Der Beitrag untersucht das Verhältnis von Arbeitsstrafen und Zuchthausstrafen, vor allem die Frage, ob dem Zuchthaus die dominierende Rolle bei der Entstehung der modernen Freiheitsstrafe zuzumessen ist. Ziel ist es daher, anhand einer historischen Betrachtung vom römischen Strafrecht bis hin zum Strafrecht im 17. und 18. Jahrhundert, die verschiedenen Ausprägungen der öffentlichen Arbeitsstrafen zu skizzieren und zu prüfen, inwieweit opera publica Freiheitsstrafen waren und was ihr Verhältnis zu den Zuchthausstrafen angeht. Der Autor kommt zu dem Schluss, dass im 17. und 18. Jahrhundert in vielen deutschen Territorien öffentliche Arbeitsstrafen neben und auch schon vor der Zuchthausstrafe eine wichtige Rolle gespielt haben. Im Vordergrund stand nicht die körperliche Peinigung der Delinquenten, neben einer abschreckenden und disziplinierenden Wirkung waren vielmehr in erster Linie utilitaristische Gründe ausschlaggebend. Abschließend wird im Gegensatz zur herrschenden Lehre betont, dass die opera publica in der Tat auch zur Entwicklung der modernen Freiheitsstrafe beigetragen haben. (ICH)
