Die tradierte deutsche Gesetzgebungslehre kann, wie immer man ihre Leistungen ansonsten beurteilt, die gewaltigen Veränderungen ihres Gegenstandes in neuerer Zeit nicht mehr angemessen erfassen. Ein verändertes staatliches Aufgabenverständnis hat die Privatisierung und Hybridisierung der Normierung befördert, Europäisierung und Internationalisierung haben neue Formen nichtstaatlicher Rechtsetzung durch regulierte Selbstregulierung, Standardisierung, Codes of Conduct und andere Formen von sogenanntem "soft law" entstehen lassen. Staat und Recht sind in vielen Bereichen graduell entkoppelt. Diese Veränderungen sind gleichwohl für ein zeitgemäßes Verständnis des Rechts als Steuerungsinstrument von höchstem Interesse. Sie können konzeptionell nur auf der Basis einer Regelungswissenschaft eingefangen werden, die juristische, sozialwissenschaftliche und Governance-Perspektive vereint.
