Bu durum tüm vatandaşlarca paylaşılan ortak bir politik kültürün yaratılması eğilimidir.Ulus-devlet; sınırları belirlenmiş bir toprak parçası içinde, yasal güç kullanma hakkına sahip ve yönetimi altındaki halkı türdeşleştirecek ortak kültür, simgeler, değerler yaratarak gelenekler ile köken mitini canlandıracak birleşmeyi amaçlayan devlet olarak tanımlanabilir. Ulus-devletin yapmak istediği; devleti ya da siyasal iktidarı merkezîleştirmek, kültürü standartlaştırmak, hukukta eşitliği ve ekonomide bütünleşmeyi sağlamaktır.Bugünün dünyasındaki egemenlik anlayışı, genel olarak, bir devletin ülke toprakları üzerinde yönetme yetkisini kullanma hakkı olarak tanımlanmaktadır. Bu kavramın hukuksal bir anlamı olduğu kadar siyasî bir anlamı da mevcuttur ve bu iki anlam iç içe geçmiş durumdadır. Egemenlik devletin gücünü temsil etmektedir. Uluslar işbirliğine girdikçe egemenlik gündeme gelmektedir.Küreselleşme; ülkeler arasındaki iktisâdi, sosyal ve siyasal ilişkilerin gelişmesi, farklı toplum ve kültürlerin inanç ve beklentilerinin daha iyi tanınması, uluslar arası ilişkilerin yoğunlaşması gibi birbirleriyle bağlantılı konuları içeren bir kavramdır. Küreselleşme süreci, ulus devlet yapısı içindeki hükümetlerin gücünü ve etkinliğini azaltmakta, hükümetler; ekonomik nesnelerin, teknolojik yeniliklerin, bilgi, haber ve fikirlerin akışını kontrol etmekte güçlük çekmekte, ulus devletlerin millî ekonomik politika izleme imkânı giderek azalmakta, ekonomik sınırların aşınması millî siyasî sınırların da aşınmasına yol açmaktadır. Küreselleşme olgusu, bir yandan ülkelerin ulus-üstü düzeyde ortak çıkarlarını gözeten ve koruyan örgütlenmelere katılımlarını ön plâna çıkarırken, diğer yandan ulusal ve ulus- altı düzeylerde yeni yönetişim modellerini zorunlu kılmaktadır.Dünyada devlet egemenliğinin kurulu modelleri ve uygulamalarına meydan okuyan pek çok güç vardır. Bu güçler, küreselleşeme ve uluslararasıcılıktır. Avrupa Birliği, gerek hedefleri gerekse bu hedeflere ulaşma doğrultusunda oluşturulan teşkilâtlanma yapısıyla diğer hiçbir uluslar arası örgütlenmede görülmeyecek sui generis bir uluslar arası yapılanmadır. AT'yi sui generis yapan ve diğer örgütlenmelerden ayıran en önemli özellik, belirlenen hedeflere ulaşırken hükümetler arası girişimler yerine, oluşturulan yapısal (anayasal) ve sürekli organlar vasıtasıyla bu amaçlara ulaşmasıdır.Avrupa Birliği'nin kurumlarının görev, yetki ve sorumlulukları kurucu antlaşmalarca belirlenmiştir. Antlaşmaların uluslar üstü düzenleme, uygulama ve yargılama yapma yetkisi vermiş olduğu kurumlar (Konsey, Komisyon, ATAD), Avrupa Birliği ulusları arasında uluslar üstü otorite olarak da değerlendirebilmektedir. Aynı şekilde gerek bu kurumları oluşturan antlaşmalar hukuku, gerekse yaptığı hukuk, üye devletlerde aynı etkiye sahip olup, üye devletler tarafından tek taraflı olarak değiştirilemez ve ortadan kaldırılamaz nitelikte olması da Avrupa Birliği hukukunun uluslar üstü (supranational) olduğu yaklaşımını geliştirmiştir.AB tam anlamıyla devletin ana öğelerini bünyesinde bire bir barındırmamakla beraber, devlete, özellikle federal devlet biçimine çok benzer yetkiler kullanmakta, AB Anayasal Antlaşması ile bir anayasal yurttaşlık oluşturmaya çabalamaktadır. Kuvvetler ayrılığı ilkesi çerçevesinde yasama, yürütme ve yargı yetkilerini birbirinden ayrıştırmış ve her biri için ayrı organlar yaratmış ve bunların işleyişini de kurucu antlaşmalara ve nihayetinde anayasa ile hukuk ilkelerine bağlamıştır. . The State should be interested in looking after the national society inside its own borders as well as in the larger societies existing outside wherein it should be sustainable its existence. The State takes the administration within its borders into its own monopoly. Such a situtation is a trend to create a common political culture being shared by all the citizens.The nation-state can be defined as a State having the right of employing any legal power inside a piece of o the land the borders of which have been demarcated and aiming to the integration to enliven the radical myth through the traditions by creating the common culture, symbols and values, all of which will homogenize the people under its administration. What the nation ? state is to centralize the state or poltical power , and standardize the culture, and provide the equality in law and the integration in economy.The understanding of sovereignity today in the world is defined, in general, as the right of any State for employing its powers of administration upon the country?s lands. This concept has a lawful meaning as well as a political meaning; and these two meanings are interchangeable with each other. Sovereignity represents the power of the State. As long as the nations enter into collaboration with each other, the sovereignity comes into question.Globalization is a concept containing the issues being connected with each other such as the development of economic, social and political relationships among the countries, and the better understanding the beliefs and expectations of the nations? cultures, and the intensification of international relationships. The process of globalization diminishes the power and efficiency of the governments being within the structure of nation-state; so such governments have difficulty in controlling the flow of economic objects, technological innovations, informaton, news and ideas, and the possibility of the nation-states for following up their national economic policies decrease gradually. The phenomenon of globalization puts the fact that the countries participate in the organizations guarding and protecting their common intersets and benefits at a supranational level into foreground in one hand, and makes new models of governance compulsory at both national and also supranational levels in the other hand.Today in the world, there are many forces challenging to the established models and practices of the state dominance. Such forces are globalization and internationalism. The European Union is a sui generis ınternational restructuring with its organizational structure being formed in line with both its goals and also with reaching such goals, which cannot be observed in any international organization. The most important feature making the European Community sui generis and distinguishing from other organizatons is to try to reach the goals thus determined through the formed structural (constitutional) and permanent bodies instead of the inter-governmental attempts.The tasks, authorizations, powers and responsibilities of the institutions of the European Union have been determined within the scope of the constitutive treaties. The institutions which such treaties give the authorization of making the supranational arrangement, application and judgement (such as Council, Commission, Committee, the European Community Court of Justice) can be also evaluated as the supranational authorities among the nations being included in the European countries Likewise, in the same way, both the law of treaties constituting such institutions and also the law which it has made have the same effect in the member states, and the fact that such laws cannot be changed and do away with unitalerally by the member states has developed the approach that the law of the European Union is supranational.Despite the European Union does not duly shelter the main elements of a state one to one within its own structure, it has been employing some powers similar to the ones being applied by any state state, and particularly by any federal state, and trying to form a constitutional citizenship. It has separated the powers of legislation, execution and judgment from each other within the framework of the division of powers, and created the separate bodies for each of such powers, and tied the functionality and operation of the same to the constituent treaties and law principles with the constitution. It gives its individuals the freedom of using the fundamental rights as well as of seeking such rights within the context of the Condition of the European Union Fundamental Rights. It has made the share of powers and authorizations with its member states, and included the same in the text of the constitution.

Modernleşme süreci Türkiye'sinde siyasi ve sosyal dönüşümün çok tartışılan alanlarından biri de milli egemenlik prensibinin anlam ve yorumlanmasına ilişkindir. Türkiye'de milli egemenlik düşüncesinin muhteva ve kapsamı, Batı siyasal ideolojilerinin tesirinde gelişip dönüştüğü gibi, Osmanlı Devleti'nin içerisinde bulunduğu siyasi ve sosyal hadiselerden de etkilenmiştir. Osmanlı Devleti'nden ulus devletine geçiş sürecinde Milli egemenlik prensibinin "padişahın" kutsal mevcudiyeti ile nasıl uyumlulaştırılabileceği, daha açık birifade ile padişahın varlığının, Osmanlı halkı üzerindeki haklarının nasıl sürdürülebileceği bir sorun olmuştur. II. Meşrutiyet döneminin ilk yıllarında kurulan siyasal partilerin programlarında, kutsal bir şahsiyet olan padişaha bağlılık ifade edilirken, zamanla padişah, varlığı meclise gölge düşüren bir hükümdara dönüşecektir. Bu bakımdan Türkiye'de modernleşme süreci içerisinde milli egemenlik prensibinin dönüşümü II. Meşrutiyet dönemi siyasal parti programları dikkate alınarak incelenmelidir. Türkiye'deulus devlet anlayışının ve Türkçülük ideolojisinin açık olarak ilk savunucusu Milli Meşrutiyet Fırkası'nın, mensuplarının "milli egemenlik" ilkesi hakkında görüş ve yorumları bu çalışmanın konusunu teşkil edecektir. Söz konusu fırkanın geleneksel otoriteyi, yöneten ile yönetilenler arasında var olan, karar vericinin üstünlüğüne dayanan bir ilişki biçimini koruma ve sürdürme inancı, İttihat ve Terakki Fırkasıve Hürriyet ve İtilaf Fırkası mensuplarınca eleştirilmiş ve fırka yalnızlaştırılmıştır. ; One of the most discussed areas of political and social transformation during the modernization process in Turkey was related to the meaning and interpretation of the principle of national sovereignty. While the content and scope of the idea of national sovereignty in Turkey developed and transformed under the influence of the Western political ideologies, they were also affected by the political and social events in which the Ottoman State was included. In the process of transition from the Ottoman State to the nation-state, how the principle of national sovereignty could be harmonized with the sacred existence of the padishah, more clearly, how the rights of the padishah's existence over the Ottoman people could be maintained was a problem. While loyalty to the padishah, a sacred character, as indicted in the programs of the political parties established in the first years of the II. Constitutional Monarchy period, padishah would turn into an "emperor" the existence of whom overshadowed the parliament in time. In this regard, the transformation of the principle of national sovereignty within the modernization process in Turkey should be examined by considering political party programs during the II. Constitutional Monarchy period. The opinions and comments of the members of the National Constitutional Monarchy Party (Milli Meşrutiyet Fırkası), who were clearly the first advocates of nation-state understanding and the ideology of Turkism in Turkey, about the principle of "national sovereignty" constituted the subject of this study. This party's belief in preserving and maintaining the traditional authority and a form of relationship based on the superiority of the decision-maker between the rulers and the ruled was criticized by the members of the Union and Progress Party (İttihat ve Terakki Fırkası) and the Freedom and Accord Party (Hürriyet ve İtilaf Fırkası).

Küreselleşme kavramı, yaşamların giderek çok uzaklarda alınan kararlar ve gerçekleşen olaylar tarafından biçimlendirildiği karmaşık karşılıklı ilişkilerin ortaya çıkışını ifade eder. Küreselleşme sürecinde en dikkat çekici değişim ve dönüşüme maruz kalan unsurların başında ulus-devletler gelmektedir. Bu süreçte devletler arasında karşılıklı bağımlılığın artması ile ulus-devletlerin sınırları farklı güç, amaç, kimlik ve ağlara sahip ulus-ötesi aktörler tarafından sürekli olarak geçilmektedir. Sınırların adeta ortadan kalkması ile ulus-devletler ekonomik krizler, insan güvenlik, terörizm, çevre ve iklim sorunları gibi uluslararası güvenlik sorunlarından daha fazla etkilenir hale gelmişlerdir. Bu çalışmanın amacı küreselleşme sürecinde ulus-devletlerin egemenliklerinin erozyona uğramasının nedenlerini analiz etmek yanında ortaya çıkan yeni güvenlik sorunları karşısında ulus-devletlerin yalnız başlarına çözüm üretmede yetersiz kalmaları sebebiyle işbirliğinin önemine vurgu yapmaktır. ; Globalization refers to the emergence of complex interrelationships in which lives are shaped by decisions and events taking place far beyond. In the process of globalization, the nation-state is one of the most important elements exposed to the most significant change and transformation. In this process, with the increasing interdependence between states, the boundaries of nation-states are constantly being crossed by transnational actors with different powers, goals, identities and networks. With the disappearance of borders, nation-states have become more affected by international security problems such as economic crises, human security, terrorism, environmental and climate problems. The aim of this study is to analyze the reasons for the erosion of sovereignty of nation-states in the process of globalization, and to emphasize the importance of cooperation due to insufficient state-alone solutions to new security problems.

Modern devletin vazgeçilmez unsurlarından biri olan egemenlik anlayışı önemli bir dönüşüme uğramıştır. Bugün Jean Bodin'in kurumsallaştırdığı; mutlak, bölünemez ve sürekli olarak nitelendirilen klasik egemenlik anlayışından bahsetmemiz mümkün değildir. Klasik egemenlik anlayışının geçirdiği dönüşümün çeşitli sebepleri bulunmaktadır. Bu sebepleri hukuk devleti, insan hakları, kuvvetler ayrılığı prensibi ve uluslararası kuruluşlar olarak ifade etmemiz mümkündür. Özellikle Birinci ve İkinci Dünya Savaşı sonrasında ortaya çıkan uluslararası kuruluşlar devletlerin egemenliğine müdahale konusunda oldukça dikkat çekicidir. Egemenlik anlayışının geçirdiği bu dönüşüm sırasında dünya birçok katliama ve savaşlara tanıklık etmiştir. Bu doğrultuda da önce ad hoc mahkemeler kurulmuş ardından da Uluslararası Ceza Mahkemesi'nin kuruluşuna giden süreç başlamıştır. 17 Temmuz 1998 tarihinde kabul edilip, 1 Temmuz 2002'de yürürlüğe giren Roma Statüsü ile de Uluslararası Ceza Mahkemesi kurulmuştur. Devlet egemenliğine önemli bir müdahale anlamına gelen Uluslararası Ceza Mahkemesi'nin yargılama yetkisi konusunda tamamlayıcılık ilkesinin kabul edilmesiyle, devlet egemenliğine yapılan müdahalenin daha aza indirgenmesi amaçlanmıştır. Aynı zamanda da Statü'ye taraf olacak devlet sayısını arttırmak amaçlanmıştır. ; Our understanding of sovereignty, which is one of the essential factors of modern state, has undergone a significant transformation in time. Today, it is impossible to mention a classical understanding of sovereignty which was institutionalized by Jean Bodin as; absolute, indivisible and perdurable. There are various reasons that caused the transformation of classical sovereignty; it can be said that these reasons are constitutional state, human rights, principle of separation of powers and international organizations. The international organizations, especially established after the First and Second World Wars, are quite significant instruments in the process of intervening to the sovereignty of states. During the transformation of understanding of sovereignty, the world had witnessed numerous massacres and wars. In this respect, firstly ad hoc tribunals had been established, after that the process towards the establishment of International Criminal Court started. International Criminal Court was established with Rome Statute which was acknowledged on July, 17, 1988 and inured on July, 1, 2002. Through the acceptance of complementarity principle in terms of International Criminal Court's jurisdiction, it is intended to minimize the intervention to the sovereignty of states. Also, it is aimed to increase the number of states parties to the Statute.

The Westphalian system refers to the shifting of the supreme political authority from medieval practices to modern sovereign states and related concepts such as sovereignty, non-intervention, and international law. While the system has shaped the Western political environment since 1648, it has in fact not been validated for the rest of the world. In this paper, the idea that the Westphalian system has not opened a new avenue in the discipline of International Relations is exemplified by the case of the British occupation of the Mosul Vilayet. Contrary to the terms of the Mudros Armistice and Woodrow Wilson's Fourteen Points, the British illegally occupied Mosul. The occupation was a clear violation of the Westphalian principles and thus the British mandate regime encountered resistance from both the Ottoman Empire and further the Republic of Türkiye. Despite all resistance, Mosul was ceded to the Iraqi government under the British mandate after the war.

ÖZET Bu çalışmanın temel amacı Türkiye-AB ilişkilerinde egemenlik sorunu konusunda, uluslararası ilişkiler bağlamında, tarihî gelişim içerisinde teorik tartışmalar yapmaktır. Egemenlik, ulus devlet siyasasının iç ve dış ilişkilerini, ekonomik, hukuki ve sosyal düzenini şekillendiren bir normdur. Egemenlik, ulus devlet sonrası süreçte, ulusüstü AB yapılanmasıyla da gündeme gelmiştir.Egemenlik kavramının teorik olarak çeşitli tanımları yapılmıştır. Westphalia sonrası ortaya çıkan egemen Avrupa devlet sisteminin hukuki, siyasal, ekonomik ve sosyal yapısı, egemenlik boyutunda incelenmiştir. Modern uluslararası ilişkilerin gelişiminde önemli bir yer tutan egemenlik, Avrupa ulus devletler düzenini kuran önemli siyasi olay ve gelişmeler de tartışılır.Savaş sonrası Avrupa'sında Westphalia egemen ulus devlet sisteminin yerini almakta olan AB; siyasal, ekonomik ve sosyal açıdan egemenlik bağlamında ele alınır. Ekonomik entegrasyon, siyasal birlik, ulusal egemenlik, federalizm, konfederalizm vb. AB'yi betimleyen siyasaların egemenlik söylemi vurgulanır. Ayrıca AB kurumlarının tarihî gelişimi, anayasal yapılanma ve egemenlik tartışmalarını sürdürür. Türkiye'nin egemenlik anlayışı tarihî gelişim içinde ele alınmıştır. Türkiye, Kurtuluş Savaşı'yla birlikte, Batılılaşmak ve çağdaşlaşmak, muasır medeniyet seviyesine ulaşmak için siyasal, ekonomik ve kültürel reformlar yaparak Avrupa modern egemen ulus devlet sistemine geçmiştir. Türkiye, geleneksel toplum yapısını modern, seküler, çağdaş, homojen bir ulus devlet siyasasına dönüştürürken; etnik, dinî, bölgesel ve ideolojik temelli sorunlar da ortaya çıkar. Türkiye'de siyasal iktidarı ele geçiren partilerin iktidarları süresince kendi çoğunlukçu ve fraksiyoncu millî egemenlik anlayışına, Rousseau'cu anlamda genel iradeyi temsil ettiğini düşünerek, Hobbes'cu mutlak devlet egemenliğini topluma ulusal egemenlik anlayışı gibi sunması bu partilerin Lock'cu anlamda demokratik, sivil, sınırlı ve çoğulcu bir toplumsal egemenlik anlayışını yansıtmasına engel olmaktadır. Dolayısıyla, Türkiye'nin siyasal sisteminin demokratik süreci darbeli olmakta, jeopolitik konumu da istikrarsızlığı kolaylaştırmaktadır.Türkiye AB ilişkilerinde egemenlik bağlamında; siyasal, ekonomik, sosyal, hukuk ve güvenlik sorunları vardır. Türkiye, AB'ye tam üyelik sürecinde, AB üyelerinden ve aday ülkelerden farklı olarak kendine has güçlü bir ulus devlet egemenlik kurgusuna sahiptir. Bu güçlü devlet egemenliği anlayışı; jeopolitik, siyasi, ekonomik, sosyal ve kültürel açıdan Türkiye'nin-AB ile ortak bir egemenlik inşasını, paylaşımını, transferini güçleştirmektedir. ABSTRACTThe basic purpose of this dissertation is to discuss the sovereignty matter, between Turkey and European Union relations within theoretical framework of the International relations discipline in the process of historical context. The sovereignty is a norm which shapes the polity of the nation state in terms of its internal, external relations, economy, politic, legal and social order. But, by the post-nation state process, supranational EU structure also brought that issue back into agenda.There has been done various theoretical definitions of the sovereignty notions. After the Westphalia there emerged the sovereign European state system which has political, economical, legal and social order, had been analysied within the sovereignty perspectives. The sovereignty which developed the modern international relations by constructing modern nation state order, also comprises the important political aspects of the European historical events, too. In the postwar Europe, the EU replaces the Westphalian sovereign nation state system by political, economical, legal and social direction in the context of sovereignty dimension. To explicate the sovereignty expression of the EU's polity, it also confines economic integration, political union, national sovereignty, federalizm, confederalizm, regionalism, transtate alternative variations. Moreover, the EU institutions' historical imrovements contributes in sovereignty issue in the extent of constitutionalization, democracy, legitimacy, authority and responsibility.Turkey's sovereignty comprehension, are investigated in the historical content. By the Independence War, Turkey aimed to adopt European sovereign nation state system by realizing political, economic, legal and cultural reforms in the name of westernization, civilization and modernization.Turkey transformed successfully its traditional social structure into modern, secular, contemporaneous, homojen republican sovereign nation state polity; Though it encountered with ethnic, religious, regional and ideological resistances. Whereas, Turkey experiences with some difficulties of the multiparty system in the process of democratization in which parties forms the government impose its majoritarian sovereign perceptions. In addition, they implement or introduce their sovereignty conception as Rousseau's "general will" in the sense of Hobbes' absolute state sovereignty so as to national sovereignty rules over society. Thus, this type of conception prevents the government from applying, limited, civil, democratic, pluralist social sovereignty principles in the logic of Locke. In a nutshell, Turkey's democratic process is interrupted oftenly and geopolitical power structures also leads to instability.There are some problematic issues. Those are politic, economic, legal, social and security matters in the context of sovereignty, between Turkey-EU relations.Turkey owns a very strong nation state sovereignty script, in the process of fullmembership into EU, apart from the EU members and other candidate countries. Eventhough there are various geopolitical order alternatives, quests and troubles; Turkey that conciously tries to overcome those barriers one by one so as to share sovereignty with the EU.Keywords: Sovereignty, Nation State, Federalizm, System of States, European Union, Turkey.

Devletin çok eski çağlardan günümüze kadar çeşitli şekillerde ortaya çıktığı bilinmektedir. Tarih boyunca ?devlet?i tanımlama çabası, siyasi düşünürlerin temel uğraşlarından biri olmuştur. Günümüz devlet anlayışının temelleri 1648 Westphalia Barışı ile ortaya çıkmıştır. Bu tarihten günümüze devletin ne olduğu sorusu ve günümüzdeki anlamıyla ulus-devleti oluşturan unsurların neler olması gerektiği üzerinde çeşitli görüşler ortaya atılmıştır. Devletlerin sayısal olarak Westphalia Barışı'ndan bu yana artış gösterdiği bilinmektedir. Özellikle 20. yüzyıl bu artışın en çok görüldüğü dönem olmuştur. Bu dönemin başında imparatorlukların dağılması sonucu devlet sayısında önemli atışlar meydana gelmiş, 1945 yılından Soğuk Savaş'ın bitimine kadar olan dönemde ise dekolonizasyon süreci ile birlikte uluslararası sistemde devlet sayısı hızla artmıştır. Soğuk Savaş'ın sona ermesinin ardından sosyalist değerlerin dünyadaki prestijinin sarsılmasıyla birlikte bu savaştan galip çıkan liberal dünya değerleri uluslararası sistemin yapısını kökten değiştirmiştir. Demokrasi, insan hakları, liberal ekonomi politikaları artık hemen hemen tüm devletler tarafından olmazsa olmazlar arasına girmiştir. Soğuk Savaş sonrası totaliter ve sosyalist rejimlerin istenmediği ve bu gibi yönetimlerin devlet olma arzularının uluslararası toplum tarafından kabul görmediğini söyleyebiliriz. Yugoslavya farklı etnik kökenden halkları barındıran yapısıyla, Soğuk Savaş sonrası gelişmeler ve milliyetçi akımların tekrar yükselişe geçmesiyle birlikte parçalanarak uluslararası sistemde yeni devletlerin ortaya çıkmasına neden olmuştur. Soğuk Savaş'ın galibi Batı, sosyalist rejimlerin yerine liberal değerleri benimsemiş rejimleri destekleyerek bu parçalanmaya katkıda bulunmuştur. Kosova'nın Yugoslavya'yı oluşturan diğer devletler gibi bağımsızlık yönündeki talebine Yugoslavya içindeki özel durum ileri sürülerek reddedilmiş ve uzun süre Kosova bağımsızlığını elde edememiştir. Kosova'nın 18 Şubat 2008 tarihinde Sırbistan'dan tek taraflı bağımsızlık ilanının ardından Soğuk Savaş sonrası devletlerin hangi şartlarda ortaya çıktığı tekrar sorgulanmaya başlanmıştır. ; States are known to have occurred in various sorts since prehistoric times. Throughout the history, defining what state is has been one of the chief concerns of political philosophers. The fundamentals of today?s understanding of what state is dates back Westphalia Treaty in 1648. Since then, there have been several speculations over the question of what the state is and what the components of a nation-state should be. It is known that the number of states has increased since Westphalia Treaty. Particularly, this increase was seen in the period of the 20th century. At the beginning of this period, the number of states increased because of the collapse of empires, and in the period from 1945 onwards until the end of cold war, the number of states in international system increased dramatically within decolonization period. Following the cold war period with the collapse of the prestige of the socialist values in the world, liberal victorious war leaders of the world fundamentally changed the structure of international system. Democracy, human rights, liberal economic policies in almost all states by now had become the sine qua non. We can say that totalitarian and socialist regimes were not desired and that the desires of such governments were not accepted by international communities. With a structure of having peoples from different ethnic origins, Yugoslavia caused new states to emerge in international system because of the developments in postwar period and the rise of nationalist movements. West, the winner of the cold war, adopted the liberal values instead of the socialist regimes, contributing to this fragmentation by supporting them. Kosovo?s demand for independence like other states constituting Yugoslavia was rejected due to the claims that it had special status in Yugoslavia, and thus Kosovo was not able to declare its independence for a long time. Çalışmamızın ilk bölümünde öncelikle kavramın ortaya çıkış süreci ve tanım sorunu analiz edilmiştir. İkinci bölümde, kavrama yön veren düşünürlere yer verilmiş; kavramı ilk defa ortaya çıkaran Machiavelli, kavramsallaştıran Bodin, ve kavramı sözleşme ile irtibatlandıran Hobbes incelenmiştir. Bu süreçte sınırsız egemenlik anlayışının sınırlandırılması yönünde fikirleriyle John Locke, Montesqueiu, Benjamin Constant ve John Stuart Mill analiz edilmiştir. Rousseau ile beraber kavram demokratik bir şekle bürünmüş, buna bağlı olarak da Milli İrade ve Milli Egemenlik kavramları üzerinde durulmuş, kavramlara yönelik eleştiriler çerçevesinde Duguit'nin görüşlerine ve doktrinde ifade edilen muhtelif görüşlere yer verilmiştir. Liberal Demokrasi ve Hukuk Devleti kavramları karşısında Milli İrade ve Milli Egemenlik Doktrininin konumu araştırılmıştır. Daha sonra Egemenliğin bölünmesi sorunu incelenmiş ve bu kapsamda Federal Devlet'in konumu irdelenmiştir. Üçüncü bölümde Carl Schmitt'in egemenlik kuramı kendisine kadar geliştirilmiş görüşler karşısında eleştirileri dikkate alınarak ortaya konulmuş ve bu çerçevede özellikle Schmitt'in "Siyasi İlahiyat: Egemenlik Hakkında Dört Bölüm" adlı eserinden yola çıkılarak yorumları ve değerlendirmeleri tartışılmıştır. Nitekim Schmitt, egemenin verili şartlar içerisinde, mesela milli iradenin temsil yoluyla etkin olduğu demokratik toplumlarda, karar (entscheidung) merciinin ne veya kim olacağının önceden belirlenemeyecek bir tarzda etkin olduğunu savunmuştur. Son bölümde ise Schmitt'in kuramına doktrinde yöneltilen eleştirilere yer verilmiştir. In the first part of this study, the occurance of Sovereignty and the problem of definition is analyzed. In the second part, the thinkers which gave direction to the concept will be stated in; Machiavelli, who discovered the concept, Bodin, who conceptualizated, and Hobbes, who added a contract connection to the concept. In this process, the ideas of John Locke, Montesquieu, Benjamin Constant and John Stuart Mill were analyzed with their thoughts on limiting of the unlimited Sovereignty. With Rousseau, souvereignty turned into a democratic shape, so we accordingly emphasized his thoughts on the concept of National Will and National Sovereignty, and in the frame of the critics against those concepts, the opinions of Duguit and the various critics from doctrine have been shown. The doctrines of National Will and National Sovereignty have been investigated in the face of the concepts of Liberal Democracy and Constitutional State. Then, the problem of the division of Sovereignty will be examined and in this context, the position of the Federal State discussed. In the third part, Schmitt's theory on Sovereignty has been discussed especially within his Work "Political Theology: Four Chapters on the Concept of Sovereignty", against the opinions to the concept which developed until his time. Schmitt indeed, argued that a decision (entscheidung) authority could not be predetermined, for example in the democratic sociaties which their national will are represented, it is not possible to foresee the limits and the frame of the Sovereign. On the fourth and the last part, various critics from doctrine against Schmitt have been discussed.

Tarihte devlet kavramı toprak parçası üzerinde egemenliği ifade etmiştir. Tarihler boyunca insanların sahip oldukları bencil duygular toplumları güç savaşına itmiş, ihtiyaç duyulan gücü ve toprak parçasını elinde bulundurmak isteyen toplumlar devleti kurmuştur. Devlet, belli bir toprak parçasında egemenlik sağlamış toplumların üstün güç olmak için insan, ülke ve egemenlik unsurlarının birleşmesinden oluşmuştur. Hukuk kurallarının belirlenmesiyle de kurulmuş olan devlet kendine kimlik kazanmıştır. Devletler tüzel kişilik kazanmaları ile hiçbir devletin müdahalesine uğramadan kendi belirlemiş olduğu kurallar ile sürekliliklerini sağlamıştır. Modern devlete can veren egemenlik anlayışının temelleri ise ortaçağ ve yeniçağın başlarında atılmış ve egemenliğin oluşmasına neden olan birçok tarihsel olayı içine almıştır. Toplumlar devlet kavramı etrafında oluşan zıt teoriler ve değişik ideolojileri tasvir eden filozoflar sayesinde devlet kavramı gerçekleştirmek istedikleri amaca ulaşmak için bir araç olarak değerlendirmiştir. Farklı siyasal felsefe akımlarına sahip olan filozoflar savundukları görüşler bakımından zıtlıkların oluşmasını sağlamıştır. Bu sebeple devletlerin siyasi, ekonomik ve hukuk sistemlerinde farklılıklar ortaya çıkmıştır. Sonuç olarak devletler, devletsiz toplumlardan kent devletlerine, imparatorluklardan modern devlet anlayışına, gelişen siyasal iktidarlara ve devletlerin ulusal üstünlüğüne doğru iktidar yapılanmaları açısından tarihsel değişim ve gelişimlere sahip olmuştur. Devletlerin egemenlik açısından gelişimi ele alındığında da siyasi iktidarın sahip oldukları meşrutiyet ideolojisinden teokratik meşruluğa ve ondanda demokratik meşruluğa yönelen bir değişimlere sahip olmuştur. Bu da devletlerin eski varlıklarını tüm değişimlere uyum sağlayarak varlıklarını devam ettirdiğini göstermiştir. Böylece devlet gücü oluşmuş ve sınırlı egemenlik anlayışı uygulanmasıyla toplumların hakları devlet içinde korunmuş devletler üstün konumları sayesinde varlıklarında güçlü hale getirilmiştir. ; The consept of State expresses the sovereignty on piece of land in the past. Self- centeredness of people causes power struggle throughout history and the societies wishing to have the power and the piece of land establish a state. The State consists of human, country and sovereignty of people who to be a superior power on a certain piece of land. The State has gained an identity by determining the rules of law. Thanks to the legal entity, the States have maintained their continuity by their own rules without any state invervention. The basis of the concept of sovereignty that ensouls the modern state was founnded at the beginning of the middle age and the new age and covered many historical events that led to the formation of sovereignty. The societies have evaluated the consept of State as a means to achieve their wishings thanks to the philosophers describing the contradictory theories and the dfferent ideologies related to this concept. The philosophers who have different Political philosophical movements create opposing views about the State. Therefore, there are differences in the Political, economic and legal systems of the States. Consequently, the States have historical developments with regard to the power structures towards the Political power and the national state supremacy from the societies to the city states, from the emprires to the sense of modern state. When the development of State in terms of sovereignty is taken into consideration, it is seen that the consitutional monarchy of Political Powers changes from theocratical to democratic legitimacy. This situation indicates that the states continue thir existences by adapting to the new developments. Thus, the state has power and the application of the concept of limited sovereignty cause to protect the right of societies within the state and the states have gained strength by their superior positions.

"Avrupa güvenlik ve savunma politikası ve Türkiye" başlıklı bu tez çalışması, üç bölümden oluşmaktadır. Tezin ilk bölümünde, çalışmaya kuramsal bir çerçeve kazandırabilmek için baz alman "egemenlik teorileri" ve bu bağlamda "Avrupa Güvenlik ve Savunma Politikası"nın hali hazırdaki yapısında büyük bir rol oynadığmı düşündüğümüz Avrupa'da egemenlik kavramının gelişimi ile Avrupa Birliği (ve dolayısıyla Avrupa Toplulukları) örneğinde egemenlik kavramı analiz edilmiştir. Çalışmamızın bütünlüğü dikkate alınarak, bu bölümde ayrıca, Türk hukuk sisteminde "millî egemenlik ilkesi"nin tarihsel gelişimi ve önemi ile 1982 Anayasası'nm ilgili düzenlemeleri itibarıyla egemenlik yetkilerimizin Avrupa Birliği'ne (ve dolayısıyla Avrupa Topluluklarına) devri sorunu da irdelenmeye çalışılmıştır. Çalışmamızın ikinci bölümünde ise, Avrupa Güvenlik ve Savunma Politikası'nın oluşum süreci iki alt kısım dahilinde incelenmiştir. Bu kısımların ilkinde, Avrupa'da güvenlik, savunma ve dış politika alanlarında işbirliği oluşturma çabalarının tarihsel gelişimi ele alınırken, ikinci kısımda da Ortak Dış Politika ve Güvenlik Politikası'nın ve Avrupa Güvenlik ve Savunma Politikası'nın IIyapısı, Avrupa Birliği Kurucu Andlaşması'nın ilgili düzenlemeleri dikkate alınarak aktarılmaya çalışılmıştır. Üçüncü ve son bölümde ise Türkiye-Avrupa Toplulukları ve dolayısıyla Avrupa Birliği ilişkilerinin tarihsel gelişimi ana hatlarıyla aktarıldıktan sonra, Türkiye'nin güvenlik ve savunma stratejilerinde Avrupa Birliği'nin konumu ve Avrupa Güvenlik ve Savunma Politikası'nın Türkiye - Avrupa Birliği ilişkilerine etkileri araştırılmaya çalışılmıştır. Ana hatlarıyla yukarıda belirttiğimiz bu plan kapsamında çalışmamızda temel tez olarak ise, birinci bölümünde değinilen egemenlik teorileri ile ikinci ve üçüncü bölümlerde aktarılan tarihsel süreçler ışığında Avrupa Güvenlik ve Savunma Politikası'nın, Avrupa Birliği üyesi Devletler arasında bir uzlaşma olmamasından dolayı yakın bir gelecekte, etkin bir biçimde uygulanmasının mümkün olmadığı savunulurken, bu politikanın, Türkiye-Avrupa Birliği ilişkilerinde yarattığı / yaratabileceği sonuçlar da irdelenmiştir. ; This Ph.D thesis, named "The European security and defence policy and Turkey", has been consisted of three chapters. In first chapter, because of playing an important role in Europe and creating great effects on the European Security and Defence Policy; concept of sovereignty and sovereignty theories have been examined in the example of the European Union (European Communities). Also, the concept and the relevant theories provide a theoritical framework in order to explain and analyse this political and juristical process. Historical improvement and importance of "national sovereignty" and issue of to transfer some of sovereignty powers from Turkey to the Union according to Turkish Constitution (1982), have been discussed in the first chapter. In the second chapter, progress of the European Security and Defence Policy has been discussed in two subchapters. In the first of the subchapters, historical developments and engagements considering to built a cooperation in the fields of security, defence and foreign policies in Europe, have been analysed. In the second subchapter; structures of the Common Foreign and Security Policy and also the European Security and Defence Policy have been studied in the perspective of regulations of the European Union Treaty. IVIn the third chapter, historical process of Turkey and the European Union relations have been examined. Finally effects of the Europen Security and Defence Policy on relations between Turkey and the European Union have been analysed by searching the positon of the European Union and its policies in Turkey's security and defence strategies. According to this scheme in the perspective of sovereignty theories and historical processes, it has been basic assertion in the thesis that due to there is no full comprimise among member states of the European Union, the European Security and Defence Policy can not be executed effectively in near future.

Devletin üzerinde tam ve mutlak hâkimiyeti olduğu ülke topraklarından ayrı tutulan insanların, salt egemenliğin bir parçası olmayacağı anlayışı uluslararası antlaşmalar ile geliştirilmiştir. Üç aşamalı bir yapı üzerine kurulu bu sorumluluk "insani müdahale" gibi zorlayıcı tedbirleri içermekte, "insani müdahale"den farklı olarak "önleyici diplomasi" ve "yeniden inşa" sorumluluklarını da uluslararası topluma yüklemektedir.Koruma sorumluluğunun varlığının kabul edilmesiyle birlikte, uluslararası barış ve güvenliği sağlama konusunda birincil derecede yetkili uluslararası aktör olan Birleşmiş Milletler Güvenlik Konseyi'nin norm uygulayıcısı olarak uluslararası barış ve güvenliğin tehdidi dışında bir sebeple ilgili devletin rızası olmadan egemenliğine müdahale etme yetkisinin olduğu kabul edilmiştir. Ancak normun uygulaması aşamasında üç sütunlu yapıda öngörülen sıraya riayet edilmemesi, müdahalenin insani koruma amacı dışında doğrudan bir devletin siyasi bütünlüğüne ve bağımsızlığına müdahale şeklinde gerçekleşmesi, müdahalenin son çare olması ilkesine uyulmaması ve uygulamadaki istikrarsızlık normun gelişimini sekteye uğratmıştır. Bu çalışmada, uluslararası toplumun koruma sorumluluğu adı altında ilk zorlayıcı müdahalesi olma özelliğine sahip olan Libya müdahalesi ile benzer iç çatışmalara sahne olan Suriye hakkında Güvenlik Konseyi'nin 2011'den günümüze almış olduğu kararların nitel içerik analizi yapılmıştır. Bu analiz sayesinde koruma sorumluluğu normunun uygulanış şekli, uluslararası hukuk normlarına uygunluğu, uluslararası pratiğin tutarsızlığının nedenleri ve küresel sistem düzeyinde P5'in aralarındaki güç ilişkilerinin normun uygulanmasına yansıması irdelenmiştir. Sonuç olarak bir devlette insani krizin ortaya çıktığı olaylarda yetkili otorite tarafından yapılacak olası bir müdahalenin amacının "norm mu? egemenlik mi?" olduğu sorunsalı uluslararası ilişkiler teorileri ve uluslararası hukuk kuralları çerçevesinde değerlendirilmiştir. ; There is a lack of responsibility for sovereignty when states cannot protect their citizens against genocide, war crimes, crimes against humanity and ethnic cleansing, or are reluctant to protect them or use violence against their own citizens. With the emergence of this concept of open responsibility for protection, it has been tried to be closed by giving the intervention authority to the international community. The concept of sovereignty has been replaced by the concept of sovereignty as responsibility where the population has suffered serious damage as a result of civil war, rebellion, repression or failure of the state and the government has failed to control the situation. The understanding that the people who are separated from the territory of the country where the state has full and absolute sovereignty will not be a part of pure sovereignty has been developed by international treaties. This responsibility, which is based on a three-stage structure, includes coercive measures such as humanitarian intervention, and, unlike "humanitarian intervention" imposes"preventive diplomacy"and" reconstruction "responsibilities on the international community. With the recognition of the responsibility of protection, international peace and security As the norm enforcer of the United Nations Security Council, which is the primary international actor competent to provide, it is recognized that it has the authority to intervene in the sovereignty of the state without the consent of the relevant state for a reason other than the threat of international peace and security. However, failure to comply with the order envisaged in the three-pillar structure during the implementation of the norm, the fact that the intervention took place in the form of an intervention directly to the political integrity and independence of a state other than the purpose of human protection, the non-compliance with the principle of being the last resort of the intervention and the instability in practice interrupted the development of the norm. In this study, the qualitative content analysis of the decisions taken by the Security Council since 2011, which has witnessed similar internal conflicts with the Libya intervention, which is the first coercive intervention under the name of protection responsibility of the international community, has been conducted. With this analysis, the application of protection responsibility norm, compliance with international norms of law, the reasons of inconsistency of international practice and the reflection of the power relations between P5 on the implementation of the norm at global system level were examined. As a result, the question of whether a possible intervention by the competent authority in the events of humanitarian crisis in a state is 'norm or sovereignty? It has been evaluated within the framework of international relations theories and international law rules.
