ЛЮБАЯ ЛИ ОРГАНИЗАЦИЯ МОЖЕТ БЫТЬ ПРИЗНАНА ПОТЕРПЕВШЕЙ ОТ ПРЕСТУПЛЕНИЯ?

Abstract

В статье анализируются соотношение понятий «организация», «юридическое лицо» как категории, используемые в уголовно-процессуальном законодательстве. Обосновывается вывод, что в статьях 42 «Потерпевший» и 44 «Гражданский истец» УПК РФ корректнее использовать термин «организация». ; The paper deals with correlation of notions of organization and legal body as categories applied in criminal procedure legislation. The author justifies the conclusion that it would be more adequate to use the term organization in the Article 42 Wronged Person and Article 44 Civil Claimant of the Criminal Procedure Code of the RF.
