Im Zuge der Josephinischen Reformen kam es im gesamten habsburgischen Herrschaftsbereich zur Umgestaltung kirchlichen Eigentums. Entsprechend wurde bereits 1783 ein dezidiert der Bukowina zugeordneter griechisch-orientalischer Religionsfonds eingerichtet. Über seine wachsende wirtschaftliche und politische Bedeutung entwickelte sich diese Institution bis zu ihrer Auflösung 1949 zu einem die Region maßgeblich prägenden Faktor. ; A comprehensive secularisation process in the course of the Josephinian reforms led to a complete restructuring of church assets. As early as 1783 a Greek-Oriental Religious Fund attributed to the Bukovina was established. Its growing economic and political role made this institution a major factor in the development of the region. It kept this important position until its eventual dissolution in the course of socialist restructuring of Romania in 1949.
The article substantiates the reasons of the split in the Ukrainian communist movement in Canada in the mid-1930s at the peak of its popularity. They consisted of acquainting of its supporters with information about dekulakization, the Holodomor of 1932–1933, the Bolshevik repressions on the territory of the Ukrainian Socialist Soviet Republic, and so on. It clearly describes how this conflict took place in the Ukrainian labour-farmer temple association, which united Ukrainian communists, how it was perceived by its members, what consequences it led to and how it affected on spreading of communist views among Ukrainians in Canada. The society was divided into those who unquestioningly believed or knew the truth and equally supported Stalin's policy in Ukraine and those who condemned it and saw a different way of further life in the workers 'and peasants' state. It shows how the communist movement developed in the 1930s, how the so-called socialist segment stood out from it, who its supporters were and what ideas they professed. It is worth noting that for some time the "opportunists", that formed Federation of Ukrainian Labour-Farmer Organizations, could not decide on their socio-political position and hesitated on whose side to stand and whether to join the Ukrainian national-patriotic bloc of organizations or to function separately, despite the small number. The leading members of the newly created organization were D. Lobay, T. Kobzey, S. Khvaliboga, Y. Elendyuk, and M. Zmiyovsky. In August 1928, M. Mandryka arrived to Canada, delegated by the Ukrainian Party of Socialist Revolutionaries in Prague to seek financial support for Ukrainian socialist institutions in Czechoslovakia. It was to be a short-term mission, that transformed into a permanent staying overseas. M. Mandryka managed to unite Ukrainian socialists who had nothing to do with the ULFTA. The research also describes the directions of activity of Ukrainian socialists in Canada, their ties with other public organizations, political parties and future relations with former like-minded people. An attempt is made to evaluate the socialist movement and establish its significance for the social and political life of the diaspora.

Определены основные направления функциональных преобразований, имеющих место на территории микрорайона, ключевые агенты, которые инициируют изменения прилегающего городского пространства, и общественно-пространственные процессы, которые меняют культурный ландшафт жилого микрорайона в постсоциалистическом городе. ; Problem Statement and Purpose. The question of post-socialist city transformation takes a prominent place in modern scientific discourse. In Ukraine, functional transformations of urban areas were investigated mainly in the inner parts of cities. Therefore, the aim of this paper was to determine key trends and peculiarities of the spatial transformations within the residential district of Ukrainian post-socialist city.Data & Methods. As a test area site for the research was chosen Vyshenka, the largest residential area of the Vinnytsa,. All objects, located within the test area, were evaluated during the field trip in terms of their functional profile and condition (level of renewal or modernization). Obtained data were analyzed using spatial interpolation and overlay operations.Results. Analysis of the data revealed that the functional profile of the test area and condition of the objects located within have undergone substantial changes during the analyzed period. Three types of spatial transformations were identified: renewal, modernization, and functional change. The primary agents of spatial transformations include public transport, large-scale trade facilities, sacral places, dormitories, periphery of industrial areas, areas of new housing construction, higher and professional educational institutions. The secondary agents include secondary educational institutions, open spaces, and industrial areas. We identified integrated socio-spatial processes such as polarization, commercialization, de-industrialization, revitalization, as well as some manifestations of segregation and gentrification. The results indicate similarity to the trends taking place in other post-socialist Ukrainian cities; specificity of the case is caused by peculiarities of the interaction between the key transformation actors, namely citizens, local government, and business.

The emphasis is placed on the fact that the model of Spanish transition to democracy is considered to be paradigmatic, and it has been tried and tested in a number of countries. The political, socio-economic, legal and regional prerequisites of the peaceful dismantlement of francoism have been studied. A particular focus has been put on the development of the personality of the Spanish monarch, Juan Carlos I, as a liberal, driving force and guarantor of democratic reforms, on h3is ability to select and keep within his orbit politicians and intellectuals, advocates for democratic change, and communicate with different sectors of the Spanish politics; on his political instinct, determination, consistency, responsibility and courage. The use of extensive factual material from the most recent Spanish sources justified the conclusion that the institution of monarchy restored in Spain in 1976 proved to be crucial for reconciliation of differently vectored political groups and parties, including communists and socialists. This was accomplished through negotiations and the signing of the pact of national unity (the Moncloa Pacts). The king acted as the initiator and guarantor of irreversible, peaceful and legal transition of Spain to democracy. The article highlights the decisive and exceptional role of Juan Carlos I in keeping down the military coup attempted with a view to eliminating democratic changes and returning the country to authoritarian rule, which occurred in February 1981. It led to the appearance and and spreading of the so-called Juancarlism (i.e. respect and admiration for the figure of the Spanish monarch) in the Spanish society. The article traces the evolution of the institution of monarchy in Spain: from absolute and authoritarian to constitutional, parliamentary and democratic. It emphasizes the progressive role of monarchical system in the current context. ; У статті йдеться про роль, місце та значення інституту монархії в особі короля Хуана Карлоса І у переході іспанського суспільства від майже 40-річної авторитарної диктатури Ф.Франко до повноцінної конституційної демократичної монархії. Abstract. Attention is paid to the important role of an effective system of institutions to ensure the economic development of Ukraine. It is noted that the formation of this system should be given the attention of scientists, as well as government agencies. The content of economic transformation of postsocialist countries, in particular Ukraine, is studied. The study was conducted using the methodology of comparing the capitalist and socialist systems, as well as the historical approach. The content of categories «property» and «transformation» is considered, as well as the influence of property institutions on the dynamics of transformation processes that took place in postsocialist countries. The interrelation and interdependence between the influence of institutions and the dynamics of the process of postsocialist transformation are determined. Results of the study showed a low level of development of formal institutions in Ukraine, while informal institutions act as a natural brake on further economic development. It is emphasized that the influence of institutions on the dynamics of postsocialist transformation processes is essential and crucial in Ukraine. Based on the institution of ownership, the effects of ownership are considered. Western countries are able to generate capital and maximize the benefits of using property due to their full use. Unlike Western countries, in Ukraine property is considered on the basis of the object, and not through a system of rights that can be used by the owner. The nature of legal and illegal property relations, as well as the preconditions for the transformation of property institutions, are considered in detail. The influence of formal and informal institutions on the dynamics of postsocialist transformation processes in Ukraine is determined. The emergence of intangible property by example of intellectual property, as well as the importance of compliance and implementation of property rights by the legislative system are considered. Conclusions are made about the current situation of the socio-economic system of Ukraine in the context of the transformation of formal and informal institutions. Проведено дослідження з використанням методики порівняння капіталістичної та соціалістичної систем, а також історичного підходу. Розглянуто зміст категорій «власність» і «трансформація», а також вплив інститутів власності на динаміку трансформаційних процесів, що відбувалися в постсоціалістичних країнах. Визначено взаємозв'язок і взаємозалежність між впливом інститутів і динамікою процесу постсоціалістичної трансформації. Результати дослідження засвідчили невисокий рівень розвитку формальних інститутів в Україні, тоді як неформальні інститути виступають природним гальмом для подальшого економічного розвитку. Наголошено, що вплив інститутів на динаміку процесів постсоціалістичної трансформації має істотне значення і вирішальну роль в Україні. На основі інституту власності розглянуто ефекти власності. Завдяки їхньому повноцінному використанню західні країни здатні генерувати капітал і максимізувати вигоди від використання об'єктів власності. На відміну від західних країн, в Україні власність розглядається виходячи з об'єкта, а не через систему прав, якими може користуватися власник. Детально розглянуто природу легальних та нелегальних відносин власності, а також передумов, що зумовлюють трансформацію інститутів власності. Визначено вплив формальних і неформальних інститутів на динаміку процесів постсоціалістичної трансформації в Україні. Розглянуто появу нематеріальних об'єктів власності на прикладі інтелектуальної власності, а також важливість дотримання та реалізації прав власності законодавчою системою. Зроблено висновки щодо поточного становища соціально-економічної системи України в контексті трансформації формальних і неформальних інститутів. The article covers development aspects of the institution of judicial defence of human rights at labour. The analysis of the labour rights defence condition in Soviet Ukraine from adopting the Constitution of the Ukrainian Soviet Socialist Republic of 1937 and throughout the Second World War is carried out. In the late 30s of the XX century Ukraine started losing its sovereignty and independence which was a natural consequence of the conducted change in republic constitutional and legal status. This follows from the content of constitutional regulations of various years. Thus, if amendments to the Constitution of the Ukrainian Socialist Soviet Republic adopted in 1925 are taken into account, it was enshrined that the Ukrainian Socialist Soviet Republic was the part of the Union of Soviet Socialist Republics as "an independent republic", thereafter, in the Constitution of the Ukrainian Soviet Socialist Republic of 1929 it was registered as "an independent contracting state", and there was no union state creation was mentioned. Nevertheless, in the Constitution of 1937 (the name of the Ukrainian Socialist Soviet Republic was changed to the Ukrainian Soviet Socialist Republic (UkrSSR) at the XIV Emergency Congress of Soviets in January 1937), these regulations are absent. There is only one record about joining the republics into one union state. Instead of the Congresses of Soviets, Central Election Commission of the UkrSSR and their Executive Committees, the Constitution of the UkrSSR of 1937 determined the Supreme Soviet of the UkrSSR as the republic highest body of state power. The Supreme Soviet of the USSR elected the Executive Committee – a collegial permanent power agency in the periods between the sessions of the Supreme Soviet. Incrementally, the governance of all-union governing bodies by republican economic facilities went to the foreground in Ukraine, the action of all-union laws above the republican laws was the priority – both in the form of copying the content of all-union legislative acts and adopting union regulatory acts as acts with direct effect. Such downward trends also concerned the field of labour law. Theoretically, the adaptation of the Constitution of the UkrSSR of 1937 had to be an important step in the way of establishing progressive principles in labour law and consolidating the new approaches to improve the defence of workers' rights; however, the democratic principles and regulations of the Constitution remained declarative. The Constitution declared the right of everyone to work (the regulations on universal labour duty were absent), though the right to work declared by the Constitution of the UkrSSR was actually an obligation to work and, other regulatory acts assigned workers to the enterprises, institutions. It was forbidden to move in order to earn money for the living and so on. In the late 30s – early 40s of the previous century, the initial basis of forced labour was introduced in all union states (including, the UkrSSR) to increase production output in all fields of national economy and to improve productivity. Particularly, people who did not work without valid excuse (so-called "parasites", "freeloaders", "loafers") were brought to executive or criminal responsibilities. There was tougher penalty for violation of labour discipline, for producing items with defects, for non-observance of health and safety rules. During the Second World War, there was a significant deterioration in labour conditions, a decline in workers' rights and guarantees. In general, there was no possibility to defend their labour rights, rather labour law referred to defend workers' rights gained certain regressive features. Such deviation from the general foundations and principles of labour law was attributed to the fact that an essential part of the working population (mostly males) joined the armed forces. In order to provide the defence significance and farming enterprises (collective farms, state farms) with workforce, it was necessary to change the state policy in regulating the labour, since the Code of Labour Laws of 1922–1924, the content of which provided the foundations of voluntary work, acted on the territory of the USSR, the Russian Soviet Federative Socialist Republic (RSFSR) and other union republics. Labour laws foresaw labour duty only if it was necessary to combat natural disasters and to fulfil the most important state issues, but only on certain regulations of the People's Commissar Soviets. Such democratic principles were unable to ensure proper functioning of defence industry, the completion of defence and construction works, the fuel storage, the uninterrupted functioning of transport and so on. To ensure the fulfilment of the mentioned issues, the Soviet government adopted a certain number of Decrees of the Executive Committee of the Supreme Soviet of the USSR and Regulations of the People's Commissar Soviets of the USSR, according to which the entire state switched to the state of martial law and particularly destroyed all previously gained democratic achievements in labour law. This period is characterized by the labour militarisation, mobilization of the working population, the involvement of adolescents from the age of 14 into work, the increase in working hours, the annulment of holidays and the introduction of overtime work. The uniqueness of this phenomenon in terms of research in the domain of judicial defence of population's labour rights in Ukraine lies in the fact that generally such regressive trends did not take place on the territory of the UkrSSR itself, but on the territory of the RSFSR where Ukrainian enterprises were evacuated together with their workers and families due to the temporary occupation of the Ukrainian territory by the Nazi army. Also, the legislative and executive power agencies of the Ukrainian Republic carried out their activities (they were evacuated to Saratov and later located in Ufa and Moscow) on the territory of the RSFSR during the period from August 1941 to February 1943. During war, the labour laws of union republics actually did not function, it followed the law principles and regulations of the Union of Soviet Socialist Republics which, therefore, was intended not to ensure and defend the workers' rights and guarantees, but to introduce such methods and actions in work organization which in the shortest period could provide defence industry improvement and military production output in such capacities that it was possible to beat the Nazi invaders. ; Наукова стаття присвячена розкриттю аспектів розвитку інституту судового захисту прав людини у сфері праці. Здійснено аналіз стану захисту трудо-вих прав у Радянській Україні з періоду прийняття Конституції УРСР 1937 року та за часів Другої світової війни. Наприкінці 30-х років ХХ сто-річчя Україна починає втрачати свою суверенність та незалеж-ність, що є закономірним наслідком здійсненої зміни конституційно-правового статусу республіки. Це вбачається зі змісту конститу-ційних положень різних років. Так, якщо взяти до уваги зміст допов-нень до Конституції УСРР, при-йнятих у 1925 році, то там було закріплено, що УСРР входить до складу СРСР як «незалежна рес-публіка», згодом у Конституції УСРР 1929 року зазначалося, як «суверенна договірна держава», а про створення союзної держави мови не було. Проте в Конститу-ції 1937 року (найменування УСРР було змінене на УРСР на Надзви-чайному XIV з'їзді Рад у січні 1937 року) ці положення відсутні, є лише запис про об'єднання респу-блік у союзну державу. Конститу-ція УРСР 1937 року замість з'їздів Рад, ЦВК УРСР та їх Президій визначала найвищим органом дер-жавної влади республіки Верховну Раду УРСР. Верховна Рада УРСР вибирала Президію – колегіальний постійно діючий орган влади у пері-оди між сесіями Верховної Ради. В Україні поступово на перший план виходило керування загально-союзних органів управління респу-бліканськими об'єктами господар-ства, пріоритетною ставала дія загальносоюзного законодавства над республіканським як у вигляді копiювання змiсту загальносо-юзних законодавчих актів, так і застосуванням союзних норматив-них актів як актів прямої дії. Такі негативні тенденції не оминули і галузь трудового права. Теоретично прийняття у 1937 році Конституції УРСР мало б бути важливим кроком на шляху встановлення прогресивних принципів трудового права та закріплення нових підходів до удосконалювання захисту прав працівників, проте демократичні засади і положення Конституції залишилися деклара-тивними. Конституцією проголошувалося право кожного на працю (положення про загальну трудову повинність було відсутнє), але проголошене Конституцією УРСР право на працю фактично було обов'язком працювати, а іншими нормативним актами відбувалося закріплення працівників за під-приємствами, установами, заборо-нялося виїжджати на заробітки тощо. Наприкінці 30-х – початку 40-х років минулого століття у всій союзній державі (у тому числі і в УРСР) з метою збільшення випуску продукції у всіх галузях народного господарства та підви-щення продуктивності вводилися початкові засади примусової праці. Зокрема, особи, які не працювали без поважних причин (так звані «тунеядці», «дармоїди», «нероби»), притягувалися до адміністратив-ної або до кримінальної відповідаль-ності; мало місце більш жорстке покарання за порушення трудової дисципліни, за виробництво про-дукції з браком, за недотримання правил техніки безпеки. У період Другої світової війни відбулося значне погіршення умов праці, падіння рівня прав та гаран-тій працівників, взагалі була від-сутня можливість захисту їхніх трудових прав, тобто трудове право, покликане захищати права працівників, набуло певних регре-сивних ознак. Такий відступ від основних засад і принципів трудового права був зумовлений тим, що суттєва частина працездатного населення (в основному чоловічої статі) поповнила лави збройних сил. З метою забезпечення кадрами підприємств оборонного значення та сільгосппідприємств (колгос-пів, радгоспів) слід було змінювати політику держави у сфері регулю-вання праці, оскільки на теренах УССР, РСФСР та інших союзних республік діяли Кодекси законів про працю 1922–1924 років, за зміс-том яких передбачалися засади добровільної праці. Трудовим зако-нодавством трудова повинність була передбачена лише у разі необ-хідності боротьби зі стихійними лихами та для виконання найважливіших державних завдань, та лише на підставі конкретних постанов Ради Народних Коміса-рів. Такі демократичні засади не в змозі були забезпечити безперервну роботу оборонної промисловості, проведення оборонних і будівель-них робіт, заготівлю палива, без-перебійного функціонування тран-спорту тощо. Для забезпечення виконання цих завдань радянський уряд прийняв певну кількість ука-зів Президії Верховної Ради СРСР та постанов РНК СРСР, за якими вся держава переходила на воєнний стан і фактично руйнувалися всі набуті раніше демократичні досяг-нення в сфері трудового права. Цей період характеризується міліта-ризацією праці, мобілізацією пра-цездатного населення, залученням до праці підлітків з 14 років, збіль-шенням тривалості робочого часу, скасуванням відпусток та введен-ням надурочних робіт. Унікальність цього явища у плані дослідження ґенези судового захисту трудових прав населення України полягає в тому, що такі регресивні тенденції в основному мали місце не на території УРСР, а на території РСФСР, куди були евакуйовані українські підприєм-ства разом зі своїми працівниками та їхніми родинами у зв'язку з тимчасовою окупацією німець-ко-фашистськими військами тери-торії України. Також на території РСФСР у період із серпня 1941 року до лютого 1943 року здійснювали свою діяльність законодавчі та виконавчі органи влади української республіки (вони були евакуйовані до Саратова, а пізніше перебували в Уфі та Москві). Під час війни трудове законодавство союзних республік фактично не діяло, було повністю підкорене принципам і положенням законодавства СРСР, яке, своєю чергою, мало на меті не забезпечення та захист прав і гарантій працівників, а застосування таких методів і заходів в організації праці, які б у найкоротші строки сприяли налагодженню оборонної промисловості та випуску воєнної продукції в таких обсягах, щоб можна було здобути перемогу над німецько-фашистськими загарбниками.
The article covers development aspects of the institution of judicial defense of human rights at labour. The analysis of the labour rights defense condition in Soviet Ukraine from adopting the Constitution of the Ukrainian Soviet Socialist Republic of 1937 and throughout the Second World War is carried out. In the late 30s of the XX century, Ukraine started losing its sovereignty and independence which was a natural consequence of the conducted change in republic constitutional and legal status. This follows from the content of constitutional regulations of various years. Thus, if amendments to the Constitution of the Ukrainian Socialist Soviet Republic adopted in 1925 are taken into account, it was enshrined that the Ukrainian Socialist Soviet Republic was the part of the Union of Soviet Socialist Republics as "an independent republic", thereafter, in the Constitution of the Ukrainian Soviet Socialist Republic of 1929 it was registered as "an independent contracting state", and there was no union state creation was mentioned. Nevertheless, in the Constitution of 1937 (the name of the Ukrainian Socialist Soviet Republic was changed to the Ukrainian SovietSocialist Republic (UkrSSR) at the XIV Emergency Congress of Soviets in January 1937), these regulations are absent. There is only one record about joining the republics into one union state. Instead of the Congresses of Soviets, Central Election Commission of the UkrSSR and their Executive Committees, the Constitution of the UkrSSR of 1937 determined the Supreme Soviet of the UkrSSR as the republic highest body of state power. The Supreme Soviet of the USSR elected the Executive Committee - a collegial permanent power agency in the periods between the sessions of the Supreme Soviet. Incrementally, the governance of all-union governing bodies by republican economic facilities went to the foreground in Ukraine, the action of all-union laws above the republican laws was the priority - both in the form of copying the content of all-union legislative acts and adopting union regulatory acts as acts with direct effect. Such downward trends also concerned the field of labour law. Theoretically, the adaptation of the Constitution of the UkrSSRof1937 had to be an important step in the way of establishing progressive principles in labour law and consolidating the new approaches to improve the defense of workers' rights; however, the democratic principles and regulations of the Constitution remained declarative. The Constitution declared the right of everyone to work (the regulations on universal labour duty were absent), though the right to work declared by the Constitution of the UkrSSR was actually an obligation to work and, other regulatory acts assigned workers to the enterprises, institutions. It was forbidden to move in order to earn money for the living and so on. In the late 30s - early 40s of the previous century, the initial basis of forced labour was introduced in all union states (including, the UkrSSR) to increase production output in all fields of national economy and to improve productivity. Particularly, people who did not work without valid excuse (so-called parasites, freeloaders, loafers) were brought to executive or criminal responsibilities. There was tougher penalty for violation of labour discipline, for producing items with defects, for non-observance of health and safety rules. During the Second World War, there was a significant deterioration in labour conditions, a decline in workers' rights and guarantees. In general, there was no possibility to defend their labour rights, rather labour law referred to defend workers' rights gained certain regressive features. Such deviation from the general foundations and principles of labour law was attributed to the fact that an essential part of the working population (mostly males) joined the armed forces. In order to provide the defense significance and farming enterprises (collective farms, state farms) with workforce, it was necessary to change the state policy in regulating the labour, since the Code of Labour Laws of 1922-1924, the content of which provided the foundations of voluntary work, acted on the territory of the USSR, the Russian Soviet Federative Socialist Republic (RSFSR) and other union republics. Labour laws foresaw labour duty only if it was necessary to combat natural disasters and to fulfil the most important state issues, but only on certain regulations of the People's Commissar Soviets. Such democratic principles were unable to ensure proper functioning of defense industry, the completion of defense and construction works, the fuel storage, the uninterrupted functioning of transport and so on. To ensure the fulfilment of the mentioned issues, the Soviet government adopted a certain number of Decrees of the Executive Committee of the Supreme Soviet of the USSR and Regulations of thePeople's Commissar Soviets of the USSR, according to which the entire state switched to the state of martial law and particularly destroyed all previously gained democratic achievements in labour law. This period is characterized by the labour militarization, mobilization of the working population, the involvement of adolescents from the age of 14 into work, the increase in working hours, the annulment of holidays and the introduction of overtime work. The uniqueness of this phenomenon in terms of research in the domain of judicial defense of population's labour rights in Ukraine lies in the fact that generally such regressive trends did not take place on the territory of the UkrSSR itself, but on the territory of the RSFSR where Ukrainian enterprises were evacuated together with their workers and families due to the temporary occupation of the Ukrainian territory by the Nazi army. Also, the legislative and executive power agencies of the Ukrainian Republic carried out their activities (they were evacuated to Saratov and later located in Ufa and Moscow) on the territory of the RSFSR during the period from August 1941 to February 1943. During war, the labour laws of union republics actually did not function, it followed the law principles and regulations of the Union of Soviet Socialist Republics which, therefore, was intended not to ensure and defend the workers' rights and guarantees, but to introduce such methods and actions in work organization which in the shortest period could provide defense industry improvement and military production output in such capacities that it was possible to beat the Nazi invaders. ; Наукова стаття присвячена розкриттю аспектів розвитку інституту судового захисту прав людини у сфері праці. Здійснено аналіз стану захисту трудових прав в Радянській Україні з періоду прийняття Конституції УРСР 1937 р. та за часів Другої світової війни. Наприкінці 30-х рр. ХХ сторіччя Україна починає втрачати свою суверенність та незалежність, що є закономірним наслідком здійсненоїзміни конституційно-правового статусу республіки. Це вбачається зі змісту конституційних положень різних років. Так, якщо взяти до уваги зміст доповнень до Конституції УСРР, прийнятих у 1925 році, то можна побачити, що там було закріплено, що УСРР входить до складу СРСР як «незалежна республіка», згодом у Конституції УСРР 1929 р. зазначалася «суверенна договірна держава», а про створення союзної держави не йшлося. Проте в Конституції 1937 року (найменування УСРР було змінено на УРСР на Надзвичайному XIV з'їзді Рад в січні 1937 р.) ці положення відсутні, є лише запис про об'єднання республік у союзну державу. Конституція УРСР 1937 р. замість з'їздів Рад, ЦВК УРСР та їх Президій визначала найвищим органом державної влади республіки Верховну Раду УРСР. Верховна Рада УРСР обирала Президію -колегіальний постійно діючий орган влади у періоди між сесіями Верховної Ради. В Україні поступово на перший план виходило керування загальносоюзних органів управління республіканськими об'єктами господарства, пріоритетною ставала дія загальносоюзного законодавства над республіканським як у вигляді копіювання змісту загальносоюзних законодавчих актів, так і щодо застосування союзних нормативних актів як актів прямої дії. Такі негативні тенденції не оминули галузь трудового права. Теоретично прийняття у 1937 р. Конституції УРСР мало би бути важливим кроком на шляху встановлення прогресивних принципів трудового права та закріплення нових підходів до вдосконалення захисту прав працівників, проте демократичні засади й положення Конституції залишилися декларативними. Конституцією проголошувалося право кожного на працю (положення про загальну трудову повинність було відсутнє), але проголошене Конституцією УРСР право на працю фактично було обов'язком працювати, а іншими нормативним актами відбувалося закріплення працівників за підприємствами, установами, заборонялося виїжджати на заробітки тощо. Наприкінці30-х - початку 40-хрр. минулого століття у всій союзній державі (зокрема, в УРСР) задля збільшення випуску продукції у всіх галузях народного господарства та підвищення продуктивності вводилися початкові засади примусової праці. Зокрема, особи, які не працювали без поважних причин (так звані тунеядці, дармоїди, нероби), притягувалися до адміністративної або кримінальної відповідальності; було більш жорстке покарання за порушення трудової дисципліни, виробництво продукції з браком, недотримання правил техніки безпеки. У період Другої світової війни відбулося значне погіршення умов праці, падіння рівня прав та гарантій працівників, взагалі була відсутня можливість захисту їх трудових прав, тобто трудове право, покликане захищати права працівників, набуло певних регресивних ознак. Такий відступ від основних засад і принципів трудового права був обумовлений тим, що суттєва частина працездатного населення (переважно чоловічої статі) поповнила лави збройних сил. Задля забезпечення кадрами підприємств оборонного значення та сільгосппідприємств (колгоспів, радгоспів) слід було змінювати політику держави у сфері регулювання праці, оскільки на теренах УССР, РСФСР та інших союзних республік діяли Кодекси законів про працю 19221924 рр., за змістом яких передбачалися засади добровільної праці. Трудовим законодавством трудоваповинність була передбачена лише за необхідності боротьби зі стихійними лихами та для виконання найважливіших державних завдань, а також лише на підставі конкретних постанов Ради Народних Комісарів. Такі демократичні засади не в змозі були забезпечити безперервну роботу оборонної промисловості, проведення оборонних і будівельних робіт, заготівку палива, безперебійного функціонування транспорту тощо. Для забезпечення виконання цих завдань радянський уряд прийняв певну кількість Указів Президії Верховної Ради СРСР та Постанов РНК СРСР, за якими вся держава переходила на воєнний стан, фактично руйнувалися всі набуті раніше демократичні досягнення у сфері трудового права. Цей період характеризується мілітаризацією праці, мобілізацією працездатного населення, залученням до праці підлітків з 14 років, збільшенням тривалості робочого часу, скасуванням відпусток та введенням надурочних робіт. Унікальність цього явища щодо дослідження генези судового захисту трудових прав населення України полягає в тому, що такі регресивні тенденції переважно були не на території УРСР, а на території РСФСР, куди були евакуйовані українські підприємства разом зі своїми працівниками та їх родинами у зв'язку з тимчасовою окупацією німецько-фашистськими військами території України. Також на території РСФСР у період із серпня 1941 р. до лютого 1943 р. здійснювали свою діяльність законодавчі та виконавчі органи влади української республіки (вони були евакуйовані до Саратова, а пізніше перебували в Уфі та Москві). Під час війни трудове законодавство союзних республік фактично не діяло, було повністю підкорено принципам і положенням законодавства СРСР, як мало на меті не забезпечення та захист прав і гарантій працівників, а застосування таких методів і заходів в організації праці, які б у найко-ротші строки сприяли налагодженню оборонної промисловості та випуску воєнної продукції в таких обсягах, щоб можна було отримати перемогу над німецько-фашистськими загарбниками.
The article raised the issue of contermeasures against smuggling in Soviet Ukraine in 20s-30s of the twentieth century. The dangers of smuggling for the development of economic, financial, credit and political system of the Soviet state were studied. The process of legal framework formation combating smuggling was studied. It is stressed that smuggling undermines the state's economy, violates the state order of material assets movement through the state border, as well as objects and substances circulation of which is restricted or forbidden, causes damage to the national security and health of people, therefore counteracting smuggling should constantly be in the field of specialists-practices of state institutions involved in the protection of state borders, in particular in the field of fiscal, customs, border services of each state. Legal regulatory basis for combating smuggling were investigated. The basic laws and documents that disclosed the concept of "smuggling", its features and the responsibility for it were researched. Studied the role of documents such as USSR Criminal Code, RSSR Criminal Code, Customs statute of USSR, the decree of Council of People's Commissars of RRSFR "On Combating smuggling" to counter economic crimes. The role of customs and border protection to counter smuggling during the 1921-1939 years was shown. The state institutions work of on the issue of illegal goods trafficing combat has been studied (discovered). The methods of combating smuggling such as: arrest at the border; operations with the seizure of contraband from apartments and shops; creation of special protective units in the areas of goods smuggling; surveillance of persons suspected of illegal activities; interception of correspondence; infiltration of agents; creating a network of informants and others were analyzed. ; У статті піднято питання протидії контрабанді в радянській Україні у 20-30і роки ХХ століття. Розглянуто небезпеку контрабанди для розвитку економічної, фінансово-кредитної і політичної системи радянської держави. Вивчено процес формування юридичної бази протидії контрабанді. Наголошено, що контрабанда підриває економіку держави, порушує державний порядок переміщення через державний кордон матеріальних цінностей, а також предметів та речовин, обіг яких обмежений чи заборонений, спричиняє шкоду національній безпеці й здоров'ю людей, тому протидія контрабанді повинна постійно знаходиться у полі зору фахівців-практиків державних інституцій, які займаються охороною державних кордонів, зокрема у полі зору фіскальної, митної, прикордонної служб кожної держави. Досліджено нормативно-правове підґрунтя протидії контрабанді. Розглянуто основні закони і документи, в яких розкрито поняття «контрабанда», її ознаки та відповідальність за неї. Вивчено роль таких документів, як Кримінальний кодекс УСРР, Кримінальний кодекс РРСФР, Митний статут СРСР, Декрет Ради Народних Комісарів РРСФР «Про боротьбу з контрабандою» у справі протидії економічним злочинам. The article revealed the relationship between Ukrainian and Polish socialists in Eastern Galicia at the beginning of the 20th century, on the eve and during the First World War, which ended with the collapse of the Austro-Hungarian Empire and the proclamation of the Western Ukrainian People's Republic (WUPR, ZUNR). In the political life of Austria-Hungary at the beginning of the 20th century а prominent place was occupied by the socialists, to which in Galicia, in particular, belonged the Polish Social-Democratic Party of Galicia and Silesia (from 1919 – the Polish Socialist Party) and the Ukrainian Social-Democratic Party of Galicia and Bukovina. Both autonomous parties were part of the Social Democratic Workers' Party of Austria and tried to combine the national idea and Marxism. In the conditions of the First World War, Ukrainian and Polish Social Democrats clearly declared the priority of the national over the social-class and international, and their traditional critique and hostility towards the "bourgeois" parties became declarative. The leaders of both parties realized that the world war opened up real prospects for solving the national issue and took an active part in the activities of national representative institutions: the USDP leaders were in the Main Ukrainian Council, later – in the General Ukrainian Council, the PSDP leaders – in the Polish circle in the Austrian Parliament etc. After the collapse of the Habsburg monarchy in the autumn of 1918, the USDP and PSDP became the hostile sides of the armed conflict between the two nations. The Polish Socialists led the first governments of the Second Rzeczpospolita (Polish Republic), while the USDP representatives supported the November 1 uprising of Ukrainians in Lviv and in most of the Galician cities, joined the first Government of the ZUNR (WUPR), headed by K. Levytsky. At the same time, in the composition of both parties, there were few figures calling for a Polish-Ukrainian understanding and an alliance in the struggle against Russian imperialism. Thus, on March 31, 1918, the USDP official M.Hankevych wrote a letter to Polish socialist I.Dashinsky in order to reverse the Polish-Ukrainian conflict, but it did not get the result. After the defeat of the ZUNR (WUPR), the Polish Socialists proposed the projects of the territorial autonomy of the Eastern Galicia in the Second Rzeczpospolita, which, however, did not find support among the leaders of the USDP, which were the supporters of the formation of an independent Ukrainian state, to which Galicia had to enter. Відновлена УСДП з 1928 р. мала взаємини з ППС, стабільній співпраці двох партій заважали розбіжності в національному питанні.
The article shows the social and political activity of Polish students ofpedagogical educational institutions of Soviet Ukraine in the interwar period. It is told about the work of the organizations of the KP (B) U and LKSMU ideological circles (political economy, Marxist-Leninist). The author states that in this period, for students were conducted group discussions, were organized lectures on ideological issues. At the same time, it is stated that there have been cases when party members allowed abuses that undermined the authority of the party. Thearticle analyzes, educational institutions participated in the socialist competition of high schools and colleges in the USSR. It is noted that the socialist competition held between individual institutions. In the course of the competition were determined students- "strikers", who were financially encouraged. It is stated that the universities paid attention to the anti-religious work, in particular, anti-religious work seminars, the organization "Union of Militant Atheists", atheistic circles "Atheist." It is noted that an important place in the life of the then institutions engaged in social work: cell functioning of trade unions and social organizations. The article described the attitude of Ukrainian leftist parties to church and religion in the late nineteenth century – the first third of the twentieth century. Ukrainian Galicia left hand – is a special phenomenon of the Ukrainian movement in this period. It is significantly different from similar political camp on the Dnieper. Українська лівиця в Галичині – це особливий феномен українського руху в зазначений період. Вона істотно відрізнялася від подібного політичного табору на Наддніпрянщині. Передусім, вона швидше оформилася організаційно, ґрунтовніше використовувала у політичній практиці європейські традиції лівого руху, виразно визначала соборницькі прагнення українців. Водночас лівим Галичини і Наддніпрянщини були притаманні виступи за збільшення рівня соціальної справедливості, політичного, релігійного, національного рівноправ'я, демократизацію виборчого права тощо. Наприкінці ХІХ століття партії лівого спектра пережили період ідеологічного становлення, пошуку базових векторів діяльності. Вони різнилися чисельністю, ідеологією, національним складом, територією, на яку поширювали діяльність. Саме у цей період українська лівиця Галичини виробила власні погляди щодо релігії та церкви, що відображено у партійних програмах, теоретичній спадщині визначних представників соціалістичних та комуністичних партій. У міжвоєнний період ХХ ст. представники лівих політичних партій Західної України надалі критично і негативно ставилися до інституту церкви і релігії, проте, зважаючи на високу релігійність місцевого населення, були змушені адаптувати програмні принципи до реалій часу. У цей період існували також суттєві відмінності між соціалістами і комуністами. Перші критикували релігійні догми виходячи з національних принципів (критика «польського костелу», угодовства окремих грекокатолицьких єпископів тощо), другі керувалися працями класиків марксизмуленінізму, які взагалі заперечували необхідність релігійності суспільства. У статті відзначено, що найнепримиреннішу позицію до церкви та релігії займали представники комуністичних сил, які, здебільшого, сповідували атеїстичні переконання, боролися за поглиблення марксистського світогляду серед населення регіону. Незважаючи на те, що декларативно комуністи проголошували релігію приватною справою, наголошували, що кожен повинен бути цілком вільний у тому, щоб сповідувати яку завгодно релігію або не визнавати ніякої релігії, на практиці члени КПСГ, КПЗУ боролися за поширення атеїстичного світогляду. Висока релігійність населення Західної України, незначні впливи комуністичних сил на суспільнополітичні процеси не дозволили КПЗУ, СельРобу реалізувати програмні положення у церковнорелігійній сфері. До того ж, церква також поборювала поширення комуністичних ідей у Галичині. Розглянуто ставлення соціалістів до церкви та релігії. Зауважено, що загалом, незважаючи на своє попівське походження, представники радикалів та соціалдемократів ставилися до духовенства доволі критично. Останні, зокрема, вважали церкву «найбільшим, натуральним ворогом всякої вільної думки, поступу». Соціалдемократи звинувачували церкву у «придушенні національних почуттів» не лише галицького люду загалом, а й молодого патріотичного духовенства. У міжвоєнний період ХХ ст. соціалдемократи підпали під вплив комуністичних ідей, що вплинуло на зміну ідеологічної платформи партії у церковнорелігійному питанні. Радикали у своїй практичній діяльності використовували теоретичні напрацювання І. Франка, який гостро критикував галицьке духовенство. Проте УРП дистанціонувалася від церковної проблематики, наголошуючи, що її електорат сам вибиратиме як ставитися до церковних інституцій та загалом релігії. Соціалістичнорадикальна партія продовжила лінію УРП, проте трансформувала національнокультурну програму до вимог часу. Перебуваючи в умовах політичної системи Другої Речі Посполитої, УСРП розглядала церкву як один із засобів національного усвідомлення населення, виступала проти ліквідації православних храмів, збільшення церковного землеволодіння, наголошувала на необхідності відокремлення церкви від держави. The purpose of the article is to structure and reflect the history of such medical institution as the Chernihiv Military Hospital on the basis of the studied materials (archive resources of SACR (State Archive of Chernihiv Region), Chernihiv Military Hospital, mass media, information provided by the respondents). Methodologically, the publication is based on analytical and statistical methods. The scientific novelty of this article is an attempt to cover the process of creation and operation of the Chernihiv Military Hospital from its inception to the present day. Also, the periods of change of localization of the medical institution on the territory of Chernihiv were traced, the key events were examined. Conclusions. The establishment of the Chernihiv Military Hospital in Chernihiv was happening in difficult conditions. The institution did not have its own premises, in key times for the history of Ukraine, it changed its location. Most of the buildings did not meet the proper conditions and were not equipped for medical needs, which to some extent affected the quality of service. However, this did not prevent from providing assistance to the military who took part in World War II in the post-war period. Overtime, the hospital received a renovated new building, deployed comprehensive assistance to the military with specialists, where it is located now. The authority stimulated the improvement of the quality of work by hold in socialist competitions, celebrating Soviet anniversaries, organizing annual military exercises etc. The change of managers of the institution helped to improve the professionalism of doctors by holding seminars on different topics, conferences, researches, equipment upgrades, etc. on the basis of the hospital and other institutions. Guarding the health of their defenders due to the beginning of military events in eastern Ukraine, thus confirming its necessity and significance.
The little-known pages of the history of Podillia are studied in the paper, namely: the activities of Jewish cultural organizations, from the period of the so-called 'Kamianets Era' of the UNR (Ukrainian People's Republic) in June-November 1919 to the beginning of accelerated, forced collectivization in the Ukrainian SSR, when the gradual onset of central and local power on Jewish cultural institutions and their step-by-step abolition began. The goals of the study are to highlight the activities of Jewish cultural organizations in Podillia during the UNR and the first decade of Soviet rule; to analyze and compare the policy of state institutions of the Ukrainian People's Republic and the Soviet government regarding the activities of Jewish cultural societies; to show the process of struggle in the Jewish environment itself for the prospects of the Jewish cultural and educational process. The author has concluded that the history of Jewish cultural societies and institutions in Podillia, which operated in the 1920s, could be divided into several main stages: 1)1919-1920 – a period of struggle in the Jewish environment itself for the defining of the essence of cultural work among the Jews. While the Jewish socialist parties (Poale Zion, United Socialists) advocated the creation of a new modernized Jewish culture, the right-wing Jewish circles (Zionists, Ahdus) insisted on preserving a traditional ethnic culture closely associated with Judaic values. The UNR authorities, although they supported the Jewish socialist parties, tried not to interfere in that process, did not set themselves the goal of controlling it in any way; 2)1920-1923 – establishment of control by the Bilshovyks over the cultural and educational life of the Jews of Podillia, the ban by the Soviet authorities on the activities of all cultural organizations that focused on the ancient Jewish language and culture. The main focus was on the creation of a new Jewish socialist culture; 3)1923-1929 – establishment of a wide network of Jewish cultural and educational institutions (village community centers, libraries, and village reading rooms), which after all gradually managed to bring to the side of the Soviet power the vast majority of Podillia Jews. At the same time, the members of illegal and semi-legal organizations were being persecuted by local authorities. In the late 1920s, the process of closing synagogues began in Podillia, and from the mid-1930s the network of Soviet Jewish libraries, village community centers, village reading rooms, and clubs began to dwindle. This issue may be the subject of new research. ; У статті досліджуються маловідомі сторінки історії Поділля, а саме: діяльність єврейських культурницьких організацій, починаючи від періоду так званої «Кам'янецької Доби» УНР (червень-листопад 1919р.) до початку насильницької форсованої колективізації в УСРР, коли розпочався поступовий наступ з боку центральної та місцевої влади на єврейські заклади культури та поступове їх скасування. У даній праці ми ставимо за мету висвітлити діяльність єврейських культурницьких організацій на Поділлі у часи УНР і в перше десятиліття радянської влади; проаналізувати та порівняти політику державних інституцій УНР і радянської влади стосовно діяльності єврейських культурницьких товариств; показати процес боротьби у самому єврейському середовищі щодо перспектив єврейського культурно-освітнього процесу. На основі маловідомих для широкого кола дослідників архівних матеріалів визначені основні етапи в історії діяльності єврейських культурницьких закладів та установ на теренах Поділля у 1920-тірр. Визначені особливості кожного з цих етапів на подальший стан етнонаціональних відносин у Подільському регіоні і загалом в Україні.
