Abstract: Contemporary international society is characterized, among other elements, by its progressive humanization, which situates human beings at the centre of all international concerns. This conceptual approach, and the capacity of global health to situate itself transversally across multiple dimensions, means that health is a material domain that can become a central axis of international action and of International Law. In this paper are discussed, fi rstly, the international notion of health and its global character in a globalized world; secondly, are analysed certain key aspects concerning health as an object of cooperation and international regulation, particularly as it involves the United Nations and the World Health Organization (WHO). Finally, are presented some of the principal substantive dimensions of current international action in matters of global health. Keywords : Global Health; United Nations; World Health Organisation; foreign policy; epidemic outbreaks; social determinants of health. ; Derecho Internacional y Salud Global: una panorámica Resumen: La sociedad internacional contemporánea se caracteriza, entre otros elementos, por su progresiva humanización, que ha situado a los seres humanos en el centro de todas las preocupaciones internacionales. The purpose of the article is to focus on the need to strengthen the interaction of the law enforcement agencies of various states, highlighting the role of financial institutions in this process, to find optimal ways to improve international cooperation. The study is based on the methods of systemic and critical analysis, as well as a formal logical method. The article confirms that the need to strengthen international cooperation is explained by the existence of certain factors that determine the possibility of money laundering. It has been established that without adequate cooperation between law enforcement agencies and financial institutions at the national level, it is quite difficult to detect crime and prevent money laundering at the initial stage. As a conclusion of the investigation, it is proposed to develop a methodology for the interaction of the law enforcement agencies of several states to counteract money laundering. The results obtained can also become the basis for developing legislative proposals to improve international cooperation in law enforcement and, at the same time, they can be used to increase the efficiency of their anti-money laundering activities.
Through materialist dialectics, the article is dedicated to the study and solution of theoretical and practical questions related to the right of a person not to declare or give explanations about himself, his relatives, or close relatives. Interested here was the thorough review of the doctrinal sources of this right, the meaning and methodology of its research, the concept and content of the right of a person not to testify, the peculiarities of this right in Ukraine and in the world, its legislation, as well as its guarantee of implementation. In addition, based on the analysis of the legislation of each country, the authors identify the characteristics of the guarantee, analyze the theoretical aspects and the practical problems of granting the police and judicial authorities the right not to declare or give explanations about themselves. It is concluded that the immunity of witnesses means a set of rules that exempts certain groups of witnesses from the obligation to testify in criminal proceedings, as well as from the obligation of the witness to testify against himself. In this sense, immunity for a witness is divided into two types of imperatives: (absolute, unconditional) and device (relative, conditional).
This paper analyses legal interpretation in Private International Law. It focuseson the legal reasoning of Spanish judges when dealing with international disputes ofa private nature, without forgetting that they are also European Union judges. Afterdescribing the reduced scope of Codification in Private International Law, the paperattempts to clarify why interpretation in this area is more complex than in otherlegal domains: international objectives but with basically national means, a PrivateLaw focus and the development of European Union Private International Law aresome of the aspects that will be assessed in order to explain, briefly, the very creativerole of judges in looking for justice in each particular case. Finally, this paper dealswith methods of interpretation in Private International Law as well as the problemsof legal language and translation.
This book explores the issue of environmentally-induced migrations from the point of view of international human rights law, international humanitarian law, international refugee law and international law of statelessness. Last few years have become a period of unprecedented growth in the number of studies devoted to the forced migration caused by climate change. The book by professor Jane McAdam, published by Oxford University Press, differs significantly from previous studies in this area. The focus of the author became a state responsibility for the situation of climate-change induced displaced people with a particular focus on legal aspects of this problem. The basis of the author`s considerations are four particular areas of public international law: international human rights law, international humanitarian law, international refugee law and international law of statelessness. The issue of climate change-induced displacement is now becoming a growing challenge for public international law. The growing number of climate change migrants becomes a challenge for the international istitutions dealing with humanitarian assistance. Sea level rise become a factor of specific legal problems, such as climatic deterritorialization of the state, state succession on the new territory, the status of people forced to leave their country submerged under the waters of ocean (forced migrants?, refugees?, stateless people?, citizens of the former country continuing its status within a new territory?).
Lexistence dun droit international privé européen nest plus à démontrer. Les développements considérables auxquels il donne lieu aujourdhui soulèvent la question de ses frontières. Où commence et où sarrête le DIP européen ?
Adjusting the legal status, and support policies for migrant workers is an issue on the agenda of international institutions for nearly a hundred years. The first efforts to protect foreign workers have been taken during the first session of the International Labour Conference in 1919. In the following decades ILO activities has led to the preparation of three international documents concerning this issue (non-binding ILO Convention No. 66 in 1939, and Convention No. 97 of 1949, and No. 143 of 1975). For many decades, the problem of the protection and assistance of migrant workers' rights was considered as a narrow issue of international labor law. Codification efforts, undertaken during seventies, has led to the adaptation of the UN document (International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families) in 1990, and inclusion this issue into more general area of international human rights law. Despite this fact, and the existence of several categories of documents concerning migrant workers within Council of Europe, the European Union, and even ASEAN, the protection of migrant workers has never been effectively functioning system. The aim of this article is the analysis of the codification of that issue, and the main obstacles to consensus on the protection of migrant workers' rights. The state parties of the UN Convention contains primarily countries of origin of migrants (such as Mexico, Morocco and the Philippines). It seems, therefore, that despite 46 ratifications the, UN convention does not have a global character, and activities of its monitoring body (Committee on Migrant Workers-CMW) reflects primarily demands of sending countries. The article closely examines particularly controversial provisions of the ILO and UN documents from the point of view of current labour migrations and policies of sending and host countries.
