Community land trusts as a resistance instrument to neoliberal urban projects ; Os community land trusts como instrumento de resistência aos projetos urbanos neoliberais
Community Land Trusts are established models designed to protect the maintenance of vulnerable communities in certain territories. The figure emerges in the United States in the 1960s, tied to civil rights movements and the population living in rural areas. The present article will evaluate the potentialities and limits of the application of the Community Land Trusts instrument in Brazil as resistance and biopotent practice in an urban space marked by high percentages of irregularity and by a serious situation of socio-spatial inequality. In a context that worsens after the mega-events at the beginning of the second decade of the twenty-first century and with the democratic rupture and deepening of neoliberal logic in cities from 2016 onwards, it is necessary and urgent to establish new practices and forms of property management in a way to draw possible subversions to the logic of Power. CLTs are proposed here as a form of subversive legal practice, either from the defense of the design of a specific legislation on the subject, or by the use of existing legal instruments in order to base the creation of an emancipatory proprietary model. ; O Community Land Trust é um modelo estabelecido com vistas à proteção de permanência de comunidades vulneráveis. Ela surge nos Estados Unidos, na década de 1960, atrelada aos movimentos por direitos civis e à população residente em áreas rurais. Este artigo busca avaliar as potencialidades e os limites de sua aplicação no Brasil enquanto resistência e prática biopotente em um espaço urbano marcado por elevados percentuais de irregularidade e por uma grave situação de desigualdade socioespacial. Em um contexto que agrava após os megaeventos no início da segunda década do século XXI e com a ruptura democrática e o aprofundamento da lógica neoliberal nas cidades a partir de 2016, torna-se necessário e urgente o estabelecimento de novas práticas e formas de gestão da propriedade que desenhem possíveis subversões à lógica do Poder. Os Community Land Trusts são propostos aqui como forma de prática jurídica subversiva, seja a partir da defesa da necessidade de uma legislação própria sobre o tema, seja pela utilização dos instrumentos jurídicos já existentes de forma a basear a criação de um modelo proprietário emancipatório.

A generalização do uso de comunicações eletrónicas em todas as esferas das atividades humanas traz a necessidade de uma nova perspetiva legal. Esta necessidade é particularmente sentida a nível da União Europeia com o objetivo assumido de construir um mercado digital único e fiável. O Regulamento 910/2014 foi estabelecido como o principal quadro jurídico europeu destinado a harmonizar o entendimento de instrumentos como identificação eletrónica, autenticação eletrónica, serviços eletrónicos e também outros serviços de confiança da sociedade de informação, como selos eletrónicos, carimbos, serviços de entrega registrada eletrónica e autenticação de sites. No seu conjunto, o Regulamento 910/2014 visa estabelecer um quadro jurídico comum que permitisse aos cidadãos europeus tirarem pleno partido dos serviços digitais num ambiente técnica e juridicamente seguro. ; The generalization of the use of electronic communications in all spheres of human activities brings along a need for a new legal perspective. This need is particularly felt at European Union level with the assumed aim of building a trustable Digital Single Market. Regulation 910/2014 was set as the main European legal framework aimed at harmonizing the understanding of instruments such as electronic identification, electronic authentication, electronic services, and other trust services of information society, such as electronic seals, electronic time stamps, electronic registered delivery services and website authentication. In the whole, Regulation 910/2014 is intended to establish a common legal framework allowing European citizens to take full advantage of digital services in a technically and legally secure environment.

Who Do the Portuguese Trust? Government Communication Management in the Covid-19 Pandemic ; Em Quem Confiam os Portugueses? A Gestão da Comunicação Governamental na Pandemia Covid-19
Numa situação de emergência sanitária, o grau de cumprimento público das ordens governamentais das autoridades de saúde pode afetar grandemente o curso da pandemia. Partindo do pressuposto que o (in)cumprimento das recomendações das autoridades está diretamente ligado à confiança nas fontes de informação, neste artigo, discutimos o caso concreto da comunicação governamental de Portugal durante o início da segunda vaga da doença. No contexto de uma investigação internacional da rede European Public Relations Education and Research Association Com-Covid, foi aplicado um inquérito online a 460 cidadãos portugueses entre 7 de outubro e 11 de novembro de 2020. Para este trabalho analisamos uma secção do inquérito com questões relativas às fontes de informação que inspiram maior confiança junto da população portuguesa e à opinião dos portugueses sobre a gestão da comunicação do governo. Os inquéritos foram codificados e inseridos no software estatístico SPSS. O estudo concluiu que sobressai uma perceção positiva sobre a comunicação governamental entre os inquiridos, mas que os portugueses consideram os atores do campo da saúde fontes de informação mais confiáveis do que os media ou as autoridades governamentais. Em relação à questão de género, concluiu-se que as mulheres confiam mais no governo e que têm também melhor opinião sobre a comunicação das autoridades. No que concerne à idade, verificou-se serem os jovens quem mais confia nas autoridades e nos media, ao mesmo tempo que são os mais críticos do desempenho do governo na gestão comunicacional da crise. De maneira geral, os inquiridos demonstraram pouca confiança nas redes sociais digitais e nos influenciadores digitais como fonte de informação sobre a covid-19, sendo que quanto maior é o grau académico menor é a confiança dos inquiridos nos influencers e nas redes sociais digitais. ; In a health emergency situation, the degree of public compliance with orders from health authorities and governments can significantly affect the course of the pandemic. In general, respondents showed little confidence in digital social networks and digital influencers as a source of information about covid-19, and the higher the academic degree, the lesser confidence respondents have in influencers and digital social networks.

Resumo: Há um consenso no sentido de que a falta de moralidade degrada as atividades privadas e públicas e as desvia de seus reais objetivos. Os efeitos da falta de moralidade sobre os direitos fundamentais são ainda mais inaceitáveis e graves quando perpetrados por autoridades públicas. Os casos de desperdício de recursos minam a confiança e a eficiência do poder público. Além disso, a tolerância à corrupção desvirtua as regras da sociedade civil e a qualidade dos serviços públicos. Nesse sentido, o objetivo deste trabalho é destacar até que ponto a corrupção corrói os pilares da democracia, o princípio da solidariedade e a confiança nas instituições públicas. Os representantes do povo são, muitas vezes, capturados por interesses econômicos pouco transparentes e acabam deixando de atuar em favor do interesse público e da população. A corrupção no setor público representa um emblemático caso de tal desvio, implicando na quebra da confiança na administração pública. A sociedade civil tem um papel fundamental na luta contra a corrupção, consistente em monitorar as atividades públicas para denunciar maus feitos e desenvolver iniciativas para conscientização sobre as consequências causadas pelo mau uso dos recursos públicos. Desperdícios e corrupção quebram o vínculo da solidariedade entre o cidadão e a coesão social.Palavras-chave: corrupção; moralidade; direitos fundamentais; participação popular; solidariedade; transparência.CORRUPTION AS BETRAYAL OF TRUST IN PUBLIC ADMINISTRATION AND AS A VIOLATION OF FUNDAMENTAL RIGHTSAbstract: It is a commonly shared view that poor integrity undermines the main objectives of private and public activities and distracts from their main goals. The lack of integrity affects fundamental rights and is even more unacceptable and serious when perpetrated by public authorities. It causes a waste of resources and undermines the trust and effectiveness of public powers. Moreover, tolerance of corruption distorts the rules of civil society and the quality of services provided to citizens. This paper highlights to what extent corruption erodes the pillars of democracy, the solidarity principle and the trust in public institutions. The principle of solidarity provides that the citizens should assure loyalty to the members of a social body assuring social cohesion. The pillars of anticorruption should be the values of solidarity and social cohesion that hold citizens together in any legal system. Such principles should exclude any tolerance for corruption, as corruption undermines fundamental rights. People's representatives are all too often captured by non-transparent economic interests and divert the pursuit of public and citizens' interests. Corruption in the public sector represents an emblematic case of such diversion determining the betrayal of trust in public administration. Systemic corruption costs to the citizens and they pay it with lower-quality public services. In the past often stakeholders have been kept unaware of such distortions due to a lack of transparency, information asymmetries, or undeveloped competences. A wider transparency and the oversight by civil society might be extremely useful for ensuring that the public activities are correctly performed. Civil society has a key role to play in fighting corruption, from monitoring public activities to denounce bribery and raising awareness of the risks of wasting public money. A new emphasis on the accountability of politicians and of public officials, organizational design and social sanctions is needed. Wastes and corruption betray the links of solidarity among citizens and social cohesion. Los casos de despilfarro de recursos minan la confianza y la eficiencia del gobierno. Además, la tolerancia a la corrupción distorsiona las reglas de la sociedad civil y la calidad de los servicios públicos. En este sentido, el objetivo de este trabajo es resaltar hasta qué punto la corrupción erosiona los pilares de la democracia, el principio de solidaridad y confianza en las instituciones públicas. Los representantes del pueblo a menudo son capturados por intereses económicos no transparentes y terminan actuando en el interés público y la población. La corrupción en el sector público representa un caso emblemático de tal desviación, lo que implica un abuso de confianza en la administración pública. La sociedad civil tiene un papel fundamental en la lucha contra la corrupción, consistente en monitorear las actividades públicas para denunciar las malas acciones y desarrollar iniciativas de sensibilización sobre las consecuencias que genera el mal uso de los recursos públicos.
