The Internet is one of the most important technological innovations in human history. Nowadays, more than half of the global population is using Internet, and became the basis for the new Digital Economy. Although the Internet was created as a technology without a unique point of control, many actors have increased their efforts to control the infrastructure and traffic pursuing their own interests. In this scenario, with the changes driven by advances in technologies, services and the fast-growing of the Internet over the past two decades, the role of those who control the Internet infrastructure is one of the central issues of public debate about Internet policies. The main point of discussion is the Net Neutrality, that includes the access and control over content and applications without discrimination, the users and Internet service provider's rights. This work analyzes how government authorities and stakeholders in four South American countries have approached the Net Neutrality debate between 2010 and 2017, also detail the particular conditions and characteristics of the situation that surround the creation and application of laws. The conclusions presents some problems and challenges that the countries should face in order to maintain the benefits of the policy.
Uno de los permanentes objetivos de índole geopolítica y geoestratégica de las potencias mundiales reside en su aspiración al dominio de los países interoceánicos, los estrechos, los puertos, puntas e islas que les permita el control de las rutas de comunicación universal. De igual manera, una de las aspiraciones permanentes de las medianas potencias y de los países pequeños, es lograr el paso franco por las vías interoceánicas para tener libertad de comunicación, tránsito y comercio. A medida que se avecina la presencia Estadounidense en la República de Panamá y la transferencia a este país del canal que atraviesa su territorio; hecho que ha de ocurrir en poco más de 60 días (31 de diciembre de 1999, a las 12:00 meridiano, hora de Panamá), las discusiones a lo interno del congreso norteamericano y en los más altos sectores políticos conservadores de ese Estado, al igual que a lo interno de la nación panameña, son cada vez más intensos. Uno de los temas más debatidos en torno al Canal Interoceánico es el referido a la Defensa y el régimen de Neutralidad al que será sometido el mismo después del año 2000 por virtud del Tratado de Neutralidad Permanente y Funcionamiento del Canal de Panamá. En este breve esbozo informativo ensayamos algunas aproximaciones y críticas sobre este tema que se ventila en éste espacio geopolítico y que es de interés capital para todas las naciones de la comunidad internacional. ; One of the permanent geo-political and geo-strategic objectives of world superpowers is their aspiration to dominate inter-oceanic countries, straits, ports, islands, which allow them to control the routes of world communication. Likewise, one of the permanent aspirations of middle powers and small countries is to reach open passage through inter-oceanic ways in order to achieve freedom of communication, transit and trade. As the American presence comes nearer to the Panama Republic and the transfer to this country of this canal which crosses its territory, happening in about 60 days time (on 31 December 1999, at 12 o clock Panama Time), discussions within the American Congress and the most highly conservative political sectors of this state, as well as within Panama, are getting more and more intense. One of the issues under debate as regards the Inter-oceanic Canal is the one of Defence and the Neutrality Regime under which the canal will be ruled after the year 2000 by virtue of the Treaty of Permanent Neutrality and Functioning of the Panama Canal. In this brief informative article, we try to reach some approximations and critical views concerning this issue, which is of immense interest to all the international community. A recent debate regarding the principle of Net Neutrality (NN) and Open Internet has raised various concerns and positions worldwide, being an issue that impacts society. In a nutshell, this article aims to provide the reader an insight of the NN debate, since its early beginning in the United States and Court's decisions in that country regarding NN, identify the stakeholders related to the issue, the absence of a definition of what is NN, the vast debate worldwide in regions such as the European Union and Latin America and the diverse approaches to the issue; some countries have decided to legislate, another country leaders on the basis of the telecommunications market peculiarities have declared the possibility of allowing a two speed internet; and in the other hand, some countries have decided that regulation on NN is not necessary. To conclude this paper, it will be analyzed if the Nicaraguan regulatory framework supports an Open Internet. ; El reciente debate sobre el principio de la Neutralidad de la Red (NN) y el Internet abierto han suscitado diversas inquietudes y posturas a nivel mundial por ser un tema que repercute en la sociedad actual. Este artículo pretende brindar luces al lector sobre la NN, desde el surgimiento del debate en Estados Unidos y las decisiones judiciales en dicho país, así como conocer los principales grupos de interés en este tema, la ausencia de consenso respecto a la definición de la NN y ahondar en el debate en distintos países y regiones como la Unión Europea y Latinoamérica y los diversos enfoques al respecto. Algunos países han tomado la decisión de legislar, otros líderes dada las peculiaridades del mercado de las telecomunicaciones, han contemplado la posibilidad que exista un internet a dos velocidades; y por otro lado, ciertos países han optado por la no regulación respecto a la NN. Para concluir, se analizará si en Nicaragua existen normas que sustenten el internet abierto.
Los cambios en Internet y las complejidades para su regulación se derivan de su carácter abierto, libre, global, descentralizado y des-territorializado. Por ello resulta clave analizar las tendencias regulatorias por las oportunidades y desafíos que supone para el diseño de las políticas de comunicación. Dada la creciente importancia de Internet para el ejercicio de la libertad de expresión y en la circulación de los bienes culturales, uno de los ejes del debate internacional se centra en el principio de la neutralidad de la red, que implica garantizar el acceso a los usuarios, la antidiscriminación en la circulación de los contenidos y la interoperabilidad de las redes. Desde un abordaje de la economía política de la comunicación, el artículo tiene como objetivo analizar las legislaciones y proyectos vigentes ligadas al desarrollo de Internet en Argentina, que se plantean por acción u omisión del Estado, a partir de la identificación de dos tensiones: el interés público versus el interés corporativo y la libertad de expresión versus el control del acceso. E indaga en qué medida se articula el principio de neutralidad de la red en las regulaciones emergentes para lo cual se identifican los actores clave y se evalúa el impacto de los intereses afectados. ; The transformations and the difficulties to regulate Internet take place because of being open, free, global, descentralized and des territorialized. Accordingly, it is important to analize the regulatories bias in order to elaborate communication policies. Since the key role that Internet is playing on the freedom of expression and the circulation of culture products, the worldwide debate is focused on the neutrality net. This is oriented to guarantee consumer's access to networks, the non-discrimmination between different kind of contents and applications, and the interoperability between different nets. Within political economy of communication´s approach, this paper aims to analize the laws and bills over the development of Internet in Argentina, that are proposed by action or omission from governments. This study highlates two tensions: public interest versus corporate interest and the freedom of expression versus control access. El modelo de democracia liberal suele ser asociado con la idea de neutralidad. Según esta posición, el Estado debe abstenerse de fijar como cierta una determinada concepción de vida buena y, en cambio, debe garantizar las condiciones necesarias para efectos de que cada uno de los ciudadanos pueda llevar a cabo su propia visión de vida buena. No obstante, frente a la anterior pretensión, han surgido críticas que afirman que el objetivo mismo de la neutralidad es inalcanzable y que, además, lo que hacen las democracias liberales es hacer pasar por neutras visiones de lo bueno que realmente privilegian alguna forma de individualismo. El objetivo de esta investigación es reivindicar la posibilidad de la neutralidad a partir de una ampliación del concepto de lo justo. Para lograr esto he dividido el texto en cuatro partes. En la primera parte, mediante la exposición de la teoría de Rawls, daré cuenta de dónde se puede hallar la fuente de la neutralidad (capítulo 1). Una vez realizado lo anterior, expongo algunos de los principales problemas presentes en la teoría de Rawls y algunas de las consecuencias de aceptar estos problemas (capítulo 2). En el siguiente capítulo, muestro que el concepto de justicia puede ser ampliado mediante el concepto de equidad y que, como consecuencia de ello, se pueden resolver muchos de los problemas expuestos con anterioridad (capítulo 3). Finalmente, siguiendo el trabajo de Martha Nussbaum, muestro algunas aplicaciones prácticas de afirmar el concepto de equidad. Allí veremos que el concepto de equidad ha hecho posible un concepto de neutralidad abierta que, sin renunciar a los principales postulados del liberalismo, es capaz de responder a las críticas que a éste se le han formulado (capítulo 4). According to this position, the state should refrain from setting as certain a particular conception of the good life and, instead, should guarantee the necessary conditions for each citizen to be able to carry out his or her own vision of the good life. However, in response to the above claim, criticism has arisen that the very goal of neutrality is unattainable and that, moreover, what liberal democracies really do is to pass off as neutral visions of the good that actually privilege some form of individualism. The objective of this research is to vindicate the possibility of neutrality based on an extension of the concept of justice. To achieve this I have divided the text into four parts. In the first part, through the exposition of Rawls' theory, I will give an account of where the source of neutrality can be found (chapter 1). Having done so, I expose some of the main problems present in Rawls' theory and some of the consequences of affirming these problems (chapter 2). In the next chapter, I show that the concept of justice can be extended by the concept of equity and that, as a consequence, many of the problems exposed above can be solved (chapter 3). Finally, following Martha Nussbaum's work, I show some practical applications of affirming the concept of equity. At the beginning of the 20th century, the debates on Americanization intensified among European intellectual circles. These discussions were known in Spain thanks, on one side, to the increasing number of news coming directly from the United States, and on the other, to the appearance of new generations of Spanish intellectuals acquainted with the English-speaking world.After the outbreak of World War I, the weekly España became one the most important pro-allied organs. Its editors and collaborators continuously referred to the impressions and images of the United States spread in previous years, to present American neutrality as a model for the Spanish government. ; A comienzos del siglo XX se intensificaron en distintos círculos intelectuales europeos los debates en torno a la americanización. Éstos llegaron a España gracias, por una parte, al incremento de noticias venidas directamente desde Estados Unidos y por otra, al surgimiento de nuevas generaciones de intelectuales familiarizados con el mundo anglosajón.Tras el estallido de la I Guerra Mundial, la revista España se convirtió en uno de los medios intelectuales aliadófilos más importantes. Sus colaboradores recogieron las impresiones sobre Estados Unidos, difundidas en los años anteriores, para presentar la neutralidad de ese país como el modelo que debería seguir el gobierno español.
In this work we deal with the conceptual delimitation of the following categories: neutrality, objectivity and impartiality. The neutrality is a prohibition of political nature which acts imposing on the civil servant the duty of collaboration with any Government, independently of the political option which has formed it. The objectivity is the characteristic way of the interpretation and observance of the Law by the Administration, which acts imposing on the civil servant the duty of dispensing with any kind of aim or subjective interest in such interpretation and observance. The impartiality of the Administration, to such an extent that the Administration must keep watch over fulfilling the general interests, it does not exist in itself; the impartiality identifies with the objectivity and the good appearance of the Administration. Lastly, we think about the appearance of independent administrative authorities in the context of an impartial, objective and neutral Public Administration. ; En el presente trabajo se acomete la delimitación conceptual de las categorías de neutralidad, objetividad e imparcialidad. La neutralidad es la prohibición del carácter político de la Administración, que opera imponiendo al funcionario el deber de colaboración con cualquier Gobierno, con independencia de la opción política de éste. La objetividad es el modo característico de la interpretación y aplicación de la Ley por parte de la Administración, que opera imponiendo al funcionario el deber de realizar dicha labor hermenéutica y aplicativa adecuándose a la voluntad normativa y prescindiendo de cualquier tipo de fin o interés subjetivo. La imparcialidad de la Administración, en tanto en cuanto ésta ha de velar por la satisfacción de los intereses generales, no existe propiamente como tal, identificándose con la objetividad y protegiendo la buena apariencia de la Administración. Por último, se reflexiona sobre la aparición de las autoridades administrativas independientes en el contexto de una Administración pública neutral, objetiva e imparcial.
The Internet has become the ultimate platform for convergence, closely associated with network, technology, and media, due to its open and nondiscriminatory architecture. Convergence in telecommunications is propelled by ideas, ideologies, and policies progressively and cyclically, bringing further technological advancement, market, business, and policy changes. As a response to convergence, net neutrality seeks to regulate the relationship between Internet service providers and users to avoid discriminatory practices and ensure the openness of the Internet as a platform for innovation, economic development, and access to information for all. The objective of this work is to analyze the development of convergence in the telecommunications sector and the progress of net neutrality policies in South America, with five specific cases using a qualitative empirical approach. Within the findings, we identify different approaches for legislating net neutrality, controversies concerning the levels of commitment to the principles, ambiguity for effective enforcement of the rules, and commercial arrangements that in practice violate net neutrality. ; El Internet se ha convertido en la plataforma definitiva para la convergencia, estrechamente asociada con las redes, la tecnología y los medios, debido a su arquitectura abierta y no discriminatoria. La convergencia en las telecomunicaciones es impulsada por ideas, ideologías y políticas de manera progresiva y cíclica, lo que genera más avances tecnológicos, cambios en el mercado, los negocios y las políticas. Como respuesta a la convergencia, la neutralidad en la red busca regular la relación entre los proveedores de servicios de Internet y los usuarios para evitar prácticas discriminatorias y asegurar un Internet abierto como plataforma de innovación, desarrollo económico y acceso a la información para todos. El objetivo de este trabajo es analizar el desarrollo de la convergencia en el sector de las telecomunicaciones y el avance de las políticas de neutralidad en la red en América del Sur, con cinco casos específicos utilizando un enfoque empírico cualitativo. Dentro de los hallazgos, se identifican diferentes enfoques para legislar la neutralidad en la red, controversias sobre los niveles de compromiso con los principios, ambigüedad para la aplicación efectiva de las reglas y acuerdos comerciales que en la práctica violan la neutralidad de la red.
This research aims to demonstrate the importance of neutrality of red, its functionalities, rules and benefits. Bearing in mind that there is a growing interest on this issue, both in the governmental and corporate spheres. The methodology used was quantitative through surveys and qualitative through the critical analysis of the authors; so also theoretical col- lection that needs to know the massive red neutrality regulations in their corporate policy. The information collected through its results demonstrates the great impact called "Net Neutrality" evidencing its fall in 2018, with chaos in companies such as Netflix, Amazon, Facebook, among others; that oppose the proposal to change internet regulations in the US. UU. In the case of Ecuador there are laws that regulate companies so that the Internet is used by users and the use in the manipulation of networks. ; Esta investigación tiene como objetivo demostrar la importancia de neutralidad de red, sus funcionalidades, reglas y beneficios. Teniendo en cuenta que existe un creciente de in- terés sobre este tema, tanto en el ámbito gubernamental como corporativo. La metodología utilizada fue de carácter cuantitativo a través de encuestas y cualitativo a través del análisis crítico de los autores; así también recopilación teórica que permitió conocer las masivas regulaciones de neutralidad de red en la política-corporativa de las mismas. La informa- ción recopilada a través de sus resultados demuestra el gran impacto llamado "Neutralidad de Red" evidenciando su caída en el año 2018 existiendo caos en empresas como Netflix, Amazon, Facebook, entre otras; que se oponen a la propuesta de cambiar las regulaciones de internet en EE.UU. En el caso de Ecuador existen leyes que regulan las empresas a fin que el internet es utilizado por los usuarios y el uso en la manipulación de la redes.
This paper outlines an analytical model for relations between objectivity and political ideology from an ethically sound historical research standpoint. With a recent public debate on the interpretations of the 1936 Spanish general elections as a case study, this paper lays out the impossibility of separating subjectivity from objectivity and disempowering the political subject, from both a Philosophical Hermeneutics and an Epistemology of Social Science viewpoint. Relativism is avoided in spite of this approach, and possible route plans for an ethically sound historiographical research, while claiming the need for those studies within the scope of Moral Philosophy. ; El presente trabajo plantea un modelo de análisis de las relaciones entre objetividad e ideología política desde una ética de la investigación histórica. Tomando por caso un reciente debate acerca de las elecciones españolas de febrero de 1936 y sus interpretaciones, se plantea la imposibilidad de separar la subjetividad de la objetividad y de apagar el sujeto político, tanto desde la hermenéutica filosófica como desde la epistemología de las ciencias sociales. Sin caer por ello en el relativismo, se plantean posibles caminos para un trabajo historiográfico ético, reclamando la necesidad de este tipo de estudios desde el ámbito propio de la filosofía práctica.
Uno de los presupuestos más cuestionados en el campo de la museología es la imaginaria pretensión de considerar a los museos como espacios neutrales, libres de presiones políticas o religiosas. Sin embargo, nada más lejano a la realidad que considerar a los museos como instituciones de absoluta autonomía por fuera de los circuitos de poder y legitimización estatal, o cuando menos, como escenarios absueltos de las batallas de confrontación política e ideológica. Los museos estatales, no solo por su filiación institucional, sino por los objetos que resguardan, representan una carga semántica y simbólica ligada a la tradición pero también a la concepción dominante en variados ámbitos sociales. Adicionalmente, el arte moderno y contemporáneo en particular, tiene su pilote en la autonomía e independencia de su lenguaje, que en contadas ocasiones juega de forma metafórica con dicho contenido simbólico de los objetos y espacios museales, apuntando justamente al ámbito político del museo y sus piezas. A la luz de lo anterior, este trabajo explora las sutiles transferencias de sentido entre los objetos de carácter religioso y sagrado en los museos vinculados al Estado y el carácter polisémico de los espacios y las colecciones. Con ello se pretende discutir sobre la pertinencia o no de la participación del Estado en la exhibición y promoción de un variado tipo de objetos y piezas, en su múltiple dimensión semiótica, dentro de los museos estatales. ; One of the most questioned assumptions in the field of museology is the imaginary claim to consider museums as neutral spaces, free from political or religious concerns. However, nothing is further from reality than considering museums as institutions of absolute autonomy outside the circuits of power and state legitimization, or at least, scenarios free of the battles of political and ideological confrontation. State museums, due to their institutional affiliation as well as the objects that they protect, represent a semantic and symbolic burden linked not only to tradition, but also to the dominant conception in various social spheres. Moreover, modern and contemporary art in particular, considers its strength in the autonomy and independence of its language, which rarely plays metaphorically with symbolic content of museum objects and spaces, precisely targeting the political sphere of the museum and its pieces. This paper aims to explore the subtle transfers of meaning between objects of a religious and sacred nature in museums linked to the State and the polysemic nature of spaces and collections. It discusses the pertinence or not of the State within this type of museums, on the exhibition, and promotion of a varied type of objects and pieces within their multiple semiotic aspects.
Este artículo trata de analizar la postura del diario regional La Voz de Galicia durante los años de la Primera Guerra Mundial. Cuando se inició la Guerra, la postura oficial de España, con Eduardo Dato en el gobierno, fue la neutralidad. Los periódicos, al igual que los políticos, respetaban esta decisión porque además de conveniente era una postura inevitable. A partir de agosto de 1914 la atención principal de La Voz de Galicia se dirigió a informar sobre la guerra, fue durante muchos meses el único tema de la primera plana. Aunque La Voz se declarase neutral, a través de los artículos publicados se podía observar desde el principio su aliadofilia. ; This article tries to analyze the position of the newspaper during the years of First World War. When the World War began, the official position of Spain with Dato on power was neutrality. The newspapers, like politicians, respected this decision of the government because besides convenient it was an inevitable posture. Since August 1914 the main focus of La Voz de Galicia went to report on the war, which was for many months the only subject on the front page. Though La Voz was declared neutral, through the published articles it could be seen from the beginning its affiliation with the allies.
El futuro de la Web está condicionado por la neutralidad de la Red. Para que la Web pueda desarrollarse en plenitud todos los contenidos, blogs y plataformas deben ser tratados de la misma forma. Se indica el origen y las motivaciones presentes en el debate de la neutralidad. Se centran las dos posiciones encontradas en este debate: los aperturistas, partidarios de una Red abierta sin restricciones; y los desreguladores que defienden la capacidad de intervenir sobre los contenidos que circulan, privatizándola. Finalmente se describe el estado de la cuestión respecto a la regulación de la neutralidad de la Red en la Unión Europea. ; The future development of the web largely depends on net neutrality, that is, ensuring that all content, sites and platforms are treated equally. This article assesses the origins and motivations that exist in the debate about network neutrality. Then it focuses on the two distinct views regarding net neutrality: the Openists, supporters of an open net without restrictions, on one side and Deregulationists, naturally suspicious of any government regulation, on the other. Finally, this article describes the net neutrality regulatory framework within the European Union.
Suecia fue uno de los pocos países europeos neutrales durante la Segunda Guerra Mundial. Este hecho reforzó su status moral en las décadas de posguerra como superpotencia humanitaria y el epítome del Estado del bienestar. Solamente en los años noventa comenzó la historiografía a poner en cuestión esta visión complaciente, señalando aspectos como las exportaciones de hierro a Alemania, los sentimientos pro-alemanes entre considerables grupos sociales o las concesiones militares al Ejército alemán en momentos clave. No obstante, estos temas polémicos ya habían sido afrontados por varios escritores en las décadas anteriores, lo cual suscita el tema de las relaciones entre literatura e historia. ; Sweden was one of the few neutral European countries during the Second WorldWar. This fact reinforced its moral status in postwar decades as a humanitarian superpowerand the epitome of the Welfare state. Only in the 1990s began historiography to put into questionthis complacent view, pointing at aspects such as the iron exports to Germany, the pro-German feelings among significant social groups or the military concessions to the German Army in key-moments. However, these contentious issues had been already dealt with by several writers in previous decades, which raises the issue of the relationships between literature and history. ; SI
