Verfahren über Immaterialgüterrechte werden oft in mehreren Staaten parallel geführt. Es besteht deshalb die Gefahr, dass Gerichte im Wesentlichen gleiche Rechtsfragen unterschiedlich beurteilen und somit widersprüchliche Entscheidungen fällen. In einer kritischen Würdigung der Brüssel-Ia-Verordnung, der CLIP-Principles und der ALI-Principles analysiert die Autorin, wie Verfahren nach diesen Regelwerken durch Verfahrensabweisung und -aussetzung koordiniert werden. Dem stellt sie die Forderung nach einer stärkeren Kooperation zwischen Gerichten gegenüber. Hierzu systematisiert die Autorin verschiedene Formen der zwischengerichtlichen Kooperation und untersucht, inwieweit diese geeignet sind, den internationalen Entscheidungseinklang zu fördern und gleichzeitig die Souveränitätsinteressen der betroffenen Staaten sowie die Verfahrensgrundrechte der Parteien zu wahren. Der Kooperation stehen allerdings rechtliche und praktische Schwierigkeiten entgegen, die die Autorin ebenfalls aufzeigt. »Coordination of Proceedings in Transnational Legal Disputes on Intellectual Property Rights« The author demonstrates how parallel proceedings on intellectual property rights in different countries can be coordinated under the Brussels Recast Regulation, the CLIP-Principles, and the ALI-Principles. Further, she proposes intensifying transnational cooperation between courts. She argues that such cooperation can enhance international consistency of judgments, while maintaining the national sovereignty interests and the fundamental procedural rights of the parties. Die Autorin zeigt auf, wie parallele Verfahren über Immaterialgüterrechte in unterschiedlichen Staaten nach der Brüssel-Ia-Verordnung, den CLIP-Principles und den ALI-Principles koordiniert werden. Darüber hinaus fordert sie eine verstärkte transnationale zwischengerichtliche Kooperation. Sie argumentiert, dass diese geeignet ist, den internationalen Entscheidungseinklang zu fördern und gleichzeitig die nationalen Souveränitätsinteressen und die Verfahrensgrundrechte der Parteien zu wahren. Anja Becker studierte Rechtswissenschaften in Frankfurt am Main und Gainesville/Florida (USA). Nach dem ersten juristischen Staatsexamen promovierte sie an der Goethe-Universität Frankfurt am Main bei Herrn Professor Dr. Alexander Peukert. Dabei wurde sie als Stipendiatin des Exzellenzclusters »Die Herausbildung normativer Ordnungen« gefördert. Ihre Dissertation wurde mit dem Baker & McKenzie-Preis 2015 ausgezeichnet. Den juristischen Vorbereitungsdienst im OLG-Bezirk Frankfurt am Main schloss sie im Jahr 2014 mit dem zweiten juristischen Staatsexamen ab. Seitdem ist sie als Rechtsanwältin in einer internationalen Wirtschaftskanzlei im Bereich Prozessführung tätig.

"This volume traces the life, thought and work of Ralph Waldo Emerson, a giant of American intellectual history, whose transforming ideas greatly strengthened the two leading reform issues of his day: abolition and women's rights. A broad and deep, yet cautious revolutionary, he spoke about a spectrum of inner and outer realities—personal, philosophical, theological and cultural—all of which gave his mid-career turn to political and social issues their immediate and lasting power. This multi-authored study frankly explores Emerson's private prejudices against blacks and women while he also publicly championed their causes. Such a juxtaposition freshly charts the evolution of Emerson's slow but steady application of his early neo-idealism to emancipating blacks and freeing women from social bondage. His shift from philosopher to active reformer had lasting effects not only in America but also abroad.
In the U.S. Emerson influenced such diverse figures as Thoreau, Whitman, Dickinson and William James and in Europe Mickiewicz, Wilde, Kipling, Nietzsche, and Camus in Europe as well as many leading followers in India and Japan. The book includes over 170 illustrations, among them eight custom-made maps of Emerson's haunts and wide-ranging lecture itineraries as well as a new four-part chronology of his life placed alongside both national and international events as well as major inventions.

Purpose: The purpose of this study is to investigate the extent to which male and female leaders report engaging in participative versus directive intellectually stimulating transformational leadership behaviour across three different contexts (business, government and military). Design/methodology/approach: Semi-structured interviews were conducted with 64 senior leaders (29 female and 35 male) across Canada. Findings: Leaders were more likely to describe using a participative versus directive approach to intellectual stimulation. Gender similarities and differences also appeared across contexts: government leaders reported almost twice as many directive examples as business leaders, and men and women in both of these contexts were very similar in their reports about how they enacted intellectual stimulation. In contrast, men and women in the military diverged, with male leaders reporting more participative behaviour than female leaders. Research limitations/implications: This study extends the leadership literature through an integration of participative and directive leadership theory with transformational leadership theory. Sample size and self-report data are possible limitations. Practical implications: Findings provide insight into the behaviours leaders engage in to enhance creative thinking and problem solving within organizations across different contexts and suggests that this aspect of transformational leadership is most likely to be enacted in a participative way by both male and female leaders. Originality/value: This is one of the first studies to empirically investigate participative versus directive transformational leadership behaviour. Gender differences between contexts are worthy of further study, specifically regarding the implications of these findings for female leaders' promotion and career progression.

Magazines with a political orientation have become a source for understanding intellectual history, they continent as much the development of certain ideologies as the networks built over time and space. With the enlightened spirit that distinguishes it, the Marxist left found in these publications a means to understand its reality and also to intervene in it. Intellectual intervention exceeded its immediate frameworks of action and projected knowledge about other realities, while accumulating specific knowledge about certain geographic areas. In this work, the place occupied by Latin American societies will be outlined in a recognized magazine of the United States: Monthly Review. This will allow us to understand the main anchor points, debates and authors that circulated through its pages ; Las revistas con una orientación política se han convertido en una fuente para comprender la historia intelectual, ellas continente tanto el desarrollo de ciertas ideologías como las redes construidas a lo largo del tiempo y el espacio. Con el espíritu ilustrado que le distingue, la izquierda marxista encontró en dichas publicaciones un medio para comprender su realidad y también para intervenir en ella. La intervención intelectual superaba sus marcos de acción inmediatos y proyectaba un conocimiento sobre otras realidades, al tiempo que acumulaba un saber específico sobre ciertas áreas geográficas. This paper explores the problem of the structure of General Intellect, the theory of which is developing in the post-operaismo intellectual movement. In this paper General Intellect is analysed as a property of a social connection structure, named here as heterarchy. As connection structure heterarchy forms different kinds of singularities: aggregations made by statistical repetitions of relations and individual egos making values through their goal setting and other intellectual activity. The main argument of the article is that although to some extent General Intellect may denote capacity for the self-organization of society, it is difficult to identify it with only one particular institutional organisation or political regime. General Intellect appears in any type of social structuring through self-organising processes.Key words: general intellect, heterarchy, singularity, complexity, aggregate, multitude. ; В статье исследуется проблема структуры общего интеллекта, теория которого развивается в интеллектуальном движении (пост)операизма. Общий интеллект анализируется в качестве свойства структуры социальных связей (соединений), названной здесь гетерархией. В качестве структуры связей гетерархия формирует различные виды сингулярностей: агрегаты (совокупности), производимые статистическими повторениями отношений, и индивидуальные эго, полагающие значения через постановку целей и другую интеллектуальную деятельность. Основной аргумент статьи заключается в том, что, хотя в некоторой степени общий интеллект может обозначать способность к самоорганизации общества, его трудно отождествить только с одной конкретной институциональной организацией или политическим режимом. Общий интеллект появляется в любом виде социального структурирования посредством процессов самоорганизации. Ключевые слова: общий интеллект, гетерархия, сложность, сингулярность, агрегат, множество.

This paper proposes a first analysis of an oral history survey conducted between 2009 and 2011 in the frame of the research program " Cooperation time in Maghreb ". The survey mainly consisted in about sixty filmed interviews, conducted with men and women trained in the disciplines of humanities and social sciences, former cooperants in higher education in the postcolonial Maghreb. The analysis aims at understanding how young intellectuals have combined scientific and activist commitments while confronting postcolonial transitions. At a more global level, it also allows to observe how the social sciences, at a time of intense intellectual ferment, have found their way into these transition process. ; Ce texte propose une première analyse transversale de l'enquête d'histoire orale menée entre 2009 et 2011 à l'occasion du programme " Le temps de la coopération au Maghreb ". Cette enquête consistait principalement en une soixantaine d'entretiens filmés en vidéo, réalisés auprès d'hommes et des femmes formés aux disciplines des sciences humaines et sociales, anciens coopérants dans l'enseignement supérieur, ou plus rarement secondaire, dans les pays du Maghreb. PurposeThe purpose of this paper is to provide a review of an analytic methodology (knowledge valuation analysis, i.e. KVA), based on complexity and information theory, that is capable of quantifying value creation by corporate intellectual capital. It aims to use a real‐world case to demonstrate this methodology within a consulting context.Design/methodology/approachThe fundamental assumptions and theoretical constructs underlying KVA are summarized. The history of the concept, a case application, limitations, and implications for the methodology are presented.FindingsAlthough well‐known financial analytic tools were used to justify IT investment proposals, none provided a satisfying result because none offered an unambiguous way to tie IT performance to value creation. KVA provided a means to count the amount of corporate knowledge, in equivalent units, required to produce the outputs of client core processes. This enabled stakeholders to assign revenue streams to IT, develop IT ROIs, and decide with clarity where to invest.Practical implicationsWhen stakeholders can assign revenue streams to sub‐corporate processes, they have a new context for making IC investment decisions. "Cost centers" and decisions based on cost containment can be replaced. Concepts such as a knowledge market, the knowledge asset pricing model, k‐betas, and a sub‐corporate equities market can be developed and applied. Some of the limitations related to real options analysis can be resolved.Originality/valueThis paper introduces an approach to measuring corporate intellectual capital that solves some long‐standing IC valuation problems.

Background  This paper describes a study of one aspect of the lives of mothers of children with intellectual disabilities. It focuses on their perspectives of their dealings with the professional and service worlds. Much attention has been given in recent years to developing and co‐ordinating a multiprofessional and multiagency network of support around families. Although such aims can be seen as beneficial for families, there is also good reason to expect these to present problematic experiences for family carers.Methods  Data are presented and analysed in this paper on mothers' perceptions of their dealings with professionals. The sample consisted of 30 mothers of young people with intellectual disabilities. The data were obtained by qualitative interviews.Results and discussion  Overall, the study confirmed that mothers' dealings with professionals were highly problematic for them. They felt that such encounters could be based upon conflict and that their worth and character as mothers were being continually scrutinized. However, the data show that mothers were willing to challenge professional perspectives of their children and their needs. They embraced advocacy for their sons and daughters as part‐and‐parcel of being a mother. However, in doing so, they were much more hesitant and reluctant to raise any needs and aspirations for their own lives. They fear that in giving these voice, they could be seen and typified as selfish mothers. That is, their struggles to be taken as advocates for their sons and daughters would be undermined. The implications of these findings for research and service development are discussed.

The purpose of the article. Since digital information and information technologies are significantly changing the activities of libraries, the purpose of the article is to explore new professional qualifications and competencies for those working in the field of digital curation and corresponding challenges for library and information education. The paper defines and describes digital curation as emerging field of theory and practice in the LIS (that includes digital preservation, data curation, and management of information assets over their lifecycle), the trends which are influencing its development. It analyses the genesis of the term and traditional libraries' roles relating to digital data and digital curation.
The methodology. The task was accomplished using theoretical and general scientific research methods, such as analysis, synthesis, induction and deduction, and specification. Equally significant was the method of comparison, with the help of which it was possible to compare the practice of applying digital curation in the leading countries of the world, in particular the USA, and Ukraine. The work also applies the method of abstraction used during the analysis of general theoretical approaches to digital curation as a new reality and social need.
The scientific novelty. The analysis and content of the concept of "digital curation", the history of its emergence, the main competencies for library specialists who can work in the field of digital curation, as well as the corresponding tasks of library and information education, including lifelong learning education. The article also synthesizes previous research in the area of digital curation and helps LIS scholars to understand the intellectual and practical framework and the importance of digital curation in adding value to all types of data.
The conclusions. The term "digital curation" is increasingly being used for the actions needed to add value to and maintain digital data over time for current and future generations of users. The generalization of existing research and practice that has developed in the world in the field of digital curation indicates the urgency of the need to create appropriate educational programs in library and information science in Ukraine (both within master's programs and in continuous formal and informal education). The need for qualified specialists in data curation is urgent now and will only grow over time. The training of such specialists is entirely within the competence of the library and information field. The results of the analysis indicate that activities in the field of digital curation are characterized by a complex interaction of various skills and knowledge. They lack attention in modern library and information education, including the understanding of these challenges, which provides a new point of reference for appropriate changes. The significant effort needs to be put into developing a persistent information infrastructure for digital data and into developing the digital curation skills of librarians and information professionals.

Kalman Silvert highlights the extraordinary career of an extraordinary man—one of the founding architects of Latin American studies in the United States, a major builder of the inter-American scholarly community, and an influential figure in US-Latin American relations. Thirteen distinguished Latin Americanists discuss Silvert's role as scholar, teacher, mentor, colleague, public intellectual, institution builder, and philanthropist. They also emphasize his contributions at the Ford Foundation, where he served as senior program adviser from 1967 until his death in 1976. Coeditors Abraham Lowenthal and Martin Weinstein frame the retrospective, underlining the integration of Silvert's multiple contributions and the continuing relevance of his legacy
