European Union Policy towards the Pacific Island States
The article concerns the idea as well as the form of international cooperation between states and international organizations, illustrated by the example of the relationship between the European Union and the Pacific region. There is some useful literature on the subject but this needs be to completed. The influences of the world's leaders collide on the Pacific Ocean, which gives this area primacy in geopolitical domination, slowly downgrading the Atlantic Community. The main purpose of the paper is, therefore, to research the possibilities and methods of legal and extrajudicial cooperation betweentwo continents which are very distant from each other. W ostatnich paru latach do władzy doszły w niektórych państwach zachodnich partie prawicowe, które bardziej posługują się argumentami politycznymi i nie dostrzegają korzyści, jakie niesie ze sobą wolny handel. Przykładem może być Parnterstwo Transpacyficzne (TPP), które miało doprowadzić do przyśpieszenia handlu i wzmocnienia współpracy gospodarczej w regionie Azji i Pacyfiku. Partnerstwo to miało też być przeciwwagą dla ekspansji gospodarczej Chin w tym regionie. Stany Zjednoczone wspierały prawie 7-letni proces negocjacji i doprowadziły przy końcu 2015 roku do podpisania porozumienia o utworzeniu TPP. Do początku 2017 roku porozumienie to nie zostało jednak ratyfikowane przez parlamenty państw członkowskich, a w lutym 2017 roku prezydent Donald Trump wycofał USA z tego partnerstwa. Stworzyło to szansę dla Chin, które forsują swoją koncepcję Regionalnego Kompleksowego Partnerstwa Gospodarczego (RCEP) i osłabiło zaufanie do Stanów Zjednoczonych wśród wielu dotychczasowych sojuszników tego mocarstwa. ; In the recent times some rightist's political parties which have come to power in a number of Western states, seem to favour political arguments over the free trade advantages. The case of Trans-Pacific Partnership is the most illustrative as that regional free-trade agreement was aimed at "rebalancing" the economic cooperation within the Pacific region. It also was to create a trade bloc acting as a bulwark against China's hegemony in that region. The United States has promoted the seven years negotiation process which brought about in 2015 the creation of TPP. However that trade agreement was not ratified by the parliaments of the member countries till the beginning of 2017, and in February president Donald Trump withdrew the United States from the TPP. This created a room for the China's backed different proposition called the Regional Comprehensive Economic Partnership and highly weakened trust in the USA among its Asian allies.

Spory międzynarodowe i potrzeba nowego podejścia do ich załatwiania środkami pokojowymi ; International Disputes and the Need of a New Approach of their Solution by Pacific Means
Both the present theory of international conflicts and recent development in international relations in the sphere of procedures and bases for pacific solution of international disputes call for an urgent re-examination of a number of relevant problems involved. There are three such problems the examination of which is essential to meet the necessity of a new approach to international disputes and their solution by pacific means. First of all it seems to be of primary importance to propose a new and more adequate systematization of international disputes using such criteria as they appeared to have played in practice decisive role in the originating (sources) of particular disputes their stages and possible mutations. The author proposes five such criteria which give an opportunity to systematize all disputes and show them in the light of variety of characteristic features. These criteria are as follows: a) substance of the dispute (the subject matter may be territorial or personal), b) persons meaning parties to a dispute (there may by bilateral or multilateral disputes; disputes between states, states and an organization, or between organizations etc.), c) the factor of time which may have and material significance or plays a formal and procedural role, d) the factor of the locus in the meaning of the character of circumstances (local, regional or universal) which bear upon sources of a particular dispute, and e) the factor of forum which shows whether and under what conditions a particular dispute may be discussed on the international plane or falls within the exclusive national jurisdiction. The visible decline of using existing devices and means of pacific solution of international disputes as listed in the article 33 of the Charter tends to expose the international peace to a real danger. There is therefore a further need of thorough research of present practices spontaneously and often informally developing. The author gives a number of such instances which together with some other propositions may be used as a helpful indication by drafting new devices and institutions of pacific solution of international disputes. Finally there is another problem which consists in an hypothesis that there is an intimate relation between particular types of international disputes and means best calculated to bring such disputes to an desirable end. Międzynarodowa pozycja Nowej Zelandii jako mocarstwa regionalnego
Located in the South Pacific, for many years New Zealand has been an important part of a great power concert taking place within the region. The post- 1945 process which had given independence and the right to self-government to various states and territories formerly administered by the great powers, allowed them to shape their external relations with other states autonomously, and thus rendered the position of formal dominance previously held by the great powers obsolete. This included also New Zealand whose international position at that time was highly conditioned by trusteeship responsibilities performed pursuant to a UN mandate. Combining David A. Baldwin's contextual approach to power analysis with Ray S. Cline's resource-based power model, the author examines the presentday distribution of military and socio-economic potential within the South Pacific region and depicts the unilateral exercise of local preponderance by the Wellington government conducted in the last 10 years. He reaches a conclusion that, stemming either from individual actions conducive to an efficient exploitation of the social potential, or a close cooperative relationship with Australia, which gives rise to an asymmetrical great-power military tandem, in which the Wellington side plays a complementary role, New Zealand currently holds a position of a regional military and social power, whereas its capabilities predestine it obtain a similar status also with respect to economic matters.

Europa/Unia Europejska, dysponując niekwestionowanymi atutami, powinna też być aktywnym i skutecznym graczem na arenie międzynarodowej. Takie były oczekiwania Stanów Zjednoczonych, formułowane zwłaszcza przez administrację Baracka Obamy. Jednak z amerykańskiej perspektywy Europa nie sprawdziła się jako ważny aktor na scenie międzynarodowej, zaangażowany w rozwiązywanie problemów globalnych i gotowy brać większą odpowiedzialność zabieg spraw w świecie. Tainercja Unii Europejskiej powodowała, że nastąpiła marginalizacja Europy w polityce amerykańskiej, czego wyrazem był "pivot to the Pacific Rim". Dopiero wydarzenia na Ukrainie, będące efektem imperialnych tendencji w działaniach Rosji, spowodowały większą aktywność i koherentność polityki amerykańskiej i europejskiej, prowadząc też do wzmocnienia układu transatlantyckiego ; Europe/the European Union, with its obvious trump cards, should be an active and efficient player on the international arena. Regionalna integracja krajów jako strategia wzmocnienia bezpieczeństwa politycznego i ekonomicznego państw i regionów, jest również adekwatna do sytuacji krajów Azji Południowo-Wschodniej. Zapoczątkowane w 1967 r. procesy skutkują pogłębieniem integracji w dziedzinie politycznej i ekonomicznej, co z kolei owocuje wzrostem bezpieczeństwa politycznego i ekonomicznego nie tylko w samej Azji Południowo- Wschodniej, ale również w całej Azji i Pacyfiku. Podjęcie decyzji o powstaniu Wspólnoty ASEAN w oparciu o filary współpracy politycznej i bezpieczeństwa, ekonomicznej i kulturalnej, pokazuje, iż Stowarzyszenie Narodów Azji Południowo- Wschodniej ASEAN, jako ważny podmiot na stałe wpisuje się nie tylko w region Azji i Pacyfiku, ale w cały system międzynarodowy. ; The regional integration of countries as a strategy for reinforcement of political and economic security of states in the region is also adequate for the countries of Southeast Asia. Initiated in 1967, these processes result in the reinforcement of integration in politics and economy, which in turn results in the increased political and economic security, not only in Southeast Asia, but also in the entire continent and on the Pacific. The decision to establish the ASEAN community based on the foundations of economic, cultural, and political cooperation and security proves that the Association of Southeast Asian Nations is an important element not only of the Asia and Pacific region, but also of the entire international system. ; Региональная интеграция стран, как стратегия укрепления политической и экономической безопасности государств и регионов, происходит также в странах Юго-Восточной Азии. Начатые в 1967 году процессы, кроме углубления политической и экономической интеграции, привели к росту политической и экономической безопасности не только в самой Юго-Восточной Азии, но также во всей Азии и в регионе Тихого океана. Принятые решения об образовании Ассоциации АСЕАН, основанной на политическом, экономическом и культурном сотрудничестве, показало, что Ассоциация государств Юго-Восточной Азии АСЕАН, стала важным субъектом не только в регионе Азии и Тихого океана, но и всей международной системы.

This book explores the impact of climate change on the legal situation of small island states such as Marshall Islands. Climate change-related problems of these nations touching their legal situation in a very different way than in the case of large countries threatened by economic and social consequences of sea level rise (such as Bangladesh, Vietnam, Nigeria and Egypt). Presentation of scientific forecasts is an introduction to the in-depth deliberations from the point of view of international law. According to many researchers, global sea level rise of 0,5-1 m. is highly possible in the next hundred years. Sea level rise is not the only climate-related threat experienced by small island states. Among other significant problems associated with climate change we can list tropical cyclones, floods, and droughts. Island nations must prepare for such problems on the basis of public international law. The authors draw attention to the most crucial legal challenges associated with sea level rise, such as the deterritorialization of the state, continuity of statehood, the issue of citizenship or the legal status of forced environmental migrants. The authors draw attention to the significant legal challenges (e.g. the legal status of migrants forced to leave their country of origin/residence as a result of irreversible climate change). This issue has still not been regulated by international law documents. Much attention is also being paid to the analysis of the consequences of climate change on the basis of international law of the sea. The core elements of the analysis presented in this book are, inter alia, the impact of sea level rise on Exclusive Economic Zones and fishing rights. The book is focused on the social and legal challenges facing microstates. Presented considerations may become a useful point of reference in the analysis of the problems facing larger countries affected by climate change and sea level rise.
