Among the existing models in the Brazilian legal system that deals with the transfer of non-state public activities to private entities without profit, the management contract signed with entities qualified as Social Organizations stands out, inaugurated with Federal Law no. 9.637/98. This work focuses on addressing issues for which the edited legal norms were not able to solve. It addresses all the questions that involve everything from the qualification process of the entity, through its selection, to the execution of the management contract, with emphasis on the debates around its legal nature and related issues. It also focuseson the implementation phase of the adjustment and possible civil liability of the Social Organization. Finally, external control is also addressed, with emphasis on the performance of the Audit Cours. ; Dentre os modelos existentes no ordenamento jurídico brasileiro que tratam da transferência de atividades públicas não-estatais a entes privados desprovidos de fins lucrativos, destaca-se o contrato de gestão firmado com entidades qualificadas como Organizações Sociais, inaugurado com a Lei Federal nº 9.637/98. Este trabalho volta-se ao enfrentamento de questões cujas normas legais editadas não foram capazes de solucionar. Aborda-se todos os questionamentos que envolvem desde o processo de qualificação da entidade, passando pela sua seleção, até a execução do contrato de gestão, com destaque para os debates em torno da sua natureza jurídica e questões afins. Foca-se, ainda, a fase de execução do ajuste e possível responsabilização civil da Organização Social. Por fim, o controle externo é também abordado, com ênfase à atuação dos Tribunais de Contas.

A integração dos sistemas de educação superior na Europa: de Roma a Bolonha ou da integração econômica à integração acadêmica

Este trabalho trata a respeito do processo de integração dos sistemas de educação superior na Europa, região que, desde o fim da segunda guerra mundial, está procurando eliminar as fronteiras em todos os âmbitos. O Processo de Bolonha, homenagem à universidade mais antiga da Europa, é o nome do conjunto dos eventos (reuniões, resoluções e normas) relativos às medidas de implementação dos princípios da reunião de ministros da educação europeus que ocorreu em Bolonha, em 1999, com a finalidade de construir um espaço europeu de educação superior até o ano 2010, cujos objetivos fundamentais encetam, principalmente, para a competitividade do Sistema Europeu de Ensino Superior frente a outras regiões e para a mobilidade e o emprego no Espaço Europeu. Dessa maneira, analisa-se também o papel dos atores sociais nesse processo e a discussão a respeito da natureza da educação superior: um bem público catalisador da solidariedade internacional ou uma mercadoria a ser explorada na construção de um mercado educativo transnacional.

Le droit de l'Union Européenne est fondé sur la garantie de la liberté de circulation des personnes, des marchandises, des capitaux et des services. D'autres impératifs sont venus s'ajouter à la garantie de ces libertés, dont la garantie d'un niveau élevé de protection de la santé humaine. Pour concilier ces objectifs, il est notamment nécessaire de s'assurer que les professionnels de santé souhaitant délivrer des prestations dans l'Union Européenne disposent de qualifications suffisantes. Chaque Etat membre de l'Union reste en principe maître de l'organisation générale de son système de santé. Mais le droit de l'Union Européenne peut parfois inciter voire obliger les Etats à modifier certaines limites de compétence entre professionnels. ; European Union law is based on guaranteeing the free movement of people, goods, capital and services. Other requirements were added to these freedoms, including the ensure of a high level of protection for human health. To reconcile these objectives, it is essential to ensure that health professionals who provide services throughout the European Union are sufficiently qualified. In principle, each Member State is responsable for the general organization of its health system. However, European Union law may, in many cases, encourage or even oblige States to modify certain limits of competence among the health professions. ; O direito da União Europeia baseia-se na garantia da livre circulação de pessoas, bens, capitais e serviços. Outros quesitos foram adicionados a essas liberdades, incluindo a garantia a um elevado nível de proteção da saúde humana. Para conciliar esses objetivos, é especialmente necessário assegurar que os profissionais de saúde que prestam serviços na União Europeia sejam suficientemente qualificados. Em princípio, cada Estado-membro é responsável pela organização geral de seu sistema de saúde, mas a legislação da União Europeia pode, em muitos casos, estimular ou mesmo obrigar os Estados a modificarem certos limites de competência entre as profissões de saúde.

EUROPEAN UNION AND INTERNATIONAL RELATIONS: OLD TIMES, NEW TIMES?
Today, Europe is living a new decisive time as it has been in its past after World War II, in search of unity in diversity in the name of a peace project to safeguard future. If, on the one hand, Europe expresses aspirations for profound changes in its external environment, in the domestic context, it ends up colliding with aspects linked to sovereignty and human rights; on the other hand, in European foreign policy, the model reveals the search to legitimize its action. Precisely, the objective and the motivation of this study seek, through the qualitative methodology in Political Science, to analyse and understand the current context of the European Union in the international system. In fact, it is identified that this new hierarchy of powers, in the reaffirmation of the Westphalian system, where economic power comes, is bound to consolidate the democratic development between the old and new times of international relations in the destiny of Europe. From the results obtained during the analysis, in order to face again the unpredictability of the world scenario, it is a reality that Europe must promote the re-encounter of an alternative role, in other words, to assume its initial project of European edification in the name of equality of circumstances and rights of its affirmation in the global arena.

Contributions of Latin American revolutionary intellectuals for the study of the organization of liberating struggles
The aim of this paper is to establish a dialogue with the ideas of three revolutionary Latin American intellectuals – José Carlos Mariátegui, Ernesto Che Guevara and Paulo Freire, in order to share, from our intellectual tradition, a different vision, from the US/UK/European one, of what means to be critical; and to discuss possible inspirations for those of us working in Latin America and interested in contributing to the political processes of liberation which happen around us. We constructed this text in dialogue with the words of these three organic intellectuals which were able to engage creatively with the European thought, producing political appropriations and new theoretical developments informed by their praxis. These intellectuals produced worthy political theories based on their revolutionary praxis, offering ideas, insights and arguments for our analysis of the organization of social struggles and for social practices which confront our society in its imprisonment by the law of value. The paper defends the relevance of history as a space for creative dialogues with the ideas of intellectuals involved in direct activism and producing testimonies of political rebellion against external aggressions, discrimination, marginality, and social injustices; and intellectuals which produced knowledge in solidarity with these struggles.

This article is about the Euro crisis. It intends to present a small contribution concerning the political interests that guided member states on the issue of monetary cooperation, since the so-called "Snake" to the European monetary system, and later on the creation of the Monetary Union. Then it concentrates on the Euro crisis, trying to identify the interests that prevailed on what was done by the area countries to overcome the current crisis, and also on what remains to be done. It ends up with a brief reflection on the political effects of the crisis on the EU balance of power. Adapted from the source document.
Anti-Roma racism and the white academic agenda: hidden blind-spots of the Education System
Education has been depicted as the main 'social elevator' to confront the internal inequalities of modern abyssal societies. Roma, as the largest, ancient European minority, are perpetually targeted as a 'sensitive' population in regard to access to and success in basic and higher education, creating a framework where Roma themselves, from an early age, are considered a 'problem'. Academia, scientific research and knowledge production are not isolated from these practices and political/epistemological framework. In this sense, the article unravels its complicity and responsibility in the maintenance of the white order, the modern civilisatory mission toward the racialised bodies and the 'ideology of integration' as the only possible political path. This paper discusses the current academic production of evidence-based research in the field of education in regards to Roma, exploring the semantics and conceptual constructions that frame the discussion related to the Roma experience in the educative system. Furthermore, the article discusses how the conceptual codification of such a framework actually serves to condition intellectual and political approaches that attempt to go beyond the complicit 'ideology of integration' when addressing public and educative policies.

A relação dialética entre identidade constitucional nacional e europeia, no quadro do Direito Constitucional Europeu ; The dialectic relation between the national and the European constitutional identity in the framework of European Constitutional Law
O presente trabalho pretende refletir sobre o conceito de identidade constitucional dos Estados, no quadro do relacionamento dialético entre o ordenamento jurídico da União Europeia e os ordenamentos nacionais. Exploram-se, designadamente, quer a dimensão conflitual da identidade constitucional, quer as relações de confluência que esta pode potenciar, concluindo-se por um entendimento aberto e flexível do conceito de identidade constitucional, que possa favorecer a evolução em sentido europeísta do direito constitucional nacional e a transformação progressiva, em sentido constitucional, do ordenamento jurídico europeu. ; This article intends to reflect on the concept of constitutional identities of states in the frame of the dialectic relationship between the legal order of the European Union and the national legal orders. Both the conflictual dimension of the constitutional identity and the relations of confluence that that can maximize are explored. It concludes with an open and flexible understanding of the concept of constitutional identity which can benefit the evolution of the national constitutional law in an Europeist sense and the progressive transformation of the European legal system in aconstitutional sense.
