the article deals with the problems of criminal legal qualification of violent actions of some accomplices of a crime in relation to others with the purpose of involving the latter to a joint commission of the crime. The norm that determines the actions of the perpetrator (co-executor), instigator and accomplice in committing a crime has been analyzes. A suggestion for the improvement of the legislation on criminal liability in this area has been given. ; в статье рассматриваются проблемы уголовно-правовой квалификации насильственных действий одних соучастников преступления по отношению к другим с целью привлечения последних к совместному совершению преступления. Анализируются нормы, которые определяют действия исполнителя (соисполнителя), подстрекателя и пособника в совершении преступления. Даются предложения по усовершенствованию законодательства об уголовной ответственности в данной сфере. ; у статті розглядаються проблеми кримінально-правової кваліфікації насильницьких дій одних співучасників злочину відносно інших з метою залучення останніх до спільного вчинення злочинів. Аналізуються норми, які визначають дії виконавця (співвиконавця), підбурювача та пособника у вчиненні злочину. Пропонуються авторські рекомендації кваліфікації злочинів у відповідних випадках. Надаються пропозиції щодо вдосконалення законодавства про кримінальну відповідальність у даній сфері.
Published during Nicolas Sarkozy's presidency, L'Enfance (Childhood) is an autobiographical and pamphletary text in which French-Portuguese singer, Catherine Ribeiro, reflects on the links between her (artistic) freedom, her political activism and the lack of personal, national, and professional recognition. In this article, I argue that, like other writers of working class origins inspired by sociologist Pierre Bourdieu, such as Annie Ernaux (recently in Retour à Yvetot) or Didier Eribon in Retour à Reims, Ribeiro returns to her childhood in Saint-Fons, not so much to make a critique of her abusive mother and absent father, but rather to do an "auto-socio-[ethno-] analysis" of her Portuguese immigrant upbringing in the suburbs of Lyon in the forties and fifties. Her original autobiography, mixed with excerpts of her protest songs, allows the reader to better understand the roots of her politically engaged life and career. Ultimately, she argues for a recognition of Portuguese immigrants and their descendants' contributions in France, including her own.
