In recent times, international practice has provided new cases of decolonization, but also of mutually agreed secession with a due independence referendum, as well as violent ruptures. Although the unilateral secessions are not well received by the international community, they are not only possible, but have been favored by the Advisory Opinion on Kosovo. The present paper analyzes the new cases arising from international practice in order to explore the contours of the so-called "Modern Self-Determination". ; En tiempos recientes, la práctica internacional viene brindando nuevos casos de descolonización, pero también de secesiones pactadas, con el debido referéndum independentista de por medio, así como de rupturas violentas. Si bien las secesiones unilaterales no son bien vistas por la comunidad internacional, éstas no solo son posibles, sino que se han visto favorecidas con la Opinión Consultiva sobre Kosovo. El presente estudio analiza los nuevos supuestos surgidos de la práctica internacional a efectos de explorar los contornos de la denominada "Autodeterminación Moderna".
The referendum of October 1st, 2017 on self-determination in Catalonia was called by the Catalan government, but it was possible thanks to the popular organization. A judicial ban and the police violence and brutality were the State's response to the call. This political repression would be followed by the opening of several legal cases, the most important of them is known as the "trial of the process", which would end with accusations of very serious crimes, with imprisonment and with political exile on the part of the Catalan government and social leaders. In this article we analyze the "frames of reference" and the "repertoires of action" of the collective action of the voters of October 1st. We use these same constructs to analyze the political and judicial responseof the Spanish State. This analysis allows us to discover that the political conflict around the events of October 1st, is the expression of a transitional confrontational divide between a social bloc that defends conservative, authoritarian and ultra-nationalist values with another social bloc that wants to expand the democratizing limits and, therefore, rights and freedoms. We also note that the political repression of the State has functioned as a factor that increases meanings and imaginations linked to the need to broaden and deepen democracy, at the same time, it has shown that the principles of authority and Spain's indissoluble unity are deeply rooted. ; El referéndum del 1 de octubre de 2017 sobre la autodeterminación en Catalunya fue convocado por el gobierno catalán, pero la jornada fue posible gracias a la organización popular. Una prohibición judicial y la violencia y la brutalidad policial fueron la respuesta del Estado a la convocatoria. A esta represión política, le seguirían la apertura de varias causas judiciales, la más importante de ellas la que se ha conocido como "juicio del proceso", que acabarían con acusaciones de delitos muy graves, con encarcelamientos y con el exilio político de par-te del gobierno catalán y de líderes sociales. En este artículo analizamos los "marcos de referencia" y los "repertorios de acción" de la acción colectiva de los votantes del 1 de octubre, y usamos esos mismos constructos para analizar la respuesta política y judicial del Estado español. Este análisis nos permite descubrir que el conflicto político alrededor de los hechos del 1 de octubre, es la expresión de una divisoria de confrontación transicional entre un bloque social que defiende unos valores conservadores, autoritarios y ultranacionalistas con otro bloque social que quiere ampliar los límites democratizadores y, por lo tanto, derechos y libertades. Constatamos, además, que la represión política del Estado ha funcionado como un factor acrecentador de unos significados e imaginarios ligados a la necesidad de ampliar y profundizar en la democracia, a la vez, que ha puesto de manifiesto que los principios de autoridad y de la indisoluble unidad de España están muy arraigados.
El artículo está dedicado al desarrollo de la ley para la autodeterminación, la base jurídica internacional y nacional de su establecimiento. Se investiga la interacción con la ley de autodeterminación con otros principios del derecho internacional. Los criterios de implementación de esta ley son diferenciados. Se concluye que la autodeterminación como derecho tiene una base en el derecho internacional,y se aplica a las naciones que viven bajo dependencia colonial; la autodeterminación para las minorías está relacionada con el tipo de régimen político y el derecho de autodeterminación tiene un carácter colectivo, contenido legal que garantiza los derechos individuales. ; The article is dedicated to the development of the law for self-determination, and the international and national legal basis of its establishment. The interaction with the law of selfdetermination with other principles of international law is investigated. The criteria for implementing this law are differentiated. It is concluded that self-determination as a right has a basis in international law, and applies to nations that live under colonial dependence; Selfdetermination for minorities is related to the type of political regime and the right to selfdetermination has a collective character, legal content that guarantees individual rights.
El verdadero significado y alcance de las leyes es desconocido para la mayoría de la población, como evidencian diversos estudios sobre cultura jurídica en el mundo. Por ello, cuando se difunde información falsa o inexacta sobre cuestiones legales, el impacto en la opinión pública puede ser enorme. Este estudio evidencia que esto ha sucedido, en el llamado conflicto catalán, con el derecho de autodeterminación. Así, mientras los expertos en derecho niegan que Cataluña pueda invocar el "derecho de libre determinación de los pueblos" para obtener su independencia, asociaciones civiles, medios de comunicación y, sobre todo, responsables políticos, aseguran lo contrario, o bien realizan afirmaciones inexactas que, queriendo negar este derecho, aumentan la confusión popular. Como resultado, el discurso polarizado actual en torno a la autodeterminación de Cataluña se construye, al menos en parte, sobre el conocimiento jurídico erróneo de tres cuartas partes de los ciudadanos. ; The true meaning and scope of laws is unknown to most of the population, as evidenced by various studies on legal culture around the world. Therefore, whenever false or inaccurate information about legal issues is disseminated, the impact on public opinion can be enormous. This study shows that this has happened, in the so-called Catalan conflict, with respect to the right to self-determination. Thus, while legal experts deny that Catalonia is entitled to invoke the "right to self-determination of peoples" to obtain its independence, some civil associations, the media and, above all, political leaders, claim the opposite or make inaccurate statements which, in an attempt to deny this right, increase popular confusion. Esta contribución glosa el texto de Josep Maria Vilajosana, Democracia y derecho a decidir, entablando un diálogo crítico con el mismo y proponiendo reflexiones en torno al derecho a decidir y la autodeterminación en los conflictos territoriales de soberanía –como los existentes en Cataluña y en Euskadi respecto de España– hacia una concepción pluralista de demoi. Propone recuperar el derecho a la autodeterminación, la afirmación propia de una comunidad política a quien le viene sistemáticamente negada la libertad de definir su status por vérsele negada y vetada, ab initio y ad eternum, su condición de pueblo (demos). La justificación profunda de la autodeterminación reside precisamente en la democracia –derecho a decidir– y en la relación entre soberanía popular, derecho y democracia. ; This contribution engages a conversation with Josep Maria Vilajosana's reference text on democracy and the right to decide, and makes some theoretical proposals favoring the right to self-determination in the peaceful solution of territorial sovereignty conflicts, such as can be found in Spain regrading Catalonia and the Basque Country. It advocates a constitutional pluralist concept of demoicracy and recovers the centrality of self-determination of peoples as the self-assertion of a political community that has been systematically denied the freedom to decide on its own status and its self-definition as a people, a demos. The deep justification of self-determination lies in democracy and the right to decide and in the close links between popular sovereignty, democracy and law (justice).

The purpose of this paper is to develop the contradictions of the international standard of the right to indigenous consultation expressed in the confrontation between two paradigms: a decolonial one of self-determination, and that of a human right to participate within the democratic framework of a State. Discussions of the reliable history - from the mid-19th century - of the discussion of the main instruments of international law referring to indigenous peoples as subjects of international law, and in particular the right to indigenous consultation, are examined. This is complemented by specialized doctrinarian literature and official interpretation agencies. We conclude that there is a paradoxical coexistence to the extent that, even though the participation paradigm has been prioritized in abstract and formally, the weak consolidation of the right to consultation, added to certain particularities, brings with it the increase in the legitimacy of self-determination. ; El presente trabajo tiene por objeto desarrollar las contradicciones del estándar internacional del derecho a la consulta indígena expresadas en la confrontación entre dos paradigmas: uno decolonial de libre determinación, y la de un derecho humano a la participación dentro del marco democrático de un Estado. Se examinan los debates de la historia fidedigna -desde mediados del siglo XIX- de la elaboración de los principales instrumentos de derecho internacional referentes a los pueblos originarios como sujetos de derecho internacional, y en particular del derecho a la consulta indígena. Se complementa aquello con la literatura de doctrina especializada y organismos de interpretación oficial. Concluimos que existe una coexistencia paradójica en la medida que, aun habiéndose priorizado en abstracto y formalmente el paradigma de participación, la consolidación débil del derecho a consulta, sumado a ciertas particularidades, trae aparejado el incremento de la legitimidad de la autodeterminación.

Kurdistan, people not recognized as a State, settled mainly in four states of the Middle East, almost more than 90 years after the Treaty of Sevres was recognized as an independent State; This treaty was never ratified and began a turning point following the conclusion of the Treaty of Lausanne in 1923, in which, Kurdistan is hindered from obtaining its independence mainly due to the centralization of the Turkish state and nationalist groups against the Kurdish autonomy; After a series of revolts since 1930, the nationalist and identity sentiments of the Kurdish people, divided between four nations: Iraq, Iran, Syria and Turkey, intensify in which, in addition, a large part of the reserves of crude oil worldwide is identified. In this way, they are so called as an ethnic minority, more than 30 million people violating their right to self-determination, a principle recognized within the framework of the United Nations. in the present investigation some difficulties arise for its recognition as a possible Kurdish confederation from the reality in which they currently live. Reality that must be concordant based on respect for the political, cultural, religious and even territorial ideals of each of the countries in which they are settled. The 21st century has been greatly advanced and still many people around the world are still being repressed in the search for their autonomy. ; El Kurdistán es un pueblo no reconocido como Estado, asentado principalmente en cuatro Estados de Oriente Medio en la región al este de Anatolias, la cordillera del Zagros. A casi más de 90 años de la celebración del Tratado de Sévres, donde se reconocía como Estado independiente, dicho Tratado nunca fue ratificado e inicia un punto de inflexión a raíz de la celebración del Tratado de Lausana en 1923, en el cual, Kurdistán queda dificultado de obtener su independencia debido principalmente a la centralización del Estado turco y a los grupos nacionalistas en contra de la autonomía kurda. Luego de una serie de revueltas, desde 1930 se intensifican los sentimientos nacionalistas e identitarios del pueblo kurdo, dividido entre cuatro naciones Irak, Irán, Siria y Turquía, y en las cuales se localizan, además, gran parte de las reservas de petróleo crudo a nivel mundial. De esta manera, más de 30 millones de personas, son llamados como minoría étnica, violentando su derecho a la autodeterminación, principio reconocido en el marco de las Naciones Unidas. En la presente investigación, se plantean algunas dificultades para su reconocimiento como una posible confederación kurda desde la realidad en la que ellos viven actualmente. Realidad que debe ser concordante sobre la base del respeto de los ideales políticos, culturales, religiosos e incluso territoriales de cada uno de los países en los que se encuentran asentados. Avanzado en gran medida el siglo XXI, aún muchos pueblos alrededor del mundo siguen siendo reprimidos en la búsqueda de su autonomía.
El derecho de autodeterminación de género tiene importantes implicaciones en el desarrollo del derecho a la educación y muy concretamente en el ámbito universitario. El estudio analiza, en primer lugar, las dificultades que afronta el reconocimiento del derecho de autodeterminación de género y el impulso que la legislación autonómica ha supuesto para superar el inicial enfoque antidiscriminatorio, en favor de un concepto jurídico-constitucional de identidad desarrollada con plena libertad. Después se analiza cuál es la posición de las Universidades y qué mecanismos tienen para garantizar la tutela integral de la identidad de género, con especial atención a las Universidades de la Comunitat Valenciana. ; The right to gender self-determination has important implications in the development of the right to education and very specifically in the university sphere. This contribution tries to examine the notion of self-determination and its relation with the People of Western Sahara in the frame of the International Law. Considering the historical developments that lead to the proclamation of the «self-determination» in the Charter of the United Nations (I), this text studies the legal nature of the self-determination and the legal consequences of its recognition as «principle» and as «right» (II). The next chapter addresses the issue of the holders of the right of self-determination (III). Then, it tries to identify the content of the right to self-determination in the political as well as in the economic level (IV) and afterwards it considers the limits and the legal remedies to the self-determination (V). Once established the legal regime of the right to self-determination (II-V), this contribution examines how this general norms have been applied to the People of Western Sahara. ; El presente artículo intenta examinar la noción de autodeterminación y su relación con el pueblo saharaui en el marco del Derecho Internacional. Considerando los antecedentes históricos que han llevado a la proclamación de la «autodeterminación» en la Carta de las Naciones Unidas (I), en este texto se estudia la naturaleza jurídica de la autodeterminación y las consecuencias jurídicas de su reconocimiento como «principio» y como «derecho» (II). En el siguiente capítulo se trata de la cuestión de los titulares del derecho a la autodeterminación (III) Después, se intenta identificar el contenido del derecho a la autodeterminación, tanto en el nivel político como en el económico (IV), tras lo cual se consideran los límites y las garantías de la autodeterminación (V). Una vez establecido el régimen jurídico del derecho a la auto-determinación (II-V), en este artículo se examina cómo esas normas generales han sido aplicadas al pueblo del Sahara Occidental.
The financial crisis of 2008 amended the sustained relationships between the political system, the legal system and the financial system globally. Given the inability of the regulatory structures of the concerned countries to safeguard the stability of its markets, the political solution has focused in increased state involvement on legal bodies to supervise financial processes, causing a new turn in the dispute over sustained control of financial regulation between the political system and the financial system. This article explores the origins and the potential effects of this emerging dynamics, identifying the main structural links arranged by the State to correct the functional defects of the global financial system, as well as the roots of dedifferentiation derived regulatory capture in which incurred historically the financial system. To describe this emerging dynamics from a sociological perspective, was conjugated the optic that provides analytical systems theory with own theoretical arsenal of financial regulation, including recent empirical research in this field. Finally, this article highlight the functional advantages of this intersystemic struggle, introducing a reflection that rescues its benefits to the social system in the long term. ; La crisis financiera del 2008 modificó las relaciones sostenidas entre el sistema político, la esfera jurídica y el dominio financiero a escala global. Ante la incapacidad de las estructuras regulatorias de los países afectados por salvaguardar la estabilidad de sus mercados, la solución política ha estribado en un incremento de la participación estatal sobre los órganos jurídicos encargados de supervigilar los procesos financieros, provocando un nuevo giro en la disputa por el control de la regulación financiera sostenida entre el sistema político y el sistema financiero. The idea of popular sovereignty in the formation of the Venezuelan state as a modern state has been linked to contradictions that made sense to it at each stage of the country's political formation. This work raised the re-signification of popular sovereignty as a whole to enunciate the state of justice without exclusions on the basis of the conceptual peers people-civil society, power-government, sovereignty-self-determination. By meeting the Venezuelan state of the nineteenth, twentieth and twenty-first centuries to give birth to the understanding of the meaning of bourgeois-liberal popular sovereignty, as well as its revealing through the constitutional statement on the horizon of leading democracy, to undress the deepest and most persistent factors associated with social self-determination ; La idea de soberanía popular en la formación del Estado venezolano como Estado moderno, ha estado vinculada a contradicciones que le dieron sentido en cada una de las etapas de la formación política del país. El presente trabajo planteó la re-significación de la soberanía popular como totalidad para enunciar al Estado de justicia sin exclusiones a partir los pares conceptuales pueblo-sociedad civil, poder-gobierno, soberanía-autodeterminación. Mediante el conocer al Estado venezolano de los siglos XIX, XX y XXI a parir de la comprensión del significado de la soberanía popular burguesa-liberal, así como su revelar a través del enunciado constitucional en el horizonte de la democracia protagónica, para desvestir los factores más profundos y persistentes asociados a la autodeterminación social.
The general objective of the research is to develop an analysis of abortion derived from these extremes, from a legal, social and cultural point of view. The methodology used is documentary type. In conclusion, the practice of abortion is penalized, not only for women but also for those people or professionals who are involved in this act, which leads to determine that Ecuador respects the right to life of people, from their gestation; Through what is stated in the Magna Carta, such as the COIP, where abortion is not punishable if and only if the life of the pregnant woman is in danger of death or if she suffers some mental disability; In contrast, the rights to reproductive health and the right to responsible sexuality are limited; In this sense, the importance of self-determination and empowerment of women has been manifested within all social, economic, political and cultural spaces, without taking into consideration any reform that changes the perception of the criminalization of abortion, with the prevailing culture conservative within the competent bodies. ; El objetivo general de la investigación es desarrollar un análisis sobre el aborto derivado por estos extremos, desde un punto de vista legal, social y cultural. La metodología utilizada es de tipo documental. Como conclusión, la práctica del aborto es penalizado, no solo para las mujeres sino también para aquellas personas o profesionales que están involucradas en este acto, lo cual conlleva a determinar que Ecuador respeta el derecho a la vida de las personas, desde su gestación; a través de lo que manifiesta la carta magna, como el COIP, donde el aborto no es punible si y solo si la vida de la mujer embarazada corre peligro de muerte o si la misma sufre alguna discapacidad mental; en cambio, los derechos a la salud reproductiva y el derecho a la sexualidad responsable son limitados; en este sentido, se ha manifestado la importancia de la autodeterminación y el empoderamiento de la mujer dentro de todos los espacios sociales, económicos, políticos y culturales, sin tomar en consideración alguna reforma que cambia la percepción de la penalización del aborto, prevaleciendo la cultura conservadora dentro de los organismos competentes
