ВОЕННО-СУДЕБНЫЕ ОРГАНЫ БЕЛОЙ АРМИИ В ПЕРИОД ГРАЖДАНСКОЙ ВОЙНЫ В РОССИИ (19171922 ГГ.)

Abstract

В статье освещаются проблемы реорганизации войск Белого движения в России в период Гражданской войны. Проведён анализ объединения их в единую, возрождение актуальных позиций построения Вооруженных Сил, уставов и традиций. Рассматриваются способы комплектования Белой армии, как на добровольной основе, так и на основе мобилизаций. Углубленно анализируется вопрос о роли военных судов в деле поддержания дисциплины и правопорядка в войсках, а также возможностях, которые командование могло задействовать, используя военные суды и для борьбы проявлениями беззакония со стороны военной администрации. Исследуется нормативная основа организации военно-судебных органов. Уделено внимание причинам поражения Белой армии в Гражданской войне и ликвидации большинства военно-судебных органов к 1922 г., которые не позволили в полном объёме восстановить военно-судебную систему. Статья носит междисциплинарный характер, написана на стыке истории и юриспруденции, имеет историко-правовую направленность. ; The article deals with the problem of reorganizing the troops of the White movement in Russia during the Civil War. The author carries out an analysis of combining them into a single Russian army, the revival of the construction of the current position of the Armed Forces, its statutes and traditions. The author considers methods of recruiting of the White Army on a voluntary basis and on the basis of mobilization. The research thoroughly analyzes the role of military courts in maintaining discipline and order in the army, as well as the opportunities that the command could involve using military courts and to combat manifestations of lawlessness on the part of the military administration. The author studies the regulatory framework of military organization of the judiciary. The researcher pays attention to reasons that led to the defeat of the White Army in the Civil War and the elimination of most of the military judiciary by 1922, which did not allow full restoring of the military judicial system. The article is an interdisciplinary research, written at the crossroads of history and jurisprudence, and has a historical and legal orientation.
