Правовое обеспечение государственного регулирования сельского хозяйства: соотношение аграрного и предпринимательского законодательства

Abstract

The article is devoted of the problem of the coordination of the economic and the agrarian law. The author justifies that the economic and the agrarian legislation on the state regulation of the agrarian relations corresponds as the general and the especial. Methods of state regulation of the economic and the agrarian relations are uniform and should be considered by the economic legislation. The combination of the methods of the state regulation is independently fixed in the agrarian legislation. The author comes to a conclusion about necessity of three-level construction of the agrarian obligations legislation. The first level consolidates institutes of the economic obligations it is the subject of the economic law. The second level is directed on transfer of the methods of the state regulation of the agrarian relations it is the subject of the agrarian law. The third practical level of the obligations legislation is responsible for the legal maintenance of the state regulation of the agrarian relations it is the subject of the agrarian law.
