The extent to which agents acting on behalf of the state are constrained by internal & external factors is examined. Literature on the influence of various factors on state decision making is reviewed, & constraints that affect state decision making on foreign policy are identified: agent views & inclinations; agent positions in the state structure; state political & legal foundations; & state economic, historical, & geographical position in relation to other states. International diplomatic standards, global law, international morality, different regimes, & global institutions also influence state decision making. Although none of the aforementioned constraints are absolutes, it is concluded that successful foreign policy requires the balancing of freedom & necessity. 34 References. J. W. Parker

The article is written in form of pseudo dialogue between sociologist and lawyer. The data of interrogation of Kharkiv region in habitants in few indicators is showed in the article:
1. A part of victimized residents during last 12 months (population's victimization proportion).
2. General quantity of reported crimes during survey.
3. Quantity of police reports.
4. Degree of latency.
The so called "Latency paradox" as a world-view and as a methodological problem is discussed in the article. The author maintains the thought about necessity of developing the domestic sociology of crime in cooperation with other criminal-law disciplines.

Is the US a rogue state? Based on its unilateral foreign policy, numerous human rights violations, & its attempts to reshape the world as it sees fit, the authors argue that it is. The authors support their claim with examples from US foreign policy, & then examine how American attitudes encourage US actions, & preclude the development of a moral or multilateral foreign policy. Finally, the authors address the necessity of such a foreign policy, & discuss the importance of grass-roots activism in bring about a shift in US foreign policy. References. J. Harwell

"Im Zeitalter der Globalisierung sind Rechtssysteme ähnlichen Zwängen ausgesetzt wie andere gesellschaftliche Subsysteme. Sie unterscheiden sich von diesen aber durch ihr relativ hohes Beharrungsvermögen. Unter Rechtssystem (i. w. S.) soll hier zum einen ein durch Sinngrenzen von anderen Systemen abgegrenztes Rechtssystem (i. e. S.), zum anderen die aus Rechtsnormen, Gerichtsbarkeit und Rechtsstab bestehende Rechtsordnung und drittens schließlich die unter Polity-, Policy- und Politics-Aspekten zu analysierende Rechtsanwendung verstanden werden. Da Rechtsnormen soziale Normen sind, kann man zwar Gesetze jederzeit ändern, das Verhalten der Menschen, das damit gesteuert werden soll, aber nicht. Zudem greift hier die 'Glokalisierung' (Zygmunt Bauman), d. h. Globalisierung und Lokalisierung laufen gleichzeitig ab. Recht muss sowohl den Imperativen zur globalen Beseitigung von Barrieren für die Kapitalverwertung folgen als auch den lokalen Bedürfnissen nach adäquater Erfassung kleinräumiger Bedürfnisse Rechnung tragen. Das Grundgesetz öffnet die deutsche Rechtsordnung für das Internationale Recht, z. B. indem es bestimmte Regelungen des Völkerrechts für unmittelbar gültig erklärt (Art. 25 GG). Durch internationale Institutionen, Verträge und Regime ist das deutsche Recht in nicht geringem Maße Teil eines übernationalen Normsetzungsprozesses. Die nationale Gerichtsbarkeit einschließlich der Richter und Staatsanwälte ist davon aber traditionell in geringerem Maße betroffen. Demgegenüber ist zumindest bei den großen Rechtsanwaltskanzleien eine Tendenz zur Internationalisierung ('Law Firms') erkennbar. Betrachtet man die einzelnen Rechtsmaterien unter dem Gesichtspunkt der Globalisierung, dann lässt sich ein deutliches Gefälle vom Wirtschaftsrecht (v. a. Vertragsrecht) über Strafrecht und Sozialrecht bis hin zum Familienrecht erkennen. Umso bemerkenswerter erscheint der Vorstoß des Erzbischofs von Canterbury, Teile der islamischen Scharia - ggf. begrenzt auf Muslime - in die britische Zivilrechtsprechung aufzunehmen. Neben den internationalen Institutionen, Regimen und Normen gibt es im Bereich der globalen Wirtschaft ein Recht 3. Ordnung, das transnationale Recht. Es besteht aus Verträgen zwischen Großkonzernen, mit denen für beide Seiten gültiges Recht geschaffen wird. Diese Verträge enthalten i. d. R. Klauseln, mit denen sich die Parteien einer Schiedsgerichtsbarkeit (Arbitration Courts) unterwerfen. Die nationale Gerichtsbarkeit wird dabei bewusst ausgeschlossen. Je ein (Schieds-) Richter wird von jeder der beiden Parteien benannt, den Vorsitzenden stellt die Internationale Handelskammer (ICC) in Paris. Aus den sog. ICC-Rules entwickeln sich auf die Dauer Rechtsmaterien, die von allen Beteiligten akzeptiert werden. Langfristig 'sickern' sie auch in die nationale Gesetzgebung ein (z. B. ZPO). Die Entscheidungen der Schiedsgerichte werden gesammelt und - ähnlich wie die Urteile nationaler Gerichte - veröffentlicht und später als Präzedenzfälle verwendet." (Autorenreferat).;;;"In the era of globalization legal systems are exposed to pressures and constraints like other societal subsystems. However, legal systems differ from the latter by their relatively high inertia. In the present context, the term 'legal system' is used in a threefold meaning. It is understood as a 'system of law' delineated from other systems through germane boundaries. The term is also used for a system where a legal order consists of legal norms, jurisdiction and legal measures. Finally, it includes the application of law to be analyzed under the criteria of polity, policy and politics. For legal norms are social norms, legal norms can be changed at any time - as opposed to the human behavior being subject of legal norms. Additionally, the "Glocalization" (Zygmunt Bauman), i.e. the simultaneous globalization and localization, has to be taken into account. The law must comply at the same time with the imperative to reduce barriers for the capital flow on a global level and with the local necessity to assess small-scale needs adequately. The German Basic Law (Grundgesetz) is the gateway of the German legal order for international law, e.g. by declaring specific norms of international public law as being directly binding (article 25 of the Grundgesetz). Due to international institutions, treaties and regimes, the German legal order takes part in the transnational process of lawmaking to a not inconsiderable extent. Whereas national courts as well as judges and prosecutors are traditionally less concerned by this tendency towards internationalization at least larger law firms are highly impacted by it. The consideration of different areas of law under the aspect of globalization reveals a clearly-shaped downward gradient, beginning with the highly influenced international commercial law (especially contract law), going down first to criminal law and social law and then, at the bottom, to family law. Seen against this background, the idea of the Archbishop of Canterbury to incorporate parts of Islamic Sharia law - where applicable limited to Muslims - into British civil jurisprudence appears to be most noteworthy. Besides international institutions, laws and norms, there exists a law of 3rd degree, the law of international commerce, the transnational law. It has its legal foundations in international commercial contracts which are concluded between multi-national corporations, thereby creating valid law for both sides. Usually these contracts provide for clauses by which the parties submit themselves to arbitration (arbitration courts). At the same time, the jurisdiction of national courts is consciously excluded. Whereas each party may nominate one arbitrator, the third arbitrator and chairman of the court is appointed by the International Chamber of Commerce (ICC) in Paris. Over the time, new branches of law develop from the ICC-Rules which are accepted by all participants. On the long run, they even 'sweep' into national legislation (such as the ZPO, the German Code of Civil Procedure). The decisions of the arbitration courts are collected and - like national court's decisions - published to be used as precedents later on." (author's abstract).
