The article considers the main innovations of current legislation concerning inventions and utility models. The conditions for granting legal protection of an invention (utility model), the procedure for filing and considering an application for an invention and a utility model, the application of «pre grant opposition» and «post grant opposition» procedures, and ways to protect patent rights are studied and analyzed. The author proves the importance of creating a national patent office (NIPO) in Ukraine. The article substantiates the need to adopt a separate law on NIPO instead of duplicating the rules on the legal status of NIPO, its structure, competence, etc. in several legislative acts. The author determines that the law eliminated the inaccuracy in the definition of a patent that certifies intellectual property rights to an invention and utility model, rather than ownership of them. This is fully consistent with the application of the theory of exclusive rights in the legislation of Ukraine on intellectual property. The article states that the law provides for only two types of patents (excluding secret and official inventions, utility models): a patent for an invention granted for 20 years based on the results of a qualifying examination, and a patent for a utility model granted for 10 years based on the results of a formal examination. The author notes that this patent by its legal nature remains declaratory, and it is granted under the responsibility of the applicant. The researcher proves the importance of legislative innovations, which eliminated the possibility of granting so-called «evergreen patents» (by improving the content of the inventive step as a condition of patentability). Проблеми реформування та розвитку житлово-комунального комплексу останнім часом набувають усе більшої актуальності. Кризовий стан ЖКГ обумовлений неефективністю системи управління, не адаптованої до ринкових умов господарювання. В умовах соціально-економічного реформування система управління ЖКГ регіонів України має забезпечити суттєве підвищення рівня ресурсозбереження за рахунок формування механізму управління цим процесом. Визначено специфіку реалізації загальних функцій управління у сфері житлово-комунального господарства. Обґрунтовано, що формування механізму управління ресурсозбереженням у ЖКГ об'єктивно вимагає реалізації комплексу спеціальних функцій управління: облік, стандартизація, правове забезпечення, інформаційне забезпечення. Обґрунтовано, що метою вдосконалення системи управління житлово-комунальним комплексом регіону стає формування механізму управління ресурсозбереженням. Він являє собою цілісну єдність функцій і інструментів управління, які за нових умов господарювання сприятимуть підвищенню комплексного регіонального ефекту ресурсозбереження. У статті визначено комплекс найважливіших проблем у ЖКГ, для вирішення яких регіональна система управління має об'єднати відомчі органи управління, відповідні структури місцевих органів влади, підприємства всіх форм власності та населення для підвищення у регіоні комплексного ефекту ресурсозбереження. В рамках реалізації розглянутих функцій управління для підвищення комплексного ефекту ресурсозбереження можуть бути використані наступні інструменти: організаційні заходи; розробка стандартів і нормативів; сертифікація продукції; комплексний облік ресурсів і комунальних послуг; створення конкурентного середовища; активізація інвестиційного процесу; нормативно-правові документи; енергетичний аудит; штрафні санкції та економічні пільги; інформаційні та рекламні кампанії з метою популяризації принципів ресурсозбереження у побутовому секторі; підвищення рівня кваліфікації кадрів в галузі ресурсозбереження та т. д. Таким чином, вдосконалення діючої системи управління житлово-комунальним господарством регіону стає необхідною умовою формування механізму управління ресурсозбереженням. ; The problems of reforming and developing the housing and utilities network have recently become increasingly important. The crisis state of housing and utility services is caused by inefficiency of the management system which is not adapted to market conditions. In conditions of socio-economic reform, the management system of housing and utility services in the regions of Ukraine should ensure a significant increase in the level of resource-saving due to the formation of a mechanism for managing this process. The specifics of the implementation of general management functions in the sphere of housing and utility services are described in the work. It is substantiated that the formation of the resource management mechanism in housing and utility services objectively requires the implementation of a set of special management functions: accounting, standardization, legal support, information support. It has been substantiated that the purpose of improving the management system of the housing and utility network of the region is the formation of a resource-saving management mechanism. It represents an integral unity of functions and management tools which, in the new economic conditions, should contribute to enhancing the integrated regional resource saving effect. The article defines a range of the most important problems in the housing and utility services, for the solution of which the regional management system should unite departmental government bodies, relevant structures of local authorities, enterprises of all forms of ownership and the population in order to enhance the integrated resource saving effect in the region. Within the framework of the considered management functions the following tools can be used to enhance the integrated resource-saving effect: organizational arrangements; development of standards and norms; certification of products; integrated accounting of resources and utilities; creation of a competitive environment; activation of the investment process; normative and legal documents; energy audit penalties and economic benefits; Information and advertising campaigns in order to popularize the principles of resource saving in the domestic sector; raising the level of skills of personnel in the field of resource conservation, etc. Thus, the improvement of the current management system of the housing and utility services of the region becomes an indispensable condition for the formation of a resource-saving management mechanism.

The issue of utility model (UM) protection in Ukraine in1993–2020 and the practice of the EU Member–States is considered. It is noted theproblem of UM trolling and exceeding the number of applications in Ukraine for UM in comparison with inventions. It is associated with the expansion in 2003 of the UM object in addition to the device also to a process, substance, microorganism strain, plant or animal cells culture and limiting the criterion of patentability only to the requirementnovelty and industrial applicability.It is concluded that the adoption of the Law of 21.07.2020 № 816-IX is an important step to limit patent trolling. The Law provides for exclusion from the protection of the substance and the introduction of post grant opposition in the Appellate Chamber.However the Law does not solve the problem of patent trolling at the customs border and did not exclude process from the protection. Also there will still be the problem at the courts as well Appellate Chamber to declare a utility model invalid if the UM is a new but obvious technical solution due to the lack of inventive step requirement or lower requirements for inventive step.The peculiarities of the protection of the utility model in the 15 old EU member states and the United Kingdom are analyzed. It is shown the tendency to increase level of protection of UM in the EU. In 6 EU countries there is no UM protection. In 5 there is an inventive step requirement. In 2 countries protection is possible only for three-dimensional objects (Italy, Greece). In 2 countries (Finland, Spain) - lower requirements for the inventive step.The directions of change of UM legislation in Ukraine are substantiated, including: Option 1: cancellation of protection of UM taking into account experience of Luxembourg, Sweden, Great Britain, Belgium, the Netherlands.Option 2: introduction of protection only for three-dimensional UM (protection is not provided to the method, substances, biotechnological inventions). Establishment of the criterion of inventive step the same as for inventions. Determination of mandatory examination of compliancewith the criteria of patentability (novelty, inventive step, industrial applicability) before the enforcement of UM in the courts, customs, Antimonopoly Committee.Option 3. The article examines the issues of legal protection of secret inventions and utility models in the context of protection of national interests of Ukraine. The national procedure for acquiring property rights to inventions and utility models established by the norms of the current national legislation is analyzed. Comparing the mechanism of legal protection of intellectual property rights to open and secret technical developments, the peculiarities of acquiring rights to secret inventions (utility models) and the use of rights to such industrial property are highlighted.Examining the procedure for acquiring property rights to secret technical solutions and their implementation, it was found that the patent as a tool for legal protection of technical developments containing information classified as state secrets, has its own legal regime that combines current legislation in the field of state secrets and intellectual property. It is emphasized that a patent for secret objects of industrial property is issued for a period, as well as for open 20 years for the invention and 10 years for the rat model, but their validity depends on the period of secrecy of these developments. The use of rights arising from a secret patent also has its limitations, in particular: the patent owner may not authorize other persons to exercise the rights to such secret inventionsand utility models without the permission of a state secret expert. It is noted that the state monetary compensation to the owner of patented secret technical solutions for the payment of fees for filing an application and maintaining the validity of a secret patent generally does not compensate the owner of classified developments for all costs and restrictions associated with the possible use of such patents. Considering the content of criminal liability for illegal use of rights to patented secret developments, it was found that such an offense gives rise to a set of crimes. ; В статье исследованы вопросы правовой охраны секретных изобрете-ний и полезных моделей в контексте защиты национальных интересов Украины. На основе сравнения механизма правовой охраны прав интеллектуальной собственности на открытые и секретные технические решения освещены особенности приобретения имущественных прав на секретные изобретения (полезные модели) и их реализация. The article considers the state and prospects for adaptation of the national legislation of Ukraine on compulsory licensing of the rights to inventions and utility models. The types of compulsory licenses for inventions (utility models) are studied. It is established that, taking into account the positive European experience, a consideration of the issue of granting a compulsory license for an invention (utility model) should be attributed to the competence of the National Intellectual Property Authority. This body shall consider applications from potential users (licensees) for granting compulsory licenses, determine whether the conditions for the issuance of such licenses as well as shall decide on the granting of compulsory licenses (refusal to grant them).It is proved that the court should consider only disputes related to the compulsory licensing of the rights to inventions (utility models), and not resolve the issue of granting a compulsory license. Given the establishment of the Supreme Specialized Court on Intellectual Property in Ukraine, it is advisable to refer to its competence to consider and resolve such issues. Therefore, it is necessary to make amendments to Art. 20 of the Code of Civil Procedure of Ukraine, transferring consideration of the cases related to the granting of compulsory licenses (for example, resolution of the disputes over granting compulsory licenses, the amount of remuneration to the patent owner, etc.) to the jurisdiction of the High Court of Intellectual Property.It is established that the legislative experience of the EU countries shows that the governments of the EU countries are not authorized to make decisions on the granting of compulsory licenses for inventions (utility models) due to the public interest. Consideration and resolution of this issue is the responsibility of the relevant national intellectual property authorities (in particular, the relevant patent offices).The inconsistency of the domestic legislator regarding the normalization of relations related to the use of biotechnological inventions is substantiated. In particular, as a part of the reform of patent law, the Law of Ukraine «On the Protection of Rights to Inventions and Utility Models» was amended on the concept of biological material and its legal protection, on the non-patentability of biotechnology-related objects, on patents for biological material. At the same time, the provisions of Part 11 of Art. 221 of the Association Agreement between Ukraine and the EU on the granting of a compulsory license for these objects of patent law had been ignored.It is proved that in order to complete the reform of the national legislation in the field of biotechnological inventions, it is expedient to amend the Law of Ukraine «On the Protection of Rights to Inventions and Utility Models» and accordingly reflect in it the possibility of the breeder and the patent holder for an invention in the field of biotechnology to obtain a dependent license for the use of a plant variety protected by the patent, if such a license is required for the use of the plant variety or patent, respectively; the possibility for the holder of a previous patent for a plant variety or the holder of a patent for an invention in the field of biotechnology to obtain the right to a cross-license on mutually beneficial terms for the use of a protected variety. ; Проаналізовано стан та перспективи адаптації національного законодавства України щодо примусового ліцензування прав на винаходи та корисні моделі. Досліджено види примусових ліцензій на винаходи (корисні моделі). З'ясовано, що з урахуванням позитив-ного європейського досвіду розгляд питання про видання примусової ліцензії на винахід (корисну модель) доцільно віднести до компетенції Національного органу інтелектуальної власності.Доведено, що суд має розглядати винятково спори, пов'язані з примусовим ліцензу-ванням прав на винаходи (корисні моделі), а не вирішувати питання видачі примусової ліцензії. Встановлено, що законодавчий досвід країн ЄС свідчить про те, що уряди країн ЄС не уповноважені приймати рішення про видання примусових ліцензій на винаходи (корисні моделі) у зв'язку з наявністю суспільного інтересу. Розгляд і вирішення цього питання перебуває у віданні відповідних національних органів інтелектуальної власності (зокрема, відповідних патентних відомств).Обґрунтовано непослідовність вітчизняного законодавця щодо унормування відносин, пов'язаних із використанням біотехнологічних винаходів. Доведено, що для завершення реформування національного законодавства у сфері біотехнологічного винахідництва до-цільно внести зміни до Закону України «Про охорону прав на винаходи і корисні моделі» та відповідно відобразити у ньому можливість селекціонера та власника патенту на винахід у галузі біотехнологій отримати залежну ліцензію на використання сорту рослини, що охороняється патентом, якщо така ліцензія необхідна для використання відповідного сорту рослини або патенту відповідно; можливість власника попереднього патенту на сорт рослин або власника патенту на винахід у галузі біотехнологій отримати право на перехресну ліцензію на взаємовигідних умовах на використання сорту, що охороняється.
The article is devoted to the study of the formation and modernization of the public utility system of provincial cities of Left Bank Ukraine late 18th – early 20th centuries. The Cossack regimental cities of the Left Bank Hetmanate-Chernihiv, Poltava and Kharkiv became the administrative centers of the Russian Empire at the end of the 18th century. The inclusion of these cities in the territorial structure of the empire becomes an impetus for the formation of municipal services of these cities. The functions of public utility institutions are performed by the Six-voice Duma, the police and the governor's office during this period. These structures regulate urban space, illuminate the streets of the city and control the process of providing the population with water. The intensification of urbanization tendencies leads to the need to modernize the existing public utility complex in cities. The city government established after the 1870 City Reform is leading the process of modernizing the municipal sector. Water supply, electricity, and sewerage appeared in cities at this time. The functions of the city government changed. It focused on strategic planning for the development of the utility system. Special service centers were created to manage and maintain the facilities. The states of these structures consisted of qualified engineers and technicians who not only monitored the operation of the utility, but also provided services to the public. ; Статья посвящена исследованию подходов городского самоуправления губернских центров Левобережной Украины к организации системы служб коммунального хозяйства. Охарактеризованы особенности формирования структур коммунальной сети Харькова, Полтавы и Чернигова. There are knowledge of the economic nature of the price is marked by the following milestones: the quantitative theory of money, which has become widespread in the form of "equation of exchange" (MV = PQ); the theory of labor value determines the price as a monetary expression of the value of the goods, this model price was called costly pricing; the theory of marginal utility, where the price is presented in the form of an estimate of the marginal utility of this good, the price is the monetary expression of the ultimate or marginal utility of the economic good. These theories do not take into account the specifics of pricing for military products, because these products have specific characteristics, namely: the only buyer is the state, in most cases there is a monopoly on this type of product. Therefore, there is a need to develop a pricing methodology for military purposes in conditions of imperfect competition, resource constraints, economic crisis and conflicts.
The article is devoted to theoretical positions about the formation and development of the institute of compulsory licenses for an invention (utility model). The analysis of legislation on the regulation of these relations was done. The theoretical positions on the subject of research are analyzed. It was established that the national legislation on compulsory licenses began to be formed in 1992, but its most significant development occurred in 2000-2003, when several types of compulsory licenses were imposed in the law, which have been applied to the present time.Compulsory licensing is conditioned either by public needs or by the groundless refusal of the right holder to authorize such use of a particular object of industrial property rights. After Ukraine gained independence in 1991 the formation of national legislation in the field of intellectual property began. In 1992 the Presidential Decree approved the Provisional Regulations on the Legal Protection of Industrial Property Objects and Innovative Proposals in Ukraine, which contained a minor legal regulation of the investigated relations. In the Law of Ukraine "On Protection of Rights to Inventions and Utility Models" in the wording of 15.12.1993, too, there were not many legal norms on compulsory licensing. In particular, Art. 24 of the Law ("Forced alienation of rights") contained norms that determined only one case of obtaining a license for the use of the invention in a compulsory manner.In 2000, the Law of Ukraine "On the Protection of Rights to Inventions and Utility Models" was set forth in a new version, and the legal regulation of compulsory licensing was substantially improved, as unlike the version of the 1993 law, the grounds for issuing compulsory licenses were expanded.The Law of Ukraine No. 850-IV of May 22, 2003 introduced radical changes to the compulsory licensing of inventions, utility models taking into account public interests. So, if before 2003 the Government could issue such compulsory licenses based on the interests of the society and subject to military and emergency state without specifying these interests, in the 2003 one was changed the grounds and conditions for such licensing.As of today, the only area with special legal regulation regarding compulsory licensing of patent law objects is the sphere of health protection. ; У статті досліджувалися теоретичні питання щодо становлення та розвитку інституту примусових ліцензій на винахід (корисну модель). Здійснено аналіз законодавства щодо регулювання цих відносин. Проаналізовано теоретичні позиції з предмету дослідження. Встановлено, що національне законодавство про примусові ліцензії почало формуватися у 1992 р., однак його найбільш значний розвиток припав на 2000–2003 р., коли в законі було закріплено кілька видів примусових ліцензій, які застосовуються і на даний час.

The article is devoted to research of social conditionality of construction ofsanctions of criminal law norms. It was made sequential analysis of such circumstancesof social conditionality as public utility, systemic and legal consistency, clearness andclarity of language. It has been established that sanctions of the current legislation ofUkraine of criminal liability contain not a single one cases of violation of the mentionedcircumstances. On the basis of the study, the proposals to make appropriate amendmentsto the Criminal Code of Ukraine were made.It is concluded that a criminal law norm corresponds to such a condition of socialconditioning as a public utility, in the case where its sanction gives to court an opportunityto assign a necessary and sufficient punishment to a guilty person without involvingprivileged institutions of the General Part. In this aspect, establishment of certain typesand sizes of punishment in sanctions of the articles of the Special Part of the CriminalCode is restriction of the court's ability to appoint those types and sizes of punishments,which contains the General Part of the Criminal Code. In general, such a limitationshould be considered appropriate (since its absence generally can lead to judicialarbitrariness), but it is justified not in all cases. In particular, this applies to the sanctionswhere the lower limit of a more severe type of punishment is greater than that of the lesssevere.It is shown that the most striking example of the violation of systemic and legalinconsistency is use of the notion «tax-free minimum individual income» in criminal law,which has already been replaced by the concept of «social privilege» and «subsistenceminimum per person» in the regulatory legislation. At the same time, the specified defectrefers not only to sanctions (which impose a penalty in the form of fines), but alsodispositions (where the amount of property damage is set). ; Статья посвящена исследованию социальной обусловленности построениясанкций уголовно-правовых норм. Последовательно проанализированы такие об-стоятельства социальной обусловленности, как общественная полезность, си-стемно-правовая непротиворечивость, четкость и ясность языка. Установлено,что санкции действующего законодательства Украины об уголовной ответствен-ности содержат отдельные случаи нарушения названных обстоятельств. Наосновании проведенного исследования сформулированы предложения по внесениюсоответствующих изменений в Уголовный кодекс Украины.Сделан вывод, что уголовно-правовая норма соответствует такому обсто-ятельству социальной обусловленности, как общественная полезность, в томслучае, если ее санкция предоставляет суду возможность назначить виновномулицу необходимое и достаточное наказание без применения льготных институтовОбщей части. В этом аспекте установление определенных видов и размеров на-казания в санкции статьи Особенной части УК является ограничением возмож-ностей суда по назначению тех видов и размеров наказаний, которые содержитОбщая часть УК. Такое ограничение в целом следует признать целесообразным(поскольку его отсутствие вообще может привести к судейскому произволу),однако не во всех случаях оно является обоснованным. В частности, это касает-ся тех санкций, где нижняя граница более строгого вида наказания являетсябольшей, чем у менее строгого.Показано, что наиболее ярким примером нарушения системно-правовойнепротиворечивости является использование в уголовно-правовых нормах понятия«необлагаемый минимум доходов граждан», которое уже заменено в регуляторномзаконодательстве понятиями «социальная льгота» и «прожиточный минимумна одно лицо». При этом названный недостаток касается не только санкций (вкоторых закреплено наказание в виде штрафа), но и диспозиций (где устанавли-вается размер имущественного вреда). ; Стаття присвячена дослідженню соціальної обумовленості побудовисанкцій кримінально-правових норм. Послідовно проаналізовано такі обставинисоціальної обумовленості, як суспільна корисність, системно-правованесуперечливість, чіткість і ясність мови. Встановлено, що санкції чинного за-конодавства України про кримінальну відповідальність містять непоодиноківипадки порушення названих обставин. На підставі проведеного дослідженнясформульовано пропозиції щодо внесення відповідних змін до Кримінального ко-дексу України.Зроблено висновок, що кримінально-правова норма відповідає такійобставині соціальної обумовленості, як суспільна корисність, у тому разі, коли їїсанкція надає суду можливість призначити винній особі необхідне і достатнєпокарання без залучення пільгових інститутів Загальної частини. В цьому аспектівстановлення певних видів і розмірів покарання в санкції статті Особливої ча-стини КК є обмеженням можливостей суду щодо призначення тих видів і розмірівпокарань, що містить Загальна частина КК. Таке обмеження в цілому слід виз-нати доцільним (оскільки його відсутність узагалі може призвести до суддівськогосвавілля), проте не в усіх випадках воно є обґрунтованим. Зокрема, це стосуєтьсятих санкцій, де нижня межа більш суворого виду покарання є більшою, ніж у меншсуворого.Показано, що найбільш яскравим прикладом порушення системно-правовоїнесуперечливості є використання у кримінально-правових нормах поняття «не-оподатковуваний мінімум доходів громадян», яке вже замінено в регуляторномузаконодавстві на поняття «соціальна пільга» та «прожитковий мінімум на однуособу». При цьому названа вада стосується не лише санкцій (в яких закріпленепокарання у виді штрафу), а і диспозицій (де встановлюється розмір майновоїшкоди).
