Mediacija je postopek alternativnega reševanja sporov, ki je primerna za skoraj vse vrste sporov, v katerih si stranke želijo obdržati nadzor nad procesom ter izidom njihovega spora. Mediator namreč ne sprejme končne odločitve v postopku, temveč strankam le pomaga, da najdejo skupni jezik, se zbližajo v stališčih in rešitev najdejo same. Pri tem pa mediatorju pomagajo mediacijske tehnike. Mediacijske tehnike so osnova in bistvo mediatorjevega dela, brez njihove uporabe pa je situacija ista, kot če bi se pogovarjali stranki sami brez mediatorja, saj je mediatorjev prispevek zanemarljiv. Osnovni mediacijski tehniki sta aktivno poslušanje ter povzemanje, zanemarljiva pa niso niti ločena srečanja, ki so hkrati ena izmed največjih prednosti mediacijskega postopka v primerjavi s pravdnim. Čeprav se na papirju zdi enostavna, je uporaba mediacijskih tehnik v praksi vse prej kot preprosta, vendar pa lahko z njihovo pravilno, natančno ter vztrajno uporabo dober mediator doseže, da so stranke pripravljene na prilagajanje in popuščanje. Uporaba tehnik je nujna tako v pravdnih kot gospodarskih mediacijah, kot tudi v drugih vrstah spora, pri tem pa je nujno slediti strankam ter ne »prehitevati«. Tudi sicer je mediacija postopek, ki je namenjen bolj strankam kot njihovim pravnim pooblaščencem, v kolikor pa so ti vseeno prisotni, je zaželeno, da sodelujejo z mediatorjem in ne otežujejo njegovega dela. Sodelovanje je mišljeno v smislu naklonjenosti dogovarjanju in poravnavanju ter spodbujanju strank k iskanju mirnih, stroškovno ugodnih ter predvsem bolj trdnih rešitev. Dogovor, sprejet v mediaciji, je namreč praviloma bolj trden in spoštovan, kot če je vsiljen s strani tretje osebe. ; Mediation is a process of alternative dispute resolution that is suitable for almost all types of disputes where parties want to have control over the process of resolution and the eventual outcome. The role of a mediator is not to arbitrate, but to facilitate discourse and mutual understanding between parties, and to assist them in negotiating a settlement. The essence of a mediator's work are mediation techniques. Without them, the process of mediation is reduced to parties attempting to resolve a conflict on their own, making a mediator's contribution negligible. Besides listening and summarizing, one of the most important techniques are separate meetings, which is also one of the biggest advantages of mediation over litigation. These mediation techniques seem simple in theory, but are difficult to apply in practice. By using them correctly, thoroughly, and persistently, a skilled mediator can steer parties towards being more agreeable and willing to compromise. The use of mediation techniques is necessary in both civil and commercial proceedings, as well as in other types of disputes. In using them, a mediator should always follow each party's lead and not rush the process. Mediation is designed for the benefit of parties themselves and not for their attorneys. If attorneys are present, they should cooperate with the mediator by being open to agreements and settlements, and by encouraging parties to reach peaceful, affordable, and firm solutions. Solutions reached with mediation namely tend to be firmer and are more likely to be respected than the ones imposed by a judge or someone else.
Pridobivanje informacij s pogovorom je ključna naloga preiskovalec pri preiskovanju kaznivih dejanj in nekaterih drugih posameznikov, ki s poslužujejo podobnih metod. Magistrska naloga vsebuje povzetke in opise najbolj uporabljenih tehnik pridobivanja informacij oziroma zasliševanj, ki se trenutno uporabljajo po svetu. V sklopu magistrskega dela smo naredili še pregled empiričnih raziskav v Sloveniji, ki obravnavajo tematiko zasliševanja. Narejena je bila taksonomija velike večine tehnik zasliševanja ter natančen in empiričen pregled dveh metod, ki sta trenutno najbolj uveljavljeni v svetu. Tako imenovani PEACE metoda in Reid tehnika. Na podlagi primerjave obeh tehnik in skladnosti s pravno ureditvijo, je bilo ugotovljeno, da Reid tehnika ni kompatibilna s slovensko zakonodajo saj se poslužuje metod, ki so eksplicitno prepovedane. Uporaba takšnih metod lahko resno ogrozi celoten kazenski postopek. Na podlagi pregleda lahko sklepamo, da so tehnike zasliševanja v Sloveniji zelo stare, v primerjavi z ostalim zahodnim svetom, neustrezne in ne dosegajo etičnih standardov. Poleg tega opažamo pomanjkanje empiričnih raziskav na tem področju, ki šele zadnjih nekaj let kaže rahel premik v razvoju. ; Obtaining information from the conversation is a key task of the investigator in criminal investigation. Although certain other individuals can make use of similar methods. This dissertation contains abstracts and descriptions of the most commonly used techniques for obtaining information or confessions, which are currently in use around the world. As part of the dissertation we review various empirical research in Slovenia, which deals with a subject of interrogation. We made taxonomy of vast majority of interrogation techniques and a precise and empirical examination of the two methods, which are currently the most renowned in the world. The so-called PEACE method and Reid Technique. Based on a comparison of the two techniques and compliance with the legislation, it was found that the Reid technique is not compatible with Slovenian legislation as it makes use of methods that are explicitly prohibited. The use of such methods can seriously jeopardize the entire criminal proceeding. Based on the review we can conclude that the interrogation techniques in Slovenia are very old, compared with the rest of the Western world, they are inadequate and do not meet ethical standards. Moreover, we note a lack of empirical research in Slovenia, which only in the last few years shows a slight shift in development.
Spanje je ena izmed osnovnih življenjskih potreb vsakega posameznika. Kako dragoceno je spanje, po katerem se zbudimo spočiti in naspani, pa se pogosto zavemo šele takrat, ko spanca ni več. Ker v postelji preživimo tretjino svojega časa, je zelo pomembno, da ta čas preživimo oziroma prespimo kakovostno. Ponudba ležišč v Sloveniji presega povpraševanje. Posamezniki imajo na razpolago veliko izbirno območje, a ker je konkurenca med ponudniki vsak dan ostrejša, se nam je pojavilo vprašanje, kako se posameznik odloči za nakup določenega ležišča. Se odloča na podlagi blagovne znamke, cene, garancije, preizkusa, naravnih materialov ali zgolj na podlagi oglasov, priporočil prijateljev in znancev, prodajnega osebja ali prodajnega mesta? To je vprašanje, ki smo ga želeli raziskati in prikazati ključne dejavnike procesa odločanja, ki vplivajo na posameznika in ga privedejo do odločitve za nakup oz. nenakup ležišča. Teoretični del magistrskega dela je predstavljen v drugem poglavju. S pomočjo izbranega gradiva s področja problematike na področju nakupnega vedenja porabnikov smo opredelili kulturne, družbene, osebne in psihološke dejavnike nakupnega vedenja. Predstavili smo proces odločanja pri nakupu ležišča ter dejavnike, ki vplivajo nanj, ter opredelili stopnje procesa odločanja. V tretjem in četrtem poglavju smo predstavili trg ležišč v Sloveniji in ključne dejavnike procesa odločanja pri nakupu ležišča. V drugem delu magistrskega dela predstavljamo raziskavo ključnih dejavnikov procesa odločanja pri nakupu ležišča in njihovo pomembnost. Ugotovili smo, da so osebe, vključene v raziskavo, izrazito racionalne. Na njih ne vpliva samo ena informacija, en oglas, ampak več dejavnikov. Ključni dejavniki, ki vplivajo na proces odločanju pri nakupu ležišča, na podlagi rezultatov raziskave, so: priporočila prijateljev in znancev kot glavni viri informacij, naravni materiali kot glavna značilnost ležišča ter garancija ležišča kot daleč najpomembnejša dodatna storitev pri nakupu ležišča. Podrobnejše ugotovitve in predloge za ponudnike ležišč smo strnili v zaključnem delu magistrskega dela. ; Sleep is one of primary human needs. But we are often not aware of the value of a good night's sleep that leaves us feeling rested until it's gone. Since we spend a third of our lives in bed, it is very important to spend or sleep those years in a quality way. Selection of mattresses in Slovenia exceeds their demand. People have a vast area of selection at their disposal, but since the competition among providers stiffens every day, we asked ourselves how somebody decides to buy a certain mattress. Does he or she decide on the basis of a brand, price, warranty, test, natural materials, or solely on the basis of ads, recommendations of friends and acquaintances, sales personnel, point of sale? This is the issue we wanted to explore and present the key factors in the decision making process, which influence a person and lead him to decide to buy or not to buy a certain mattress. The master's thesis is essentially divided to two parts ; the theoretical and practical part. We can say that appendices represent the third part, because they contain more extensive tables and computer print-outs, which served as the basis for the research part. The theoretical part of the thesis is presented in the second chapter. By means of the selected material in the problem area relating to the purchase behaviour of users, we defined cultural, social, personal and psychological factors of purchase behaviour. We introduced the decision-making process when buying a mattress and the factors influencing it, and defined the levels of the decision-making process. In the third and fourth chapter we present the mattress market in Slovenia and the key factors in the decision making process when buying a mattress. The second part of the thesis presents the research of key factors in the decision-making process when buying a mattress and their significance. We have determined that persons included in the research are distinctly rational. They are not influenced by one single piece of information, one ad, but by several factors. The key factors, which influence the decision-making process when buying a mattress, on the basis of the research results, include: recommendations of friends and acquaintances as the main sources of information, natural materials as the main feature of a mattress, and warranty of mattress as the far most important additional service in the purchase of a mattress. More detailed findings and proposals for providers of mattresses were summed up in the final part of the thesis.
The civil mediation programme, which is a court-connected programme, established as a form of alternative dispute resolution, is increasingly gaining ground as a field with its own theoretical and practical knowledge, principles and basic rules. Mediation has already set up its own body of knowledge, based on studies, classification of cases and the analyses of the results. In this article, we examine whether in the context of the development of mediation in Slovenia we might already talk about the profession of the mediator, defined as a provider of the mediation process. We examine the court-connected civil mediation and mediators who mediate at the court-connected civil mediation, and define them theoretically. By interviewing the mediation experts and mediators we examine their opinions about mediators and the court mediation. We examine the legal basis for the court-connected mediation programmes in Slovenia as well as in the European Union. Proceeding from our findings we conclude that the legal regulation of the court mediation in Slovenia is well established, and that the mediators of the court-connected civil mediation programmes can be accepted as the professional providers of the mediation process. ; Sodišču pridružena mediacija se kot alternativna metoda reševanja sporov vse bolj uveljavlja kot področje dela z lastnim teoretičnim in praktičnim znanjem, lastnimi načeli in osnovnimi pravili. Mediacija je vzpostavila lastno znanje, ki temelji na študijah, razvrstitvi primerov in analizi rezultatov. V prispevku bomo preverili, ali lahko glede na razvoj mediacije v Sloveniji govorimo o poklicu mediatorja in ga opredelimo kot strokovnega nosilca postopka mediacije. Najprej bomo sodišču pridruženo mediacijo in mediatorje, ki mediirajo v sodišču pridruženi mediaciji, teoretsko opredeliti ter s pomočjo intervjujev s strokovnjaki za mediacijo in mediatorji v nadaljevanju preverili, kakšno je njihovo mnenje o mediatorjih in sodišču pridruženi mediaciji. Proučili bomo tudi pravno podlago sodišču pridružene mediacije tako v Sloveniji kot Evropski uniji. Glede na ugotovitve bomo sklenili, da je pravna ureditev sodišču pridružene mediacije v Sloveniji dobra in da lahko o mediatorjih sodišču pridružene mediacije govorimo kot o strokovnih nosilcih mediacijskega postopka.
Namen dela je predvsem proučiti oblikovanje, delovanje, vlogo in pomen Demosa kot instrumenta in akterja nacionalne emancipacije in demokratične tranzicije na Slovenskem. Pred osrednjim delom analize so opredeljeni ključni pojmi in koncepti: definicija nacionalizma ter glavni teoretični pristopi k nacionalizmu, opredelitev demokracije in demokratizacije. Za celovito razumevanje vloge in pomena posameznih političnih akterjev, kakršen je bil konec osemdesetih in v začetku devetdesetih Demos, je potrebno dobro poznati zgodovinske okoliščine. Najprej sem v poglavju o zgodovinskih mejnikih oblikovanja slovenske nacionalne identitete poskušala dokazati, da pomembni procesi v osemdesetih in devetdesetih letih niso vznikli sami od sebe, ampak imajo dolgo zgodovinsko podlago. V nadaljevanju obravnavam širjenje političnega prostora, obdobje liberalizacije in razcveta civilne družbe ter ključne procese in dogodke na poti v pluralno družbo. Procesi liberalizacije so soustvarjali tudi politično okolje, v katerem je začela nastajati politična opozicija. Konec osemdesetih let, tik pred nastankom Demosa, sta se izoblikovala dva konsistentna in nekompatibilna narodno-politična programa, ki sta simbolizirala politično polarizacijo. Nove, alternativne 'zveze' so se začele povezovati v pričakovanju demokratičnih volitev in soočenja s skupino družbenopolitičnih organizacij z Zvezo komunistov na čelu. Osrednji del disertacije predstavlja obravnava Demosa, akterja demokratizacije. Znotraj tega obdobja namenjam posebno pozornost najvidnejši osebnosti združene demokratične opozicije Jožetu Pučniku, analiziram predvolilne programe, rezultate volitev, ter oblikovanje novih oblastnih organov. V tem kontekstu analiziram tudi njihovo sodelovanje s Predsedstvom republike Slovenije. V nadaljevanju orišem vlogo Demosa v osamosvojitvenih procesih. Demos je v svojih glavnih namerah uspel, kljub temu, da ga niso ustrezno podpirali mediji, ni imel ustrezne zaslombe v gospodarstvu, pa tudi ne v državni upravi in, razen slovenske vojske in do neke mere policije, v represivnih organih oblasti. Kljub temu je uresničil glavne cilje, za uspešno izpeljano tranzicijo oziroma bolj popolno in konsolidirano demokratizacijo pa mu je zmanjkalo tako časa kot politične moči. Proces uvedbe demokracije, kot drugi od Demosovih ciljev, je bil uresničen v institucionalnem smislu, z vzpostavitvijo temeljnih demokratičnih struktur. Istočasno pa je bil Demos ključni dejavnik ne le pri oblikovanju splošnega soglasja o nujnosti osamosvojitve slovenskega naroda, ki se izraža v visokem rezultatu slovenskega plebiscita 23. decembra 1990, ampak je bil tudi glavni akter in instrument nacionalne osamosvojitve, obrambe slovenske samostojnosti v vojni za Slovenijo ter mednarodnega priznanja. ; The purpose of the thesis is primarily to examine the creation, operations, role and importance of Demos – Democratic Opposition of Slovenia as an instrument and actor of national emancipation and democratic transition in Slovenia. Prior to the central part of the analysis key terms and concepts are identified: definition of nationalism and the main theoretical approaches to nationalism, definition of democracy and democratization. For comprehensive understanding of the role and importance of individual political actors, like Demos was in the late eighties and early nineties, we should also be familiar with historical circumstances. At first I tried to stress that the main events and processes in the eighties and nineties had not emerged by themselves but were results of long historical development. Next I discuss broadening of political space, a period of liberalization and flourishing of civil society and also key processes and events on the way to a pluralistic society. The liberalization processes co-created also the political environment, in which the political opposition started to take shape. At the end of the eighties, just before the establishment of Demos, two consistent and incompatible national-political programmes were formed which symbolized the political polarization. New, alternative 'unions' began to link pending democratic elections and confrontations with a group of the so-called socio-political organizations with the Communists Party at the head. The central part of the thesis is the analysis of Demos, the actor of democratization. Within this period I pay particular attention to Jože Pučnik, the most prominent personality of the united democratic opposition, I analyse election programs, results of elections and the creation of new public authorities. In this context, I analyse also their cooperation with the Presidency of the Republic of Slovenia and outline the role of Demos in the independence processes. Demos succeeded in its main intentions, despite the fact that it had not adequate support of the media, no support of the economy nor in the public service and, with the exception of the Slovenian Army and to some extent police forces, the repressive authorities. Despite all these Demos accomplished its main objectives, however, for a successful transition or a more complete and consolidated democratization it ran out of time and political power. The process of introducing democracy was realized in a formal sense, with the establishment of basic democratic structures. At the same time Demos was a key factor in the creation of the general consensus on the necessity of the Slovenian independency which is shown in the high score of the plebiscite on 23rd Dec 1990. Demos was also the key actor and an instrument of the national independence process, the defence of the Slovenian territory in the war for Slovenia as well as in the process of the international recognition of the new Slovenian sovereign state.
Namen magistrskega dela je bilo proučiti stanje ozaveščenosti glede sistema navzkrižne skladnosti. Ravno tako je bil namen proučiti možnosti poenotenja postopkov v izvajanju sistema, identificirati dobre prakse med deležniki in jih kot skupek dobrih praks, združenih v smernice, predstaviti vsem deležnikom, z namenom postati učinkovitejši v upravljanju kontrolnih sistemov. Pri tem smo kot osnovo za izboljšanje sistema analizirali izvedbeni model obstoječega sistema navzkrižne skladnosti, proučili akreditacijska merila, ki jih mora izpolnjevati plačilna agencija in jih nadgradili z zahtevami novega standarda ISO 9001:2015. Pri standardizaciji procesov smo sledili merilom, ki prispevajo k učinkovitejšemu upravljanju kontrolnih sistemov in ugotovitve združili v prepoznane pomanjkljivosti sistema ter predloge za izboljšanje delovanja modela za dosego večje učinkovitosti sistema vodenja in uspešnejšega izvajanja sistema. Precizen odgovor na učinkovito upravljanje nadzora je v raziskavi opredeljen kot rezultat primerljivosti ugotovitev rednih sistemskih kontrol izven sistema subvencij z ugotovitvami kontrol v subvencijskem modelu. Ugotovili smo, da idejna zasnova modela deluje, vendar pa je mogoče z uporabo predlogov izboljšav obstoječega modela in odpravo izpostavljenih pomanjkljivosti učinkovitejše upravljati kontrolne sisteme znotraj skupne kmetijske politike. V okviru magistrskega dela smo izvedli kvalitativno raziskavo s pomočjo intervjujev z udeleženci vodstvenega in operativnega nivoja deležnikov modela ter s kvantitativno raziskavo. Ta je temeljila na spletnem vprašalniku, posredovanem kmetijskim svetovalcem, kmetom in potrošnikom. Na osnovi raziskave, izvedene z deležniki modela navzkrižne skladnosti, smo ugotovili, da je bistvenega pomena za uspešno skupno politiko uskladitev ciljev kmetijske, okoljske in naravovarstvene politike, ki s svojim zakonodajnim okvirjem, smernicami in ukrepi bodisi neposredno bodisi posredno vplivajo na področje navzkrižne skladnosti. Te s svojim zakonodajnim okvirjem, smernicami in ukrepi bodisi neposredno bodisi posredno vplivajo na področje navzkrižne skladnosti. Izkoristiti je potrebno prožnost politik na ravni EU kot tudi specifike naše države ter postaviti jasno srednje ročno in daljno ročno strategijo kmetijstva, z načrtovanimi in ciljno naravnanimi ukrepi, ki jih podpirajo vse ključne politike in so v interesu kmetov ter hkrati dovolj stabilni v času. Usmerjenost k temu cilju bo privedla do skladnosti s standardi, trajnostnega razvoja kmetijstva, kakor tudi večje združljivosti skupne kmetijske politike s pričakovanji kritične družbe na splošno. Navedeni elementi so bili prepoznani kot cilji politike navzkrižne skladnosti. ; The purpose of the Master thesis was to examine the state of awareness of the cross-compliance system. It was also intended to examine the possibility of standardization of the system implementation procedures, to identify best practices among shareholders and to present these to all shareholders as a set of good practices joined in guidelines, in order to become more efficient in the management of control systems. The implementation model of the existing cross-compliance system was analyzed as a basis for the improvement of the system. Furthermore, the accreditation criteria to be met by a paying agency were also examined and upgraded with the requirements of the new ISO 9001: 2015. The criteria that contribute to more effective management of control systems were followed during the standardization processes. In order to achieve greater effectiveness of the management system and more effective implementation of the system the findings were combined in the identified deficiencies of the system and proposals for improving the functioning of the model. Within the study the precise answer to the effective management of controls is defined as a result of the comparability between findings based on regular system checks outside the subsidy system and findings of controls in the subsidy model. As established the concept of the model is in place. However, with the application of proposed improvements of the existing model and the elimination of the exposed weaknesses the control systems within the Common Agricultural Policy could be managed more effectively. In the framework of the Master thesis the quantitative survey and the qualitative research were carried out, the latest through interviews with managerial and operational level of shareholders model. The quantitative survey was based on an online questionnaire submitted to agricultural advisers, farmers and consumers. The results of the research conducted with shareholders of the cross-compliance model showed that harmonization of objectives concerning agricultural, environmental and conservation policy is essential for a successful common policy. The legislative frameworks, guidelines and measures of the above mentioned policies have either direct or indirect influence on the scope of cross-compliance. It is necessary to take advantage of the flexibility of policies at EU level as well as the specifics of our country and to set clear medium term and long-term agriculture strategy, with planned and targeted measures that are supported by all key policies, in the interests of the farmers and sufficiently stable in time. Direction towards this goal will lead to the compliance with standards, the sustainable development of agriculture and will make Common Agricultural Policy more compatible with the expectations of critical society in general. These elements are identified as the cross-compliance policy objectives.
V magistrskem delu obravnavamo različne politike internacionalizacije visokega šolstva v Sloveniji in na Nizozemskem. Glavni temelj naloge predstavlja analiza in primerjava strateških dokumentov internacionalizacije visokega šolstva obeh izbranih držav. V teoretičnem delu izpostavimo internacionalizacijo v zgodovinski perspektivi. Na kratko opišemo družbenoekonomski kontekst razvoja nizozemskih univerz ter obravnavamo nastanek in razvoj slovenskih in nizozemskih univerz. Osredotočimo se na njihovo poslanstvo ter z njim povezanim položajem jezika v raziskovalni in pedagoški dejavnosti. Opredelimo tudi termin internacionalizacije in navedemo različne definicije. Nato predstavimo oblike internacionalizacije: internacionalizacijo doma, internacionalizacijo kurikuluma ter internacionalizacijo v tujini. V okviru razvoja bolonjskega procesa predstavimo nastanek evropske gospodarske skupnosti, začetke samega procesa ter kritiko njegove neoliberalne zasnove. Raziščemo tudi zelo relevantno temo – transfer izobraževalnih politik. Zaključimo s predstavitvijo jezikovne problematike, to je vedno večja vloga angleščine v pedagoškem in raziskovalnem visokošolskem prostoru ter položaj nacionalnih jezikov. V okviru empiričnega dela najprej ugotavljamo podobnosti in razlike med nacionalnimi politikami internacionalizacije visokega šolstva v Sloveniji in na Nizozemskem ter med politikami na institucionalni ravni – opravimo torej primerjavo Univerze v Ljubljani in Univerze v Amsterdamu. Analiza nacionalnih strateških dokumentov dokazuje, da tako slovensko kot nizozemsko visoko šolstvo sledi podobnim ciljem internacionalizacije. Kot prvo bistveno razliko pa lahko izpostavimo težnjo Nizozemske po povezovanju visokošolskih institucij z gospodarstvom in posledično prevlado gospodarskih motivov za internacionalizacijo. Nasprotno pa internacionalizacijo slovenskega visokega šolstva usmerjajo predvsem politični motivi, saj želi država utrditi prepoznavno podobo nacionalnega visokega šolstva. S tem pa je povezana tudi druga pomembna razlika. V nizozemskih strateških dokumentih je poudarjena namera po konkurenčnosti in prepoznavnosti države na globalni ravni, medtem ko je v slovenskih strateških dokumentih v ospredju potreba po vzpostavitvi regionalne identitete. Nizozemska se torej usmerja v bolj globalno internacionalizacijo, Slovenija pa v regionalno. Državi sta si podobni v tem, da vidita internacionalizacijo kot poglavitni dejavnik pri razvoju svojega visokega šolstva, ki rezultira v izboljšanje njegove kakovosti. Analiza politike internacionalizacije dveh osrednjih univerz v obeh država pokaže, da je zaradi statusa mednarodne in dvojezične univerze Univerze v Amsterdamu internacionalizacija njena ključna značilnost, medtem ko je ljubljanska univerza pri svoji internacionalizaciji dokaj omejena. Zaradi svoje izrazite mednarodne usmerjenosti Univerza v Amsterdamu izvaja pouk v t. i. mednarodni predavalnici. Nizozemska in njene univerze so že – gledano z zgodovinske perspektive – veliko bolj mednarodno odprte. Slednje pa je prispevalo k temu, da Nizozemska spada med najbogatejše države na svetu. Prednost bogatih držav pa niso le zadostna finančna sredstva za implementacijo optimalne internacionalizacije, ampak tudi »privilegij« postavljanja trendov na področju internacionalizacije. Preučujemo tudi medsebojno skladnost strateških dokumentov v posamezni državi ter način odražaja ciljev bolonjskega procesa v ciljih strateških dokumentov. Ugotovimo, da je v nizozemskih strateških dokumentih v primerjavi s slovenskimi prisotno bistveno večje ujemanje v ključnih oziroma prioritetnih ciljih, kar je mogoče pripisati aktivni vključenosti nizozemskih univerz pri oblikovaju politik. Bolonjski cilji so izraženi v obeh državnih in obeh institucionalnih strategijah internacionalizacije. Izpostavili bi cilj pospeševanja mobilnosti, ki se pojavi v vseh štirih strategijah. Na koncu raziskujemo, kako državi urejata oziroma rešujeta vprašanje jezika visokega šolstva. Ugotovili smo, da v obeh državah zakona, ki urejata področje visokega šolstva, izpostavljata skrb za materinščino. Ta naloga spada v okvir visokošolskih zavodov. Univerza v Amsterdamu ima – za razliko od Univerze v Ljubljani – oblikovano svojo jezikovno strategijo, v kateri je pojasnjeno, na kakšen način se izbere oziroma določi jezik poučevanja, s čimer je odločitev o jeziku poučevanja olajšana. Kot je pokazala primerjava različnih dokumentov s področja visokega šolstva in strategij, je današnja internacionalizacija v različnih državah pod vplivom tako sodobnih procesov, konkretneje bolonjskega procesa, kot tudi različnih zgodovinskih dejavnikov oziroma okoliščin. Enake politike internacionalizacije se torej v različnih okoljih implementirajo različno. S tem tudi potrjujemo ugotovitev de Wita in F. Hunter (2015, str. 2), da ni modela internacionalizacije, ki bi ustrezal vsem. ; Internationalisation of Higher Education in Slovenia and the Netherlands After the Implementation of the Bologna Process In this thesis, we discuss the different internationalisation policies of higher education in Slovenia and the Netherlands. Analysing and comparing the strategic documents about the internationalisation of higher education in the chosen countries is the basis of the following thesis. In the theoretical part, we put internationalisation in a historical perspective. We concisely describe the socioeconomic context of the development of Dutch universities and analyse the origins and development of Slovene and Dutch universities. Furthermore, we focus on the mission of universities and their related position of language in research and teaching. We also define internationalisation and present its different definitions. Additionally, we introduce the forms of internationalisation: internationalisation at home, internationalisation of the curriculum, and internationalisation abroad. In the context of the development of the Bologna Process, we present the emergence of the European Economic Community, the beginnings of the process itself, and a critique of its neo-liberal concept. Moreover, we also explore the transfer of educational policies. We conclude by presenting the language issues, i.e., the growing role of English in teaching and research in higher education, and the position of national languages. In the empirical part, we first identify similarities and differences between national policies on the internationalisation of higher education in Slovenia and the Netherlands. Then we examine the policies at the institutional level by comparing the University of Ljubljana and the University of Amsterdam. Analysis of national strategy documents shows that both Slovenian and Dutch higher education pursue similar internationalisation objectives. However, the first significant difference is the Dutch tendency to connect higher education institutions with the economy. Consequently, economic motives for internationalisation prevail. In contrast, the internationalisation of Slovenian higher education is driven primarily by political motives, as the country wants to consolidate a recognisable national higher education. Nonetheless, there is another important difference. The Dutch strategy documents emphasise the intention to make the country competitive and visible on a global level, while the Slovenian strategy documents focus on the need to establish a regional identity. The Netherlands is therefore moving towards a more global internationalisation, whereas Slovenia moves towards a regional one. At the same time, they both perceive internationalisation as the crucial factor in developing higher education. Particularly, in the context of increasing its quality. The two countries are similar in the way they see internationalisation – as the major factor in the development of their higher education and as means to enhance its quality. An analysis of the internationalisation policies of the two central universities in both countries shows that, due to its status as an international and bilingual university, internationalisation is a leading feature of the University of Amsterdam. On the contrary, the University of Ljubljana is somewhat limited in its internationalisation. Due to its strong international orientation, the University of Amsterdam holds its classes in a so-called "international classroom." Historically viewed, The Netherlands and its universities have been much more internationally opened. This has contributed to the Netherlands being one of the wealthiest countries in the world. The advantage of rich countries is not only having sufficient financial resources to implement optimal internationalisation, but also the "privilege" of setting trends in the area of internationalisation. We also look at the coherence between the strategic documents in each country and how the objectives of the Bologna Process are reflected in the objectives of the strategic documents. We have found out that there is a significantly higher congruence in the key objectives in the Dutch strategic document compared to the Slovenian ones. The reason for that could be the active involvement of Dutch universities in policymaking. The Bologna objectives are reflected in both national and both institutional internationalisation strategies. We aim to highlight the objective of promoting mobility, which appears in all four strategies. Lastly, we explore the way of how countries are addressing the issue of the language of higher education. We have discovered that the laws governing higher education emphasise care for the mother tongue in both countries. The University of Amsterdam has constructed a language strategy that explains how the instruction language is chosen and determined. By doing so, the decision for the instruction language is less complicated. At the moment, the University of Ljubljana still does not have the same approach. By comparing different higher education documents and strategies, we have shown that contemporary changes (specifically the Bologna Process) and various historical factors have influenced internationalisation today. The same internationalisation policies are therefore implemented differently in various contexts. This also confirms the observation made by de Wit and F. Hunter (2015, p. 2) that there is "no one model that fits all".
Abstract. The article aims to explore the public's fear of data being misused when using European Covid-19 contact-tracing applications. The point of departure lies in considering the research question of whether the Covid-19 pandemic has influenced the platformisation of traditional institutions, i.e., whether the design of Europe's proximity-tracing applications mimic the dataintensive web services of commercial platforms, namely commercial APIs and their data policies, in order to bypass the right to privacy. We accordingly argue that is vital to address the public's fears of governmental and corporate dataveillance as well as data misuse while using such apps. The investigation entails of a critical analysis of the Exposure Notification System framework designed by Apple and Google (or GAEN) and the #OstaniZdrav application. The article rejects the justification of the public's fear of governmental dataveillance, while recognising the possibility of corporate data misuse. The Slovenian constitution guarantees local self-government to all inhabitants and local self-government can be executed in municipalities and other local communities. Although municipalities are foundational units of local self-government, they experience some very basic problems since the re-establishment in the middle of 1990s; those problems are closely connected with inadequate exercise of subsidiarity and connection principles from in 1996 ratified European charter of local self-government. Slovenia has larger number of undersized municipalities that report problems with normative overload and their administrative incapacity. According to the findings of empirical study presented in the paper, the latter is often the case in municipalities smaller than 5000 inhabitants. The authors are also analysing inadequately defined scope of municipal jurisdiction; Slovenian municipalities are currently responsible for local affairs that affect only municipal inhabitants, and that narrow scope of jurisdiction is in many cases causing problems in managing the municipality, especially in cases of smaller municipalities.
