Globalization is an economic, political and ideological form assumed by contemporary society as a whole. In this article, these three dimensions are analyzed in a critical way, weighing various judgments about the phenomenon, and seeking to evidence its religious and inhuman substratum. Finally, it seeks to indicate some alternative references for the construction of a more just society. ; La globalización es una forma económica, política e ideológica que asume la sociedad contemporánea en conjunto. Aquí se analizan estas tres dimensiones de manera crítica, sopesando diversos juicios en torno del fenómeno y buscando evidenciar su sustrato religioso e inhumano. A hot sociopolitical issue today is the extent to which religions should be publicly represented. This text discusses the «state of the question» critically focusing on the main and common argument used by all the experts: liberty of conscience understood as freedom of choice. We are not allowed to identify both kinds of freedom without erasing the necessary division between religion and politics. Nevertheless, the elimination of this division not only occurs in practice but also in the theoretical outlines of the advocates of secularism based on freedom of choice. As the whole question concerns the «monotheism of reason», the philosophical discourse should not be a simple mediator between the different parts. ; Un problema sociopolítico candente es el grado de representatividad pública que merezcan las religiones. The Osmanoğlu et Kocabaş v. Switzerland case, decided by the European Court of Human Rights in 2017, is the main focus of this article, which uses that case to study in depth the interpretation and application of the right to freedom of religion under Article 9 of the European Convention on Human Rights and its possible conflict with other norms (right to education) and values in democratic societies. ; L'affaire Osmanoğlu et Kocabaş c. It is quite likely that the origins of prayer are to be found in ancient mourning and bereavement rites. Primeval ritual prayer was codified and handed down socially to become a deep-rooted feature of people's cultural behavior, so much so, that it may surface again several years later, in the face of death, danger, need, even in the case of relapse from faith and religious practice. Modes of prayer depend on religious experience, on relations between personal prayer and political action, between prayer and forgiveness, and between prayer and approaches to religions. Various forms of prayer exist, from the covert-hidden to the overt-manifest kind. How can they be investigated? How can one, for instance, explore mental prayer? These issues regard the canon of diffused religion and, therefore, of diffused prayer.

'Religion' still occupies and maintains a position of formal and informal privilege in many current societies. It retains these privileges despite the increasing numbers of people who label themselves 'non-religious'. There is also evidence that overtly non-religious people are being persecuted due to the continuation of these privileges. This paper will examine such treatment of the non-religious in the context of human rights instruments and laws. It lays out the international law case for the rights of the non-religious. It also discusses the extent to which state actors have or have not ignored human rights standards in their persecution or deprivileging of non-religious people. This paper will proceed through a three-step analysis. Step 1 is to examine the aspirational Universal Declaration of Human Rights (UDHR) in relation to the non-religious. The relevant sections of the UDHR and interpretations that they have received will be discussed. Step 2 is to do the same with the binding International Covenant on Civil and Political Rights (ICCPR). Finally, Step 3 is to give examples of lower-level and local laws, where I shall examine the extent to which individual countries' laws and practices toward non-religious people support or contradict the treaty commitments that those countries have made. The continuation in coercion/persecution cases suggests that something is amiss with human rights protections being provided to the non-religious. If we are to create social structures that are more inclusive of the non-religious and to advocate for non-religious rights, it is necessary to examine the societal power and privilege still held by 'religion'. It is hoped that this article can inform and encourage further similar engagements among sociologists, religious studies scholars, activists and lay-people interested in the treatment of non-religious peoples.
Der von Manfred Brocker und Mathias Hildebrandt herausgegebene Band stellt die Frage nach dem friedensstiftenden Potential von Religion. Dieses wurde angesichts der von Samuel Huntington entfachten Diskussion vom religionsimprägnierten "Kampf der Kulturen" und insbesondere nach dem 11. September 2001 kaum noch wahrgenommen. Mit der vorliegenden Publikation, hervorgegangen aus der bereits 2004 zum Thema durchgeführten Jahrestagung des Arbeitskreises 'Politik und Religion' der Deutschen Vereinigung für Politische Wissenschaft, setzten die Herausgeber bei diesem Manko an. Die interdisziplinär angelegten Beiträge des Bandes analysieren das Befriedungspotential religiöser Akteure aus theologischer, historischer, philosophischer und politikwissenschaftlicher Perspektive und lösen das Ziel des Bandes, durch eine erste Bestandsaufnahme zum Thema zu weiteren Studien anzuregen, konstruktiv ein. Im Kern besteht die Beantwortung der titelgebenden Ausgangsfrage aus einem "Ja, wenn", wobei diese vermeintlich simple Schlussfolgerung in ihrer Komplexität entfaltet wird und neben erforderlichen Bedingungen gute Gründe und Möglichkeiten aufgezeigt werden, warum es notwendig und gewinnbringend ist, Religion mit wohlwollender Offenheit zu begegnen.

Eine Gesamtinterpretation ist dabei nicht allein deshalb angestrebt, weil die Rede bisher nicht allzu häufig behandelt wurde. Wie an kaum einer anderen Quelle läßt sich an ihr exemplarisch verdeutlichen, wie stark die politische Öffentlichkeit sich auch sakral definierte, in welchem organisatorischen Rahmen dies Ausdruck fand und wie im konkreten parteipolitischen Streitfall Nutzen daraus gezogen werden konnte. In seiner weitgehend politisch geprägten Argumentation angesichts einer zu nächst rein sakralrechtlichen Thematik gewährt Cicero darüber hinaus Ein blicke in den regulativen Umgang mit Tendenzen, die für die res publica über den vorliegenden Einzelfall hinaus problematisch erschienen. Um die auf diversen Ebenen bestehenden Zusammengehörigkeiten besser verdeutlichen zu können, erwies es sich gelegentlich als notwendig, entgegen den Vorgaben der Quelle Erscheinungen des politischen und des sakralen Bereichs zu unterscheiden und zunächst voneinander getrennt aufzuzeigen, wenn dies auch die Darstellung erschwert hat. Freedom of religion and belief is one of the strongest rights contained in the International Covenant on Civil and Political Rights (ICCPR), but simultaneously one of the most elusive. Article 18 of the ICCPR protects "theistic, non-theistic and atheistic beliefs, as well as the right not to profess any religion or belief." And yet jurisprudence is yet to fully explore the capacity of this right to stand up to the challenge of meaningfully protecting freedom of religion and belief across the spectrum of worldviews. At the outset of this thesis, a brief history of religious persecution is offered as a backdrop to the emergence of the human right to freedom of religion and belief, before that human right in its present form is unpacked. The compatibility and incompatibility of freedom of religion and belief and other human rights is explored, with reference to some religious approaches to understanding rights. Pluralism is ultimately identified as a key value in balancing conflicts that may arise between different approaches. The human rights obligations of non-state religious actors are then discussed, before asserting that there is a hierarchy of religion and belief in the practice of international human rights law. Despite the fact that article 18 provides for the equal protection of those who believe in one God, those who believe in many gods and those who believe in no god, monotheists are asserted to occupy the highest rung of the hierarchy, with new religions that have not yet become entrenched in history and atheists below them. This assertion is further explored through case study chapters. A case study on proselytism determines the point at which proselytism, as a manifestation of a person's religion or beliefs, becomes coercion of another person that should be limited. In the following case study chapter on hate speech, it is found that persons who are hated for their religion are more likely to be protected than those who are hated by the religious. The beliefs and traits of parties concerned are thus found to have more bearing on legal decisions than whether or not the hate speech at issue incites violence. The third and final case study chapter considers the conflict between a child's right to enjoy religious freedom with the right of her parent to impose a religion or belief upon her. By exploring this tension through analysis of education and the religious circumcision of infants, it is asserted that international human rights law protects parents' religious rights vis-à-vis their child, above the child's own rights and freedoms. It is then considered whether the hierarchy of religion and belief is justified. From a rights-based perspective premised on the value of individual freedoms above ideology, the conclusion reached is that such a hierarchy is indefensible and may serve to entrench the vulnerability of people on the basis of their religion or belief. In order to level the hierarchy at play, freedom from religion is ultimately offered as the measure of freedom of religion and belief. Freedom of religion and belief is only meaningful when an individual is free to choose, change, maintain or reject any religion or belief or even profess atheism, and when the rights of people around him are protected from harmful manifestations of his choice.
