СТРАТЕГИЯ РАЗВИТИЯ ГРАЖДАНСКОГО ОБЩЕСТВА В РОССИИ

Abstract

В статье рассматриваются вопросы развития и институциализации гражданского общества в России. Опираясь на точки зрения учёных-правоведов, автор раскрывает суть и природу гражданского общества. При идентификации институтов и субъектов гражданского общества автор обращает внимание на роль права, проводя анализ законодательных актов, касающихся функционирования отдельных структур гражданского общества. В процессе исследования правовой основы гражданского общества России отмечены некоторое нарушение принципов организации гражданского общества, факты излишнего вмешательства в его деятельность государственных структур. В статье показаны положительные примеры законодательного регулирования передачи государственных функций лицензирования, учёта, контроля и др. самоуправляемым общественным организациям. Результаты исследования позволили сделать вывод о том, что современные тенденции развития гражданского общества должны быть связаны с реализацией как государственных интересов, так и интересов каждого отдельного человека, обеспечивая оптимальный баланс их ценностей. ; The problems of civil society development and institutionalization in Russia are considered in the article. Taking into account the viewpoints of law scholars the author reveals the essence and nature of civil society. When identifying the institutions and subjects of a civil society the author draws special attention to the role of law through the analysis of legislation acts related to the functioning of separate structures of the civil society. In the process of studies on the legal foundations of civil society of Russia certain violations of the principles of its organization and a number of facts of excessive interference in its activities of state structures have been pointed out. Some positive examples of legislative regulation of the transfer of public functions of licensing, accounting, control and others to the self-governed social organizations are shown. The results of studies conducted led to the conclusion that the current trends of the civil society development should be linked with the implementation of both the public interests and the interests of each individual providing an optimal balance of their values.
