In a global context marked by the rise of an information society, shared knowledge and digital economy, this study proposes an assessment of the protection of databases by Copyright (french meaning), privileging a comparative approach between French and Senegalese law. By highlighting the elements of convergence but also of divergence that emerge from the confrontation between the two legislations, this analysis starts from the identification of the strengths and weaknesses of copyright, to propose orientations aimed at improving the legal framework for the protection of databases. Copyright being the unanimously consecrated protection mechanism for databases, it is necessary, far from divesting it, to identify the best legal options that could contribute to its reinforcement. In this respect, it is imperative to take into account a perfect balance between the various interests for the development of the information society. ; Dans un contexte mondial marqué par l'essor d'une société de l'information, des savoirs partagés et de l'économie numérique, cette étude propose une évaluation de la protection des bases de données par le droit d'auteur, en privilégiant une approche comparative entre le droit français et le droit sénégalais. Le droit d'auteur étant le mécanisme de protection unanimement consacré pour les bases de données, il y a lieu, loin de s'en départir, d'identifier les meilleures options juridiques qui pourraient concourir à son renforcement. Dans cette optique, la prise en compte d'un équilibre parfait entre les divers intérêts en présence constitue un impératif pour le développement de la société de l'information.

Responding to demands from a group of parties to formalize Islamic law, the Counter Legal Draft Compilation of Islamic Law (CLD KHI) team has compiled a pluralist, democratic, humanist, and gender fair Islamic law text.This manuscript reaps pros and cons during society because it is considered not in line with the values contained in the Qur'an and hadith.Because of the discrepancy between the opinions of most jurists in general with the contents of the CLD-KHI, of course, it will result in the absence of legal certainty in the future. The object of this research is only focused on the concept of walimujbir. The method used in this research is a qualitative method with a descriptive approach, data is collected openly according to what is obtained from primary and secondary sources. The results of this study indicate that the presence of a guardian in a marriage is positioned as a pillar of Marriage. In contrast, in the CLD-KHI formulation, a guardian is not required in a marriage. The formulation of Islamic family law reform offered by CLD-KHI is based solely on public logic, local wisdom, and on several perspectives such as democracy, pluralism, human rights, justice, gender equality, and western ideology. In matters of marriage, especially regarding guardians of mujbir, the ideas of CLD-KHI are different and even contradict the common understanding of principles of Islamic teachings and practices.

DERYWACYJNA KONCEPCJA WYKŁADNI W PRAWIE UEDerywacyjna koncepcja wykładni autorstwa Zygmunta Ziembińskiego i Macieja Zielińskiego jest jedną z dwóch, obok semantycznej intensjonalnej klaryfikacyjnej sformułowanej przez Jerzego Wróblewskiego, powstałych w powojennej polskiej teorii prawa normatywnych koncepcji wykładni. W doktrynie prezentowany jest pogląd, zgodnie z którym wykładnia dokonywana przez Trybunał Sprawiedliwości Unii Europejskiej miałaby odpowiadać szerokiemu, walidacyjno-derywacyjnemu ujęciu wykładni, a to ze względu na charakter źródeł prawa UE oraz wyraźny w tym przypadku element walidacyjny wykluczający sytuację izomorfii. Rozważania dotyczące kwestii walidacyjnych, uwzględniające różnorodność źródeł prawa unijnego, są bardzo cenne, szczególnie wobec faktu, że źródła prawa Unii Europejskiej bardzo różnią się od źródeł prawa krajowego. Akceptacja ujęcia derywacyjnego wydaje się nie do pogodzenia z doktryną acte clair. Z drugiej strony praktyka interpretacyjna prawa Unii Europejskiej, związana z wielością podmiotów pełniących funkcje prawodawcze, wymogiem wykładni prowspólnotowej przyjaznej, jednolitej, technicyzacją większości regulacji prawa Unii Europejskiej oraz wielojęzycznością przepisów prawa unijnego stawia wyzwania przed koncepcją derywacyjną.

Under the influence of objective theory, Georgian criminal law interprets both crime preparation and attempted crime in restrictive terms and prescribes punishment only for the preparatory actions that are akin to the objectively interpreted attempt. Penal laws of the German speaking countries (Germany and Austria), that do not identify criminal liability for crime preparation, provide extensive interpretation for attempted crime. The general range of punishable actions in one part of delicts displays eventual similarity. Finally, the following conclusion can be derived based on the correlation of the above legal systems: The denial of essential penality in the legislation and intro-duction of the penality for specific corpora delicti of crime preparation might lead to an extensive interpretation.

This book argues that lawyers must often rely on contestable ethical and strategic intuitions when dealing with legal and factual uncertainties in 'hard cases' of resort to force. This area of international law relies on multiple tests which can be interpreted in different ways, do not yield binary 'yes/no' answers, and together define 'paradigms' of lawful and unlawful force. Controversial cases of force differ from these paradigms, requiring lawyers to assess complex, incomplete factual evidence, and to forecast the immediate and long-term consequences of using and not using force. Legal rules cannot resolve such uncertainties; instead, techniques from legal risk management, strategic intelligence assessment and political forecasting may help. This study develops these arguments using the philosophy of knowledge, socio-legal, politico-strategic and ethical theory, structured interviews and a survey with 31 UK-based international lawyers, and systematic analysis of key International Court of Justice cases and scholarly assessments of US-led interventions
