The debate over the question of the sustainability of development has been for some time underway in relation to the environment and to public health. More recently attention has turned to other aspects of sustainability as well, now that a generally accepted meaning of the term has been reached which defines it as the sum total of policies for satisfying the needs of the present generation without compromising the capacity of future generations to satisfy their own needs. Within this broader context the role of public administration is obvious. The purpose of this Ph.D. dissertation is to analyze the United States model of transparency in the public sector. The dissertation moves from the assumption that this model does not coincide with the Freedom of Information Act (FOIA), which is only a component – albeit prominent – of it. Government secrecy, which extends beyond the executive branch, constitutes a comprehensive limit to transparency. At the heart of the concept of government secrecy is the system of classification of national security information, which has implications for each of the three branches of the Federal Government, as the Author shows. Despite several connections with executive branch secrecy, which may be pinpointed at a theoretical level, the relation between transparency and secrecy features its own framework in the legislative and judicial branches. How this relation emerges in the executive branch, however, is the core of the issue, and its study requires distinguishing executive privilege from mandatory disclosure that federal agencies have to ensure under the FOIA. The former is mostly meant in the United States as the power of the President, implicitly recognized by the Constitution, to withhold information from Congress. The exercise of this power affects the carrying out of the congressional oversight function. As to the latter, the FOIA exemptions mold the level of agency disclosure, and the President and the Attorney General establish the extent of disclosure by issuing memoranda on implementation of the FOIA. The Author dwells on exemptions 1 and 5, as their scope embraces most of the issues addressed in the present dissertation. The federal legislation on agency open meetings, which provides for specific exemptions, complete the system of executive branch transparency. In the conclusions, the Author identifies some paradoxes in the United States model of transparency considered as a whole, which, however, turns out to be satisfactory.

Austerity policies embraced after 2009 in the European union have been very controversial both in political and academical debate. While its supporters claim that fiscal adjustment is necessary to restore the sustainability of public finances, critics argue that the negative effect of austerity on economic growth is so large that it may even be counterproductive. Indeed, the improvement of fiscal position and the debt to GDP ratio has been much slower and fiscal multipliers considerably larger than expected , suggesting that self-defeating austerity might be a realistic possibility. This work will examine various aspects that determine the effectiveness of fiscal policy in reducing the debt to GDP ratio, such as the initial level of debt, tax and expenditure levels, size and timing of consolidation, long run effect on economic growth. The focus will be on the sensitivity of debt to GDP projections to the underlying assumptions, to highlight the complex trade-offs of different policy options. This thesis is organized as follows: chapter 2 is devoted to the development of the general analytical framework used and its relations with previous works; in chapter 3 we will study the properties of the model through a simulation exercise under different parametrizations; in chapter 4 we will compare these results with the European countries in the period after the financial crisis. Some conclusive remarks (chapter 5) follow.

Conservazione e rigenerazione della fabbrica della città dipendono dagli orientamenti culturali che i cittadini hanno maturato a partire dai grandi ideali sociali di giustizia, libertà e partecipazione democratica; i termini sono altresì collegati alle scelte tra libero mercato ed "economia civile" quale prassi che dovrebbe mirare al benessere collettivo riservando al linguaggio etico uno spazio di rinnovato protagonismo. ; Naples as a centre of development and human relations must choose amongst the relational goods: friendship, cultural exchange, mobility, sports, green spaces etc. or goods which reflect "acquired positions": the size and quality of the houses, monetary wealth, automobiles etc. to go towards a model in modern society where the increase in income is in contrast with the increase in well-being. Conservation and regeneration of the fabric of the city depend on the cultural orientation which its citizens have attained coming from the great ideals of social justice, liberty and democratic participation; these terms are also related to the choice between free market and "civil economy" which should aim at the common well-being, reserving for ethics the place of a renewed protagonist role.

Il presente lavoro analizza il ruolo ricoperto dal legislatore e dalla pubblica amministrazione rispettivamente nel delineare e attuare politiche pubbliche volte alla promozione di modelli di sviluppo economico caratterizzati da un elevato tasso di sostenibilità ambientale. A tal fine, il lavoro è suddiviso in quattro capitoli. Nel primo capitolo vengono presi in considerazione i principali elementi della teoria generale che costituiscono i piani di lettura del tema trattato. Questa prima fase della ricerca è incentrata, da un lato, sull'analisi (storico-evolutiva) del concetto di ambiente alla luce della prevalente elaborazione giuridica e, dall'altro, sulla formazione del concetto di sviluppo sostenibile, con particolare riguardo alla sua declinazione in chiave ambientale. Nella parte centrale del lavoro, costituita dal secondo e dal terzo capitolo, l'analisi è rivolta a tre settori d'indagine determinanti per l'inquadramento sistematico delle politiche pubbliche del settore: il sistema di rapporti che esiste tra i molteplici soggetti (internazionali, nazionali e locali) coinvolti nella ricerca di soluzioni alla crisi sistemica ambientale; l'individuazione e la definizione dell'insieme dei principi sostanziali che governano il sistema di tutela ambientale e che indirizzano le scelte di policy nel settore; i principali strumenti (giuridici ed economici) di protezione attualmente in vigore. Il quarto ed ultimo capitolo prende in considerazione le politiche relative alle procedure di autorizzazione alla costruzione e all'esercizio degli impianti per la produzione di energia alimentati da fonti energetiche rinnovabili, analizzate quale caso specifico che può essere assunto a paradigma del ruolo ricoperto dal legislatore e dalla pubblica amministrazione nel settore delle politiche di sviluppo sostenibile. L'analisi condotta mostra un elevato tasso di complessità del sistema istituzionale e organizzativo, a cui si aggiungono evidenti limiti di efficienza per quanto riguarda il regime amministrativo delle autorizzazioni introdotto dal legislatore nazionale. ; This work analyzes the role of the legislator and of the public administration respectively in outlining and implementing public policies aimed at the promotion of economic development models distinguished by a high rate of environmental sustainability. For this purpose, the work is split into four chapters. The first chapter takes into consideration the main elements of the general theory making up the keys to understanding the topic being dealt with. This first research phase is centred, on the one hand, on the (historical-evolutionary) analysis of the environment concept in the light of prevalent legal interpretation and, on the other, on the formation of the concept of sustainable development, especially in an environmental perspective. In the central part of the work, consisting of the second and the third chapter, the analysis involves three areas of investigation of great importance for the systematic contextualization of public policies in the sector: the system of relations existing between the numerous entities (international, national and local) involved in finding solutions to the systemic environmental crisis; the identification and definition of the substantial principles regulating the environment protection system and directing policy choices in the sector; the main, currently applicable protection instruments (juridical and economic). The fourth and last chapter takes into consideration the policies relating to the authorization procedures for the building and running of energy production plants fuelled by renewable sources, analyzed as a specific case which can be taken as a paradigm of the role played by the legislator and the public administration in the sector of sustainable development policies. The analysis conducted shows a high rate of complexity of the institutional and organizational system, to which must be added evident limits of efficiency as regards the administrative system of authorizations introduced by the national legislator.

This paper aims to discuss the model of administration for public purposes from the point of view of the complex dynamic between public finance choices, administrative organization, and the protection of constitutionally guaranteed rights. Starting from the analysis of the constitutional foundations of the power of organization and financial sovereignty, after framing the function of financial constraints from the perspective of popular sovereignty, the objective of the article is to evaluate the implications of the public financial law on the protection of the fundamental rights of the person and, consequently, on the choices concerning the organization called to give protection PA PERSONA E AMMINISTRAZIONE Ricerche Giuridiche sull'Amministrazione e l'Economia 272 to them, according to a discursive-rational paradigm. Through the criticism of the thesis of financially conditioned rights, developed in the wake of the jurisprudential orientation that recognizes the existence of a minimum nucleus of social rights that have to be satisfy, and the recognition of the existence of different legal situations directly operating by the citizen in relation to the exercise of the power of organization, the author proposes a rereading of the political and administrative dynamics concerning the protection of the fundamental rights of the person, framing them within the framework of a legal-institutional dialectic based on criteria of economic rationality and the principle of loyal collaboration. Ritengo utile spiegare le motivazioni della intitolazione della mia contribuzione: "Le relazioni Chiesa-Mondo dal Concilio di Trento al Concilio Vaticano II". Una prima motivazione deriva dalla recente pubblicazione di un mio volume sull'evoluzione storico-giuridica delle relazioni fra la Chiesa e le Comunità politiche dal punto di vista della scienza giuspubblicistica. Una seconda motivazione, intimamente collegata alla prima, deriva dalla precisa consapevolezza, maturata in questi anni di ricerche sulle tematiche del Diritto pubblico ecclesiastico, che tale scienza giuridica ha un profondo valore culturale e che è doveroso, come storico del diritto, scavare a fondo per comprendere bene le radici di questa disciplina e la sua importanza nella società, non solo ecclesiastica, odierna. Nella odierna conferenza cercherò di evidenziare in che modo le relazioni Chiesa-Mondo si sono delineate nel periodo storico indicato nel titolo dell'intervento, accennando agli effetti che il Concilio Vaticano II ha provocato nelle suddette relazioni. ; I consider it is useful to explain the motivations of the title that I chose for my contribution: "The relations Church-World from the Council of Trent to the Second Vatican Council". The first motivation derives from the recent publication of a volume that I wrote about the historical and juridical development of the relations between the Church and the political Communities from the perspective of the public law science. The second motivation, which is strictly linked to the first one, derives from the precise awareness, that I reached during these years of researches about the themes of Public Ecclesiastical Law, that this juridical science has a deep cultural value; this value should be analysed in-depth, as an historian of Law, for a better understanding of the roots of this discipline and its importance in the current, and not only ecclesiastical, society. Il presente contributo indaga due aspetti problematici dell'Unione Europea che emergono durante le crisi. Il primo riguarda il rapporto tra Stato e mercato, soprattutto con riferimento alla presenza della sfera pubblica nel mercato; il secondo, invece, si riferisce al ruolo che gli Stati membri riservano all'Unione Europea durante le emergenze. A tal riguardo, si prenderanno in esame, quali focus tematici: la crisi del debito greco, l'emergenza climatica e la crisi del Coronavirus. ; This paper explores two problematic aspects of European Union, which have emerged in the last few crisis. The first concerns the relation between the State and the market, referring specifically to the public intervention in the economy; the second one is related to the role reserved for the European Union by the Member States during the emergencies. In order to analyse these two issues, we'll take into consideration the greek crisis, the climate emergency and the Coronavirus crisis.

La tesi si propone di esaminare il principio di distinzione tra politica ed amministrazione, riguardato dall'angolo visuale della disciplina della burocrazia e, in particolare della dirigenza. Sintetizzando i risultati della ricerca, il lavoro muove verso risultati in controtendenza rispetto al panorama dottrinario e giurisprudenziale attuale, generalmente attratto dal problema dell'imparzialità e della lotta verso la corruzione, argomenti che in genere sottendono un giudizio di matrice antidemocratica. L'idea di fondo è che la creazione di cesure nette tra politica ed amministrazione, tali da recidere gli eliminabili elementi di fiduciarietà delle nomine, non possa che comportare una rimessa in discussione dell'intero modello della distinzione, specie in riferimento alle scelte discrezionali a più alto tasso di politicità, in relazione alle quali appare tuttora imprescindibile, pur nella salvaguardia delle prerogative tecniche ed istruttorie dell'amministrazioni, la remissione della scelta in capo agli organi legittimati dall'investitura popolare. ; The thesis aims to examine the principle of distinction between politics and administration, regarded from the angle of the discipline of the bureaucracy, especially the leadership. Summarizing the results of research, the work moves results in contrast to the current doctrinal and jurisprudential views, generally attracted by the problem of impartiality and to fight corruption, topics that typically underlie a judgment of undemocratic matrix. The basic idea is that the creation of a clear break between politics and administration, such as to sever the eliminated elements of the trust- appointments, can only lead to a questioning of the entire model of the distinction, especially in reference to the discretionary choices highest rate of political nature, in relation to which still appears unavoidable, while recognizing the technical and investigative prerogatives of the administration, the remission of the choice that the managerial bodies legitimized popular investiture.
