term 'guarantism', the aim of the author is to contribute to individualize its linguistic uses consolidated so much in its penal meaning, the most reputable one, as in its meaning more general of guarantism of the Rights, from the exam of the writings of Luigi Ferrajoli and of Norberto Bobbio, scholars to whom are attributed them the paternity, respectively, of an and another guarantism meaning. A more ambitious objective, besides, is to identify –with the intention to present the garantismo as a general idea of Law and of the Politics– the links between both notions of the garantismo and what has been given in calling neoconstitutionalism, i. e. the theoretical movement – but also its consolidation in the constitutional specific praxis– that from the Second postwar period has modified radically the structures of the State through rigid constitutionalism and control of constitutionality. The author's purpose, clearly normative, is to provide reasons in favour of the idea that the theoretical connection between guarantism and neoconstitutionalism has fundamental importance for a better guarantee of the rights as for the consolidation of the constitutional Rule of Law
This work responds to the research line on "contemporary legal issues" and is a breakthrough of the research project in place titled " the validity problem of the current sources' system in the Colombian law". Even though the project's purpose is to develop a critical assessment of the validity concept as well as study the current sources' system in the Colombian Law following the promulgation of the 1991 Political Constitution as a step forward, this article aims only at developing the first aspect; this is the legal validity concept issue in the currents of iusnaturalist, positivist and neoconstitutionalist thoughts. ; Este trabajo responde a la línea de investigación en "problemas jurídicos contemporáneos" y constituye un avance del proyecto de investigación en ejecución titulado: "El problema de la validez y del actual sistema de fuentes en el derecho colombiano". Si bien el proyecto tiene como propósito desarrollar un examen crítico del concepto de validez y estudiar el actual sistema de fuentes en el derecho colombiano luego de la expedición de la Constitución Política de 1991, por constituir un avance, este artículo solo se limita a desarrollar el primer aspecto; esto es el problema del concepto de validez jurídica en las corrientes de pensamiento iusnaturalista y positivista.
En la actualidad nos encontramos ante una crisis irreversible del Estado moderno tradicional, que asoma bajo la pérdida de soberanía y el grave deterioro del principio de legalidad como principio fundamental del Estado de derecho. La primacía de la economía sobre la política y el crecimiento exponencial del mercado sobre la esfera pública cuestionan gravemente el modelo de Estado democrático y social que deseamos construir. El presente trabajo se centra en analizar las distintas transformaciones que está sufriendo nuestro modelo de Estado desde el nuevo paradigma del neoconstitucionalismo. Un paradigma epistemológico y metodológico que está revolucionando la ciencia política y constitucional. ; Nowadays we face up to an irreversible crisis of the traditional modern State, with a loss of sovereignty and with a serious deterioration of the principle of legality as a fundamental principle of rule of law. The primacy of economics over politics and the exponential growth of the market over the public sphere are seriously questioning the model of social democratic state that we want to build. This text focuses on analyzing the various transformations that is suffering the state model from the new paradigm of neoconstitutionalism. An epistemological and methodological paradigm that is revolutionizing the political and constitutional science.

En el presente trabajo se hace una exposición de los antecedentes y desarrollos de la Doctrina de Seguridad Nacional y su aplicación en políticas públicas en Latinoamérica, y en concreto, en los Estados Unidos Mexicanos. Se lleva a cabo una exposición de los antecedentes históricos, en México, de la aplicación de la Doctrina de Seguridad Nacional y sus consecuencias sociales, políticas y jurídicas, hasta el vigente marco jurídico del tema de seguridad nacional y de los órganos de inteligencia del Estado, del cual se brinda un análisis y se contrasta con el modelo teórico del Estado Constitucional de Derecho y su paradigma el neoconstitucionalismo, así como, con la teoría de los derechos fundamentales en lo relativo al tema de su restricción o limitación por causas de seguridad nacional, ofreciendo algunas propuestas para consolidar el modelo democrático del Estado mexicano en el tema relativo a la Seguridad Nacional. ; In the present paper is a summary of the background and developments of the National Security Doctrine and its application in public policy in Latin America, and specifically in Mexico. Held an exhibition of historical background, in Mexico, the implementation of the National Security Doctrine and its social, political and legal framework to force the issue of national security and intelligence agencies of the State , which is provided an analysis and contrasts with the theoretical model of the "State Constitutional law" and neoconstitutionalism paradigm, on the theory of fundamental rights as regards the subject of their restriction or limitation for reasons of national security , offering some proposals to strengthen the democratic model of the Mexican State in the topic of National Security.
The project of Multicultural Nation-State promoted by contemporary societies is based on the recognition of diversity, on differentiated rights, and on equality as a structural condition of life in community. This recognition means legitimizing the historical struggles of vernacular ethnic groups and social minorities, which have been paradigmatic subjects of the struggles for economic, social, and political participation. The analysis of the perspectives as regards diversity and multiculturalism for the construction of an inclusive and equitable nation-state implies recognizing the right to cultural identity of the ethnic and culturally differentiated groups, appreciating and learning about them, and determining their territorial location by means of the permanent construction of an intercultural dialog. This article is a historical study that analyzes the importance of constitutional recognition of multiculturality in order to comprehend the ethnic and cultural conflicts in the Colombian society within the framework of the social state of law as a mechanism for building intercultural dialogs, which would make it possible to shape a more inclusive and equitable society; one which transcends the monocultural state model on which Latin American republics have been constructed since their foundation. ; El proyecto de Estado-Nación Multicultural impulsado por las sociedades contemporáneas se fundamenta en el reconocimiento de la diversidad, de los derechos diferenciados y de la igualdad como condición estructural de la vida en comunidad. El presente artículo de revisión tiene como fi nalidad reseñar cómo el concepto del Estado Social de Derecho ha evolucionado, desde la perspectiva del neoconstitucionalismo partiendo históricamente desde la Segunda Guerra Mundial hasta nuestros días, mediante una investigación bibliográfica sobre la posición ideológica y jurídica de autoridades sobre el tema, encontrándose que todos los autores son enfáticos en determinar que dependiendo del tipo de Estado que tenga un país, la democracia avanzará pacifi cando las civilizaciones, y eso es uno de los acontecimientos más importantes de la posmodernidad, los liberales consiguieron el derecho a la propiedad para acaparar la riqueza, pero cedieron ante la intervención del Estado en las políticas económicas, y se implementó el respeto de los derechos fundamentales de las personas, debido a la tutela efectiva que es controlada por el máximo órgano constitucional, en aras de propender por el cumplimiento de los lineamientos constitucionales, y la democracia participativa, que permita el cumplimiento de los fi nes esenciales del Estado. En el presente estudio se analizan los avances del neoconstitucionalismo y la democracia participativa en Bolivia, Ecuador y Venezuela. Desde 2006, estos tres países han dirigido la llamada transformación hacia la izquierda en América Latina y el socialismodel siglo xxi. ¿Cómo se reflejan las ideas de la democracia radical en las nuevas Constitucionesandinas y cuáles son los probables desafíos y contradicciones acerca de la implementación de estas medidas para animar la participación popular local e inclusión de los sectores previamente excluidos? Adicionalmente, un objetivo principal del artículoes aplicar un nuevo concepto para el debate académicosobre el desarrollo político en América Latina: descentralización socialista. Consecuentemente,el propósito es problematizar el debate teórico sobre la descentralización y la democracia radical participativa en los tres países andinos, e igualmente indicar algunos desafíos para los proyectos políticos participativos alrededor de los presidentes Hugo Chávez, Evo Morales y Rafael Correa. ; This study is an analysis of the processes of neoconstitutionalism and participatory democracy in Bolivia, Ecuador and Venezuela. Since 2006, these three countries have led the alleged leftist transformation of Latin America and the 21st Century Socialism. This article shows how the ideas ofradical democracy laid down in the new Andean constitutions are reflected and the likely challenges,tensions and contradictions regarding the implementation of these measures to enhance local popular participation and social inclusion of previously marginalized groups. Additionally, this article aims is to apply a relatively novel concept for the academic debate on political development in Latin America: socialist decentralization. Therefore, the study will offer a problematization of the theoretical debateon decentralization and radical participatory democracyin the three Andean countries. Furthermore, certain challenges for the participatory political projects by Presidents Hugo Chávez, Evo Morales and Rafael Correa will be identified.
